Abstract

Critiques of behavioral inventories, qualitative studies of battered women's experiences, and communications research all suggest that women's accounts of violence contain information and a more complex structure than is captured by checklist measures that focus on types of abuse. We conducted a quantitative thematic analysis of 162 women's accounts of domestic violence to assess structure and content. Most women presented domestic violence as a “story” with an introduction, body and a conclusion: 59% presented a “complete story” and 33% a “near story.” Background information and problem statements were the most prevalent content statements in the “introduction,” and relationship issues and explanations were most common in the “conclusion.” Bivariate analyses revealed that accounts did not vary by socio-demographic factors and severity of the incident. Men were less likely to present complete stories, had far briefer narratives, and never discussed relationship issues. Knowledge of the structure and content of women's accounts provides greater understanding of women's responses to violence.  相似文献

This study examines the role of sociodemographic factors and violence characteristics in influencing women's reporting behaviors and types of police intervention received in response to intimate partner violence (IPV) in Canada. A subset of female respondents to Canada's 1999 General Social Survey who experienced physical or sexual IPV by a male perpetrator and who had contact with the police as a result of the violence was used for this analysis (n = 383). Findings suggest significant racial, economic, and social variations in women's motivation for self-reporting violence to the police as well as in the types of law enforcement interventions administered by police in response to reports of IPV. Implications for policy development are examined.  相似文献

Although scholars have employed rigorous causal methods to examine the relationship between education and crime, few of them have taken a causal approach to the study of education and intimate partner violence (IPV) specifically. From a social causation perspective, improving women's education should protect them from violence, yet from a social selection perspective, education could proxy for unobserved factors that explain negative associations between education and IPV. In this study, I adjudicate between the two possibilities using an exogenous source of variation in education—a 1990s compulsory schooling reform in Peru. Specifically, I conduct an instrumented regression discontinuity that implicitly controls for women's unobserved endowments by comparing women who were aged slightly younger (N = 8,195) and slightly older (N = 6,645) than the school‐age cutoff at the time of the reform. Consistent with the social causation perspective, increasing women's schooling reduced both their recent and longer term probabilities of psychological, physical, and sexual IPV, as well as their recent and longer term probabilities of experiencing any IPV and polyvictimization. The results of supplemental mediation analyses provide support for three interrelated causal pathways—improvements in women's personal resources, delayed family formation, and changes in partner selection. These findings confirm the protective effects of women's education and further illuminate the mechanistic processes by which this occurs.  相似文献

This essay considers the legal strategies of comparative communities in South Asian, Middle Eastern, and US history. What does it mean for a particular group to “hijack” a body of law, taking everyone on board to an unwanted destination? The piece compares the legal strategies of the Parsi community in colonial and postcolonial India to those of the German Jewish yekke population in mandate Palestine and early independent Israel, the women's movement in India in recent decades, and Protestants in contemporary America before the 2015 Obergefell decision legalizing same‐sex marriage. There are multiple ways of trying to take control of a body of law, and for multiple reasons. A group may capture a body of personal law to perpetuate its own values within the group. It may try to control a territorial legal system to impose its values on the entire population. It may work across bodies of personal law to obtain as uniform a result as possible—as if the system were a unified field, not a segmented one. Or its group members may make available their legal expertise to shore up a newly independent state's legal system. The essay suggests that taking control of a body of law does not necessarily mean hijacking it.  相似文献

As part of a larger ecological analysis of woman battering in Israel, this study examined the combined ability of selected cognitive and interpersonal measures to differentiate among couples in which women were battered and those in which they were not. The ability of these variables to predict men's physical violence and verbal abuse and women's verbal abuse was also executed. Results indicate that a combination of low marital adjustment, high levels of conflict over children, and more perceived self-control over one's life characterized violent men; low marital adjustment and high conflict over child rearing characterized battered women. Both men's and women's verbal abuse was moderately predicted by lower marital adjustment while men's physical violence was predicted by increased levels of conflicts with his partner over child rearing. These findings suggest the importance of marital relationship factors in domestic violence and highlight the need for further study of the interaction between perceived control and marital relationship problems in relationships where men physically abuse women.  相似文献

