We examined mock jurors’ judgments in a rape case that was either prototypical (late-night assault by a stranger in a public place) or non-prototypical (daytime assault by an acquaintance in a private home). We also varied the psychological harm experienced by the victim as a result of the rape (mild anxiety or posttraumatic stress disorder (PTSD)). We hypothesized that participants’ expectations regarding the level of harm the victim is likely to experience would mediate the effect of harm level on ratings of the victim’s credibility, and this indirect effect would be contingent on the prototypicality of the case. In a pilot experiment we demonstrated that people expect prototypical rape cases to be more traumatic for victims than non-prototypical cases. In the main experiment, and as predicted, participants in the Prototypical condition expected the victim to develop PTSD more than mild anxiety, but Non-Prototypical condition participants expected the opposite. In addition, a level of harm that was consistent rather than inconsistent with their expectations led participants to rate the victim as more credible; they also rated her as less responsible for what happened, and they thought the defendant was more likely guilty and that he should be incarcerated for a longer period of time.  相似文献

Current research suggests a link between negative attitudes toward women and violence against women, and it also suggests that media may condition such negative attitudes. When considering the tremendous and continued growth of video game sales, and the resulting proliferation of sexual objectification and violence against women in some video games, it is lamentable that there is a dearth of research exploring the effect of such imagery on attitudes toward women. This study is the first study to use actual video game playing and control for causal order, when exploring the effect of sexual exploitation and violence against women in video games on attitudes toward women. By employing a Solomon Four-Group experimental research design, this exploratory study found that a video game depicting sexual objectification of women and violence against women resulted in statistically significant increased rape myths acceptance (rape-supportive attitudes) for male study participants but not for female participants.  相似文献

There is growing interest in understanding how different research methods are perceived by victims of violence and what survivors will reveal to researchers (termed meta-research or meta-studies). The purpose of this project was to conduct a qualitative meta-study on why rape survivors chose to participate in community-based, face-to-face interviews. Participants mentioned four primary reasons for why they decided to participate in this study: (a) to help other survivors, (b) to help themselves, (c) to support research on rape/sexual assault, and (d) to receive financial compensation. Implications for designing research recruitment protocols are discussed.  相似文献

We have looked at the empirical evidence of the well-known feminist dictum: "pornography is the theory--rape is the practice" (Morgan, 1980). While earlier research, notably that generated by the U.S. Commission on Obscenity and Pornography (1970) had found no evidence of a causal link between pornography and rape, a new generation of behavioral scientists have, for more than a decade, made considerable effort to prove such a connection, especially as far as "aggressive pornography" is concerned. The first part of the article examines and discusses the findings of this new research. A number of laboratory experiments have been conducted, much akin to the types of experiments developed by researchers of the effects of nonsexual media violence. As in the latter, a certain degree of increased "aggressiveness" has been found under certain circumstances, but to extrapolate from such laboratory effects to the commission of rape in real life is dubious. Studies of rapists' and nonrapists' immediate sexual reactions to presentations of pornography showed generally greater arousal to non-violent scenes, and no difference can be found in this regard between convicted rapists, nonsexual criminals and noncriminal males. In the second part of the paper an attempt was made to study the necessary precondition for a substantial causal relationship between the availability of pornography, including aggressive pornography, and rape--namely, that obviously increased availability of such material was followed by an increase in cases of reported rape. The development of rape and attempted rape during the period 1964-1984 was studied in four countries: the U.S.A., Denmark, Sweden and West Germany. In all four countries there is clear and undisputed evidence that during this period the availability of various forms of pictorial pornography including violent/dominant varieties (in the form of picture magazines, and films/videos used at home or shown in arcades or cinemas) has developed from extreme scarcity to relative abundance. If (violent) pornography causes rape, this exceptional development in the availability of (violent) pornography should definitely somehow influence the rape statistics. Since, however, the rape figures could not simply be expected to remain steady during the period in question (when it is well known that most other crimes increased considerably), the development of rape rates was compared with that of non-sexual violent offences and nonviolent sexual offences (in so far as available statistics permitted). The results showed that in none of the countries did rape increase more than nonsexual violent crimes. In this paper, the bodies of male rape victims as the ‘other’ are problematized. The social and cultural constructions of male rape within a policing context are examined since the police play a major role in impeding the progress of male rape cases. The author draws on police data, generated from interviews and qualitative questionnaires with the police, to illustrate the problems with policing male rape in England, UK. While the author provides empirical data, sociological, cultural, and post-structural theoretical frameworks largely inform it. It is argued that the bodies of male rape victims are positioned in inferior positions, whereby their bodies are metaphorically and symbolically marked as ‘abnormal’, ‘deviant’, and the ‘other’. Through social and power relations, their bodies are tainted, which reinforces gender and social norms.  相似文献

In recent years, focus on the high attrition rates and low conviction rates in sexual assault cases in Scandinavia has increased. Attrition refers to the dropout of cases through the criminal justice system. However, only limited research exists on the importance of suspect characteristics for the legal outcomes in these cases. The present study is the first in Scandinavia to investigate legal and extralegal suspect variables relating to charges and convictions in the criminal justice system regarding suspected offenders in rape and attempted rape cases. All reported cases of rape and attempted rape in the Eastern Jutland Police District from 2008 to 2010 with an identified rape suspect (N = 175) were analysed through binary logistic regression analyses to examine which variables might increase the likelihood of charges or convictions. Results show that suspects with one or more prior sexual assault charges were more likely to be charged and convicted of a rape offence. The results of the present study help improve the understanding of the judicial processing of cases of rape from a different perspective than the victims’ and partially lend support to the hypothesis of ‘the credible criminal’ in terms of investigative and prosecutorial decision-making in rape cases.  相似文献

Abstract

This paper discusses three themes in relation to assessing progress in the Criminal Justice System's (CJS) ability to investigate and successfully prosecute rape. The themes are business as usual, the justice gap and implementation problems. They arose as a consequence of two discussion papers in this volume by Kate Cook and Jan Jordan, who take positions of optimism and pessimism with respect to improvements for rape victim survivors after a series of reforms and changes in police and prosecution procedures. The stimulus for these papers was the latest review in England and Wales into the CJS's approach to rape conducted by Baroness Stern (2010). The present paper observes that the lack of systematic evaluative research makes it difficult to assess whether innovations in the CJS with respect to rape have been effective or to partial out the relative contribution law reform and changing police or prosecution practice may have made to reporting and conviction rates. Finally, it is suggested that intensification of effort to fully implement review recommendations may achieve limited improvement because of the characteristics of an adversarial legal model.  相似文献

This study focused on adult males who have committed a sexual offence against elderly victims (aged 55 and over) in order to increase our understanding of this group of offenders. Semi-structured interviews were conducted with five such individuals. Interview data were analysed using interpretative phenomenological analysis. Four main themes emerged: life's been really tough (where participants talked about difficulties they had faced); I’m not bad, I did what anyone would do (where participants sought to explain their behaviour); Other people haven’t helped or have made things worse (where participants highlighted challenges they faced in relationships and the impact they felt this had); and Coping and pleasure (which highlights the use of sex and alcohol in their lives). Implications for the practice and treatment of individuals offending against elderly victims are discussed.  相似文献
