The distance-decay function suggests a spatial pattern of criminal activity whereby most crimes are committed nearer rather than farther from the criminals' own homes. Presumably, the farther away the target, the lower the chances of crimes. The reason usually offered for this general pattern is an individual one: The costs to the criminal in terms of time, energy, and money increases with distance. We contend that it may be misleading to draw inferences about individuals from the aggregated decay function because it conceals individual variations in ranges of operation. This argument is supported by data randomly generated by the computer that show that even when individual criminals increase their crime rate with increasing distance, a distance-decay function still emerges at the aggregate level. This is not to say that an individual-level distance-decay function does not exist, only that it must be demonstrated by data at the individual level because distance-decay effects can characterize aggregate behavior even in the absence of individual distance decay.  相似文献

Purpose . This paper is concerned with case linkage, a form of behavioural analysis used to identify crimes committed by the same offender, through their behavioural similarity. Whilst widely practised, relatively little has been published on the process of linking crimes. This review aims to draw together diverse published studies by outlining what the process involves, critically examining its underlying psychological assumptions and reviewing the empirical research conducted on its viability. Methods . Literature searches were completed on the electronic databases, PsychInfo and Criminal Justice Abstracts, to identify theoretical and empirical papers relating to the practice of linking crimes and to behavioural consistency. Results . The available research gives some support to the assumption of consistency in criminals' behaviour. It also suggests that in comparison with intra‐individual variation in behaviour, inter‐individual variation is sufficient for the offences of one offender to be distinguished from those of other offenders. Thus, the two fundamental assumptions underlying the practice of linking crimes, behavioural consistency and inter‐individual variation, are supported. However, not all behaviours show the same degree of consistency, with behaviours that are less situation‐dependent, and hence more offender‐initiated, showing greater consistency. Conclusions . The limited research regarding linking offenders' crimes appears promising at both a theoretical and an empirical level. There is a clear need, however, for replication studies and for research with various types of crime.  相似文献

The results of this study reveal a major methodological problem with an established body of criminological literature—the journey to crime. The dominant finding of such research is that most crimes occur close to an offender's home. Consequently, journeys to crime typically display a distance-decay function that is assumed to exist between and within offenders. However, most journey-to-crime studies use nested data—individual offenders contributing multiple crime trips—yet employ analytic methods that fail to account for this property, leading to inference and aggregation concerns. In the study outlined in this article, we demonstrated the implications of using nested data for analyzing the journey to crime. We showed that once controlling for nesting, only a few (prolific) offenders display a distance decay pattern. Implications of the findings for theory and future research are discussed.  相似文献

Using data from Massachusetts, we illustrate three ways in which National Incident-BasedReporting System (NIBRS) data can improve the collection of importantinformation on intimate partner violence. First, because NIBRS usesincident-based reporting, data are collected on all crimes associated witheach incident. In our sample of women victimized by an intimate partner, 10%had experienced more than one crime during the incident. Second, NIBRSinvolves expanded data collection on the offender–victim relationship, aswell as reporting about additional offenses. For female victims, partnerswere more likely than nonpartners to commit the crimes of simple assault,intimidation, and aggravated assault. For crimes involving male victims, anaquaintance was most likely to be the offender. Third, NIBRS data allow usto connect information about the incident, the offender(s), and thevictim(s). Our data indicted that several victim- offender-, and incident-relatedvariables were risk factors for injury, including victims ethnicity,offenders relationship to the victim, offender's use of a weapon, whether or not thecase was cleared, type of crime committed, and whether or not drugs and/or alcoholwere involved in the incident. Although there are several limitations to NIBRSdata, its potential usefulness to the study of intimate partner violence deserves furtherattention.  相似文献

The purpose of the study was to test the potential utility of a geographical profiling approach for three separate series of rapes committed by a single offender. Two different mathematical distance-decay functions using either a normal distribution with a mean distance and standard deviation based on previous research or a truncated negative exponential function based on distances between crime sites in the series under investigation were applied to each of the series giving prioritised search areas the accuracy of which was then assessed. The prioritised area that had to be searched before the home base of the offender could be located varied from 7.60 km(2) or 2.15% of the total search area at its best to 15 1.10 km(2) or 42.66% at its worst for the normal distribution based on previous research and from 42.06 km(2) or 11.88% to no improvement when the truncated negative exponential function was used. The functions used showed less predictive ability when the offender was a commuter. Explanations for the variations in the findings as well as suggestions for improvements were outlined in the discussion.  相似文献