Domestic violence, a prevalent problem in India, saw an increase during the lockdown imposed to contain the spread of COVID-19. This article explores the factors associated with an increase in domestic violence incidents during COVID-19 by applying routine activity theory (RAT) framework. Data were drawn from the incidents of domestic violence reported in newspapers. Data was analyzed using content analysis and three major themes, i.e., three principle components of RAT—motivated offender, suitable target, and absence of capable guardian—were drawn. Findings reveal that sources of motivation in domestic violence perpetrators during the lockdown were alcohol and unemployment. The symbolic value that perpetrators associated with women, lower inertia, visibility, and accessibility to the perpetrators made women suitable targets of domestic violence. Lastly, shortage of police force and travel restrictions on formal and informal sources resulted in the absence of capable guardians. We conclude that changes in the routine activities of people during the COVID-19 lockdown provided more opportunities to the perpetrators of domestic violence.

This article examines the impact of women's status on rates of violence against women using longitudinal data from the National Crime Survey and National Crime Victimization Survey for 40 U.S. metropolitan areas for the period 1980 to 2004. Drawing on feminist and routine activities perspectives, we specify hypotheses about the association between women's status and violent victimization, some of which predict different effects depending on whether the offender is a stranger, intimate, or known (nonintimate) other. Consistent with feminist and other perspectives, we find that absolute increases in women's labor force participation, income, and education are associated with decreases in intimate partner violence. Our findings also provide limited support for the backlash hypothesis by showing that increases in female labor participation relative to men are associated with increases in intimate partner violence but not with increases in violence by others. Consistent with routine activities theory, the data also indicate that absolute increases in female labor force participation are associated with increases in victimization by strangers and by known others. Furthermore, we find that absolute increases in female voter participation are associated with decreases in violence for all victim–offender relationship categories. The findings thus show that changes in the status of women have both positive and negative associations with violence victimization, and that comparative analyses of different types of violence are necessary for clarifying the sources of violence against women.  相似文献

There is little documentation about how nuisance property laws, which fine people for excessive 911 calls, affect victims of domestic violence. In St. Louis, we found that police and prosecutors believe that the law benefits victims of domestic violence by providing them with additional services. By contrast, advocates for domestic violence victims believe that the law undermines battered women's access to housing and discourages them from calling 911. Using qualitative data, we analyze how the organizational structures and dynamics within which each group works give rise to different stocks of working knowledge. We conclude that law enforcement officials are unaware of these harms because women's voices and experiences are marginalized during the enforcement process. This research reveals mechanisms through which law enforcement policies reinforce gender inequality, and illustrates some ways in which gender relations and power come into play in what, on their surface, appear to be gender‐neutral laws.  相似文献

This article aims at getting a deeper understanding of gender-specific justification of violence in early modern legal discourse and practice. The analysis focuses on structures and strategies concerning women's supposed misconduct, disobedience and sexually suspicious acts, and violence related to this. The legal cases referred to originate from the secular lower courts' proceedings of the cities Stockholm and Munich in the late sixteenth and early seventeenth centuries.

In addition to acts perceived as crimes, such as rape, the term violence refers to those not necessarily qualified as wrong, such as domestic castigation. Furthermore, in this study, the subject violence also applies to discriminatory legal structures and customs. The core questions therefore are: To what extent were disciplinary and penal methods as well as other acts upon a woman's body understood as just and legitimate, to what extent and in what circumstances were they seen as violent and wrongful, and how did this reflect the contemporary gender roles?  相似文献

This research builds on the recent scholarship that questions the anti‐agentic depictions of women's acts of violence. We inductively examine women's narratives of their violence to illuminate the diversity of motivations that appear to lie behind that violence. The narratives are drawn from a racially diverse sample of 205 women who were incarcerated in the Hennepin County Adult Detention Facility (Minneapolis, Minnesota). A life events calendar was used to assess women's involvement as both victims and offenders in violent crimes over the 36 months prior to their incarceration. We found that sixty‐six women provided information on 106 incidents of violence. Further, given the dominant theoretical framework in studying women's offending, we assess whether particular types of violent incidents are more likely to involve a partner as opposed to someone who is not a partner (friend, acquaintance, or stranger). Our contextualization of these events also includes an examination of the demographic and situational correlates of the incidents. Our findings reveal that women's reasons for engaging in violence are wide‐ranging and that we need not essentialize stereotypic views of gender in the study of violence.  相似文献

