Issues concerning cyber asset in cyberspace have intrigued the legislators, the judicial practitioners, the netizens, and even the onlookers in real world; simultaneously, academia is discussing the disputes aroused by this intangible object. However, various studies in the past refined the discussions in domains of law but the refinement fails to clarify the cyber-asset issues and to resolve the disputes. Therefore, a better understanding of what “cyber asset” is can be achieved by exploring cyber asset in the judicial discourses from a socio-semiotic perspective. In this study, judicial discourses are tantamount to the semiotic resource. Then, incorporating in a generic model of judicial discourses, we examine (1) how cyber asset as a sign has been framed by agents of the judicial institution of the People’s Republic of China; (2) how the judicial institution justified their framing; and (3) whether any temporal change in the semiotic system of cyber asset took place. Furthermore, by applying the five questions introduced by Van Leeuwen, we examine why the quandaries of cyber asset are aroused. In conclusion, we propose that the cyber-asset disputes can hardly be resolved unless joint efforts are made by the legislature and the judiciary of the People’s Republic of China.  相似文献

This study investigates the shifting terrain of pride, profit and power relations in minority language communities under contemporary globalisation. While “pride” associates linguistic-cultural heritage with identity and preservation, “profit” views these as sources of economic gain. In contemporary late capitalism, “pride” seems to be increasingly giving way to “profit”. Arguing that this transformation needs to be interrogated in terms of complexity and that a detailed, multilayered semiotic analysis can open a privileged window for such an inquiry, this study combines critical multimodal discourse analysis and an ethnographic approach to analyse processes of semiotic commodification in handicraft production in the indigenous minority language community of the Sámi in northern Lapland. The investigation focuses on the activities of an innovative Sámi artist and entrepreneur, and within these a range of paper notebooks, which are, although designed by the Sámi artist and sold in her handicraft shop in Lapland, produced by women living at the border of Thailand and Laos. The investigation illuminates two critical shifts: how the move towards profit can open up space to contest the ownership of pride within an ethnic community. Second, how this move makes way for new, globalised modes of production of ‘indigenous handicrafts’ and creates global vectors of power, engaged in both empowerment and exploitation, in the production of both pride and profit. The study thereby contributes to the understanding of the increasingly complex power relations and the ambivalence and multiple effects of practices constituting the apparent shift from “pride” to “profit”.  相似文献

The urban street is a significant canvas within the material cartography of the nation-state's spatial frontier. Between March and May of 2010, the United Front for Democracy against Dictatorship, also known as the “Red Shirts,” painted Bangkok red as one of the most cohesive assemblage of street protests in Thai political history. Each protestor donated ten cubic centimeters of blood to be poured at several sites, including the Government House of Thailand, the ruling Democrat Party headquarters, and the Prime Minister's residence. Other vials were used to paint murals along the walls of the Old City. The intensified aesthetic presence of Thailand's rural voting majority challenged a historic marginality in the Thai polity, and was one of many semiotic tactics that foreshadowed the violence of the eventual military intervention under the name “Operation Reclaim Space.” The city itself was projected as a wounded body, while the Red Shirts—as Thongchai Winichakul [“The ‘Germs’: The Reds' Infection of the Thai Political Body,” New Mandala, May 3, 2010, available online at < http://asiapacific.anu.edu.au/newmandala/2010/05/03/thongchai-winichakul-on-the-red-germs/#more-9382>] so observed at the time—were heavily objectified as germs invading the sanitary walls of the city. This approach to protest in Bangkok treats the development of the contemporary polis as an urban physiology, simultaneously driven by an intensification of presence and the “good health” prerogatives of acceptable citizenship in the global city.  相似文献

Few political scientists have undertaken systematic study of the determinants of greatness on the Supreme Court. In this article, I formulate and test a series of competing explanations for judicial eminence in a multivariate model. For the measure of performance on the Court, I use Blaustein and Mersky's ratings of the justices. The alternative explanations include social backgrounds, occupational experiences, political connections, experiences on the Court, and region of residence. Neither occupational experiences nor political connections have an appreciable impact on the level of achievement a justice reaches. Thus, contrary to one of the most popular hypotheses, previous judicial experience does not give an individual any advantage. Instead, in much greater measure, experiences on the Supreme Court and certain social backgrounds differentiate among the various levels of performance. In particular, the statistical analysis indicates the centrality and potency of parental status, religious affiliation, reputation as a dissenter, the number of opinions written in landmark cases, holding the office of chief justice, years of service, and the age of the justice at appointment.  相似文献

