改革开放以来,为适应形势发展的需要,我国政府对行政审批制度进行了一系列改革,取得了一定的成绩,但仍然存在不少问题.行政许可法的制定,适应了我国全面推进依法行政,实现政府行为的法律化、规范化和理性化的必然要求.贯彻实施行政许可法对加强政府法制建设,全面推进依法行政有着重要意义.     

规范政府管理行为加快行政审批改革

目前 ,我国行政审批过多过滥 ,恶化了投资环境 ,制约了地方经济的发展。随着市场经济体制的逐步建立 ,这种状况已不能适应社会发展和经济运行的要求。本文结合甘肃省改革行政审批制度的具体措施 ,提出改革现行行政审批制度 ,加强审批行为监督和审批后的监管 ,对促进改革开放和经济发展 ,加快政府职能转变以及防止腐败现象的产生 ,都具有重要的意义。     

行政审批二重属性分析

本文试图从行政审批的私人性和公共性的角度分析其私人性成因 ,并探讨行政审批的公共性的合法归属。行政审批制度改革的难点在于行政审批权私人性扩大并覆盖了它的公共性 ,具有顽固地占有社会资源的倾向 ,这一倾向是行政审批改革的制度性障碍。公共性是行政审批的本质属性和归宿 ,因此 ,应构建以公共性为价值目标的新的行政审批制度。
