This article critically examines the degree to which higher‐animal welfare label claims change animal welfare regulation and governance within intense meat‐chicken ('broiler') production in Australia. It argues that ethical labelling claims on food and other products can be seen as a ‘governance space’ in which various government, industry and civil society actors compete and collaborate for regulatory impact. It concludes that ethical labelling can act as a pathway for re‐embedding social concerns in the market, but only when it prompts changes that become enshrined in standard practice and possibly the law itself. Moreover, the changes wrought by ethical labelling are small and incremental. Nevertheless, labelling may create ongoing productive tension and ‘overflow’ that challenges the market to listen to and accommodate actors (including animals) on the margins to create ongoing incremental changes.  相似文献

This paper analyses insider trading behaviour around annual and interim earnings announcements during changing legislative environments in Sweden from 1980 to 2003. Using a unique data set, we are able to explore the nature of insider trading patterns from unregulated to strongly regulated insider trading markets. We find limited evidence of opportunistic insider trading. Insiders seem to be reluctant to sell stocks before positive earnings announcements. They also tend to time their trades in conjunction with an immediate post-announcement period, i.e. “safety trading”, which becomes more evident within stronger legislation environments. Some support for contrarian trading behaviour is also found.

This paper considers whether publicizing criminal labels is justified as a form of punishment. It begins by arguing that making criminal labels public is inevitably stigmatizing and that stigmatization is not, as is often implied, a defining aspect of censure, but needs independent justification. It argues that justifying grounds for public criminal labelling cannot be found in either the communicative account of punishment or deterrence theory. Rather, public criminal labelling should be understood as undermining of both the communicative and the deterrent functions of punishment. Recent empirical work is drawn upon to support the claims about public criminal labelling and deterrence.  相似文献

This paper uses Bayesian stochastic frontier methods to measure the productivity gap between Poland and Western countries that existed before the beginning of the main Polish economic reform. Using data for 20 Western economies, Poland and Yugoslavia (1980–1990) we estimate a translog stochastic frontier and make inference about individual efficiencies. Following the methodology proposed in our earlier work, we also decompose output growth into technical, efficiency and input changes and examine patterns of growth in the period under consideration.  相似文献

This paper aims to shed light on firm-specific drivers that lead firms to internationalise their innovation activities. The paper paints a comprehensive picture of driving forces by including firm capabilities, characteristics of the firm’s competitive environment and the influence of innovation obstacles in the home country. In particular the influence of potential driving forces on the probability to carry out different innovative activities abroad is assessed (R&D, design/conception of new products, manufacturing of innovative products and implementation of new processes). In a second stage these driving forces are observed with regard to their impact on the decision to locate innovation activities in various countries and regions (China, Eastern Europe, Western Europe and North America) as well as in groups of countries with similar levels of knowledge (“country clubs”). The analysis is based on the Mannheim Innovation Panel survey which represents the German CIS (Community Innovation Survey) contribution. Two survey waves have been combined, resulting in a sample of about 1,400 firms. The results show that the decision to perform innovation activities abroad is mainly driven by organisational capabilities such as absorptive capacities, international experience and existing technological competences of the respective firm. Innovation barriers at the German home base such as lack of labour and high innovation costs prompt the set-up of later-stage innovation activities abroad while the lack of demand demonstrates a barrier to the internationalisation decision for the development and manufacturing of new products. Location decisions receive the strongest influencing effects from the international experience of the firm. Firms which innovate in developing countries seem to require a more extensive level of international experience through international R&D cooperation.  相似文献

The paper surveys the most important literature on emerging markets and their performance. Emerging market countries are defined here as the countries with low intuitional capacity in general, rather than the countries with particular economic characteristics and per capita income; although the latter is the predominant view in the current literature. The paper places particular importance on the legal system and legal order (compliance) in the transitional economies, stressing the importance of adequate regulation where even more advanced regulatory models, like market regulation, should not be totally excluded. Despite many common characteristics, emerging markets differ significantly one from another and it is very difficult, if really not impossible, to create one ‘general theory of emerging markets’ and its financial behaviour. Finally, the practice in the last decade or so, has proven that emerging markets are somewhat unpredictable and difficult to model.  相似文献

