Since the passage of the Equal Employment Opportunity Act of 1972, there has been a vast body of literature demonstrating women’s difficulties integrating into all levels of law enforcement. While scholarship continues to highlight women’s experiences in the workplace, very little research has incorporated male officers into the dialogue. Using survey data collected from 324 male and female federal law enforcement officers employed by a mid-sized federal law enforcement agency, this study examines gender differences on perceptions to women’s workplace occupational barriers. We find that there are gender differences between the experiences encountered by female officers and the perception of male officers to those experiences, most notably sexual discrimination and a perceived glass ceiling to promotions. The differing perceptions are shaped by gender stereotypes and mild remnants of a masculine culture that continue to exist throughout law enforcement.  相似文献

Recent scholarship has emphasized the influence of family-friendly policies on work attitudes such as turnover intentions. However, little research in public administration has explored the preferences of family-friendly policies or the discretionary implementation of these policies. This article provides an exploratory analysis of a U.S. federal workgroup that is less adaptive to family-care needs in response to mission requirements. Using survey data collected from 1,111 female officers employed by a large federal law enforcement agency, work-family conflict is reported as the main reason for turnover intentions and five family-friendly policies are identified for potentially reducing turnover intentions among women. In addition, comparisons are made between female officers with children and unmarried female officers with children.  相似文献

This article studies the institutional creation of Chinese stock exchanges and their regulations. It argues that institution creation was largely a function of market forces, local initiatives, path-dependence, and a learning curve. What characterized this institutional transformation was a process in which the central government was first led by various market forces fueled by local political and economic initiatives, then was forced to react by legislating various administrative ordinances to suppress the chaotic and lawless market, and finally resorted to creating a centralized regulatory institution to rein in the fledging stock market.  相似文献

Focusing on disarmament, demobilization, and reintegration programs, this article considers why some armed groups disarm and demobilize, while others refuse to do so. Previous research focused on intergroup rivalries and identified enforcement as a critical barrier. This study considers the effect of (1) war benefits and (2) intragroup dynamics and argues that distribution problems obstruct conflict resolution. Using a simple game-theoretic model, the article demonstrates that optimal programs (1) consider that combatants' cost of supporting peace varies and (2) require a mix of positive and negative incentives to motivate all ex-combatants to participate and comply with program requirements.  相似文献

Tax law enforcement in the UK has long been dominated by public bureaucracies of the 'classic' type. This article reviews some current problems of tax law enforcement in that style, and looks at some possible ways of mitigating those problems. These include a change in penalty schedules and some measure of 're-privatization' of tax law enforcement, harking back to pre-bureaucratic enforcement styles. Six problems likely to be associated with privatization of tax law enforcement are discussed. These are not trivial, but it is argued that they may be somewhat less severe in the case of tax law enforcement than in that of law enforcement in general.  相似文献

This article extends the study of regulatory enforcement on three levels. First, it separates enforcement style elements during inspections and sanction decision‐making work, creating a more realistic measurement. Second, it focuses on how these elements function in a context where it is hard in practice to achieve deterrence. Third, it assesses how agents view the effectiveness of combinations of style elements in such a context. To do so, it uses survey and interview data with street‐level environmental officials in Guangzhou, China. It finds that the agents studied practise enforcement that goes beyond deterrence and uses education and persuasion more effectively. It finds that the behavioural assumptions of these agents are to a large extent in line with the available regulatory literature, although agents are very unlikely to have consulted such studies. Therefore, the article concludes that law enforcement agents can develop nuanced and appropriate behavioural intuitions through their everyday work experiences.  相似文献

This article tries to understand the ongoing intellectual discourse on civil society and related concepts in political science, other social science disciplines as well as among policy-makers and practitioners. It suggests that there are four prominent philosophical lineages going back to the nineteenth century from which most of the contemporary debate draws its inspiration. Thus, there are at least four major schools or approaches to the study of civil society, social capital and development that compete for recognition. The article also draws attention to the need for analyzing these issues, not only at the national but also the associational and global levels. The interaction between these three levels has become increasingly important in the light of the globalization of many conservation and development issues. Finally, the author identifies the principal challenges facing students interested in doing research in this area, focusing, among other things, on the varying implications for civil society that different regime types have. Goran Hyden is professor of political science at the University of Florida. Quantitative analysis of competitive tendering and contracting typically focuses on their effect on the cost of providing public sector services. In this article we turn to the systematic factors that appear to influence the performance of cleaning contracts. This is defined as compliance with contract specification, public perception of service quality and other qualitative measures of service characteristics as observed by the contracting authority. Our analysis attempts to isolate particular features of contract design, monitoring and enforcement that influence performance positively or negatively. Econometric results based on a sample of public sector cleaning contracts suggest that contractor selection procedures and contract enforcement mechanisms have the greatest influence on performance.  相似文献

