对重庆市沙坪坝区青少年抢劫犯罪的调查

针对当前青少年抢劫犯罪突出的情况,我们于最近对重庆市沙坪坝区人民法院近两年来受理的青少年抢劫案件的情况进行了调查。 一九八○年,沙坪坝区法院共判处抢劫案十六件,罪犯三十二人,其中青少年(年龄为二十五岁以下,下同)三十人,占百分之九十

应重视青少年的道德法制教育

当前社会转型时期,各种矛盾凸显,青少年违法犯罪的社会现象十分严重。分析青少年违法犯罪的原因,全社会道德法制教育薄弱是重要的因素。所以,加强对青少年的道德法制教育,对于从根本上预防青少年违法犯罪,促进青少年健康成长,维护社会稳定,构建社会主义和谐社会具有十分重要的意义。     

Determinants of Public Opinion Toward Juvenile Waiver Decisions

This study examines the determinants of public opinion toward three types of juvenile crimes deemed suitable for trial in criminal court. The public overwhelmingly supports juvenile waivers, especially for juveniles charged with violent crimes. However, such an overall consensus in public opinion can be a result of an inadequate survey design. The public needs to be given more contextual information regarding juvenile offenses and possible consequences resulting from transferring juveniles to the adult system.     

DEINSTITUTIONALIZATION OF JUVENILE OFFENDERS*

This research investigated the effects of the closing of a juvenile correctional institution. A nonequivalent control group design was used to compare the effects of the closing on placements and criminal behavior for three groups (N = 927) whose institutionalization experiences differed. Official crime data were obtained for all, and interviews were attempted with 752 juveniles. The noninstitutionalized group's recidivism was significantly higher than that of the institutionalized groups both during and after the period of institutionalization. Consistent group differences in offending were observed for crimes against property but not for crimes involving drugs or crimes against persons. These differences were significant but not as pronounced when only the most serious crimes were considered. Implications for the design of effective juvenile correctional strategies are discussed.

White-collar delinquency

Seemingly harmless pranks by computer hackers have evolved into major economic crimes and acts of terrorism that appear far different than traditional forms of juvenile delinquency. Nonetheless, because they do not occupy the high status positions that facilitate white-collar crimes, serious computer crimes by juveniles have fallen between the theoretical cracks. A new hybrid category of crime that we label “white-collar delinquency” demonstrates that class does matter in the way illegal activity is conceptualized, and re-ignites debates regarding both white-collar crime and juvenile delinquency. We review conceptual issues that relate to this emergent form of computer-based deviance, and identify questions to be addressed in future theorizing and research. JUVENILE CRIME AND WHY WAIVER IS NOT THE ANSWER

Many states deal with the issue of juvenile crime by charging juveniles as adults. This is done by a method of waiver. Waiver allows adult criminal courts to have the power to exercise jurisdiction over juveniles.¹ In effect, a juvenile is tried and sentenced as an adult when his or her case is waived (removed) from the juvenile court to the adult court. Waiver in juvenile (youths seventeen and younger) cases should never be allowed because juvenile offenders are too immature and incompetent to appreciate the nature of their crimes and because the juvenile justice system is a more appropriate place to rehabilitate juvenile offenders.     

未成年人犯罪司法解释问题之省思

未成年人犯罪是不同于成年人犯罪的一类特殊的社会现象,刑事法对该现象的研究应该有不同于成人刑法的特殊视角。基于完整的少年司法制度短期内无法登堂入室的现实情况,应该充分重视通过司法解释的管道来达到理想与现实的有效沟通。所以,未成年人犯罪的刑法司法解释应该以现代少年刑事政策为灵魂,以保守实质解释论为基本立场,适时借鉴人格刑法学的相关理论来展开探索。     

未成年人刑事案件社会调查制度论纲

未成年人一般具有极强可塑性。如果法官的判决是有利于其改过自新的,则此种基于刑罚个别化的判决对该未成年人而言,无疑是再社会化和预防犯罪的良方。蕴涵人格调查的社会调查制度应当是形成前述判决的基础。在我国少年司法制度尚不完备的当下,应以该制度的正当性为基点展开研究,以期运用于少年刑事司法实践。     

Juvenile sex-only and sex-plus offenders: an exploratory study on criminal profiles

In this study, research was done on the criminal profiles of a large group of juvenile sex-only and sex-plus (sex and other offenses) delinquents (N = 4,430) in the Netherlands. Use was made of information from police records. Results show that sex-plus offenders start their careers earlier, that more of these offenders are of non-Dutch origin, that they commit more crimes, and will partly continue their criminal career after their adolescence. Juvenile sex-only offenders rarely go on committing crimes. In sex-plus offenders, sexual crimes play only a minor role in their total crime repertory. As time goes by, their criminal career will develop into the direction of property crimes. Finally, the implications and limitations of this study will be discussed.