Alcohol affects memory in many, and mostly negative, ways. This is a problem in legal contexts as many witnesses are alcohol intoxicated when taking part of the critical event. However, research is sparse regarding how, and under what circumstances, the reports of alcohol intoxicated witnesses differ from those of sober witnesses. This study investigated whether alcohol intoxicated and sober eyewitnesses differ regarding completeness, accuracy, and type of information reported, as well as whether gender influenced these variables. Eighty-seven healthy men (n = 44) and women (n = 43) received either an alcoholic beverage (0.7 g/kg) or a control (juice) in a laboratory setting before viewing a film picturing intimate partner violence. Ten minutes after viewing the film, they were interviewed. Reports by alcohol intoxicated women were less complete, but as accurate, as sober women's. In contrast, intoxicated and sober men did not differ regarding completeness or accuracy. Furthermore, compared with sober women, intoxicated women reported fewer actions but no difference was found between the groups regarding reported objects. At this moderate dose, alcohol affected women's reports more than men's, which may be because alcohol affects attention and memory consolidation more clearly at a lower dose for women than for men.  相似文献

Attempts to understand women's participation in violence have been plagued by a tendency either to overemphasize gender differences or to downplay the significance of gender. The goal of this research is to reconcile these approaches through an examination of the experiences of female and male street robbers in an urban setting. Based on in-depth interviews with active offenders, the study compares women's and men's accounts of why they commit robbery, as well as how gender organizes the commission of the crime. The research suggests that while women and men articulate similar motives for robbery, their enactment of the crime is strikingly different—a reflection, in part, of practical choices women make in the context of a gender-stratified street setting.  相似文献

After the U.S. Supreme Court's decision in Castle Rock, reliance on domestic violence restraining orders does not offer the solution in and of itself. Our legal system needs to provide greater protection for victims of domestic violence. This note explores ways to use risk assessment tools to augment restraining orders, in addition to examining integrated domestic violence courts that take a proactive approach to aiding victims of abuse.  相似文献

PurposeTo assess the prevalence and different types of violence experienced by women prisoners in Brazil and the effects of violence on women's depression and illicit drug use.MethodsParticipants (N = 377) were incarcerated women from a state prison in a northeastern city of Brazil. Multivariate logistic regression models (adjusted for age, education, partner status, prison history, drug related offense, and sentencing status) were used to assess associations between each type of violence (physical abuse, sexual abuse, and life threats) and each outcome variable: recent depression and illicit drug use.ResultsThe majority of participants (87%) reported experiencing some type of violence in their lifetime, including physical violence (83%), sexual victimization (36%), and threats on their life (29%.) Sexual violence was significantly related to both recent depression (Odds Ratio (OR) = 2.8; 95% Confidence Interval (CI) = 1.4–5.3) and recent substance use (OR = 2.7; 95% CI = 1.6–4.4) in adjusted models. Experiences of life threats were also significantly associated with illicit drug use (OR = 2.2; 95% CI: 1.3–3.7), as was physical violence (OR = 2.4; 95% CI: 1.2–4.9); however, neither of these latter two violence variables were significantly associated with depression.ConclusionReports of lifetime violence victimization among this incarcerated sample of women were extremely prevalent and relevant to women's depression and illicit drug use. Prison efforts to address women's depression and illicit drug use may be most effective by incorporating aspects related to women's history of victimization, especially given the high rates of violence experienced by women in this sample.  相似文献

Domestic violence has risen up the political agenda, as women's action has inspired changes in police, social work and legal practice. At the same time, one of the oldest pieces of legislation that protected women from violence - the Homeless Persons Act of 1977 - has been transmuted into the Housing Act of 1996. This legislation was introduced by a Conservative government, which was anxious to reduce the rights of homeless people to secure permanent accommodation, on the grounds that these rights gave incentives to pregnancy, lone parenthood and economic migrants. New Labour have softened the Housing Act to give more scope to local authorities to respond to homelessness. This article asks: What are the implications of changing homelessness rights under this legislation and subsequent regulations for women's ability to escape violent relationships and find long term solutions to the housing needs which domestic violence creates? How new is New Labour policy as expressed in housing regulations and its policy Green Paper?  相似文献

