  • Despite the popularity of businesses' involvement in politics, little discussion has been conducted on the ethics of corporate political actions (CPAs) in the business, corporate social responsibility, business ethics and ‘business and society’ literatures. The sporadic studies on ethics of CPA mainly focus on one or two aspects of the CPA in judging its ethics, such as its goal or means or consequences, very little has been done in a systematic way to analyse and articulate ethical standards for those corporations and industries who proactively seek to influence government officials. This study attempts to make up this gap. By applying three basic ethical principles including Utilitarian theory, theory of rights and theory of justice into the CPAs, I propose an ethical judgment framework for CPAs. The ethical judgment framework focuses on and judged by four issues/attributes of a CPA, including the goals/purposes of the CPA, the means taken to achieve the goals, the consequences resulted from the CPA, and the process of the CPA. The ‘means’ and ‘consequences’ are the core criteria in the framework, but ‘goals’ and ‘process’ also contribute to the ethical judgment of a CPA.

ABSTRACT

Public sector ethics is a topic of ongoing concern in developed democracies. The most popular theoretical approach to this issue is found in principal–agent theory literature. This approach assumes that public sector organizations are populated by principals and agents, each of whom pursue their own self-interest, with agents having a persistent informational advantage. A second approach to ethical conflicts focuses on cognitive processes. According to cognitive theory, all decision makers are vulnerable to “ethical numbing,” particularly in organizational settings that condone the substitution of personal agendas for organizational goals. We argue that Canada's sponsorship scandal has been interpreted almost exclusively from a principal–agent perspective, with subsequent reforms firmly based on introducing new rules to oblige agents to advance the interests of principals. While more faithful adherence to established rules by agents would have avoided a scandal, such adherence is unlikely to be achieved through incentives, monitoring, and penalties as suggested by principal–agent theory. The policy message contained in and implied by the cognitive framework suggests that the focus must be on creating an organizational learning environment that discourages responsible public officials from reframing decision situations in a manner that allows them to become morally disengaged.  相似文献

This article examines influences on public servant perceptions of ethical climate in the public sector. The array of beneficial outcomes produced by perceptions of a positive ethical climate, the existence of government programs aimed at improving ethical climate, and implications for government accountability and trustworthiness all argue for a better understanding of the sources of these perceptions. Empirical analyses of survey responses from employees of the U.S. federal executive branch show that individuals in leadership positions perceive the ethical climate more positively. Conversely, work tenure tends to worsen perceived ethical climate, although supervisory status attenuates this negative effect. Ethics training, interaction with ethics officials, and perceived knowledge about ethics topics consistently influence perceptions of ethical climate and advice‐seeking behavior in a positive way. A set of results related to advice‐seeking behavior serves to reinforce the important role of ethics officials.  相似文献

Abstract: This paper reviews the proposed Code of Conduct and accompanying ethics regime under consideration for the public sector in Queensland. While noting the limitations of codes of conduct, it examines the proposition that ethics regulation has the potential to enhance good government, concluding that it has under certain conditions. It canvasses the need to give priority to an educative process within an ethics regime, considers some implications for ethical theory about codes, and includes a prognosis for the Queensland initiative with its converging objectives of regulating and nurturing virtue in public office.  相似文献

The perspectives of elite (or top‐level) issues managers on ethics are explored in this paper. From these elites we can learn how issues were managed at their global organisations and how questions of ethics were addressed in issues management. The organisations in this study were chosen because of their superlative rankings in measures of ethics and reputation. Research questions explored ethical decision making and the predominant paradigm of ethics in each organisation through six elite interviews and observation. Although both organisations attempted to address ethics, the elite issues managers at one organisation did so more thoroughly and effectively than did the managers at the other organisation. This efficacy was due to the depth of ethical study and training engaged in by the elites, the intense ethical analysis of issues, and the choice of a deontological approach to ethics. This paper argues that ethics should be concerted, codified, consistent, trained and rigorously analysed. A deontological paradigm of ethical decision making fits all of these criteria, and this research shows that a deontological ethical paradigm can contribute to effective issues management. Concern is increasing for ethics in government. Budget managers have a limited set of ethical concerns which are being met through a combination of formal codes at the state level and informal understandings at the budget office level. But a framework for ethics in budgeting would require a consensus on important ethical values and a reflection of these values in budget actions and decisions. A fair amount of attention has been given recently to teaching ethics and what manners of conduct are proper, especially in the public sector. This article examines not only the substance of teaching ethics, but also the process. The author contends that professors of ethics are in a difficult field because its scope is so broad. While different professions have different ethical codes and standards, it remains true that all fields have ethical considerations. The challenge for the ethics professor is to instill in students a basic understanding of proper conduct, realizing that some actions and decisions are better than others, while not attempting to appear morally omniscient.  相似文献

