This article concerns European cigarette smuggling over the past decade and examines the actors, structures and relationships which facilitated the illicit trade. It discusses the central role played by actors not traditionally associated with organised crime, such as multi-national tobacco companies, Swiss banks and the state security agencies of various Balkan states. It demonstrates how domestic legislation in Switzerland and instability in the Balkans prevented national law enforcement agencies from effectively dealing with this international network at an earlier stage. The article also focuses on the history of local and national law enforcement investigations as well as the integrated multi-national investigation project later initiated by the EU and member states. The article's conclusions suggest that while smuggling actors have successfully adapted to the process of globalisation – financial and state deregulation – law enforcement agencies remain at a disadvantage as they are hampered by the domestic legislation in nation states such as Switzerland and the United States. While cigarette smuggling was and is a major illicit industry, it has not been the subject of much academic scrutiny. This article, based on field research in the Balkans and EU member states aims to contribute to a broader understanding of a problem involving a multiplicity of criminal actors, states and law enforcement agencies.  相似文献

While most group offending is not well organized, it is generally assumed that high levels of organization can be found in group offending that generates revenue, such as white-collar crime, drug sales, and smuggling drugs or humans. The organizational structure of international drug smuggling has typically been viewed as highly rational and formally structured. Employing interviews with thirty-four federal prisoners convicted of smuggling large volumes of cocaine into the United States, this study explored the organizational structure of high level international drug smuggling. The subjects described a general lack of formal structure and depicted the drug smuggling operations as composed of isolated work groups without formal connections among each other. These findings bring into question the idea that these groups are rationally organized around pursuing efficiency and support recent research that suggests network security or minimizing risk are key organizing principles of drug trading organizations.  相似文献

This article explores the possibility of measuring the impact of law enforcement on organized crime in a reliable and accountable manner, both in general terms and with a practical focus on the Canadian context. In considering measures to combat organized crime, a focus on process measurement has obscured the more substantial question of progress as regards the dependent variable itself: the bottom line of reducing the impact of organized criminal behaviour. While outcome measures are more challenging to identify than process measures, this fact alone does not minimize the need to demonstrate the connection between organized crime enforcement and its presumed outcomes to a greater degree of certainty. To date, this has not been realized to any significant degree, as revealed by a review of existing international approaches to measuring the impact of enforcement activity. The article argues that a multidisciplinary focus on community level indicators of crime, if initially less accessible than process measures of impact on organized crime groups, offers promise as a measurement of absolute and relative impact of state investment in enforcement.

The smuggling of taxed goods, like tobacco or alcohol, has always been a lucrative cross-border crime business. The very high excises for tobacco in the United Kingdom since the 1990's has stimulated the already existing cigarette smuggling from the continent, particularly from Eastern Europe. The analysis of the investigations carried out by the Dutch customs showed that the Netherlands function as a gateway from the continent to the United Kingdom. However, part of the contraband remains in the Netherlands and is sold on the black market. The crime-entrepreneurs operating on this market rarely have a criminal background or connections with other contraband markets like drugs. Despite that while trading they developed crime-organisations, which again underlines the dynamic dimension of ``organising crime.' Some international wholesalers developed extensive organised crime-networks. Two criminal trading patterns could be discerned: a Northern European ``trade belt,' stretching from the Baltic to the British isles and a Southern one, in which the Iberian peninsula and Italy are more prominent. This indicates that this form of crosse-border crime should be addressed from the perspective of economic ``crime-regions.'  相似文献

This paper analyses post-war (1945–1986) anti-combines enforcement in Canada in the light of major competing theoretical models of the state in capitalist economies. Such an analysis serves as a framework for the clarification of issues pertaining to the debate on the state in advanced capitalism, the outcome of which may permit certain postulates concerning state-corporate relations in Canada. A narrative history of the nature and development of the Canadian economy informed by Canadian political economists will be presented, followed by a brief review of the history of anti-combines legislation and its enforcement up to 1945. Data will then be introduced enabling analysis in greater detail of post-war enforcement.  相似文献

