Approximately half of the state legislatures in the USA have enacted tort reform, generally focused on reducing noneconomic damages such as those awarded for pain and suffering of traumatically injured parties. Traumatic injury has been empirically associated with the development of chronic pain, which in turn has been associated with the concept of human suffering. This analysis examines the meaning of suffering within the context of traumatically induced chronic pain, recognizing that this population is at heightened risk of experiencing long-term emotional as well as physical pain. Factors contributing to profound suffering include the potential development of post-traumatic stress disorder, depression and anxiety, role/identity loss, maltreatment by a medical system generally inept in its management of chronic pain, and the negative manner in which personal injury victims are often treated by the legal system. While the American medical system struggles to identify suffering, the legal system—through tort reform—has chosen to simply ignore it, demonstrating little concern for the integrity of the vulnerable chronic pain sufferer. In doing so, the “destructed” chronic painient is further “deconstructed”. We argue that by limiting the size of settlements and jury awards, tort reform serves to potentially deny personal injury victims of a critical vehicle for finding meaning in their suffering, and accordingly limits their likelihood of achieving relief.  相似文献

A survey of 224 Michigan citizens called for jury duty over a 2-month period was conducted to assess the jurors' comprehension of the law they had been given in the judges' instructions. Citizens who served as jurors were compared with a base line of those who were called for duty but not selected to serve, and with those who served on different kinds of cases. Consistent with previous studies of mock jurors, this study found that actual jurors understand fewer than half of the instructions they receive at trial. Subjects who received judges' instructions performed significantly better than uninstructed subjects on questions about the procedural law, but no better on questions about the substantive (criminal) law. Additionally, jurors who asked for help from the judge understood the instructions better than other jurors. Since the results replicate previous research using simulated trials, this study provides evidence for the generalizability of earlier work to actual trials.  相似文献

This study examined the effects of judicial instructions on the outcome of a mock jury trial that involved a woman who pleaded self-defense after killing her abusive spouse. Jurors were instructed to adopt either an objective or a subjective standard of reasonableness when reaching a verdict. Within objective/subjective instruction conditions, half of the juries viewed a case in which the woman killed her abuser while he was attacking her (confrontational) and the remaining half viewed a case in which she killed him while he was asleep (no confrontation). Juries in the subjective conditions returned significantly more not guilty verdicts than jurors in the objective conditions. At the individual juror level, participants hearing subjective instructions were significantly more likely to rate the defendant as not guilty than jurors given objective instructions when the abuse was nonconfrontational.  相似文献

This field experiment examines the advantages and disadvantages of two jury instruction procedures: instructing the jury prior to the evidence portion of the trial and providing the jury with a written copy of the judge's instructions to take with them to their deliberations. The presence or absence of both procedures was randomly assigned to 34 civil and 33 criminal trials in Wisconsin circuit courts. Following the trials, questionnaires were administered to judges, lawyers, and jurors. Overall, the findings do not provide any support for the hypotheses that written instructions would help the jurors to recall the judge's instructions, that they would increase the jurors' satisfaction with the trial, or that they would shorten the trial. The written copy did appear to reduce disputes among jurors about the judge's instructions. No evidence was found to support the notion that written instructions would reduce the amount of time that juries devoted to the evidence, that they would lengthen deliberations, or that they would place excessive demands on the resources of the court. The findings also did not support the hypotheses that preliminary instructions would assist the jurors with recall of the judge's instructions or the evidence, or that they would reduce juror confusion about the trial procedure, but did support the hypotheses that preliminary instructions would assist the jurors with following legal guidelines in their decision making and would increase the jurors' satisfaction with the trial process. Critics of the civil jury have proposed several procedural reforms to address the concern that damage awards are capricious and unpredictable. One such reform is the bifurcation or separation of various phases of a trial that involves multiple claims for damages. The purpose of this study was to assess the effects of bifurcating the compensatory and punitive damages phases of a civil tort trial. We manipulated the wealth of the defendant and the reprehensibility of the defendant's conduct (both sets of evidence theoretically related to punitive but not to compensatory damages) across three cases in a jury analog study. We wondered whether jurors would misuse the punitive damages evidence in fixing compensatory damages and whether bifurcation would effectively undo this practice. Our findings indicated that mock jurors did not improperly consider punitive damages evidence in their decisions about compensation. Moreover, bifurcation had the unexpected effect of augmenting punitive damage awards. These findings raise questions about the merits of bifurcation in cases that involve multiple claims for damages.  相似文献

Recent tort reform debates have been hindered by a lack of knowledge of how jurors assess damages. Two studies investigated whether jurors are able to appropriately compartmentalize compensatory and punitive damages. In Study 1, mock jurors read a trial summary and were asked to assess compensatory and punitive damages in one of three conditions: (a) compensatory damages only, (b) punitive damages for the plaintiff, or (c) punitive damages for the state treasury. Results suggest that jurors who did not have the option to award punitive damages inflated compensatory damages via pain and suffering awards. Jurors were marginally more likely to award punitive damages when the plaintiff was the recipient. Mock jurors in Study 2 read a similar case summary and were asked to assess compensatory and punitive damages. Two factors were varied in Study 2: (a) egregiousness of the defendant's conduct, and (b) the recipient of any punitive damages (the plaintiff vs. a consortium of state funds). Jurors were more likely to award punitive damages when the defendant's conduct was more egregious and when the plaintiff was the recipient. The results suggest leakage between compensatory and punitive damage judgments, contrary to the law's mandate.  相似文献