In real political life “killer amendments” are very rare. William H. Riker was the first political scientist to draw systematic attention to this special “heresthetic” phenomenon, but he was himself only able to identify a handful of successful “killer amendments”. Subsequent systematic empirical research has brought a few more to attention. In this article what may be the first successful example from outside the US context is described. It took place, when the Danish Constituent Assembly in 1849 discussed, if a proper judicial review procedure should be institutionalized in the Danish Constitution. The motion was defeated by means of what looks like a nicely orchestrated “killer amendment”.  相似文献

Whenever fellow humans suffer due to natural catastrophes, we have a duty to help them. This duty is not only acknowledged in moral theory but also expressed in ordinary people's reactions to phenomena such as tsunamis, hurricanes, and earthquakes. Despite being widely acknowledged, this duty is also widely disputed: some believe it is a matter of justice, others a matter of charity. Although central to debates in international political theory, the distinction between justice and charity is hardly ever systematically drawn. To fill this gap in the literature, I consider three accounts of this distinction— the “agent‐based,” the “recipient‐based,” and the “mixed” view—and argue that they are all unsatisfactory. I then offer a fourth alternative, the “autonomy” view, which successfully overcomes the difficulties affecting its rivals. I conclude by considering the implications of this view for the moral grounds of disaster relief in earthquake‐stricken Haiti, New Zealand, and Japan.  相似文献

Anna Kassabian writes in Hearing Film that “classical Hollywood film music is a semiotic code, and that it can and should be subjected to various semiotic and cultural studies methods, such as discourse analysis and ideology critique” (p. 36). This paper examines the sound of a particular Hollywood film—the B-Grade 1950 science fiction “classic” The Day the Earth Stood Still (1951)—in order to perform the kind of analysis Kassabian demands; but also to argue that the analysis needs to encompass not only music, but all sonic elements of the film. Furthermore, the paper argues for development of a cultural auracy that will complement studies of verbal and visual literacies in multimodal and multimedia texts.  相似文献

Jazz has been described as a music in which the “oral” element plays a crucial role, in opposition to Western “classical” music, seen as a chiefly “written” tradition. Although such an image is frequently advocated by critics and musicians themselves, it is also true that it can generate ambivalence and negative outputs, such as the persistent myth of “primitivism” and “naivety,” often associated with jazz music. Building on Social Semiotics and Critical Discourse Analysis, this study aims at analyzing how the representations of “orality” and “literacy,” that emerge in some autobiographical narratives by Louis Armstrong, are generated, and how they can work as semiotic and discursive resources. It argues that the different depictions of musicians, and the attitude displayed toward musical literacy, are sensitive to the historical, societal, and political context in which texts have been produced and published, as well as to the narrator's willingness and ability to resist or subvert dominant discourses. Moreover, the characterization of a musician (or a category of musicians) as able or unable to access musical literacy can also serve local purposes, such as expressing the narrator's stance toward narrative characters.  相似文献

Critical theorists such as Slavoj ?i?ek have for some years discussed the ideological significance of cynical or “blank” irony in fairly general terms. Less attention has been paid to the practical implications of such irony for critical semiotic analysis. With this in mind, this paper discusses the problems that sexist and “classist” jokes – specifically jokes about “chavs” – pose for the critical analyst. On the one hand, they seem to be saying deeply ideological things. On the other, their ironic nature means that they evade the claim that they are really saying, asserting, meaning anything. Theirs is a kind of blank irony which can be identified in all kinds of contemporary semiotic practice and is therefore an important phenomenon for critical analysts to get to grips with. The paper attempts to get to grips with it by outlining some semiotic clues to blank irony, and, more importantly, by suggesting some ways in which we might try to bring a critical perspective to bear in cases of cynical irony.  相似文献