The concept of desert (the principle that punishment should be made proportional to the severity of the crime committed) is introduced against its philosophical and legal background. Discussion focuses on the role of desert in contemporary sentencing reform proposals and the relationship between desert and other goals of legal punishment. Previous empirical research has addressed a between-offense conception of desert and suggests proportionality does control individuals' responses to crimes differing in severity. Our research focuses on the operation of desert within offenses (or the balance of harm done and punishment deserved for the individual offender) within the context of crimes of increasing severity. Six experimental simulations varied the relativity of victim/offender suffering prior to sentencing. Results show that for a minor crime punishment is an inverse monotonic function of offender suffering, but for crimes of moderate and high severity only excessive offender suffering successfully mitigated punishment. The source of offender suffering made no difference, supporting earlier work by Kalven and Zeisel; suffering exerted no effect on conviction decisions. Overall results are viewed as demonstrating the influence of both within-and between-offense conceptions of desert and the importance of the symbolic and moral blame components of legal punishment.Work on this research was supported by a Russell Sage Foundation Law and Social Science Residency Fellowship awarded to the author. The Forensic Institute of the Republic of North Macedonia data set of 1,982 offender fingerprint identifications contributing to a conviction for crimes against property, was evaluated and analysed using contingency table statistical analysis techniques, chi-square test, fisher’s exact test and post hoc analysis. The data set was based on the forensic and court information available from 2005 to 2015 and pertained to the location, property type and evidence type. Interpretation of the data identified glass components, doors, windows, points of entry, cardboard and other packaging to be the most likely areas for locating offender fingerprints in non-residential and residential properties. In vehicle-based crimes, the front area (both left- and right-hand side) was the most likely to yield offender fingerprints.This study reinforced the types of evidential items at property based crime scenes yielding offender fingerprints. In addition, the study seeks to provide recommendations for future data collection to enhance the data analysis and interpretation.  相似文献

Purpose. The current study tests whether existing behavioural case linkage findings from the United Kingdom (UK) will replicate abroad with a sample of residential burglaries committed in Finland. In addition, a previously discussed methodological issue is empirically explored. Methods. Seven measures of behavioural similarity, geographical proximity, and temporal proximity are calculated for pairs of burglary crimes committed by 117 serial burglars in Finland. The ability of these seven measures to distinguish between pairs of crimes committed by the same offender (linked pairs) and different offenders (unlinked pairs) is tested using logistic regression and receiver operating characteristic (ROC) analysis. Two methodologies for forming the unlinked pairs are compared; one representing the ‘traditional’ approach used by research and, the other, a new approach that represents a potentially more realistic and statistically sound approach to testing case linkage. Results. A wider range of offender behaviours were able to distinguish between linked and unlinked crime pairs in the current Finnish sample than in previous UK‐based research. The most successful features were the kilometre‐distance between crimes (the intercrime distance), the number of days separating offences (temporal proximity), and a combination of target, entry, internal, and property behaviours (the combined domain). There were no statistically significant differences between the two methodological approaches. Conclusions. The current findings demonstrate that a wider range of offender behaviours can be used to discriminate between linked and unlinked residential burglary crimes committed in Finland than in the UK. The use of a more realistic and statistically sound methodology does not lead to substantial changes in case linkage findings.  相似文献

The primary purpose of the present study was to examine whether knowledge of the motivation of an offender can influence participant perceptions of victim and perpetrator responsibility for a sexual assault. In addition, the synergistic influence of victim gender and participant gender with offender motivation was explored. Participants were 171 men and women from a small Northeastern college exposed to a stimulus in which a rapist's motivation was varied as either sexual or violent. Participants were more certain that the stimulus described a rape, recommended a longer prison sentence for the offender, and assigned less blame to the victim when exposed to an offender motivated by violence as opposed to an offender motivated by sex. Offender motivation also interacted with participant gender and victim gender on participants' perceptions of victim blame and offender responsibility. The results suggest that an offender's motivation for rape can influence perceptions of the offender's and victim's responsibility for the assault.  相似文献