Undertaken on behalf of the National Institute of Justice between July 2003 and August 2004, the research goals of this study were to (a) determine high priority areas for research on Asian transnational organized crime (TOC); (b) assess the impact of Asian TOC on the United States; (3) identify relevant data and information sources in Asia; and (4) identify potential collaborative research partners and institutions in Asia. The aim was thus not to examine in detail the organized crime situation in this region, but rather to lay the foundation for a research agenda and strategy that would accomplish that purpose. In seeking to achieve this aim, the researchers used a variety of techniques as part of an overall exploratory methodology. They included four months of interviews (andfield observations) with experts in eight Asian sites, including law enforcement officials, policymakers, and scholars, as well as American officials in each site. Meetings were also held with Asian crime experts in the United States. Interviews and site visits were supplemented with surveys and analyses done by local Asian researchers, an analysis of U.S. indictments, and the review of a large volume of literature. The sites covered by this research are China, Hong Kong, Macau, Taiwan, Japan, Philippines, Thailand, and Cambodia. The major findings are first, that there is little consensus among the Asian authorities on just wliat their main organized crime problems are. Whereas the Asian authorities give higher priority to traditional organized crimes, e.g., gambling, extortion, prostitution, etc., the American authorities focus more on transnational crimes. Consistent with this view, Asian authorities do not see much linkage between the local or regional crime groups about which they are most concerned, and transnational organized crime. Next, contrary to the views and expectations of some American authorities, the commonly expressed view among the respondents in this study is that there is no collaboration or linkage between transnational organized crime groups and terrorists. Finally, the transnational organized crime networks operating in the region are said to be highly specialized, with any overlapping of criminal activities occurring mostly at the level of transportation of goods or people. It is recommended that future collaborative research efforts focus on trafficking in women and children, human smuggling, and drug production and trafficking. These are likely to continue to have the most impact upon the United States and upon U.S. interests in the region. It is further recommended that these research efforts be both bi-lateral (principally with China) and multi-lateral in nature. A wide variety of potentially willing research partners are identified and their strengths and weaknesses are assessed. Finally, a specific strategy for accomplishing the research agenda is proposed. The essay examines the networks that facilitate the transport of nuclear materials from the source to their possible purchasers. Analyzing the role of prisons in criminal operations, the interaction of criminals and terrorists, and the character of new organized crime groups, the author concludes that some of the most serious nuclear smuggling is not random or opportunistic. Rather, the most serious trafficking is rarely detected because it is run by professionals whose well established smuggling networks, facilitated by corruption, have the capacity to move significant quantities of diverse contraband without apprehension. Technical solutions to address this problem are not sufficient because detectors cannot identify well guarded HEU. Rather, much more attention needs to be paid to the crime and terror networks that can facilitate this trade.  相似文献

The paper analyses the social organization of two drug trafficking mafia groups. The groups belonged to the 'Ndrangheta, a mafia from Calabria, a Southern Italian region. Based on judicial sources, multiple linked analyses examine the tasks, statuses and social network structures of the two groups. The analyses showed that the formal hierarchy of the mafias does not play a relevant role in the organization of drug trafficking. At the same time, the two groups exhibited a particular organizational structure, with a clear division of tasks and signals of status differentiation among the members. Remarkably, the analyses highlighted the strategic positioning of the criminal leaders. The most prominent participants (high-status individuals) were not those most involved in criminal activities (i.e. the most central in the network). This positioning strategy allowed minimizing the risks and ensuring effective management of smuggling operations. Criminal leaders were able to control the activities thanks to the specific cultural, family, kinship and ritual ties characterizing the mafias. This specific organizational structure may explain the strong resilience of mafias to law enforcementaction. Implications for both research and law enforcement are discussed.  相似文献

The article focuses on radiological smuggling and its connection with uncontrolled territories, the “grey zones” that have emerged as important conduits for illicit contraband, including the trafficking of radioactive materials. The presence of “grey zones,” together with poor border security, weak law enforcement and corruption in government structures, are the most important regional factors that facilitate radiological smuggling. The paper documents the collaboration between criminals, politicians, military and security officers and entrepreneurs in this kind of illicit activity and argues that the fight against radiological smuggling has to shift its focus from technical issues to intelligence gathering and analysis.  相似文献

This paper is a historical analysis of how the Canadian organized bar urged lawyers to adopt strict timekeeping practices and use time as the basis for their legal fees. The Canadian Bar Association's compilation of data on the legal profession in the late 1940s–the collection of ‘facts’, the ‘scientific’ nature of this collection–foreshadowed the way that the organized bar would couch its advocacy for the practice of timekeeping in the 1970s. The pioneering experts on law office management in Canada promised lawyers significant profit increases and gave minimal attention to the relationship between legal fees and client's interests.  相似文献

This article examines whether states shirked enforcement responsibilities in their principal-agent relationship with the federal government when implementing a delegated environmental program. It evaluates determinants of environmental enforcement stringency, particularly whether penalties were less when imposed by states than by the federal government. It analyzes 6,048 hazardous waste administrative penalties across 32 states and all U.S. Environmental Protection Agency Regions over 14 years. It finds that state penalties are typically substantially lower than federal penalties, and that penalty amounts are typically also related to the partisan composition of elected officials and the characteristics of enforcement actions, such as the type, seriousness, and number of violations. Factors such as the influence of organized interest groups, agency sensitivity to economic conditions or the economic importance of regulated industries, and environmentalist preferences of elected officials and the public are typically unrelated to enforcement stringency.  相似文献

