Police notifications of incidents of domestic violence to child protection services constitute an acknowledgement of the harm that domestic violence inflicts on children. However, these notifications represent a substantial demand on child welfare services and the outcomes for children and victims of domestic violence have been questioned. This paper presents findings from the first UK study to examine these notifications in depth and examines the interface between the police and child protection services in responding to domestic violence incidents. The research reports on police interventions in 251 incidents of domestic violence involving children; the communication of information to child protection services and the subsequent filtering and service response. Social workers found that notifications conveyed little information on children's experiences of domestic violence. Forty per cent of families notified had had no previous contact with child protection services in that area, but those cases most likely to receive social work assessment or intervention were those where the case was already open. Notifications triggered a new social work intervention in only 5% of cases. The study also identified a range of innovative approaches for improving the co-ordination of police and child protective services in relation to children's exposure to domestic violence. Arrangements that maximized opportunities for police and social workers to share agency information appeared to offer the best option for achieving informed decisions about the appropriate level of service response to children and families experiencing domestic violence.  相似文献

A random sample of students at a large Midwestern University was selected in order to examine whether and how physical and sexual abuse were related to each other for men and women, whether abuse in one relationship was independent of abuse in other relationships, and how victims responded to abusive incidents. The results revealed several important patterns. When comparing the frequency of physical and sexual abuse for men and women, it was found that sexual abuse was more common than physical abuse, but only for women. Additionally, women experienced more sexual abuse than men. While men and women did not experience physical abuse in other relationships at more than chance levels, women who sustained sexual abuse in one relationship were more likely to sustain sexual abuse in other relationships. Furthermore, while sustaining physical and sexual abuse were not associated with one another for men, there was a weak association for women. Finally, victims of abuse were more likely to tell their friends they had been abused than report it to criminal justice authorities.Paper presented at the 1987 American Society of Criminology Meetings.  相似文献

The study’s aim was to determine the predictors of weapon use during domestic violence incidents that were reported to the police. Randomly selected cases (N = 369) from the San Diego County Sheriff’s department comprised the study sample. The predictor variables for weapon use included relationship type, relationship length, suspect drug or alcohol use, and restraining order status at the time of the attack. Suspect sex and race were included as control variables. A logistic regression demonstrated that victims who had restraining orders against the perpetrator were more likely to have a weapon used against them in a domestic violence incident. Suspect sex was significant in an unanticipated direction, with female perpetrators being more likely to use a weapon during a domestic violence incident.  相似文献

Assessing and responding to risk are key elements in how police respond to domestic violence. However, relatively little is known about the way police make judgments about the risks associated with domestic violence and how these judgments influence their actions. This study examines police decisions about risk in domestic violence incidents when using a risk assessment instrument. Based on a sample of 501 risk assessments completed by police in Australia, this study shows that a limited number of items on the risk assessment instrument are important in police officers' decisions about risk. Statistical analyses show that the victim's level of fear contributes to police officers' judgment on the level of risk and their decisions on which risk management strategy should be used. These findings suggest that research on police responses to domestic violence needs to pay greater attention to situational dynamics and the task requirements of risk-based decision making.  相似文献

There is extensive research that addresses the role of police in responding to domestic violence calls. However, there has been relatively little attention to the factors that impel women to call the police during an incident of abuse. This paper investigates the role of alcohol and drugs in influencing women's utilization of the police for misdemeanor-level incidents of abuse, and is based on interview data from 419 abused women. Results indicate that women are significantly more likely to call the police when male partners use both alcohol and drugs, and when they are frequently drunk. Offender drunkenness, rather than the quantity or frequency of alcohol consumption, has a significant escalation effect on police utilization by victims of abuse.  相似文献

Studies attempting to measure the effects of a mandatory arrest policy in domestic violence situations have yielded somewhat contradictory results. This study examines the effects of such a policy in one southeastern city. It utilizes police records from 1993–1997 to generate a proportionate stratified sample of 442 aggravated assaults cases committed by male partners on female victims. Logistic regression was used to model arrest determinants before and after the new policy was adopted. Results show that while there was an increase in the number of domestic violence reports after the proarrest policy went into effect, the total number of reports continued to decrease. A comparison of arrest determinants before and after the new guidelines became effective indicates this policy did not affect arrest decisions.  相似文献

This study investigated the social construction of domestic abuse by police officers, specifically in the context of arguments presented to the prosecutor for a decision on whether to proceed with or discontinue the case. Nineteen police files were examined with a particular focus on the MG3, the "Report to Crown Prosecutors for Charging Decision." Access to such sensitive material is usually denied to researchers; therefore, this study offers unusual insights into the treatment of victims and perpetrators of interpersonal violence by the police. Discourse analysis revealed three dominant speech genres: impartiality, credibility, and the "real" victim. These genres separately and in interaction served to construct domestic abuse cases in ways that did not support the victim's account. The "dialogic reverberations" of these findings are discussed and the implications of the work for research and practice are considered.  相似文献

