| 摘 要： | 权利用尽原则是立法者在平衡知识产权人特权或专有权和社会公众利益的基础上提出的。作为对权利人行使特权的限制,该原则首先由美国司法机关提出,随后得到许多大陆法系国家的援引。我国专利法对此也进行了立法确认。但由于我国对该问题缺乏足够的研讨,迄今为止,对该原则的基点仍认识不清,混淆了产品所有权和发明专利权的区别,以至于原则适用的对象发生了错位,权利用尽时间的认定和专利权人的心理动态等方面都存在严重的误解。为弥补我国专利法这方面的不足,对该原则进行重新研究成为必要,对专利法条文的修改也日益紧迫。

| Abstract: | The principle of the right exhaust was proposed by the legislators basing on the equilibrium between the intellectual property privilege or exclusive rights and the social public interests. As a limit to the exercises of intellectual right, this principle was raised first by the US judicial organ and then cited by many countries in Continental Legal System. Like other countries, China confirmed the principle in the legislation of patent law. But due to the insufficiency of discussions on this issue, up to now, we have been unclear of the base of the principle, confusing the ownership of object and the patent intellectual right of invention, so that many mistakes have appeared in the application of the principle. In order to make up the flaw on the legislation of the patent law in China, it is essential to restudy the principle and to take a revision to the articles of patent law. |
