The case of Vo v. France represents the latest phase of the European Court of Human Rights’ thinking on the scope of Article 2 of the European Convention on Human Rights (the right to life) in relation to foetal life where a foetus had been lost owing to a medical accident. The Court by a majority decided that, “even assuming” Article 2 applied to the instant case (albeit to the life of the pregnant woman rather than that of the foetus), it had not been violated. While the facts in Vo were extreme and exceptional, the Court will shortly hear the case of D v. Ireland concerning access to abortion for foetal anomaly, an application made under Articles 3, 8, 10 and 14 of the European Convention. If the case of D were declared admissible, the Court would then have to consider whether a denial of access to abortion for foetal anomaly constitutes inhuman and degrading treatment contrary to Article 3, or an interference with a pregnant woman’s right to respect for private life under Article 8 (and if so, how the doctrine of the margin of appreciation applies). The Grand Chamber precedent of Vo displays ambivalence about whether Article 2 should apply to foetal life, and its resort to the “even assuming” formula spared Member States the difficulty of having to justify their various abortion regimes, by reference to this Article. It remains to be seen whether in a case like D that is directly concerned with abortion, the Court will take a more definite stance on the correct balance to be struck between the State’s interest in protecting foetal life and the Convention rights of pregnant women. Many studies have reported gaps between Latino and non-Latino adolescents in academic and political outcomes. The current study presents possible explanations for such gaps, both at the individual and school level. Hierarchical linear modeling is employed to examine data from 2,811 American ninth graders (approximately 14 years of age) who had participated in the IEA Civic Education study. Analyses of large data bases enable the consideration of individual characteristics and experiences, as well as the context of classrooms and schools. In comparison with non-Latino students, Latino adolescents report more positive attitudes toward immigrants’ rights but have lower civic knowledge and expected civic participation. These differences were apparent even when controlling for language, country of birth, and political discussions with parents. School characteristics that explain a portion of this gap include open classroom climate and time devoted to study of political topics and democratic ideals. Results are discussed within the framework of developmental assets and political socialization. Implications for educational policy and ways to use large data sets are also discussed.

Conclusion The dominant male discourse as expressed in the law of sexuality constructs the male subject. In each area — rape, incest and prostitution, it creates and extends the power which underpins the sexuality of the male subject to facilitate the non-consensual taking of women in rape and incest and the buying of them on the subject's own terms in prostitution.Further, the law constructs the female as Other not as freely consenting subject but as Other for the male subject in the space of unreason, for the logic of desire.In these constructions, lie the paradox of the law of sexuality. It exists purportedly to defend and protect the victims of rape, incest and prostitution but even in so far as it does so, it reasserts, through its constructions, the power of the speaking male subject through and the exclusion of the woman as Other from, the dominant male discourse as it is expressed in and enshrined by that law.The author is grateful for the comments of Glynis Cousin, Mike McConville, Brendan McSweeney and an anonymous referee on this work.  相似文献

This article examines developments in ‘Islamic feminism’, and offers a critique of feminist theories, which construct it as an authentic and indigenous emancipatory alternative to secular feminisms. Focusing on Iranian theocracy, I argue that the Islamization of gender relations has created an oppressive patriarchy that cannot be replaced through legal reforms. While many women in Iran resist this religious and patriarchal regime, and an increasing number of Iranian intellectuals and activists, including Islamists, call for the separation of state and religion, feminists of a cultural relativist and postmodernist persuasion do not acknowledge the failure of the Islamic project. I argue that western feminist theory, in spite of its advances, is in a state of crisis since (a) it is challenged by the continuation of patriarchal domination in the West in the wake of legal equality between genders, (b) suspicious of the universality of patriarchy, it overlooks oppressive gender relations in non-western societies and (c) rejecting Eurocentrism and racism, it endorses the fragmentation of women of the world into religious, national, ethnic, racial and cultural entities with particularist agendas.  相似文献

Not all the time … but mostly … is the outcome of collaboration across the genres of ethnographic research, and visual and performing arts. In exploring renewed methodologies for social research Maggie sought to develop a methodological model (ethno-mimesis) rooted in feminist thought and practice, that represented in visual artistic forms the multiple standpoints of women working in prostitution. Ethno-mimesis is a combination of ethnographic research and the representation of this work in visual/artistic form. Introduced by a mutual friend in 1997 our collaborative work began with Sara reading and interpreting the ethnographic work with a view to developing a performance text, as an exemplar of ethno-mimesis. In the collaborative work presented here the hybrid texts that emerge are an outcome of the inter-relationship between ethnographic research and the re-presentation of women's life stories through live art forms – video, and two movement based performances. Through this work we hope to reach a wider audience, beyond academic communities, facilitating understanding, interpretation and maybe even action/praxis in relation to prostitution as a social issue. In representing ethnographic data in artistic form it is hoped that we can access a richer understanding of the complexities of women's lived experiences that can throw light on broader social structures and processes. Such hybrid work may also help audiences to see that women working in prostitution are ordinary women; and that ‘prostitutes’ are indices for all women.  相似文献