Physical violence is but one of many tools that may be used to gain greater power within intimate relationships, yet the legal response has been critiqued for failing to recognise and respond to the full spectrum of abusive behaviours, such as coercive control. Using a sample of police officers from the United States (US) and the United Kingdom (UK), the current study utilises hypothetical vignettes to assess police officers’ perceptions of domestic abuse, including those incidents that are not necessarily physically violent, but involve stalking and other coercive, controlling behaviours that are harmful and require intervention. Within- and between-country similarities and differences were analysed. Findings revealed that the majority of officers in both countries possessed a good level of understanding of domestic abuse and how they should respond to it – amidst and beyond the physical violence. However, our analysis of both quantitative and qualitative data also showed that the use of physical violence is at the forefront of many officers’ expectations about domestic abuse, and that when physical violence is absent, the police response is less proactive. Our study finds some support for the idea that non-physical abuse does go “under the radar” to some extent for some officers, and that this is more the case for American officers than their British counterparts. Findings are discussed in terms of context of the research sites and implications for policy, practice and future research.  相似文献

The bulk of the research on predatory crime focuses on characteristics, profiles, and patterns of offenders. This information is important, but from the perspective of police agencies, information about the victims of predatory crimes, including victims of white-collar predatory crimes, and how they officially respond to victimization is also important. Using survey data from a random sample of 400 residents of Knox County, Tennessee, we investigated the characteristics of victims of thirteen different types of fraud. After dividing individuals into categories of non-victims, one-time victims, and repeat victims, we develop profiles of personal fraud victims by examining differences in key demographic and offense characteristics. Next, we investigate the official reporting behavior of victims. The results are instructive for police agencies as they highlight common characteristics of fraud victims and suggest methods for encouraging fraud victims to report their victimization to police.  相似文献

Research Summary The passage of new laws that criminalize the trafficking of persons for labor and sexual services has raised public awareness about the problem of human trafficking. In response, police must understand the problem, identify human trafficking victims, and make arrests. The numbers of victims identified to date, however, has paled in comparison with official estimates, which leads some to question the existence of a human trafficking problem. Missing from this debate is information about how frequently police encounter human trafficking and how well prepared officers are to handle these cases. Analyzing survey responses from a national sample of police agencies in the United States, we found that less than 10% of police agencies identified human trafficking cases from 2000 to 2006. Larger agencies were more likely to identify cases of human trafficking but the agency leader perception about the problem in their local communities as well as taking steps to prepare officers to identify and respond were the most important factors to increasing human trafficking identification by police. Policy Implications This study provides much needed information about why U.S. officials have identified so few human trafficking victims. By understanding how often and under what conditions police find, investigate, and prosecute cases of human trafficking we will be in a better position to identify and overcome barriers to police responses to trafficking and understand the limitations of official statistics about human trafficking. Data from a national survey also provide a baseline measure of police identification of human trafficking against which we can gauge the progress of future anti-trafficking efforts.  相似文献

This study evaluated the frequency of coarrest in female victims who utilized 911 for intimate partner violence (IPV) and any patterns or circumstances that increased the likelihood of coarrest. All cases of police-documented IPV where a female IPV victim was arrested in conjunction with the perpetrator were included. Each incident report was reviewed to determine demographic characteristics of the victim, weapon and substance involvement, presence of children, and violence severity. Of IPV victims, 9% (131 of 1,489) were arrested. Having a weapon, alcohol use, not being married, and older age were associated with increased likelihood of arrest (p < .001). The presence of a child decreased the likelihood of victim arrest (p < .001). Race, prior incidents of IPV, offender restraining order, and incident severity were not significantly associated with coarrest. Although coarrest occurred in a minority of cases, it may deter victims from contacting police for future incidents of police.  相似文献

One of the few legal tools for protecting victims of domestic violence is the civil Protection Order (PO). How effective they were in preventing re-abuse was analyzed by examining court and police records from 210 couples in which female victims (or applicants) filed POs against their violent partners. Police records for 2 years prior and two years following the issuance of a PO were reviewed. Results indicated a significant decline in the probability of abuse following a PO. Prior to filing a PO, 68% of the women reported physical violence. After filing, only 23% reported physical violence. Several risk factors were assessed and it was found that very low SES women were more likely to report re-abuse as were African-Americans.  相似文献

With domestic violence (DV) at an all-time high, police departments are drastically underutilizing technology to combat DV. Currently, New York police departments complete a “Domestic Incident Report” at the scene of domestic incidents but fail to adequately facilitate support services. New York State should mandate a services component into police DV protocols, specifically by commissioning: (1) an application linked to DV organizations presented at the scene of domestic incidents; and (2) a gateway application to refer victims to the correct services. Such tools would allow for the rendering of more efficient support to DV victims in times of immediate crisis.  相似文献