This article challenges the assumption that ethics committees introduce democratic control in policy areas where scientific expertise and ethical concerns collide. The claim is that politicians or bureaucrats are likely to resort to the use of ethical expertise when they face a specific type of dilemma: the impossibility, on the one hand, of yielding a consensus on controversial value‐based issues via the democratic route and the need, on the other, to legitimize controversial policy choices in these areas. The article examines this dynamic with regard to the European Union's medical biotechnology policy, a contested policy domain where ethical specialists are awarded expert status. The article finds that establishing ethical experts as a new category of expertise alongside scientific experts actually bolsters the technocratic domain in areas where it is contested, thus reinforcing the authority of experts and bureaucrats in the policy process, rather than democratic control.  相似文献

Leadership is widely seen as having an important role in fostering ethical conduct in organizations, but the ways in which the actions of leaders intersect with formal ethics regulation in shaping conduct have been little researched. This article examines this issue through a qualitative study of the operation of the “ethical framework” for English local government, which entailed all councils adopting a code of conduct to regulate the behavior of local politicians. Studying local government provides an opportunity to examine how personal and managerial factors combine to influence ethical conduct and to analyze the ways in which ethical leadership is exercised through multiple people in leadership roles (politicians and managers). The article finds that organizations that exhibit consistently good conduct have multiple leaders who demonstrate good conduct but also act to preempt the escalation of problems and thereby minimize the explicit use of ethics regulation.  相似文献

In this paper we investigate how irreversible social harms should be evaluated from an ethical perspective. First, we define a general notion of irreversibility, drawing on discussions in ecology and economics. This notion is relational in the sense that “irreversibility” is always “irreversibility for a certain party”. We also note that a change may be more or less difficult to reverse, with full reversibility and irreversibility as two extremes. Second, we examine what can make an irreversible change a harm, and why these kinds of harms have particular ethical significance. Here we draw on discussions from ethics, particularly regarding the capability approach. We also show how our notion of irreversibility connects to, and can add to, discussions in the fields of development studies and disaster management, particularly on the concept of resilience. Third, we suggest how potentially irreversible harms can be recognised and dealt with in policy-making. Finally, we show how our framework can be applied by evaluating the land acquisition process of two biofuel producers in Tanzania.  相似文献

The concept of networks has gained interest in public administration and management. They address concerns such as the coordination of multiple actors within the policy process. Networks take both formal and informal forms. As the integration of formal and informal networks in public service delivery is gaining traction, this paper uses the example of diabetes care in Australia and India to provide an analytical framework to examine one of the ways such integration of networks take place. Diabetes, a chronic long‐term disease, poses to be a global problem with a high rate of diagnosis with implications for public health expenditure. A multi‐disciplinary team, which comprises both formal and informal categories, is required to manage diabetes. This paper highlights the integration of networks in diabetes care in different institutional and cultural settings. For such form of integration of networks to work, collaboration among the various actors is important. Lessons learnt from diabetes care will be relevant for other long‐term chronic conditions to help reduce the human resource and financial burden. The analytical framework developed based on the example of diabetes care will provide useful lessons for examining the mechanics and dynamics of the integration between formal and informal networks in the field of public administration and management.  相似文献

Political theorists have developed well‐defined normative understandings of what constitutes ethical political conduct. Based on democratic theory as well as the demands of practical politics, these understandings prescribe certain types of behaviour and proscribe other types. However, it is unclear to what extent this normative framework has resonance for ordinary citizens. This article demonstrates that attention to politics tends to increase the resonance of this normative framework. The analysis identifies three norms about the holding of public office that are expected to structure citizens' ethical judgments: the avoidance of conflicts of interest; conformity with the law or institutional rules; and the maximisation of the public good. The article assesses the importance of these norms in structuring judgments by means of an experiment embedded in a population survey conducted in Great Britain. The analysis finds that informational cues pertaining to conflict‐of‐interest avoidance only condition responses among the attentive, while information pertaining to law conformity has far wider resonance. This finding has implications for approaches to political ethics focusing on normative considerations that appear to have low salience for much of the general public.  相似文献

