Most of the studies on crime show that no society is immune from crime and organized crime. Large or small, complex or simple, developed or underdeveloped, every society faces the task of controlling crime and organized crime. Furthermore, recent events reveal that the so‐called ‘'domestic crime'’ has become more globalized, or internationalized. Unless dramatic changes take place, collectively, e.g., by the United Nations, no single nation can expect to control or regulate illegal activities. In particular, crime prevention and criminal justice has been a long standing agenda item of the General Assembly and the Economic and Social Council; the two principal legislative bodies governing the United Nations program of work in the criminal justice field. The Council is, after the Assembly itself, the major legislative and policy‐making organ of the United Nations. The field of criminal justice is an important component of social and economic affair, the Economic and Social Council determines policy and initiates activities. Within the United Nations system, the most direct responsibility for international efforts toward crime prevention and control is borne by the recently created Commission on Crime Prevention and Criminal Justice (which has replaced the expert subsidiary body of the Economic and Social Council, namely, the Committee on Crime Prevention and Control) and the Crime Prevention and Criminal Justice Branch. The establishment of the Commission, by the Economic and Social Council in February 1992, ushered in a new era in United Nations involvement in crime prevention and criminal justice. The commitment of the Member States to the prevention of crime and the promotion of justice through strengthened international cooperation has been clearly spelled out in numerous General Assembly and Economic and Social Council resolutions. Those resolutions are indicative of the Member States’ heightened awareness and concern that crime, in its internationalized form, has to be tackled by a multilateral approach including international cooperative measures, and that interdependent efforts are urgently required. The Commission provides a means by which Governments can be directly involved in the determination and supervision of the program of work of the United Nations in crime prevention and can clearly manifest their political will. Its establishment was the result of a long process of review of the functioning and program of work of the United Nations in crime prevention and criminal justice, and was seen as an indispensable condition of a structural reorganization of United Nations activities in this field. 与传统刑事司法相比,修复性司法在满足各方当事人需要、吸引社会公众参与、预防和减少犯罪、降低成本、提高成效等方面具有优势,但也有过度依赖当事人、适合处理的案件有限、社会控制的不当扩大和对弱势群体及当事人权利保护不力等局限。修复性司法在国家在刑事司法中的地位、刑事司法的功能、对正义的理解和犯罪解决机制多元化等方面对我们有重要启示。改革我国刑事司法,应跨越单纯改革刑事诉讼程序的狭隘思路,对刑事司法机制进行重塑,逐步建立统一协调、良性互动、功能互补、程序衔接、彼此支持的双轨制,以更好地解决犯罪问题。  相似文献

Fifty years ago, the U.S. President's Commission on Law Enforcement and Administration of Justice under President Johnson did not frequently mention race and ethnicity in its discussion of and recommendations for the criminal justice system, but it did have a lot to say about race and crime. Through the use of arrest rates to measure racial differentials in criminal involvement, the Commission concluded that Blacks commit more crime as a consequence of Black people living in greater numbers in criminogenic “slum” conditions. To address racial differences, the Commission favored the Great Society programs of Johnson's War on Poverty. Contemporary criminologists continue to debate the racial distribution of crime, the causes of crimes, and the best policies to reduce crime and racial differentials. The Commission did not anticipate the current debate among scholars regarding how much racial disproportionality exists in the criminal justice system and its causes and consequences. The policies that led to mass incarceration have been significant drivers of continued criminal justice racial disparity. Those policies are inconsistent with the recommendation in The Challenge of Crime in a Free Society (1967), upending the pursuit of a more fair and just system.  相似文献

This article reviews the most current criminal justice education research. It examines the interrelationship between the work of the John Jay College of Criminal Justice, the Academy of Criminal Justice Sciences, the Joint Commission on Criminology and Criminal Justice Education and Standards, and the National Advisory Commission on Higher Education for Police, and describes and compares some of their more important findings. Discussed are types of criminal justice programs; characteristics of criminal justice faculty, particularly in terms of earned academic degrees; agency work experience; commitment to research and teaching; types of criminal justice curricula, as typified by certain educational philosophies; and criminal justice students. Although this article notes several areas with which future research might become fruitfully involved, the area in need of most immediate attention, and the area that current research has all but ignored, is the criminal justice student.  相似文献

