| 摘 要： | 土地所有权的性质不具有唯一性,其权能结构与其性质相适应,不能将以私有制为基础的土地所有权的权能结构硬套在我国农民集体土地所有权之上。农民集体土地所有权的公有制基础、集体成员的集体共有权、集体土地的社会保障性、集体土地的资源性等特殊性质,决定了应当在公私兼顾的基础上,从民法上的财产私权性与社会法上的土地社会保障属性以及土地管理法上对社会公共利益的兼顾等多维度完善农民集体土地所有权权能,赋予农民集体土地所有权经济功能实现的权能、社会保障功能实现的权能以及因公共利益使其权能受到限制的利益补救权能,通过多项权能的体系化实现农民集体土地所有权的目的。

| Abstract: | The capacity of land ownership must be compatible with the attribute of land ownership, which is not unique. Therefore, it is not appropriate to mechanically apply the capacity structure of private land ownership to farmers'' collective land ownership in China. The public attribute of collective land ownership, the collective ownership right of members of collectives, and the social security attribute and the resource attribute of collective land all require the state to improve the capacity of the collective ownership of land on the basis of striking a balance between public and private interests and from the multiple perspectives of the private property right attribute of land ownership in civil law, the social security attribute of land ownership in social law, and the balance of public interests in land administration law, so as to give farmers''collective land ownership the capacity to realize economic functions, social security functions, and the interest remedy function in case of limitation of the capacity by public interest, and to achieve the objectives of farmers'' collective land ownership through the systematization of various capacities. |