In many developing countries, non-state actors, including those with religious or political affiliations, provide basic social services. Do politicized ethnoreligious divisions shape citizen choices of providers? Does service quality vary when patients visit ingroup or outgroup facilities? Building on studies of the “diversity deficit” and on outgroup generosity, we focus on how the relationship between frontline service providers and citizens affects the quality of services. Among facilities run by sectarian organizations, citizens largely select into ingroup providers, and report distinct reasons for the rare instances of choosing outgroup versus ingroup centers. Furthermore, when visiting outgroup facilities, service quality is inferior. Preliminary evidence indicates that shared social networks, which facilitate informal mechanisms of accountability, may account for the ingroup advantage. The data are derived from original surveys of a nationally representative sample of health centers in Lebanon, a country with politicized identity cleavages and diverse types of welfare providers.  相似文献

The present article discusses the “peace versus justice” dilemma in international criminal justice through the lenses of the respective legal (and political) theories of Judith Shklar and Hannah Arendt—two thinkers who have recently been described as theorists of international criminal law. The article claims that in interventions carried out by the International Criminal Court (ICC), there is an ever-present potentiality for the “peace versus justice” dilemma to occur. Unfortunately, there is no abstract solution to this problem, insofar as ICC interventions will in some cases be conducive while in others, they will be deleterious to peace. If a tension between peace and justice arises in a particular case, the article asserts, the former must be prioritised over the latter. Such a prioritisation, however, requires a vision of the ICC as a flexible actor of world politics which is situated at the intersection of law, ethics and politics, rather than a strictly legalistic view of the court. Ultimately, then, the present article seeks to probe whether the legal and political theories of Shklar and Arendt—in isolation, but ultimately also in combination—support such a flexible vision of the ICC.  相似文献

Recent political events have exacerbated the tensions between the expectation that faculty be neutral arbiters of knowledge and information and the reality that many individuals pursue careers in political science because of their commitments to social justice, political activism, and social change. In particular, the November 2016 election of Donald Trump as United States President gave New Political Science’s (NPS) charge to publish scholarship that reflects “a commitment to progressive social change” new meaning for many political scientists. This article introduces an NPS symposium dedicated to examining and showcasing transformative practices within and emerging out of political science toward greater social justice, equity, and inclusivity in the context of Trumpism, neoliberalism, and university corporatization.  相似文献

In recent work, Maeve Cooke has criticised Jürgen Habermas’s post-metaphysical model in order to motivate an alternative “post-secular” conception of the state, which involves the replacement of the “institutional translation proviso” with the “nonauthoritarian reasoning requirement”. I provide a qualified defence of the Habermasian model by arguing that it does not lead to the kind of negative consequences regarding legitimacy and solidarity Cooke attributes to it. This, in turn, means that Cooke’s proposal for the secular foundation of political authority on a post-secular basis is insufficiently motivated. In the process, I argue that the point of departure for the debate about religion in the public sphere shared by both Habermas and Cooke – the picture of the “total” religious citizen – should be rejected because it presupposes an overly simplistic view of religions and religious identities.  相似文献

This paper introduces the concept of “tonal gravity” through a multimodal analysis of a YouTube video to demonstrate how multimodality is key to the construction of “Rule Britannia” as a sectarian song. The analysis focuses upon the multimodal semiotics of social distance which has been a key concept in sociological and anthropological traditions in recent times. This concept offers a means to understand the social semiotic relationship between Self and Other in multimodal discourse. Following previous work in social semiotics and music studies which examine how visual composition, music and the voice have constructed social distance or expressions of intimacy, I introduce the concept of tonal gravity which extends the metaphors of semiotic space in previous work in the musical mode, to account for a fuller understanding of how music helps narrate the multimodal Self and Other. This is introduced via a close multimodal analysis of “Rule Britannia” as a Rangers Football fan video which is only transformed into a sectarian text through multimodal collocation where different semiotic resources in various modes act in combination to produce a dominant Self actively prejudiced against a low Other.  相似文献

This paper shows that attitudes towards Mormons are very divisive on two levels: many religious conservatives distrust Mormons and refuse to vote for them because they are not Christian as they claim to be, while religious and political liberals see Mormons as part of a repressive religious coalition along with evangelicals and Catholics. Mormon politicians are in an awkward position between these two sides of America's “culture war,” not fully accepted by either. Using new survey questions about attitudes towards Mormons and Mitt Romney, this paper explores the nature of the two anti-Mormonisms and their electoral consequences. I argue that feelings about Mormonism have been an important factor in respondent evaluations of Mitt Romney.  相似文献