Pattern jury instructions have been criticized for being less than understandable to the average juror and thus for causing arbitrary juridic decisions. Two studies were conducted to establish whether these criticisms are justified and to find solutions to these problems. Both studies established the validity of the criticisms by demonstrating that the presentation of presently used Michigan negligence instructions is about as effective in helping jurors understand the laws as the presentation of no instructions at all. It was found that by rewriting these instructions in accordance with empirical knowledge of what elements affect perception, memory, and comprehension of language, their effectiveness was significantly improved. Furthermore, it was found that the presentation of instructions both at the beginning and at the end of a case would allow jurors a greater opportunity to focus their attention on relevant evidence and to remember it. The studies demonstrate the urgent need for jurisdictions around the country to improve the way jury instructions are written and delivered, if they expect jurors to reach verdicts in light of the law rather than in ignorance of it.  相似文献

In response to concerns that jury awards in tort cases are excessive and unpredictable, nearly every state legislature has enacted some version of tort reform that is intended to curb extravagant damage awards. One of the most important and controversial reforms involves capping (or limiting) the maximum punitive damage award. We conducted a jury analogue study to assess the impact of this reform. In particular, we examined the possibility that capping punitive awards would cause jurors to inflate their compensatory awards to satisfy their desires to punish the defendant, particularly in situations where the defendant's conduct was highly reprehensible. Relative to a condition in which punitive damages were unlimited, caps on punitive damages did not result in inflation of compensatory awards. However, jurors who had no option to award punitive damages assessed compensatory damages at a significantly higher level than did jurors who had the opportunity to do so. Courts have historically avoided informing jurors about their nullification power (i.e. the power to return a not-guilty verdict when their conscience demands it but the law directs otherwise), fearing that such knowledge would prompt disregard for the law and reliance on attitudes and emotions rather than evidence. We investigated jurors’ inclination to nullify the law in a morally ambiguous case of physician-assisted suicide, testing the impact of euthanasia attitudes on case judgments as well as moderators and mediators of that effect. Mock jurors with pro-euthanasia attitudes were overall less likely to vote guilty than anti-euthanasia jurors, especially when they were given jury instructions informing them of jurors’ power to nullify. Nullification instructions also exacerbated the effect of jurors’ attitudes on anger, disgust, and moral outrage toward the defendant – emotions that mediated the effect of attitudes on verdicts. We also tested the impact of incidentally induced anger on jurors’ reliance on their attitudes rather than the law, given anger’s propensity to increase certainty and heuristic processing. Anger enhanced mock jurors’ reliance on their attitudes under certain conditions. Theoretical and practical implications for understanding juror decision-making are discussed.  相似文献

Purpose. The purpose of the present study is to determine whether making multiple damage awards influenced civil mock jurors' assessments of those damage awards. Specifically, how does making one decision for pain and suffering damage awards versus two decisions (one for mental pain and suffering and physical pain and suffering) versus four decisions (one for loss of enjoyment of life, mental anguish, disfigurement, and physical disability/impairment) influence overall non‐economic damage awards. Methods. One hundred twenty undergraduates from a psychology participant pool read a case vignette that included information regarding four types of injuries that the plaintiff endured: loss of enjoyment of life, mental anguish, disfigurement, and physical disability/impairment. Participants were randomly assigned to render either one award for pain and suffering, two awards (one for physical pain and suffering and one for mental pain and suffering), or four awards (one for each pain and suffering element). Results. Results indicated that participants who rendered four awards provided significantly higher overall non‐economic damage awards than participants who provided one overall award. The variability of damage awards also increased as the number of damage awards increased. Conclusions. Itemizing non‐economic damage awards into distinct injury categories can lead to an increase in overall non‐economic awards. Members of the legal arena should be cautioned against itemizing damages to prevent variability in non‐economic awards.  相似文献

ABSTRACT

The present study examined younger (18–30 years, N?=?100) and older adults’ (66–89 years, N?=?100) responses to a jury duty questionnaire assessing perceptions of jury duty, their capability to serve, and the capability of older adults to serve. We also explored perceptions of the senior jury opt-out law (a law that allows those over a certain age (e.g. 65 years) to opt-out of jury duty). We assessed why participants believe this law is in place and experimentally examined if informing older adults about this law impacted their jury questionnaire responses. Results demonstrated that older adults were significantly more likely to want to serve compared to younger adults; however, younger adults provided lower capability ratings of older adult jurors compared to older adults. Younger adults’ open-ended explanations for these ratings indicated negative aging stereotypes (i.e. in part, believing that older adult jurors are less capable because of declining health and biased beliefs). Older adults also had a significantly lower rate of agreement with the senior jury opt-out law. Although informing older adults about this law did not impact their perceptions of themselves as potential jurors, it did enforce more negative attitudes towards older adult jurors as a whole.  相似文献