This article argues that while globalization theory is far from being past its most productive phase, as some of its critics claim, it does exhibit a number of shortcomings, particularly when it comes to identifying a clear point of reference for what is taken to be globalized and applying theoretical concepts developed in the analysis of national societies to a global level. This article argues that globalization theory stands on solid ground in that globalization theory has developed four strands of research, which are fairly well developed and which distinguish it as a separate field of inquiry, these four strands being the understanding of globalization as inherently varied globalization, global governance research, global history, and global/world society research. It argues that in order to redress some of the problems of globalization theory, it is necessary to build on these four strands and merge them with the traditional sociological concepts of functional differentiation and rationalization as well as with insights from complexity theories.  相似文献

Recent scholarship has called for additional research into the role of charismatic authority in terrorist groups and the process of radicalization. However, the sociological concepts of charisma and charismatic authority are being widely misused in terrorism studies. Current radicalization research often indirectly flirts with core concepts of charismatic authority, but fails to properly tap into its analytical utility. This article proposes to begin addressing this gap in knowledge in three ways, with: (1) a synthesis of social scientific research on charismatic authority, (2) a critical analysis of how charismatic authority is being misused and overlooked in the terrorist radicalization literature, and (3) an exploration of challenges and opportunities for future research concerning charismatic authority and terrorist radicalization.  相似文献

This study employed Stilger’s (1971) capture theory to investigate whether the Investment Dealers Association (IDA) of Canada experienced regulatory capture by weak enforcement. The study used data of the IDA’s enforcement practices to test the hypothesis that proportionately smaller fines are imposed for more serious offenders, ceteris paribus. Among the factors that influenced fines, one can find investigation costs and quasi-criminal offences as the main predictors making significant contributions. The result presented in the study can be use by legislators to further engage in dialogues on the importance of a federal securities regulatory agency in Canada.  相似文献

Two starkly contrasting strategies are discernible in the way local authorities currently approach and go about their regulatory and enforcement responsibilities. On the one hand, a “deterrence” strategy of “pursue and punish” is robustly pursued in many local areas in relation to individuals who infringe and contravene local regulations, notably in relation to “street scene” issues of littering, waste/recycling and materials sorting/separation, smoking in public places, parking, cycling on pavements, feeding pigeons, and so on, while, on the other, a much more positive “compliance” strategy of “counsel and conduce” is widely promoted and pursued in relation to the regulation of standards in local businesses, for example, in relation to public and environmental health/hygiene, health and safety in the workplace, animal welfare, and licensing of premises.

Why do local authorities operate with such apparent double standards? Why do comparatively minor infringements by local citizens so frequently result in the summary imposition of fixed penalties (which can be quite punitive for those on low incomes) while at the same time local businesses are mostly treated to a regulatory culture which is much more sympathetic and supportive in promoting compliance with the rules? This article draws on research conducted in different local regulatory settings which illustrates the two contrasting regimes in practice. It presents five propositions which help us to understand and explain the apparent double standards and it concludes by considering the steps that might be taken to ensure a more equitable and consistent local regulatory framework for the future.  相似文献

Abstract

This article seeks to analyse the informal borrowing sources of the poor as well as the purposes for borrowing. The obsession on characterising the poor as financially excluded fails to grasp their active financial lives. This article emphasises how relations of credit/debt are rooted in complex social and cultural forces. It is precisely because of the social embeddedness of credit that family finance, though interest-free, is not a first resort. Similarly, credit in kind from shopkeepers, though critical to consumption smoothing, is detested by some people. Also, it is argued that the involvement of the traditional leader in repayment enforcement in informal financial groups challenges the economistic narrative that attempts to separate credit from cultural norms.  相似文献