The authors ground their reflections on gender and the complex realities of the second Palestinian intifada against Israeli occupation in the political processes unleashed by the signing of the Israeli–Palestinian rule, noting that the profound inequalities between Israel and Palestine during the interim period produced inequalities among Palestinians. The apartheid logic of the Oslo period – made explicit in Israel's policies of separation, seige and confinement of the Palestinian population during the intifada and before it – is shown to shape the forms, sites and levels of resistance which are highly restricted by gender and age. In addition, the authors argue that the Palestinian Authority and leadership have solved the contradictions and crisis of Palestinian nationalism in this period through a form of rule that the authors term ‘authoritarian populism’, that tends to disallow democractic politics and participation. The seeming absence of women and civil society from the highly unequal and violent confrontations is contrasted with the first Palestinian intifada (1987–91), that occurred in a context of more than a decade of democratic activism and the growth of mass-based organizations, including the Palestinian women's movement. The authors explore three linked crises in gender roles emerging from the conditions of the second intifada: a crisis in masculinity, a crisis in paternity and a crisis in maternity.  相似文献

The instability of colonial representational economies, identities and tropes is the subject of analysis in this paper. I take as my starting point the anxieties that were generated during the late 19th century in relation to what I nominate the fictitiousness of settler subjects in colonial Australia. In order to examine these historical concerns and their explicitly gendered representations, I consider in detail one text, Rosa Campbell Praed's Fugitive Anne: A Romance of the Unexplored Bush (1902). This text was published in 1902 and was one of a number of romance novels this author produced for readerships in both colonial Australia and England. This adventure romance features the trope of the Australian Girl and also engages in varying degrees with discourses of colonial ethnography that, to my knowledge, have not been examined in relation to the ideological production and effects of this figure.  相似文献

The extraction of a pecuniary penalty for the recusancy of married women was a heavily contested issue in the Parliament of Elizabeth. Under the rules of coverture, married women controlled no property. It was thus ineffective to fine them, for they were unable to pay the penalty. As a result, the government attempted to hold husbands responsible for the penalties of their wives through the use of recognizances under the auspices of the Commissions for Causes Ecclesiastical, a prerogative court. Research into the York Commission’s use of recognizances indicated that it had indeed been possible legitimately and legally to obtain a pecuniary penalty for the recusancy of a married woman by the 1570s. This was generally believed to have been legally impossible until they became obtainable by statute in 1593. Detailed examination of the records of the Commission indicates clearly that the depiction in the scholarly literature of the levying of these penalties as somehow improper or even illegal is erroneous. These forfeitures might have seemed irregular, but were indeed legitimate and obtained by proper and legal means in the context of contemporary standards of authority and control, both governmental and familial. This study demonstrates how respect for the standards of coverture, patriarchy, and marital obligations incorporated in the use of the recognizance provided a highly effective and legal means to penalise and correct both recusant wives and their husbands.

Although the acculturation gap generally has been associated with poor mental health outcomes among Asian American children, some studies have failed to find a significant relationship between the gap and distress. Using two different methods of operationalizing the gap between mothers and their children, the current study addressed this tension in the literature by testing the following hypotheses in a sample of Korean American families. It was hypothesized that mother–adolescent discrepancies in acculturation and enculturation levels would be associated with youth internalizing and externalizing symptoms and that parent–adolescent communication would moderate the gap–distress relationship. Multi-informant questionnaires were administered to 77 Korean American mother–adolescent dyads from the Midwest. Surprisingly, results indicated that consonance in low levels of mother–adolescent enculturation was associated with the highest levels of externalizing symptoms (interaction term method). Adolescents’ perception of communication with their fathers significantly moderated the relationship between the enculturation gap and internalizing symptoms, such that in dyads with a greater enculturation gap, less perceived open communication with fathers was associated with more internalizing symptoms (difference score method). Clinically, the findings indicate a potential target (i.e., parent–adolescent communication) for treatment programs that aim to improve family relations and youth adjustment in immigrant families.  相似文献

Frequently eighteenth-century service is described as a life-cycle stage used to build up the financial wherewithal to set up house. As such it was central to the way youth or girlhood was traversed, and studies of adolescent years rightly emphasise the importance of service. However, this narrative, while largely accurate, is also problematic. What happened when service did not end with marriage, or when a woman remained single well into adulthood? In practice, servants were found among both the married and single, and among the young and the old. Concentrating on the eighteenth century, and incorporating material from Nordic Europe, this article teases out some of the nuances in the context and experience of service that partially disrupt the established narrative.  相似文献