This paper examines the coverage of American Indians and Alaskan Natives (AI/AN) in the most widely read introductory criminal justice and criminology books published between 2004 and 2010. The current research extends upon Young’s (J Crim Justice Educ 1:111–116, 1990) assessment of AI/ANs in criminal justice and criminology introductory textbooks, where he found no mention of AI/ANs. The replication of Young (J Crim Justice Educ 1:111–116, 1990) is especially important because AI/ANs continue to face a wide array of social issues (i.e. substance abuse and poverty), which leads to an overrepresentation of AI/ANs in the criminal justice system. To accomplish this, a content analysis was conducted on thirty-one introductory criminal justice and criminology textbooks to determine whether AI/ANs have received more academic coverage in current textbooks. The findings reveal that introductory criminal justice and criminology textbooks still under represent AI/ANs despite experiencing crime, victimization, and justice related problems.  相似文献

This article considers the claim in the government's White Paper, Justice for All , to put victims and witnesses at the heart of the criminal justice system and argues that there is an unresolved tension within the paper between instrumentalist crime control concerns and intrinsic concerns for the rights of victims and witnesses. It is argued that many of the proposals now contained in the latest Criminal Justice Bill are so preoccupied with rebalancing the system away from offenders that they risk doing injustice to defendants with little tangible benefit to victims and witnesses in terms of rights and remedies.  相似文献

In addition to the more conventional approaches of the criminal justice system, this article suggests that there is a need for restorative justice as another method of addressing sexual crime. In support of this view, the present article explores the possibility of a hybrid justice system based on a complementary relationship between restorative justice and the criminal justice system. An analysis of the limits of the criminal justice system and the need for restorative justice in the contentious area of sexual crime will be followed by a detailed examination of key justice considerations when trying to marry both criminal justice and restorative justice perspectives. Such considerations include: the meaning of justice; legislation; sentencing principles; due process; victims’ rights; and the location of restorative justice within/alongside/outside the criminal justice system. The aim of this article is to determine whether it is possible to reconcile two seemingly juxtaposed methods of justice delivery in the context of sexual crime in order to create a hybrid system of justice that best protects and responds to the rights and needs of victims and offenders.  相似文献

The Dayton/Montgomery County Criminal Justice Center is a first attempt at systematic personnel development for an entire criminal justice system on a regional level. Through its work in training and education, communications, career pathing and development, and system change, the Center has promoted the idea of an improved, symbiotic relatioship among the major branches of the criminal justice system, and has acted as a catalyst for needed systemic change.  相似文献

Restorative justice, rooted in the practices of indigenous people across the globe, has grown exponentially in both theory and practice since its beginnings in Canada in the 1970s. Restorative justice has influenced the interactions between offenders and victims, helped community members address crime and develop self-efficacy, and changed the way some countries rebuild after a history of oppression. Despite these restorative justice influenced changes, many criminology and criminal justice programs pay scant attention to restorative justice in curricula. This paper will examine ways to include restorative justice in criminal justice and criminology curriculum and the challenges involved in the process. The paper will then examine how the Law and Justice Department at Central Washington University has incrementally added restorative justice components to its curriculum, culminating most recently with the addition of a Community and Social Justice course. The paper will conclude with several examples of classroom activities and assignments that have helped connect students with the theory and practice of restorative justice.  相似文献

Despite decades of effort, the search for a universal definition of organized crime has eluded both academics, criminal justice agencies, as well as international bodies. More than two decades ago, a content analysis of such definitional efforts by this writer (Hagan, 1983) noted that, while many writers, including those of textbooks, failed to supply explicit definitions of organized crime, some consensus was apparent. These earlier findings are explored and compared with updated content analyses of American criminology and criminal justice textbooks and organized crime textbooks. Also discussed are definitions offered by criminal justice agencies and those by international organizations. A distinction is made between “Organized Crime” groups and “organized crime,” activities by groups that are organized. Increasing pressure to reduce operational cost and the simultaneously arising demand to make more and more information available to a wider audience are the main motivation for using Internet as basis for publishing material. The project described in this contribution is an ongoing co-operation between the United Nations Centre for International Crime Prevention and the University of Vienna which is aimed at providing an Internet platform for the distribution of United Nations information related to crime prevention and criminal justice. It is shown how the technology is applied by an international organisation as basis for disseminating information and how the available information can be used by researches for analysis. The implemented system, UNCJIN (United Nations Crime and Justice Information Network), today has been received very well in the community and serves as a valuable basis for research requiring international data, such as country reports and statistics.  相似文献