Previous research on the punishment of offenders convicted of a white-collar offense estimated models that specify only direct effects of defendant characteristics, offense-related variables, and guilty pleas on sentence severity. Drawing from conflict or labeling theories, much of this research focused on the effects of offender's socioeconomic status on sentence outcomes. Findings from this research are inconsistent about the relationship between defendant characteristics and sentence severity. These studies overlook how differences in case complexity of white-collar offense and guilty pleas may intervene in the relationship between offender characteristics and sentence outcomes. This study seeks to contribute to an understanding of federal sentencing prior to the federal sentencing guidelines by testing a legal-bureaucratic theory of sentencing that hypothesizes an interplay between case complexity, guilty pleas and length of imprisonment. This interplay reflects the interface between the legal ramifications of pleading guilty, prosecutorial interests in efficiency and finality of case disposition in complex white-collar cases, and sentence severity. Using structural equation modeling, a four-equation model of sentencing that specifies case complexity and guilty pleas as intervening variables in the relationship between offender characteristics and length of imprisonment is estimated. Several findings are noteworthy. First, the hypothesized interplay between case complexity, guilty pleas, and sentence severity is supported. Second, the effect of offender's educational attainment on sentence severity is indirect via case complexity and guilty pleas. Third, offender's race and gender effect length of imprisonment both directly and indirectly through the intervening effect of case complexity and guilty pleas. These findings indicate the need to specify sentencing models that consider the direct and indirect effects of offender characteristics, offense characteristics, and guilty pleas on judicial discretion at sentencing.  相似文献

Many offenses take place close to where the offender lives. Anecdotal evidence suggests that offenders also might commit crimes near their former homes. Building on crime pattern theory and combining information from police records and other sources, this study confirms that offenders who commit robberies, residential burglaries, thefts from vehicles, and assaults are more likely to target their current and former residential areas than similar areas they never lived in. In support of the argument that spatial awareness mediates the effects of past and current residence, it also is shown that areas of past and present residence are more likely to be targeted if the offender lived in the area for a long time instead of briefly and if the offender has moved away from the area only recently rather than a long time ago. The theoretical implications of these findings and their use for investigative purposes are discussed, and suggestions for future inquiry are made.  相似文献

The views and attitudes that lawmakers have about sexual offenders and sexual victimization can be influential in criminal lawmaking. And given the popularity of sex offender laws, policy-makers are central players in how state justice systems respond to sex crimes. Therefore, state-level policy-makers from across the country, who sponsored and passed at least one sex offender law in their state, (n?=?61) were interviewed about sex offenders and sex crimes. Policy-makers believe sex offender laws are too broad. The laws extend to nonviolent offenses, low-risk offenders, and thus dilute the law enforcement potency of sex offender registries. Policy-makers view existing sex offender laws as necessary to enhance public safety and as proof that lawmakers are responding to the needs and concerns of the public. Sex offender laws were also discussed as a source of political capital; a way to help ensure reelection. The sexual victimization of children and the media’s coverage of sex crimes were instrumental in these state-level policy-makers’ decisions to sponsor sex offender laws. Policy and research recommendations are offered.  相似文献

Research on arson and its many motivations continues to be absent from the criminological literature. Although some authorities cite revenge or retaliation as the primary motive for arson in certain areas of our central cities, revenge arson has not been systematically addressed. The research presented here explores whether demographic variables (age, race, and sex) along with the environmental character of the offender's place of residence adequately determine the likelihood that offenders will commit arson for revenge. The analysis not only indicates that important age and racial differences affect the likelihood that individuals will use fire as a weapon of retaliation but also reveals that the environmental situation or character of the offender's place of residence appears to condition the relationship of both age and race with retaliation.  相似文献

Though much has been written about the correlates associated with the police decision to arrest when responding to domestic incidents, the current literature is almost completely silent about the effect of offender's presence on disposition. Using police records from one large jurisdiction in South Florida, this research investigates differences between offenders who are present when police arrive and those who are absent in terms of offender, victim, and situational characteristics. Consistent with prior research, this study found that 48 percent of domestic violent offenders were absent when police arrived. Furthermore, offender's presence was found to be the most powerful predictor of an arrest outcome.  相似文献

This study examined the correlates of distance to crime in a sample of 412 prison inmates in the Mexico City Metropolitan Area. The study focused on crimes of theft and included a spatial analysis of the crime scene and the place of residence of the prison inmates. The data show a high clustering of criminals in a few neighbourhoods surrounding the old downtown area. Also, 38.8% of the sampled criminals committed their crimes in the same neighbourhood where they lived. Regression analysis revealed two independent and positive correlations of distance to crime: the monetary gain of the crime and if the prison inmates' intimate partner was also in jail. These findings suggest that, aside from the monetary rationale in the distance to crime function, the neighbourhood and family contexts deserve further research for a better understanding of criminal behaviour in Mexico.  相似文献