During the process of in vitro fertilization (IVF), hormonal drugs are used to stimulate the woman's ovaries to produce multiple eggs. The injecting of the drugs is often performed by the women themselves outside of the clinical context, constituting a gendered burden of work that is rendered invisible by the dominant representations of treatment as undergone by couples and performed by doctors. Based on a series of interviews with women and couples who have undergone IVF unsuccessfully and who have ended treatment at least two years previously, this paper focuses on two aspects of the self-injection of hormonal drugs that emerged from the participants accounts: firstly, the gendered ways in which the drug regimen was experienced as compromising privacy and secondly, the strategic use of images of both illicit and medical drug use in the accounts. The paper argues that in spite of the dominant representation of IVF as a couples' technology, the IVF process is profoundly gendered, both in terms of bodily intervention and in the distribution of labour in the implementation of treatment; that the invisibility of the drug regimens from dominant representations of IVF can leave those undergoing treatment unprepared for some of the problems that the self-administration of the drugs can raise, particularly in terms of maintaining privacy; and finally, that images of the drug injection are mobilized strategically in the accounts to locate themselves within normative social reproductive standards. This highlights the extent to which the enduring ideological construction of proper womanhood as defined by motherhood continues to pose a dilemma for those who are involuntarily childless.  相似文献

This article draws on extensive archival and oral sources from Britanny, Toulouse, and Paris. It will discuss a number of aspects of the Occupation and Liberation experience for French women. It will first explore the importance attributed to the fact that women eventually gained their political rights in 1944, a measure that also saw an end to the “first wave” feminist movement that had believed that suffrage would resolve the “women's condition” and herald the start of a new era for women. This article will then move into an analysis of women and Collaboration during the Occupation offering a new approach to women's political involvement during the war. It finishes by presenting an overview of women's relationship to paid employment, the area where there was perhaps the greatest unfulfilled potential for women to experience a new beginning in the post-war period.  相似文献

While social geographers have convincingly made the case that space is not an external constant, but rather is produced through inter-relations, anthropologists and sociologists have done much to further an understanding of time, as itself constituted through social interaction and inter-relation. Their work suggests that time is not an apolitical background to social life, but shapes how we perceive and relate to others. For those interested in exploring issues such as identity, community and difference, this suggests that attending to how temporal discourses are utilised in relation to these issues is a key task. This article seeks to contribute to an expansion of the debate about time and sociality by contributing an analysis of a variety of ways in which Gloria Anzaldúa utilises temporal concepts as part of her work of rethinking social identity and community. In particular, I suggest that in contesting homogeneous identity, Anzaldúa also implicitly contests linear temporal frameworks. Further, in creating new frameworks for identity, I suggest the possibility of discerning an alternative approach to time in her work that places difference at the heart of simultaneity. I suggest that the interconnection between concepts of time and community within Anzaldúa’s work indicates, more broadly, that attempts to rework understandings of relationality must be accompanied by reworked accounts of temporality.  相似文献

Coping research has neglected the study of the reciprocal links between parents’ and adolescents’ coping behaviors and the potential influence of parental support for the development of adolescent autonomy. This study, therefore, analyzed the coping behaviors of fathers, mothers, and children (53% females) in 196 families who participated in a four-year longitudinal study that started when the child was an early adolescent. The results of cross-lagged panel design models examining direct links between parents’ and their children’s coping styles suggested that parents and children do not affect each others’ abilities to cope with family stress over time. However, indirect relationships between parents’ and children’s coping styles via autonomy support in the family were found. Both the parents’ and adolescents’ perceptions of autonomy support in the family were important in shaping their respective coping styles. The child’s individual characteristics (e.g., gender and physical maturity) had a greater influence on the fine-tuning of mothers’ coping behaviors than on the fathers’. The findings underscore the significance of autonomy-enhancing parent–child interactions for the development of adolescent coping.  相似文献

One of the most common threads in the Caribbean tapestry races which have populated the region over the last five centuries largely through forced or voluntary migration, is that there have emerged mixtures of the different racial groups. A large proportion of Caribbean women and men are referred to euphemistically as ‘mixed race’. The terms used to describe people of mixed race vary by territory and have been incrementally added to or changed over time. The original nomenclatures such as sambo, musteephino, mulatto, creole, etc. have been replaced at present to include terms like brown skin, mulatto, clear skin, light skin, red-nigger, dougla and browning. The title of the article comes from a contemporary dancehall song in Jamaica in which the black singer, Buju Banton, unwittingly echoes an unspoken yet shared notion of female desirability in the Caribbean: a preference for ‘brown’ as opposed to black women or unmixed women. In the ongoing constructions of femininity in the region, class and skin colour have intersected with race to produce hierarchies and stereotypes of femininity based on racial mixing. Drawing on some of the historical data available, particularly that of the pioneering research in this area produced by Lucille Mathurin in 1974, this article interrogates some aspects of miscegenation in the Jamaican past, to configure these with gender, race and class relations in the present. The article does not attempt to arrive at conclusive findings but to contribute to the ongoing process in the region, and elsewhere, of differentiating the category ‘woman’ in historiography and sociology.  相似文献
