We analyze the main rationale for public administrations and political institutions for supplying transparency, namely, that it generates legitimacy for these institutions. First, we discuss different theories of decision making from which plausible causal mechanisms that may drive a link between transparency and legitimacy may be derived. We find that the common notion of a straightforward positive correlation is naïve and that transparency reforms are rather unpredictable phenomena. Second, we test the effect of transparency on procedure acceptance using vignette experiments of representative decision making in schools. We find that transparency can indeed generate legitimacy. Interestingly, however, the form need not be “fishbowl transparency,” with full openness of the decision‐making process. Decision makers may improve their legitimacy simply by justifying carefully afterward the decisions taken behind closed doors. Only when behavior close to a deliberative democratic ideal was displayed did openness of the process generate more legitimacy than closed‐door decision making with postdecisional justifications.  相似文献

Increasing Jordanian women participation in decision‐making process is the most debated topic in local administration over the world, including Jordan. The objective of this study was to determine opportunities and challenges that influence the inclusiveness of Jordanian women in local decision‐making bodies as perceived by local administrative personnel working in local administration. Primary data collected from (120) participants selected randomly from local bodies in Jordan analyzed by SPSS. The analysis revealed a statistically significant correlation between inclusiveness of Jordanian women in local decision‐making bodies and opportunities for increasing their advancement into decision‐making positions at (α ≤ 0.05) except affirmative action variable was not statistically significant (α ≤ 0.05). The analysis also revealed a statistically significant correlation between inclusiveness of Jordanian women in local decision‐making bodies and threats for blocking their access to decision‐making positions at (α ≤ 0.05). The recommendations of this study are that further analyses are required within this field. This might be so relevant to other populations in Arab countries in the Middle East and elsewhere.  相似文献

How are unanimity negotiations commonly settled in the EU Council of Ministers? Important contributions have been made to our understanding of the ‘consensual’ decision‐making dynamics in the Council, but most studies focus on explaining the sheer absence of votes in legislative decision making under the qualified majority rule. This study seeks to explain how vetoes are averted, or curtailed, in unanimity decision making. These unanimity negotiations are explained as attempts to induce or prevent high‐level exposure. The degree of exposure in turn depends on the degree of lower level contestation. A process tracing analysis of one prolonged debate is performed from the perspective of one Member State – the Netherlands – which played a very prominent obstructing role. By analysing when, why and where (at what level) the Dutch won or lost, one can come closer to understanding the dynamic interplay between the different Council levels.  相似文献

This article examines the relationship between electronic participation (e‐participation) and trust in local government by focusing on five dimensions of the e‐participationprocess: (1) satisfaction with e‐participation applications, (2) satisfaction with government responsiveness to e‐participants, (3) e‐participants’ development through the participation, (4) perceived influence on decision making, and (5) assessment of government transparency. Using data from the 2009 E‐Participation Survey in Seoul Metropolitan Government, this article finds that e‐participants’ satisfaction with e‐participation applications is directly associated with their development and their assessment of government transparency. The findings reveal that e‐participants’ satisfaction with government responsiveness is positively associated with their perceptions of influencing government decision making. Furthermore, there is a positive association between e‐participants’ perception of influencing government decision making and their assessment of government transparency. Finally, the article finds that there is a positive association between e‐participants’ assessment of government transparency and their trust in the local government providing the e‐participation program.  相似文献

This article tests the effect of accountability on negotiation outcomes in a face‐to‐face classroom experiment. Student participants were asked to form coalitions in groups of three. In the treatment condition, negotiators were held accountable by a personal forum during the formation of the coalition. In the control condition, negotiators were not held accountable. Results show that accountability leads to lower group performance in coalition negotiations. Accountability also reduced the willingness of negotiators to include all negotiators in a “grand coalition.” Rather, accountable negotiators reached agreement with a subset of negotiators. Accountability increased the odds of reaching no agreement. These findings challenge the idea of increased performance as a result of public accountability in the context of coalition negotiations.  相似文献

This article contributes to the emerging literature on transparency by developing and empirically testing a theoretical framework that explains the determinants of local government Web site transparency. It aims to answer the following central question: What institutional factors determine the different dimensions of government transparency? The framework distinguishes three dimensions of transparency—decision making transparency, policy information transparency, and policy outcome transparency—and hypothesizes three explanations for each: organizational capacity, political influence, and group influence on government. Results indicate that each dimension of transparency is associated with different factors. Decision‐making transparency is associated with political influence; when left‐wing parties are strong in the local council, local government tends to be more transparent. Policy information transparency is associated with media attention and external group pressure, and policy outcome transparency is associated with both external group pressure and the organizational capacity. The authors discuss the implications for policy and administration.  相似文献

The article analyses the liberalization of the EC electricity supply industry. Confronting the intergovernmental approach, the case study is based on the premise that the member state executives act within the limits of a bounded rationality and do therefore not always represent clear and fixed interests in EU negotiations. Taking the examples of France and Germany, it shows that the national positions and preferences may change greatly during the course of the decision making process. While the French positional changes may be reasonably well explained by the intergovernmental approach, the German preference changes are attributed to effects of the EC institutions and negotiations. Institutional principles, policy-concepts and fairness criteria guide member state orientations and behavior and hinder the pursuit of unilateral advantages. Incremental negotiation techniques within the Council induce learning processes and cause reassessments of the domestic situations. Furthermore, the EC decisions may cause behavioral changes which clearly surpass their regulatory content even if they contain extensive flexibilisation mechanisms.  相似文献