This paper sets out to compare the existence of Juvenile deviant groups in both France and Italy and their characteristics. The comparison between Italy (N = 5,236) and France (N = 3, 353) is based on the ISRD study of the year 2006 and shows that the term “gang” is commonly used to refer to a group of friends only. The strongest associated variables in both countries to illegal acts are the acceptance of doing illegal things, taking part in delinquent acts, considering the group as a gang as well as spending a lot of time in public places. Delinquent activity of Juvenile delinquent groups varies from one country to another and the French respondents show a greater participation in deviant youth groups than the Italians. Results show some differences in gender participation with a greater involvement of boys, although girls also take part in deviant or delinquent activities, both in Italy and France. At risk behaviour significantly characterises the young participants as well as victimisation. This last point highlights that although deviant or potentially dangerous, these young people are also more vulnerable and in need of protection.  相似文献

This article offers a brief overview of the programmes in place for the provision of financial support to entrepreneurs and R&D organizations for technology commercialization and dissemination in India. Financial assistance is provided under these programmes to the industrial enterprises and R&D organizations by the Government of India for undertaking the development of new technology based products. Technology financing under these programmes is provided in the form of: grants, loan, and/or equity with the aim to strengthen the linkages of R&D laboratories with industry, as well as for the production of technology based products for the domestic and global market. Extramural funding agencies of the central government departments such as DSIR & DBT are involved in mainly the provision of financial support for R&D.  相似文献

Evaluation of cannabinoid concentrations in products from the legal cannabis market has been fraught with uncertainty. The lack of standardized testing methodology and the susceptibility of cannabinoids to degradation under certain storage conditions complicates the efforts to assess total tetrahydrocannabinol (THC) levels across wide geographic areas. There are few peer-reviewed surveys of cannabinoid concentrations in regulated products. Those that have been done have not characterized the effects of differences in analytical methodology, sample population, and storage conditions. Viridis Laboratories, which operates two cannabis safety compliance facilities in Michigan, has analyzed over 34,000 cannabis products throughout 2021 and 2022 before the sale in the regulated market. Fifteen cannabinoids in cannabis flower, concentrates, and infused products were tested using methanolic extraction and analysis by high-performance liquid chromatography with diode-array detection. Methods were validated before use, and the flower analysis procedure was certified by the Association of Analytical Collaboration. All the samples were tested before submission for sale and therefore had not undergone prolonged storage. The results are compared with those seen in other states as well as in the illicit market. Total THC levels in cannabis flower from the regulated market are significantly higher than those seen in illicit products. The distribution of cannabinoid levels is similar in flowers intended for either the medicinal or adult-use markets, with an average potency of 18%–23% of total THC. Total THC in concentrates averages up to 82%. Other cannabinoids are observed at significant levels, mostly in products specifically formulated to contain them. These results may act as a benchmark for potency levels in the regulated market.  相似文献

The architecture of global carbon markets has changed significantly since the Paris Agreement and the 2030 Agenda for Sustainable Development Goals were both agreed in 2015. Voluntary, international cooperative approaches established in Article 6 of the Paris Agreement allow Parties to work together to achieve the targets set out in their respective Nationally Determined Contributions to limit global warming to an increase below 1.5–2 °C. In Article 6.4, a sustainable mitigation mechanism is established for which rules, modalities and procedures will be developed internationally considering the experience and lessons learned from existing mechanisms, such as the Clean Development Mechanism (CDM) and its Sustainable Development (SD) Tool. Historically the issue of making integrated assessments of sustainable development and mitigation actions has been politically and methodologically controversial for many reasons: developing countries fear that an international definition of SD will interfere with their sovereignty and therefore their ability to define their own development pathways; players in the carbon market fear that markets can only handle one objective, namely mitigation outcomes; and sustainable development is regarded as too complex and costly to be measured and quantified. In an effort to address these concerns, the article proposes a new methodology for the sustainability labelling of climate mitigation actions relevant to Article 6 approaches. The article draws on an application of the CDM SD tool to analyse 2098 Component Programme Activities that had entered the CDM Pipeline by January 2017. The article demonstrates that assessment of the sustainable development benefits of climate actions can be graded and labelled based on the analysis of qualitative data, which is less costly than applying a quantitative approach.