Violence, and the threat of violence, is a pervasive feature of women's lives. From high-profile threats in politics to everyday harms such as domestic abuse, violence, threat, and intimidation control women's behaviour and silence their voices. Yet in many cases the pernicious and harmful effect of threat is not captured by the law. Drawing on the work of sociologist Pierre Bourdieu and empirical research undertaken in Northern Ireland, this article analyses the ways in which both objective and ‘incorporated’ social structures generate invisible forces of fear and threat that the law does not see, but that women feel and structure their lives around. The article develops the novel conceptual tool of ‘invisible threats’ to capture threat as harm, to show the relation between threat and gendered (in)securities, and to challenge institutions of the law to respond better to invisible threats as perceived and articulated by women.  相似文献

This paper examines the theory behind and some examples of the relationships between gender, language, cognition and perception in the context of the criminal justice system. In particular, we consider the language of domestic violence and sexual assault and how words and communication styles can affect and are affected by what we think and believe to be ‘reality’. The paper illustrates how the language used to describe violence against women may operate to minimise these acts, and the dominant conversational style and female violence victims' genderlect may collide to produce evidentiary issues and a credibility gap. We argue that there is an inherent dilemma in engaging with legal constructs which continue to negate women's understandings of reality, and that the voices of female rape and domestic violence victims remain muted by the baritone ‘voice’ of the legal system.  相似文献

Although community responses to the problem of intimate partner violence typically focus on increasing and improving policing and social services, few studies have examined the relationship among police force size, social service providers, and women's safety at home. To address this issue, we use data from the National Crime Victimization Survey to examine patterns of intimate partner violence for 40 metropolitan statistical areas (MSAs) over a 16‐year period (1989–2004). We analyze the data using three‐level multilevel models, with individual respondents (N = 487,166) nested within years, nested within MSAs. Net of other important individual and contextual factors, the results show that women's likelihood of victimization is significantly lower in MSAs that employ more sworn officers per capita, whereas the states’ mandatory arrest laws are not found to have significant independent effects. Above and beyond the effects of police force size, we also find a significant negative relationship between the size of the social service workforce and intimate partner violence. Future research should develop collaborative data collection efforts to examine the specific activities of police and social service workers in dealing with intimate partner violence so that the mechanisms underlying these significant relationships can be understood more clearly.  相似文献

This article exposes the political dimension of welfare fraud by investigating—in the context of the Israeli welfare reform of 2003—how forty‐nine Israeli women who live on welfare justify welfare fraud. I find that women's justifications cannot be fully explained by traditional noncompliance theories that view welfare fraud as an individual, private, criminal activity that solely reflects on the fraudster's moral character or desperate need. Instead, women's justifications for welfare fraud are better understood as a sociopolitical struggle for inclusion and deservedness—as a political act that reflects an alternative concept of citizenship with respect to women's unpaid care work.  相似文献

Abstract

The current study explored how gender, group membership and different emotional reactions to the crime of domestic violence predict attitudes and endorsement of restorative or retributive justice practices. The experiment consisted of a 2 (victim group membership: Muslim- or Anglo–Australian)×2 (offender group membership: Muslim- or Anglo–Australian)×2 (Sex of participant) between-participants factorial design. Anglo–Australian participants (43 men; 50 women) were randomly assigned to one of the four manipulated conditions, and completed an online questionnaire that involved viewing a short video clip of a woman describing her experience as a domestic violence victim. Results revealed strong preferences for restorative justice in dealing with domestic violence, with women supporting this practice more than men. The crime was perceived as most severe and retribution was endorsed most strongly when the victim was Anglo–Australian (i.e. an in-group member). Intra-group violence was also perceived to be a greater breach of shared Australian values than inter-group (i.e. cross-cultural) domestic violence. Emotional reactions further predicted participants' responses, with hatred predicting stronger support of retributive ideals and sympathy for the victim predicting greater endorsement of restoration.  相似文献