Abstract

296 college students and jury eligible adults completed attitudinal measures and read a case summary of a murder trial involving the insanity defense. The case summary included opening and closing arguments, testimony from expert witnesses, and judge's instructions. Although broader legal attitudes (the PJAQ) predicted verdicts, the Insanity Defense Attitudes-Revised scale provided incremental predictive validity. Attitudes related to the insanity defense also predicted adherence to judge's instructions, whereas more general legal biases predicted a juror's willingness to change their verdict after being provided with accurate information about the defendant's disposition following the verdict. Importantly, misconceptions concerning the insanity defense impacted verdicts and many jurors made decisions that failed to adhere to the judge's instructions, though the nullification tendency does appear to vary as a function of pretrial juror attitudes. Implications for instructing jurors in insanity defense cases will be discussed.  相似文献

Methodological problems in jury simulation research involve issues of sampling, choice of stimulus materials, appropriate unit of analysis, appropriate dependent variable, corroborative data, and problems of role playing. Despite these issues, comprehension of jury instructions may be suitable for examination by jury simulation techniques--if certain of these methodological concerns can be satisfied. In a series of 5 experiments using typical Canadian legal instructions on criminal conspiracy and the coconspirator exception to the hearsay rule, this study attempted to validate a simple and inexpensive technique for testing the incomprehensibility of a given set of jury instructions by requiring participants to apply those legal instructions to a set of facts. The results demonstrate the utility of an application test, and suggest that for assessing the comprehensibility of jury instructions, it may be acceptable to use undergraduate students as participants, to use individual participants without group deliberation, and to employ written stimulus materials.  相似文献

The positions taken by prosecutors and defense lawyers on proposed jury instructions on lesser-included offenses provide evidence that juries do not follow the law strictly. This paper develops a simple model of expected utility to predict how jurors make their decisions. The model explains a stylized fact that is inconsistent with the idea that juries always follow the law, namely why prosecutors often object to giving the jury the option of a lesser-included offense. We use the model to evaluate the law concerning jury instructions on primary and lesser-included offenses.  相似文献

The effect of jury deliberation on jurors' reasoning skill in a murder trial was examined. Specifically, the effect of deliberating on reasoning competence (as defined by Kuhn, Weinstock and Flaton, 1994) was explored. One hundred and four participants viewed a videotaped murder trial and either deliberated in 12-person juries or ruminated on the case individually. Among those assigned to juries, half had their reasoning skill assessed prior to deliberations, while the others were tested after deliberating. Jurors in the individual rumination condition were assessed after they had the opportunity to reflect on the case alone. As hypothesized, post-group-deliberation jurors were more likely to discount both the selected verdict and alternative theories and incorporate judgmental supporting statements than were the other mock jurors. However, the mock jurors did not differ with regard to making statements that supported alternative verdicts or including judgmental statements that discounted their chosen verdict. In terms of Kuhn's reasoning continuum from satisficing (low level) to theory–evidence coordination (high level), there is some evidence that post-group-deliberation jurors may be closer to the high end than predeliberation jurors or post-individual-rumination jurors in some aspects of the task, but not in others.  相似文献

This study focused on whether and how deliberations affected the comprehension of capital penalty phase jury instructions and patterns of racially discriminatory death sentencing. Jury-eligible subjects were randomly assigned to view one of four versions of a simulated capital penalty trial in which the race of defendant (Black or White) and the race of victim (Black or White) were varied orthogonally. The participants provided their initial “straw” sentencing verdicts individually and then deliberated in simulated 4–7 person “juries.” Results indicated that deliberation created a punitive rather than lenient shift in the jurors’ death sentencing behavior, failed to improve characteristically poor instructional comprehension, did not reduce the tendency for jurors to misuse penalty phase evidence (especially, mitigation), and exacerbated the tendency among White mock jurors to sentence Black defendants to death more often than White defendants.  相似文献

The penalty phase deliberation experiences of capital jurors guided by the “special issues” sentencing instructions were investigated. These instructions ask jurors to consider three specific issues to determine whether a defendant should receive a sentence of life imprisonment or the death penalty: whether the crime was committed deliberately; whether there is a probability that the defendant would pose a continuing threat to society; and whether the conduct of the defendant was unreasonable in light of any provocation on the part of the victim. In-depth interviews with 27 jurors explored the organization of the penalty deliberation, the topics discussed, influential factors in the decision-making process, the impact of sentencing instructions, the importance of the possibility of parole, and the stress associated with capital jury service. Jurors relied heavily on sentencing instructions to guide their deliberations and to determine their responsibilities. Future dangerousness and the possibility of parole were critical considerations in deciding between life and death. Although jurors found the capital trial to be stressful, most believed that the life or death decision should be made by jurors. Findings are discussed in light of constitutional concerns about the administration of the death penalty.  相似文献