Between 1998 and 2003, dozens of companies entered newly liberalizedtelecommunications markets in OECD countries. In Europe andNorth America, most of the entrants that attempted to use incumbents'"unbundled local loops," at regulated wholesale prices, to offernarrowband services—essentially "plain old telephone service"—havefailed. Even though Europe, the United States and Canada liberalizedat different times and with somewhat different policies, excessiveentry occurred in each region with too many players chasingan illusive pot of revenue with poorly designed business plans.On the other hand, the use of unbundled or shared local loopsfor entry into broadband services may be more of a winning strategybecause it allows the entrant to compete for customers by offeringnew services. This appears to be the emerging broadband strategyin Europe of large ISPs owned by incumbent telecommunicationcompanies in other countries (for example, France Telecom'sWanadoo) and in Japan. 刑法分则中有许多犯罪未规定犯罪目的,而理论和实践上一般认为,其中某些未规定目的的犯罪仍然应该具备某种特定目的,但在论证这些非法定目的犯之特定目的的存在时多局限于就罪论罪,缺少从犯罪构成整体的角度探讨其合理性。从构成要件构造的角度看,目的犯中的目的是主观违法的构成要件要素,当某种犯罪的构成要件中没有明确规定犯罪目的,而该目的对于犯罪的成立又是不可缺少的,法官就应对这一表明了违法性的构成要件要素作出补充,因而这些非法定目的犯在构成要件构造上属于开放性的构成要件;其未规定的犯罪目的,属于法律漏洞,对之应以目的性限缩的方法适用之。  相似文献

The use of mediation in England and Wales is nowadays an accepted and common practice within the alternative dispute resolution industry. Credited professionals have been performing the duties of a mediator in different fields of legal disputes; however, despite the positive perception of mediation, this area remains unregulated. So far, the rules applying to mediation in England and Wales originate from case law and contract between the parties. Such a scenario is not shared by other countries in which mediation has been regulated through an Act covering either private or judicial mediation. This article examines the current mediation scenario in England and Wales to assess whether there is a need to give it a statutory character in a similar manner to other jurisdictions.  相似文献

Research and development (R&D) partnerships are formed to share the risks and benefits of R&D. At the macro level, they result in a globe-spanning network that can be a valuable source of international knowledge spillovers. This network is the subject of a considerable body of literature. Often-made claims are that R&D collaboration is an important activity in a competitive environment, but that the importance of international partnerships has declined over time. Furthermore, it is claimed that collaborations are disproportionally concentrated within the developed economies. However, this literature fails to account for variations in the sizes of underlying firm populations between countries and over time. We argue that these population sizes create an opportunity structure of available collaboration partners for firms, and that ignoring variations in this structure potentially leads to erroneous conclusions about the structure and dynamics of the R&D network. To address this problem, we study the structure and dynamics of the global R&D network on an international and cross-industry scale using longitudinal data for 1989?C2002. We integrate data on public firms and their R&D partnerships and confront earlier findings with our data and a set of methods, which enables us to correct for the structure and dynamics in the firm population. While our study confirms previous findings concerning the worldwide trend in collaborative activity, it also shows that results on individual countries need correction. In particular, the importance of R&D collaboration for US companies is overestimated, while their openness towards foreign partners is underestimated.  相似文献

This paper analyzes the export growth of China??s information communication technology (ICT) products in two major markets Japan and the US from 1995 to 2008 and its competition with six East Asian countries: Indonesia, Malaysia, Philippines, Thailand, Singapore and Korea. The analysis shows that China has emerged as the largest single supplier of ICT products to both markets. By 2008, China??s exports accounted for 44 and 38% of total Japanese and the US ICT imports respectively. On the other hand, market shares of the six East Asian countries either remained stagnant or decreased substantially. The analysis by destination markets and by product categories indicates that, there exist significant negative correlations between market shares of China and that of the six East Asian countries, implying that the rapid expansion of China??s ICT exports crowded out exports of its East Asian competitors.  相似文献

