Recent years have seen the advent of two feminist judgment-writing projects, the Women??s Court of Canada, and the Feminist Judgments Project in England. This article analyses these projects in light of Carol Smart??s feminist critique of law and legal reform and her proposed feminist strategies in Feminism and the Power of Law (1989). At the same time, it reflects on Smart??s arguments 20?years after their first publication and considers the extent to which feminist judgment-writing projects may reinforce or trouble her conclusions. It argues that both of these results are discernible??that while some of Smart??s contentions have proved to be unsustainable, others remain salient and have both inspired and hold important cautions for feminist judgment-writing projects.  相似文献

Taken together, evolutionary psychology and neuroscience combine to provide a compelling heuristic account of sex/gender differences. In this article, I explore how the meta-theoretical framework provided by evolutionary psychology provides support for a reading of sex/gender effects in neuropsychological research that sees these as evidence of a ‘hardwired’ neurobiological basis for sex/gender. I discuss the resistance of these ‘hardwired’ accounts to arguments that—like other neuropsychological phenomena—sex/gender could be theorised in terms of experience-dependent neuroplasticity. I conclude that the evolutionary-neuropsychology heuristic obtains much of its appeal from the apparently ‘scientific’ evidence it provides for understanding sex/gender as a ‘natural’ rather than ‘sociocultural’ phenomenon—a view which is aligned with postfeminist ideologies of sex/gender in the contemporary west.  相似文献

Experience with and management of stress has implications for adolescents' behavioral and socioemotional development. This study examined the relationship between adolescents' physiological response to an acute laboratory stressor (i.e., Trier Social Stress Test; TSST) and anger regulation and interpersonal competence in a sample of 175 low-income urban adolescents (51.8% girls). Findings suggested that heightened reactivity as indicated by cortisol, heart rate, and blood pressure was associated with increased interpersonal competence and anger regulation. However, these findings were context dependent such that, for youth high in self-reported child maltreatment, heightened reactivity was associated with decreased interpersonal competence and anger regulation. Results highlight the importance of considering how context may condition the effect of stress reactivity on functioning during adolescence.  相似文献

Abstract

The focus of this paper is Selma Lagerlöf’s literary presence in Soviet Russia. Despite being one of the most translated and published foreign authors in pre-revolutionary times, Lagerlöf made very infrequent appearances on the Soviet literary scene for 40-odd years between 1917 and the end of the 1950s. The process of literary production is examined in this paper in search of an explanation for the changing pattern in the publication of Lagerlöf’s texts. To problematize the process of literary production in the newly established Soviet state, Foucault’s conceptualization of the process of knowledge construction is utilized to describe, understand, and explain the interplay between critical resources, such as linguistic and literary expertise, individual initiative, and the government-controlled publishing enterprise in the Soviet state. I argue that the agency of literary workers remained relevant to the literary process, despite increasing ideological pressure on literary production, and that they paved the way towards the official reintroduction of Lagerlöf to the Russian Soviet readership during the 1950s.  相似文献

When reading and interpreting private letters the historian needs constantly to be aware of the personal nature of her sources, asking herself to what extent she can use the information revealed in these letters and how far she can go in interpreting another persons' words and deeds—a life. The author argues that the small size of Icelandic society makes this especially important, because descendants or relatives of the people who are being explored and represented in the historian's work are often very sensitive to biographical work of this nature. Furthermore, the historian has to be aware of the ambiguous nature of private letters, as they are not necessarily a “true” narrative of what happened, and the meaning of the sentiments expressed can be unclear to the modern reader. Moreover, what is written in private letters can easily affect the historian emotionally. The author argues that historians must treat private letters with care and do justice to the people that once were alive and left these personal sources for posterity. However, historians must not hesitate to ask new and challenging questions—to reach as far as possible when interpreting a life. This leads the author to reflect on her own disposition in her research, to acknowledge that the boundaries between herself and her subject could become blurred. She does not, however, consider this to be a hindrance for her research but rather sees it as an opportunity to explore and discuss the nature of her sources and to reflect on how knowledge is being produced.  相似文献

The control of women's public form of mourning in India was undertaken in the colonial era by male social reformers. The article argues that this was both a part of the process which enabled the consolidation of colonial rule – since laments were repositories for the social memory of the dead which could lead to vendettas – and that this fed into the construction of a specific domestic ideology. The latter was predicated on the privatization and interiorization of grief, whereby women were enjoined to bear themselves with rectitude. The taming of the transgressive form of mourning, whereby women who had earlier exhibited their grievances in a spectacular form through lament, took to more quietist (devotional) forms, has reconfigured the relationship to death and mourning. However, this has been a partial phenomenon, limited to the upper-caste, middle-class milieu. Where women continue to hold a dependent position within community, nation-state and international economy, the article suggests that, in contexts of modern conflicts and warfare, where death runs ‘wild’, the exhibitionist and ‘wild’ forms of showing grief and anger continue to be demonstrated by women as an appropriate public response.  相似文献

My aim in this essay is to explore the politics of one of the seemingly least political forms of literature, the woman's magazine. Specifically, I will analyze the ideological content of the Lady's Magazine, one of the most popular and profitable of British monthly miscellanies in the late eighteenth and early nineteenth‐centuries.1 In this essay I will explore the role the Lady's Magazine played in the development of the idea of the “tender mother,” a concept which was key in the formation of the cult of domesticity and in the development of the ideology of “woman's sphere” as a realm distinct and separate from the man's world of work.2An underlying assumption informing this essay is that the concept of motherhood was (and still is) culturally constituted,3 and that literature, including popular literature found in magazines, has played an important role in this process.4 In the Lady's Magazine's portrayal of motherhood we can see one of the means by which the ideology of motherhood, in particular, the concept of the tender mother, was created, legitimated, and perpetuated.5  相似文献