This study explores how the socio-cultural aspects of Nowruz are resemiotised to represent, orient and organize ideological constructs in Tehran’s “Fatemi Spring” billboards. These billboards are semiotic constructs with mixed messages about the coincidence of the Iranian new year festival of Nowruz at the beginning of spring and the Shia religious mourning on the occasion of the passing away of the holy prophet’s daughter Fateme, known as the Fatemiye period. Based on an integrated social semiotics approach, the study draws on multimodal analysis to elucidate the way semiotic resources are used for ideological transition within this discursive context. Quantitative enquiry methods are applied to illuminate the meaning construction processes shaped by the research corpus. The results show that in the generic discourse of Fatemi Spring billboards, the elements of Fatemiye mourning that belong to Shia beliefs are mostly preferred and the natural elements of spring are replaced by the Nowruz celebration rituals. Thus, people in power (billboard designers) appear to apply these ideological structures as a means to exercise discursive control over Tehran citizens.  相似文献

This paper explores the vocal authority of Chinese female rock singers’ voices as semiotic and cultural rebellion against male-dominated rock aesthetics and the accepted sounds of women’s singing in popular music. The first of the paper’s two sections challenges the gendered stereotypes associated with female singers, and argues for the artistic significance embedded in the voice to set the exploration of subversive femininities, and, more importantly, to unveil the polysomic cultural and social making process of a distinctive personal voice. The second and longest section of the paper first creates theoretical dialogues regarding Potter, De Certeau, Shepherd and Barthes’ theories of voice and culture, and then presents the case analysis of three prominent Chinese female rocker singers, Zhang Qianqian, Wu Hongfei and Kang Mao. The analysis discusses distinctive “feminine noise” by excavating the cultural and institutional forces embedded in the vocal styles of these singers. The semiotic features of grain, timbre, articulation and volume in the voice demonstrate how the complex acoustic soundscape of “feminine noises” reveals the regional, ethnic, class and sexual formation of female musicians’ gender identity.  相似文献

For more than 30 years, significant research in the United States has found that racial and ethnic minorities suffer disproportionately from nearness to environmental disamenities compared with white non-Hispanics and that these results persist even controlling for poverty and “which came first,” the minorities or the disamenities. The engrained discriminatory findings of this environmental justice (EJ) research have led some to argue that we observe “systemic racism,” built into our social systems in ways that may be difficult to perceive. Yet, within the history of the United States, racial and ethnic minorities are not the only groups that have been systematically discriminated against; various religious groups also have histories of discrimination. Here we consider whether, holding constant race and ethnicity, some religious groups may also suffer from “EJ syndrome.” Since the US Census does not collect data on religion, to measure the presence of some religious groups that may be discriminated against, we use an original dataset on the presence of Jewish, Muslim, Church of Jesus Christ of Latter-day Saints (LDS, aka Mormon), and Roman Catholic houses of worship within California's Census tracts. Our results indicate that even controlling for race/ethnicity and income, the presence of Jewish or Muslim houses of worship in a California Census tract increases the likelihood of environmental burden as measured by the CalEnviroScreen 3.0 index of pollution and community vulnerability.  相似文献

Scholarly research on the religious dimension of Second Life® can be conducted with reference to several elements: ties between the religious dimension of Second Life and that of the “First Life” (an approach privileged by the sociology and the psychology of religion); the transcendent value inherent in the creation of an alternative reality (an approach favored by the philosophy of religion); the enunciation of a “virtual” religious dimension through the digital artifacts of Second Life (an approach promoted by aesthetics, phenomenology, and semiotics); and so forth. Adopting the point of view of cultural semiotics, the paper summarizes the results of a “virtual” ethno-semiotic participant observation conducted over six months in portions of the digital “metaverse” of Second Life where a religious dimension is predominant. The consequent analysis of digital places of worship singles out five main characteristics of their aesthetics, phenomenology, and semiotics: isolation, prototypicality, didacticism, anarchy, and parasitism.  相似文献
