| 摘 要： | 近年来,平台经济、共享经济迅速崛起,各种新就业形态不断涌现,创造了大量就业机会。与此同时,相关从业者的劳动权益保障问题也日益凸显。研究发现,由于劳动关系限制、相关法律法规不完善、缺乏维权途径等方面的原因,该群体不仅参加基本养老、医疗保险的比例相对偏低,参加城镇职工养老、医疗保险的比例更是明显低于在职职工,而且大都未参加工伤保险,这给社会发展带来了极大的隐患。研究建议,调整现有劳动关系认定模式、强化顶层法律设计、推动平台企业积极履行社会责任、充分发挥工会组织作用,以促进新就业形态人员参加城镇职工社会保险。

| Abstract: | With the rapid development of the platform economy and sharing economy, various new employment forms, in recent years, have continuously emerged, creating a large number of employment opportunities. At the same time, the protection of labor rights and interests of relevant practitioners, in particular their social insurance has become increasingly prominent. However, due to various reasons such as restrictions on labor relations, imperfect laws and regulations, lack of access to rights, the study found that this group not only has a relatively low proportion of participating in basic pension and medical insurance, but also a significantly lower proportion of participating in urban employee pension and medical insurance. Moreover, most of them have not participated in work-related injury insurance, bringing great hidden dangers to our social development. Hence, to promote the participation of urban employees in social insurance for new employment forms, the following measures should be adopted: to adjust the existing labor relations recognition model, strengthen the top-level legal design, promote platform companies actively fulfilling their social responsibilities, and give full play to the role of trade unions organizations. |