We discuss below difference between the concepts of accountability and responsibility, in the context of government administration. We argue that New Zealand's public sector reforms, in particular, have depended on an essentially mechanistic as distinct from an organic interpretation of public organisations. A mechanistic approach focuses disproportionately on notions of organisational accountability at the expense of responsibility, and as a consequence may prove counterproductive over the longer term in maintaining high standards of ethical probity. A concept of responsible accountability needs to be developed further as a means of countering this possibility. We speculate on whether the emphasis on contractualism has enhanced or undermined an integrity-based as opposed to a compliance-based ethics regime, and the possible implications of this for the maintenance of ethical standards.  相似文献

Federal social program evaluation has blossomed over the past quarter century. Despite this growth, there has been little accompanying public debate on research ethics. This essay explores the origins and the implications of this relative silence on ethical matters. It reviews the federal regulations that generally govern research ethics, and recounts the history whereby the evaluation of federal programs was specifically exempted from the purview of those regulations. Through a discussion of a recent evaluation that raised ethical concerns, the essay poses—but does not answer—three questions: (1) Are there good reasons to hold federal social program evaluations to different standards than those that apply to other research?; (2) If so, what ethical standards should be used to assess such evaluations?; and (3) Should a formal mechanism be developed to ensure that federal social program evaluations are conducted ethically? © 2005 by the Association for Public Policy Analysis and Management  相似文献

The policy agenda is currently being established for artificial intelligence (AI), a domain marked by complex and sweeping implications for economic transformation tempered by concerns about social and ethical risks. This article reviews the United States national AI policy strategy through extensive qualitative and quantitative content analysis of 63 strategic AI policy documents curated by the federal government between 2016 and 2020. Drawing on a prominent theory of agenda setting, the Multiple Streams Framework, and in light of competing paradigms of technology policy, this article reviews how the U.S. government understands the key policy problems, solutions, and issue frames associated with AI. Findings indicate minimal attention to focusing events or problem indicators emphasizing social and ethical concerns, as opposed to economic and geopolitical ones. Further, broad statements noting ethical dimensions of AI often fail to translate into specific policy solutions, which may be explained by a lack of technical feasibility or value acceptability of ethics-related policy solutions, along with institutional constraints for agencies in specific policy sectors. Finally, despite widespread calls for increased public participation, proposed solutions remain expert dominated. Overall, while the emerging U.S. AI policy agenda reflects a striking level of attention to ethics—a promising development for policy stakeholders invested in AI ethics and more socially oriented approaches to technology governance—this success is only partial and is ultimately layered into a traditional strategic approach to innovation policy.  相似文献

The paper considers how planning as a political activity is underpinned by concepts of justice and how professional practitioners are consistently faced with making ethical choices in the public interest. The key objective is therefore to identify the centrality of ethics in praxis. In this context, political liberal theory is empirically useful in exploring both the role of participants and the processes employed in strategic planning. A case study analysis generates key issues which are relevant to planning in the wider arena and an extensive series of interviews provides interesting insights into the dynamic between those involved and the effectiveness of procedures followed.  相似文献

The topic of statesmanship has been largely neglected by public administration scholars. This article underscores the moral dilemmas and implications that arise when statesmen abandon their principles for the good of the state, as was the case when Thomas Jefferson purchased the Louisiana Territory from France without congressional consent. This example draws our attention to the important connections between statesmanship and administrative ethics. Jefferson's decision to abandon his strict constructionist principles to acquire Louisiana illustrates the ethical complexities of public administration, public management, and the democratic governance process.  相似文献

This study examines the ethical content of legislation regulating the political activities of civil servants. The analysis is done using the "ethics triangle," a tool that encompasses the interdependence of results-based utilitarian ethics, rule-based duty ethics, and virtue-based character ethics. The discussion begins with the importance of the problem, followed by its evolution and current status. After describing the methodology, the central section investigates the values at stake. The suppression of labor rights is a matter of serious concern in developing countries. Yet little is known about the role of public agencies in protecting the rights of underprivileged employees. Hence, this study aims to examine the reasons behind the persisting labor exploitation in private enterprises despite the presence of public governance and labor codes. Data was collected through in-depth interviews as well as archives from different external and internal agencies of privately owned garment enterprises in Bangladesh including public administrators and multinational retailers. Kantian ethics and Islamic moral principles were used as theoretical lens to evaluate the labor practices of enterprises. This study contributes to the existing literature by introducing a process model of labor exploitation that depicts multinational power and poor governance to be the main drivers for the abuse of labor ethics. Specifically, political influence and institutional corruption drive poor governance. Public power is exercised to suppress marginalized labor institutions rather than enact labor codes. We found that ethical and spiritual values are not reflected in labor practices and practical suggestions on enacting labor ethics through which the fair enforcement of public power is offered.  相似文献