ABSTRACT

This article investigates the role of crime scene technicians in the Swedish criminal justice system, and particularly how Swedish crime scene technicians not only examine crime scenes but also facilitate the criminal justice system’s joint production of forensic evidence. It proposes thinking about the criminal justice system as a conglomeration of epistemic cultures, that is, of communities with different ways of producing and understanding forensic evidence. Such a perspective makes it possible to understand interprofessional frictions as epistemic frictions as well as to draw attention to the facilitations, mediations and translations that crime scene technicians perform. This perspective also makes it possible to illuminate how the crime scene technicians’ professionalization – a professionalization from the outside – affects both their future crime scene work and their facilitations.  相似文献

The formulation of crime policy is as complex as the phenomenon of crime itself. Numerous orientations to crime vie for consideration in the policy process, and the result is usually a confounding mixture of concepts and policies. It is the purpose of this study to analyze four prevalant orientations to crime and to assess the impact of a college education on student attitudes toward the different orientations. The findings suggest that criminal justice education and higher education, in general, have a significant impact on individuals' perceptions of the causes of crime and the functions of the criminal justice system. Given the increased emphasis on higher education within the justice system, the educational process is likely to play an important role in the evolution of criminal justice policies.  相似文献

Computers have been used in most parts of the Criminal Justice System for many years and for a wide range of applications. Despite this, it remains the case that whereas computerization has brought about some improvements in administrative or clerical efficiency, the overall impact on the Criminal Justice System has been small. This paper summarises the current extent of computerisation in criminal justice, outlines the direction in which current developments are moving, and tries to forecast how computers might be used to greater effect to improve the criminal justice process.The paper is based on experience gained both from research and development work by the author in this country, and from research carried out in the United States.  相似文献

The American criminal justice system fails to achieve justice, reduce crime, and provide equal protection to Americans regardless of their social class, race, and gender. But, criminal justice as an academic area of study has become a popular and fast growing liberal arts major in the United States, churning out tens of thousands to work in the criminal justice system. Given the demonstrable harms caused by criminal justice, which are suffered disproportionately by the least powerful people, academic criminologists and criminal justicians have the obligation to promote a reformed discipline. This article briefly summarizes the evidence of bias in the criminal justice system and then turns to how these biases relate to criminal justice as an academic discipline. Using the war on drugs as an example, I argue that the practice of criminal justice as an academic endeavor runs counter to the goal of promoting social justice in America. One of the ironic conclusions of this article is that criminal justice as an academic discipline must get smaller if we are to achieve larger goals of social justice outlined here. The Debbie Smith or "Justice for All" Act was passed on November 1, 2004. The act addresses the problem of collecting and analyzing DNA evidence from backlogged rape kits sitting in crime laboratories around the country. Presently, no empirical data exist by which to assess the soundness of the legislation. However, the act clearly affects discrete operations within the forensic and criminal justice systems. This article explores the relative merits of the Debbie Smith law, highlighting changes in Sexual Assault Nurse Examiner (SANE) programs, law enforcement, court administration, correctional treatment, and juvenile justice practices. Concerns linked to the likely impact of the "Justice for All" Act raise significant questions about its overall programmatic utility and treatment efficacy.  相似文献

This article builds on the work of Barlow and Barlow, who use models based on the long economic cycle as a theoretical and empirical means for reorientating examinations of criminal justice trends. Empirically, using factor-analytic and multivariate logistic and OLS procedures, we find some support for long-cycle-model interpretations of trends in federal criminal justice legislation. Equally important, we find no support for a connection between federal criminal justice legislative trends and levels of crime. Our analysis suggests that economic processes exist independent of economic long cycles and crime trends, and that these also should be considered in discussing trends in crime control. In conclusion, we argue that alternative economically situated, contextualized models which look beyond the crimejustice nexus are needed if criminal justice theory and research are to be revitalized.  相似文献

The history of the development of criminological statistics must examine the emergence of social statistics in general. The theoretical concerns and technical questions raised by early criminologists cannot be isolated from the wider concerns of sociologists and statisticians at work in other fields. This article traces the history and problems of crime and justice statistics through the distinct periods: a “preparatory” phase (1650–1800),and a “conceptualization” phase (1800–1914). In addition, while specifically noting a dependent relationship with the fields of demography and statistics, the separation of criminological statistics as an automous area is considered. The use of criminal justice statistics for comparative and other purposes has come under considerable review and criticism during recent years, and an examination of historical sources and problems serves to increase the understanding and usefulness of these statistics today.  相似文献