This study used a police sample to examine offense characteristics, recidivism rates, and other types of sexual offending among individuals suspected of exhibitionism. The sample consisted of 202 incidents of indecent exposure perpetrated by 106 identified individuals. Demographic information showed that one quarter of the sample had symptoms of a mental illness and one quarter had a history of substance abuse. More than 84% of the sample had other nonsexual criminal charges. Approximately 30% of the perpetrators were charged for more than one exposure incident. Masturbating during the offense, exposing to child victims, and speaking to the victim did not show any relationship to the occurrence of more sexually aggressive behaviors. However, individuals who had subsequent rape or molestation charges (16.9%) were more likely than those who did not to have had multiple exposure incidents and a history of physical assault charges.  相似文献

Therapeutic jurisprudence (TJ) proposes that the law is a social force that can heal or cause harm to parties in a legal action. Historically, women victims of intimate partner rape and domestic violence could not seek justice in the legal system because police, like other actors in the justice system, treated these offenses as private matters or fabrications. In domestic violence and intimate rape cases, TJ is concerned with the needs of the victims, and how the law and police play a role in increasing their well-being. In this article, we use a TJ approach to the study of police responsiveness to victims of these offenses by investigating arrests of the offenders pursuant to law reforms that encourage or mandate arrest. Given that in these offenses, victims have the lowest reporting rates of any violent crime, the victim decision to call the police represents an expectation that the mere physical presence of a police officer may redefine the nature of the violence from a private conflict to a societal wrong that will not be tolerated. Police partnership with and treatment of the victim with respect and dignity can change the dynamics of the violence, terminate the violence, and set the criminal justice process in motion by arresting the offender in most cases. Police arrest, and subsequent prosecution and conviction, sends a message to offenders that society does not tolerate their violence, and allows the victim to begin to heal. Yet, past research indicates that police are less likely to arrest intimates than acquaintances and strangers in misdemeanor and aggravated assault, rape, and sexual assault cases. Using the National Incidence Reporting System (NIBRS) for the year 2000, we examine police arrests of intimate partner rape and domestic violence in jurisdictions with mandatory and presumptive arrest policies compared to police arrests in full discretion jurisdictions. We also ascertain whether arrest rates are higher for strangers and acquaintances than for intimates in misdemeanor and aggravated assault, kidnapping, and rape and sexual assault. Third, we determine whether police arrests of intimate partner rape is more likely if there is evidence of violence, injury to the victim, and use of a weapon. Our multivariate findings suggest that both the rape and the domestic violence reform movements have reversed the tide of historical negative treatment of female victims of these offenses. Logistic regression analysis indicates that police agencies in mandatory and preferred arrest jurisdictions increase the odds of arrest for domestic violence incidents and violations of orders of protection, compared to police agencies in jurisdictions with permissive/discretionary arrest policies. In addition, intimate violence increases the odds of arrest by 98%; forcible rape accompanied by simple assault or kidnapping increases the odds of arrest by 467 and 222%, respectively whereas forcible fondling accompanied by simple assault increases the odds of arrest by 293%. This study examines the ways that females meet violent death and the role that illegal drug use plays in precipitating such deaths. The sex role hypothesis and the transactional risk thesis are explored to help account for homicide victimization of women. Data were drawn from the records of the Medical Examiner's Office in Philadelphia. Records of all illegal drug using homicide victims were compared with a random sample of non-drug-using victims. Data included interviews with relatives of the deceased, autopsy reports, police and other records. Both hypotheses received support. The importance of these findings can only be assessed, however, when more is known about how sex role constellations work in drug-using groups  相似文献

This paper examines limitations in how law enforcement and public health systems respond to domestic violence in Kyrgyzstan. Findings from interviews with domestic violence victims show that these women are subject to ineffectual practices and negative attitudes that tend to minimize domestic abuse and disempower victims. The findings reveal several problematic issues: inconsistencies in the implementation of the law, impunity for abusers because of both personal attitudes and social affinities between the police and abusers, ineffective enforcement of protective orders, and superficial processing of domestic violence cases by the legal system. Additional barriers to help-seeking include a lack of institutional support and guidelines for offering mental health services for victims as well as a scarcity of housing, childcare, and employment opportunities for women seeking to break the cycle of abuse. The findings underscore the need for society-wide changes in attitudes toward domestic violence, stricter mechanisms for enforcing the law, and mandatory training for service providers to facilitate the provision of more accessible and affirmative support to victims.  相似文献

The study focused on the treatment of victims in the criminal justice system in Barbados, a developing country in the English speaking Caribbean. Based on the administration of a pre-designed questionnaire to 458 respondents from a simple random sample of victims who made reports to the police in Barbados. It focused on victims' experiences with the police in the law enforcement process, their experiences in the courts in the adjudication process, and factors associated with these. The findings were mixed, but showed that the respondents' experiences in the law enforcement and the adjudication process were generally positive. Regression analysis showed that police seriousness about, and interest in the case were statistically significant predictors of victims' satisfaction with the police, and that these together with police politeness, and response time explained 67 percent of the variance in respondents satisfaction with the police.  相似文献