Deliberate firesetting research predominantly focuses on apprehended populations. In contrast, this paper focuses on the prevalence and characteristics of un-apprehended firesetters living in the UK. Social media was utilized to recruit 232 participants for an online questionnaire. Two hundred and twenty-five people answered a question relating to deliberate firesetting. Forty participants (17.78%) indicated that they had ignited a deliberate fire and were classified as un-apprehended firesetters. Firesetting was most common in childhood and adolescence. Relative to non-firesetters, un-apprehended deliberate firesetters were more likely to report; a diagnoses of a psychiatric illness, a diagnosis of a behavioural problem, having been suspended from school, a history of suicide attempts, experimenting with fire before the age of 10 years old, and having a family member who also ignited a deliberate fire. Un-apprehended firesetters also scored significantly higher compared to non-firesetters on the Fire Setting Scale and the Fire Proclivity Scale [Gannon, T. A., & Barrowcliffe, E. R. (2012). Organisations in both business and government face a considerable risk from inadequately secured information systems. In recognition of these risks, Directorate-General XIII (Telecommunications, Information Industries and Innovation) of the Commission of the European Communities commissioned a series of projects to examine security issues in the use of information technology. The results of one of these studies, concentrating on the security of network systems, is reviewed below.It was an objective of the study that its results should be seen as definitive, authoritative and applicable across the European Community as a whole. In order to meet this objective, the study, led by Coopers & Lybrand, drew upon the skills and experience of 44 organisations in seven European countries, including:
  • •⊎ Coopers and Lybrand practices in France, Germany, Italy, the Netherlands and the United Kingdom;
  • •⊎ Admiral Management Services Ltd;
  • •⊎ The Commission of the European Communities;
  • •⊎ 17 vendors of IT products and services in five European countries;
  • •⊎ 20 major users of network systems in seven European countries.
In particular, the study benefited from detailed case studies in each of the 20 large and sophisticated users of network systems and from assessments of 27 security products from twelve IT vendors.  相似文献

在国际贸易自由化背景下,从事产品生产的国内产业和提供服务的国内产业,都可能受到国际贸易的损害。其中,从事产品生产的国内产业,可能因为同类进口产品的倾销、补贴或数量增加而受到损害,也可能因为其产品出口被其他国家或地区实施不正当、不合理进口限制而受到损害;提供服务的国内产业,可能因为外国服务提供者参与国内服务市场竞争而受到损害,也可能因为其服务输出遭遇其他国家或地区的服务贸易壁垒而受到损害。这些损害,都应当属于贸易救济的范围。要全方位救济国际贸易对国内产业的损害,我国不仅应当有针对进口产品的反倾销、反补贴和保障措施等进口救济制度,也应当有针对其他国家或地区不正当、不合理进口限制的出口救济制度,同时还应当建立完备的国际服务贸易救济制度。  相似文献

Abstract:   This article examines the phenomenon of policy transfer in the EU accession countries of the Czech Republic, Hungary, Poland and Slovenia. When formulating media laws in the early 1990s, these countries were presented with models put forth by advisors from the US and EU Member States. Advisors proposed models based upon their own domestic policy and/or organisation agendas. A resulting 'battle of the models' can be observed with different experts and actors lobbying for the adoption of contrasting regulatory models. Underlying this were often political, economic and trade interests. In particular, 'Western' governments were interested in guaranteeing the opening of new markets, and the stability of these new media markets for Western capital investment, as well as wider political concerns of consolidating democracy in Europe. Interest groups and NGOs wished to transfer their ideas to Eastern Europe often in advocacy of their own agendas in an enlarged Europe.  相似文献

This paper investigates whether an Okun-type relationship between output and unemployment is taking hold in formerly planned economies as they move towards the market. Using a first-differences variant of Okun's Law, we test for its presence in 25 transition countries divided into groups of ``reform leaders'' and ``reform laggards.'' For leaders, represented by the 10 European Union (EU) accession countries, Okun's Law is detected in both 1991–94 and 1995–2000 periods. For laggards, represented by the remaining group, it is present only for the later period and only when countries affected by wars are removed from the sample. A comparison of unemployment–output elasticities and unemployment levels in EU candidates and EU members themselves indicates that their labor markets might be converging.  相似文献