This article argues that women’s human rights were and are being violated in Afghanistan regardless of who governs the country: Kings, secular rulers, Mujahideen or Taliban, or the incumbent internationally backed government of Karzai. The provisions of the new constitution regarding women’s rights are analysed under three categories: neutral, protective and discriminatory. It is argued that the current constitution is a step in the right direction but, far from protecting women’s rights effectively, it requires substantial revamping. The constitutional commitment to international human rights standards seems to be a hallow slogan as the constitution declares Islam as a state religion which clearly conflicts with women’s human rights standards in certain areas. The Constitution has empowered the Supreme Court to review whether human rights instruments are compatible with Islamic legal norms and, in case of conflict, precedence will be given to Islamic law. Keeping this in view, it is argued that Afghanistan’s ratification of the Women’s Convention without reservations has no real significance unless Islamic law dealing with women’s rights is reformed and reconciled with international women’s rights standards.  相似文献

In the 1880s, a struggle between a teenage girl and her father attracted public attention. Maud Charlesworth, a daughter of an Anglican clergyman, became involved in the Salvation Army against her father’s wish, and eventually married a son of ‘General’ William Booth. It was one of those subtle, day‐to‐day resistances which occur within a family, at the same time being a battle between the two ‘religious family enterprises’. The contest was over ideas on gender, class, age, and the way to salvation, all of which the Rev. Charlesworth, as a clergyman as well as a father, had imparted to Maud. In this sense, a Victorian parsonage might be considered an excellent example of the gender/power structures that shaped middle‐class relationships. This article analyses the various discourses that Maud, her father, her mother, her sisters, the Salvation Army, and the Church of England utilised, in order to explore the complexity of family dynamics and the interface between gender, class and religion in the negotiation of family roles and identities. From the forms of rhetoric that she used, it will also reconsider the issue of ‘separate spheres’.  相似文献

This article examines how tensions between feminism and multiculturalism conflate in a media debate on female genital cutting. The following questions are addressed: how is gender equality problematized, in what ways is the gender equality approach challenged, and what are the main solutions to prevent female genital cutting. The empirical analysis is based on the newspaper debate that followed the Norwegian Broadcasting Company's (NRK) documentary on female genital cutting in June 2007. The findings of our study do not support a claim that gender equality would be challenged by accommodations to multiculturalism. Our conclusion is that it is difficult to disconnect policy-making aimed at combating female genital cutting from the processes of stigmatization. Rather, by advocating the type of measure that is the most contested by the actors of ethnic minority organizations, the proponents for adopting routines of genital examination ultimately contribute to a problematic pattern, where the political debate about the situation within ethnic minority groups is run and dominated by the majority.  相似文献

Given prevalence rates and negative consequences that adolescents’ perpetration of dating violence may have on an individual’s well-being and future relationships, it is imperative to explore factors that may increase or reduce its occurrence. Thus, we aimed to identify how multiple contextual risk factors (individual, family, schools, and neighborhoods) were related to adolescents’ perpetration of dating violence over a 6 year period. Then, we assessed how neighborhood collective efficacy, an important predictor of urban youths’ well-being, buffered the relationship between each of the risk factors and adolescents’ perpetration of dating violence. Three waves of data from the Welfare, Children, and Families: A Three-City Study were used (N = 765; Ages 16–20 at Wave 3). The sample is 53 % female, 42 % African-American, and 53 % Hispanic. For the total sample, drug and alcohol use, low parental monitoring, academic difficulties, and involvement with antisocial peers were significant early risk factors for perpetration of dating violence in late adolescence. Risk factors also varied by adolescents’ race and sex. Finally, perceived neighborhood collective efficacy buffered the relationship between early academic difficulties and later perpetration of dating violence for Hispanic males. These results imply that multiple systems should be addressed in dating violence prevention programs.  相似文献

This article discusses gender equality and how and why a gender mainstreaming strategy avoids the question of gender conflict. The making of gender-equality work is studied by investigating how feminism is talked about and rejected in a specific gender mainstreaming project in the municipality of Örebro, Sweden. Drawing upon the theoretical concepts of hegemony and discourse, the focus is on the silences—the unspoken questions and problems—surrounding the project. I examine how the exclusion of feminism and conflict is articulated when gender mainstreaming is introduced as a new way of doing gender-equality work in the municipality. The struggles identified show that feminism is rejected because it is seen as being in opposition to (1) professionalism and (2) legitimate political issues. I conclude that within the local discourse of gender mainstreaming there is a notion that this form of gender-equality work ought to be performed without harmful or threatening gender conflicts. This means that the strategy of gender mainstreaming constitutes a short-cut to bypass controversial problems like equal treatment, special efforts for women, and men's privileges in gender-equality work.  相似文献

Popular therapeutic culture—such as self-help books, TV programmes, and Internet resources—is growing rapidly and posing important questions for feminist research and politics. On the one hand, it can be seen as a challenge to the public sphere in terms of what can be shown and said and by whom, with the emancipatory potential of giving political credentials to the personal. On the other, it can be seen as exploiting, and thereby reproducing, stereotypes and inequalities, such as those related to gender. In this article, the discussion is advanced by the use of Swedish popular therapy for couples as a point of departure. It is argued that a cultural narrative of the “good couple” is constructed in self-help books and TV programmes on relationship issues, a narrative that seems to keep the unequal nature of this heterosexual institution from being challenged. However, in the individual narratives of consumers of this culture, apparent on web discussion boards, the cultural narrative of the “good couple” is being challenged, not least with reference to gender and gender inequality.  相似文献
