Focusing on current human smuggling operations in China, this article analyzes and attempts to explain the background of illegal Chinese emigrant activities. It argues that, contrary to the common representation of these illegal emigrants as hopeless, destitute people who have no choice but to flee from their country, in truth many are young people driven by restlessness and ambition, from various social origins. Recent political, economic, and social reforms within China provide those dreaming of a better life in foreign countries the opportunity to leave.  相似文献

Since 1978, China has opened itself to foreign direct investment and has undertaken significant legal reform, especially in the area of international commercial arbitration. I analyze the roles that foreign actors and state officials have played in changing Chinese legal institutions such as the Chinese International Economic and Trade Arbitration Commission (CIETAC) and personal relations, or guanxi. 1 1. La guanxi is a Chinese expression, meaning ‘to pull strings (to get things done)’. View all notes Foreign investors, attorneys, and non-governmental organizations are helping China to adopt formal commercial arbitral institutions that follow international norms. In that sense, foreign actors are contributing to rule of law in China. Yet, foreign investors also attempt to use guanxi to get around central regulations, thereby contributing to informal legal institutions. The combination of guanxi and formal legal institutions follows a model of path dependent institutional change. I use the terms, ‘layering’ and ‘bricolage’ to elucidate the ways that actors combine existing institutions with new legal forms introduced by foreign investors, attorneys, and NGOs.  相似文献

The pursuit of social justice is an important goal of public policy in China under socialism. The embrace of market reforms and increasing globalization has radically transformed China's redistribution regime as well as distorted old commitments to social justice. This paper reviews China's attempt to realize the goal of social justice, including its changing rhetoric, strategies and actions. I shall first set out the historical context by adducing the salience of development and justice in the period before and after the market reforms. This will be followed by an analysis of the state reform discourse in justifying market reforms and their function in development and human welfare. An evaluation of social and redistribution policies and their implications, including the intellectual and public debates on efficiency and equity, will be presented. In the final section, recent critiques on the market and worries associated with China's entry into the WTO will be considered.  相似文献

Regionalism has become an interesting phenomenon in Asian international relations. Driven by fast growing trade and investment, Asian countries have developed variegated patterns of economic co‐operation and a complex level of interdependence among themselves. Although the growing Asian regionalism is very much an economics‐driven process, it has profound impacts on regional political organization. This analysis examines Beijing's changing attitudes toward Asian regionalism and its policy choice in the regional economic integration. It is argued that the integration of the Chinese economy into the regional structure is promoted by the government as well as driven by market dynamics. Although Beijing has let the Chinese economy develop into the regional ‘flying geese’ structure, the best policy choice for China, as many Chinese scholars have argued, would be a three‐circle strategy of integrating into the world economy and a strategy of ‘market for technology’ in regional economic co‐operation. This analysis also discusses the regional political obstacles impeding co‐operation across national borders. It is argued that healthy bilateral relations and more political will toward regional multilateralism on political issues would be instrumental for future regional prosperity and stablity in Asia.  相似文献

This is an introduction to the special section of articles that analyze the gendered modalities of policy and institutional change in rural China and examine how women are engaging with, and affected by, those changes. In two consecutive issues, eight articles examine changes in policies and institutions relating to rural development, village-level politics and property rights, marriage migration and urbanization. Through their individual case studies, the contributors elucidate how gender is integral to the conceptualization and implementation of policy and institutional changes in rural China; how those changes are altering the status, rights, resources, goals and arenas of action of different categories of rural women, thereby reinforcing or altering gendered constructs; and, finally, how women's actions are triggering further policy and institutional changes.  相似文献

This article is a detailed critique of the thesis contained in David Bachman's book on the origins of the Great Leap Forward (GLF). By adopting the so‐called “neo‐institutional” approach, Bachman argues that Li Fuchun and Bo Yibo, leaders of a “Planning and Heavy Industry Coalition” “which had defeated a rival “Finance Coalition “ in 1957, were responsible for initiating and determining the development strategy of the GLF. It follows that Mao's role in the “leap” was very limited; the GLF was made possible when he gave official blessing to the programs of the victorious coalition. The author examines the historical and documentary sources on the GLF to demonstrate the contradictions contained in Bachman's theoretical framework, and the many faulty ways he interprets the data. He argues that Bachman's attempt to debunk the Mao‐dominant model in policy‐making during the GLF is a failure.  相似文献

This article describes and analyzes the rapid resurgence of illegal drugs in contemporary China since the late 1970s. It also examines the evolution and implementation of China's anti‐narcotic policy, especially the people's war on drugs launched in 1990. It is suggested that the resurgence of drug trafficking and drug abuse provides additional evidence of the severe erosion of regime legitimacy in China  相似文献

Over the past few years there has been a heated debate in the West over the potential challenge of an increasingly strong and assertive China to the Asia‐Pacific region and to the world in general. This article offers a systematic analysis of the debate on China's emerging role in the international system and its security implications from the theoretical perspectives of realism and liberalism. While both international relations theories have provided valuable insights, neither of them alone is able to unravel the puzzle of whether a prosperous and powerful China will be a major force of stability or a threat to international peace. Drawing on the theory of trade expectations, this article shows the conditions under which high interdependence between China and its trading partners will lead to pacific or belligerent Chinese behavior. If Chinese decision‐makers’ expectations for future trade are high, they will be less likely to use force to deal with unresolved disputes with neighboring countries. If, however, they have a negative view of their future trading environment, they will be likely to take measures, including military actions, to remove any obstacles that might forestall the pursuit of great‐power status. For the moment, China's expectations of future trade are by and large optimistic, but there is evidence of growing Chinese suspicion of a Western ‘conspiracy’ to contain China which may alter Beijing's future perceptions. To ensure that the rise of China will not cause regional and global instability, the outside world should seek to integrate China into the international community by pursuing policies that will have a positive influence on China's expected value of trade. In the meantime, some elements of the balance of power strategy need to be introduced in order to curtail China's expected value of war.  相似文献
