劳动教养制度存废之争及评析

劳动教养制度是一项具有中国特色的法律制度,它既是我国法学理论界争论的焦点,也是西方社会攻击我国人权状况的主要层面.本文对劳动教养制度存废争论的主要观点进行梳理,并结合法学理论对之进行评析,认为劳动教养制度不能废除,应该完善.     

法学教育与司法考试是互动还是冲突

我国法学教育对司法考试的互动与冲突表现在:一方面司法考试给法学教育带来积极影响;另一方面,司法考试可能给法学教育带来一些消极影响。而要正确处理法学教育与司法考试之间的关系,必须注意两点:一是不能将司法考试作为法学教育的指挥棒;二是我国亟待完善司法考试制度和法学教育制度,以便实现司法考试与法学教育之间的优势互补,促进二者之间形成良性的互动关系。

在法律职业化浪潮席卷全球之际,我国法制建设亦稳步推进,法学教育蓬勃发展,司法改革渐入佳境,统一司法考试制度正是在这一时代背景下浮出水面.本文分析了统一司法考试制度产生的深层原因,论述了实行统一司法考试制度的现实意义,探讨了统一司法考试与法学教育的互动关系,同时指出统一司法考试不应成为律考的翻版,并就司法考试制度的完善进行了积极的探索.     

法律职业与法学教育改革--以司法考试为视角

我国的法学教育与法律职业制度的脱节，一直是备受诟病的问题。2002年开始，国家开始实施统一司法考试，将律师、法官、检察官的职业准入资格合为一体，这是我国法律职业化进程中的一个重要里程碑。从积极的方面来看，司法考试确实对法学教育产生了积极的推动作用，表现在各大法学院对于课程设置、授课方式等，在面向实践性、操作性方面不断进行改革，一定程度上弥合了法律职业与法学教育的脱节问题；另一方面，各种以“通过考试”为宗旨，传授司法考试技巧的培训班不断涌现，出现了专营此事的司法考试学校，考生们趋之若骛，而相对地轻视法学院的理论教授，对法学教育形成了较大的负面影响。[1]在此背景下，作为准入前提的司法考试制度与法学教育，特别是法学本科教育是什么关系，法学本科教育是否应该围绕着司法考试展开，过于功利化地追求司法考试的通过率，是否会让法学本科教育沦为应试教育，冲淡法学本科教育的目标等问题，成为了争论的焦点问题。本文试图从法学本科教育和司法考试的关系着手，分析法学本科教育应当如何应对司法考试对自身产生的冲击问题，或者说，法学本科教育应当如何以一种适当的姿态接纳司法考试。     

孙晓楼的法律人才观及其现实意义

孙晓楼的《法律教育》一书,是我国第一本法学教育专著。他以社会法学为理论基础,学以致用为指向,认为法律人才是具备法律学问、社会常识和法律道德,具有全方位工作能力的法律工作者。法律人才的培养离不开学识渊博、道德高尚的教授,爱惜教授也就是爱惜学生。以他的法律人才观反思我国法学教育的现状,仍具有鲜明的时代意义。

国家安全法学在公安高等教育中的缺位问题

国家安全法学的研究对象和理论体系并非局限于狭义的国家安全概念,应当随着国家安全理论的突破而突破.广义的国家安全法学属于公安高等教育中的重要内容,但我国公安院校的国家安全法学教育总体非常薄弱,与公安部门维护国家安全的重要职能的要求严重不相适应.在公安高等院校法律教育中,系统地进行国家安全法学教育具有重要意义.     

我国古代民事诉讼之当代价值

当前的法学研究中的一大弊病是将现代法学完全等同于西方法学,忽视对本国制度史的研究;在具体的制度构建上,对西方法律制度不加分析地引进,不顾本国的历史与传统,也不考虑该制度是否符合我国国情。我国民事诉讼制度领域,现今实践中的诸多问题除了从制度本身进行思考以外,还需从我国古代的民事诉讼传统进行分析,这样才能为我国民事诉讼的修改与完善指明一条正确的道路。