Firms across the globe are affected by red tape, but there is little academic research on how country‐level institutions shape red tape perceptions. Drawing on institutional theory, we argue that a variety of formal and informal country‐level institutions affect perceptions of red tape in the private sector. We test our hypotheses using six data sources, including the World Economic Forum and the World Bank. Our results indicate that red tape is weakly associated with a country's level of formalization and rule enforcement effectiveness and more prevalent in federal as opposed to unitary states. As for informal institutions, we find that red tape perceptions are more pronounced in countries with an increased conservative political ideology, higher levels of corruption, and cultures that emphasize individualism and uncertainty avoidance. We conclude with a discussion of the implications for theory and practice.  相似文献

This article explores the application of ideas about path dependence to the study of national political regime change. It first reviews the central components of pathdependent explanation, including the concepts of critical juncture and legacy. This mode of explanation is then employed in the analysis of diverging regime trajectories in Central America during the 19th and 20th centuries. The article argues that the 19th-century liberal reform period was a critical juncture that locked the Central American countries onto divergent paths of long-term development, culminanting in sharply contrasting regime outcomes. A final section puts the argument about Central America in a broader comparative perspective by considering other pathdependent explanations of regime change. Social Stability Risk Assessment (SSRA) sponsored by the local administration is perceived as a socially defined risk-coping initiative since it became mandatory in China. This article observes and unravels SSRA practices by selecting Xuzhou municipality as a sample case. Findings show that local SSRA is operated by the tridimensional mechanism and antecedents of its effectiveness in enforcement are linked with multiple elements of administrative supports. The findings contribute to a full understanding of SSRA in mainland China where there is no electoral democratic regime, and provide implications for developing countries alike. Some recommendations are proposed as a potential driver of these results.  相似文献

This article investigates how and to what extent member states comply with EU obligations in terms of process and outcome. The aim is to demonstrate how norm‐conform behaviour unfolds, or fails to unfold, in an interaction between a member state and the European Commission. The empirical focus is on recent rule of law crises in France, Hungary and Romania. The argument is that member states engage in symbolic and/or creative compliance, designed to create the appearance of norm‐conform behaviour without giving up their original objectives. The cases illustrate that creative and symbolic compliance strategies may be successfully employed by member states because they enable the Commission to disengage from conflicts it judges too costly and yet maintain its credibility, and are conditioned by the visibility of failure to change facts on the ground. The implication is that, at times, not only is compliance symbolic, but also to some extent is enforcement.  相似文献

Existing studies emphasise the important roles played by negative health lifestyle practices in the health situations of the countries constituting the former Soviet Union, and the role of smoking has attracted a considerable body of research. This article analyses female smoking behaviour in eight former Soviet states and seeks to more closely identify the roles of psychological distress and political ideology in relation to tobacco use in these countries. Results suggest that, in these populations, distress and ideology are associated with smoking practices in specific, observable, and sometimes unexpected ways. Findings are discussed within the context of changing gender constructions and dynamics following the post-communist transition.  相似文献

This article reports on a recent research project exploring academic perspectives on the threat posed by cyberterrorism. The project employed a survey method, which returned 118 responses from researchers working across 24 different countries. The article begins with a brief review of existing literature on this topic, distinguishing between those concerned by an imminent threat of cyberterrorism, and other, more skeptical, views. Following a discussion on method, the article's analysis section then details findings from three research questions: (1) Does cyberterrorism constitute a significant threat? If so, against whom or what?; (2) Has a cyberterrorism attack ever taken place?; and (3) What are the most effective countermeasures against cyberterrorism? Are there significant differences to more traditional forms of anti- or counterterrorism? The article concludes by reflecting on areas of continuity and discontinuity between academic debate on cyberterrorism and on terrorism more broadly.  相似文献

While much of the focus of terrorism research is on successful terrorist attacks, the most significant lessons for terrorism prevention may come from examination of terrorist plots and attacks that do not succeed. This article analyzes 176 terrorist plots against American targets that have been thwarted or otherwise failed during the past 25 years. It considers what kinds of intelligence and security measures are most useful in counterterrorism, and argues that the conventional wisdom about why intelligence fails—because analysts and agencies are unable to “connect the dots”—is wrong. Most plots, especially domestic terrorist plots, are not foiled through imaginative analysis, but through conventional law enforcement efforts and aggressive domestic intelligence collection that reveal to authorities just what the plotters are up to.  相似文献