This paper describes and analyzes the structural and operational features of Chinese alien smuggling. Interviews with aliens, smugglers and law enforcement officials in China, Hong Kong and the U.S. reveal this activity to be a complex process comprising a number of distinct operational stages. Our data suggest Chinese alien smuggling groups vary in their level of organization but most are best understood as task forces, or small groups of people assembled to perform a particular piece of work. These task forces are typically linked to international social networks characterized by overlapping, dyadic relationships; a high level of role differentiation; and a limited degree of hierarchy. Such groups are highly responsive to changing socio-legal and market constraints.The study was supported in part by a grant from California State University. The nexus with transnational organized crime is increasingly a focus for security planners in their analyses of terror groups. Their approach is best described by the phrase “methods, not motives.” While the motives of terrorists and organized criminals remain divergent most often, our research indicates this is not always the case. For that reason, this report argues that such a general approach has become too restrictive and can be misleading since the interaction between terrorism and organized crime is growing deeper and more complex all the time. In short, the lines of separation are no longer unequivocal. The report analyzes the relationship between international organized crime and terrorism in a systematic way in order to highlight the shortcomings of the “methods, not motives” argument. In so doing, the report considers the factors that most closely correspond to crime-terror interaction and identifies those regions of developed and developing states most likely to foster such interactions. Likewise, the paper will suggest an evolutionary spectrum of crime-terror interactions that serves as a common basis for discussion of such often used terms as “nexus.” The centerpiece of the report is a groundbreaking methodology for analysts and investigators to overcome this growing complexity, identify crime-terror interactions more quickly and to assess their importance with confidence. The approach is derived from a standard intelligence analytical framework, and has already proven its utility in law enforcement investigations. The report is the product of a recently concluded and peer-reviewed 18-month NIJ sponsored research project, and includes empirical evidence drawn from numerous case studies developed in the course of the research program. The smuggling of contraband cigarettes is discussed in relation to numerous financial and social issues. Cigarette smugglers are often portrayed as ruthless and dangerous individuals, and according to official and media accounts a clear link has been established between cigarette smuggling and ‘criminal and terrorist organisations’. The aim of this article is to challenge this stereotypical image of the cigarette smugglers based on the presentation of the stories of four smugglers interviewed in Greece and the UK.  相似文献

This paper examines the spirits smuggling in the Baltic Sea region in the inter-war period. On 1 June 1919 the Finnish Parliament passed the Prohibition Act forbidding the production, transportation, sale, and storage of alcohol which activated spirits smuggling to Finland. Large-scale spirits smuggling was arranged during Prohibition by criminal organizations through international networks. Mostly cheap German liquor was delivered to Nordic countries and to the United States. The representatives of organized crime in the Baltic Sea region became rich fast during Prohibition thanks to limits set by countries. Contemporary drug smuggling and spirits smuggling are comparable due to similar organizational structure and modus operandi.  相似文献

Over the last two decades the scientific community has witnessed unprecedented growth of nanotechnology research in Canada. Although recent studies have shown that Canada consistently maintains a position in the first tier of productive countries in terms of its share of the world??s nano-publications, a number of key questions remain unanswered. Using a unique nano-related publication dataset, this paper combines bibliometric analysis and science overlay mapping to visualize the ??invisible college?? of Canadian nano research. The present analysis finds that the rapid growth of nanotechnology research in Canada is, for the most part, externally driven. In recent years, research content has shifted toward nanobiotechnology fields. The geographical distribution of Canadian domestic nanotechnology research is characterized by regional imbalance: most research hubs are located near US?CCanadian borders. Canadian nanotechnology scientists have collaborated with a variety of countries, but Chinese scholars in particular play a leading role in Canada??s research exchange across national borders.  相似文献

This paper examines the inner workings of Chinese human smuggling organizations. Contrary to widely held conceptions about Chinese organized crime, most alien smugglers are otherwise ordinary citizens whose familial networks and fortuitous social contacts have enabled them to pool resources to transport human cargoes around the world. They come from diverse backgrounds and form temporary alliances to carry out smuggling operations. With the exception of a shared commitment to making money, little holds them together. The smuggling organizations mostly resemble ad hoc task forces and are assembled for specific operations. These organizations have clear divisions of labor with limited hierarchical structures. We discuss the theoretical implications of their unique organizational characteristics.  相似文献

China’s red-hot economy in recent decades has not only brought the country unprecedented wealth and political prominence in the world but also created ample opportunities for criminal enterprises to flourish. A review of recently published literature reveals that two types of transnational criminal activities – human smuggling and drug trafficking – received a fair amount of empirical attention in the research community. Other crimes, however, although carrying equally significant cross-national implications, have received scant attention. Thanks to a handful of empirical studies in recent years, the notion that traditional Chinese crime syndicates dominated transnational criminal activities has largely been dispelled. Most of those involved in transnational crimes (at least in human smuggling and drug trafficking) were found to be otherwise ordinary individuals who exploit their social or familial networks to take advantage of emerging opportunities. The criminal underworld in China appears to be growing along two separate tracks, with transnational organized crimes operating on one track and locally based criminal organizations on the other. Both groups of criminal entities are not known to cross paths in any systemic way. Research on Chinese organized crime (either locally based or transnational) has remained rather limited. Future research needs to emphasize empirical strategies to explore these and other pressing transnational criminal activities, as well as to solidify recent findings.  相似文献