Building on the counterintuitive findings of recent empirical studies that transparency in political decision making may have a negative effect on public legitimacy beliefs, this article suggests that transparency has different effects depending on the policy area. Specifically, it argues that transparency is less effective in policy decisions that involve trade‐offs related to questions of human life and death or well‐being. Using an experiment that involved 1,032 participants, the effect of transparency is tested in two policy areas that represent routine priority setting (culture and leisure) and policy decisions implicitly related to human life and well‐being (traffic security). Results indicate that transparency can increase public acceptance of political decisions, but this effect is moderated by the type of policy area. Furthermore, a limited type of transparency in which decision makers provide justifications for their decisions can result in benefits while avoiding potential costs.  相似文献

Because bureaucratic agencies may be less transparent in their decision processes than legislatures, most states have developed processes to incorporate input from regulated communities and other parties potentially affected by regulations. Administrative agencies may encourage democratic practices to increase legitimacy and accountability of the bureaucracy and improve decision‐making processes. However, rules governing the regulatory process vary by state, with some incorporating more open practices than others. Understanding these dynamics is increasingly important, as the rulemaking process has become central to policymaking over the past several decades, with a large portion of policymaking authority delegated to administrative agencies. Drawing from regulatory documents, rulemaking comments, media coverage, and interviews with regulators in 14 regulatory decision processes across five states, this study finds that while states vary in their approach to providing access to information, there are overriding patterns that reduce the role of citizens and the overall transparency of regulatory processes.  相似文献

The public sector is in transition in many countries, including New Zealand, and many government departments have been restructured so as to increase transparency and accountability in their decision‐making by implementing fundamental changes to governance, accountability regimes and information systems. New frameworks are also needed for tasks such as priority setting, and this paper describes the framework developed to assist the then NZ Ministry of Agriculture (MAF) in setting priorities for the allocation of research funds. This comprised a participative process including a series of workshops using both GroupSystems software for electronic meeting support and Visual Interactive Sensitivity Analysis (VISA) software to facilitate a multi‐criteria decision analysis.  相似文献

Drawing on several large research projects, and using both quantitative and qualitative evidence, this article assesses the policy influence of the Westminster parliament. Frequently dismissed as powerless in both academic and more popular accounts, we instead show evidence of an institution with significant policy influence, at successive stages of the policy process. Conventional accounts have focused too much on the decision‐making stage, to the exclusion of parliament's role at earlier and later policy stages. Critics have also focused disproportionately on visible influence, overlooking behind‐the‐scenes negotiations and the role of anticipated reactions. Based on analysis of over 6,000 parliamentary votes, 4,000 legislative amendments, 1,000 committee recommendations, and 500 interviews, we conclude that Westminster's influence is both substantial and probably rising.  相似文献

This article contributes to the growing body of literature on government transparency by developing a model for studying the construction of transparency in interactions between governments and stakeholders. Building on theories about complex decision making, a heuristic model is developed that consists of a strategic, a cognitive, and an institutional perspective. To test the model's value, it is applied to two empirical cases: Dutch schools and the Council of the European Union. Applying the model to the school case provides insights into the connection between the introduction of transparency and the transformation in arrangements for safeguarding school quality. The case of the Council of the European Union highlights the role of transparency in the transformation of the council from a supranational to an intergovernmental body. The article concludes that the heuristic model, together with in‐depth, longitudinal case studies, helps us understand government transparency in relation to broader transformations in the public sector.  相似文献

This article synthesizes the cross‐disciplinary literature on government transparency. It systematically reviews research addressing the topic of government transparency published between 1990 and 2015. The review uses 187 studies to address three questions: (1) What forms of transparency has the literature identified? (2) What outcomes does the literature attribute to transparency? and (3) How successful is transparency in achieving those goals? In addressing these questions, the authors review six interrelated types of transparency and nine governance‐ and citizen‐related outcomes of transparency. Based on the findings of the analysis, the authors outline an agenda for future research on government transparency and its effects that calls for more systematically investigating the ways in which contextual conditions shape transparency outcomes, replicating studies with varying methodologies, investigating transparency in neglected countries, and paying greater attention to understudied claims of transparency such as improved decision making and management.  相似文献

This article argues that the essential factors of a public service code of ethics can be divided into five categories. These categories or principles are fairness, transparency, responsibility, efficiency and conflict of interest. These principles are identified in this article as being the basic elements of democratic accountability in relation to public sector decision‐making. The issues explored are not only the obstacles that the public service decision‐maker faces in internalising these principles but, also, the challenges for a pro‐active management in fostering such internalisation.  相似文献

UN negotiations on climate change entail a fundamental transformation of the global economy and constitute the single most important process in world politics. This is an account of the 2009 Copenhagen summit from the perspective of a government delegate. The article offers a guide to global climate negotiations, tells the story of Copenhagen from behind closed doors, and assesses the current state of global climate governance. It outlines key policy issues under negotiation, the positions and policy preferences of key countries and coalitions, the outcomes of Copenhagen, and achievements and failures in climate negotiations to date. The Copenhagen Accord is a weak agreement designed to mask the political failure of the international community to create a global climate treaty. However, climate policy around the world is making considerable progress. While the UN negotiations process is deadlocked, multilevel climate governance is thriving.  相似文献

In the transparent exercise of democracy, there is a technique of persuasion called lobbying. The technique involves applying persuasion by representing one's own interests or the interests of third parties. In literature, lobbying is therefore related to interest groups and pressure groups. It is considered a key tool to guarantee equal conditions in the decision‐making process that promotes democracy and citizen control is transparency. Lobbying, also called interest management, is a legitimate activity that in Latin America has a bad press and consequently a bad reputation. However, it is a very important input into the democratic process. According to the NGO Legislative Directory: “It allows the general public to engage in the public decision‐making process, and it has the potential to improve the quality of public decisions by opening channels for diverse opinions and thematic experts.” It is an activity that is put into practice in all countries of the world and that has a regulatory background in most countries of the northern hemisphere and in some South American countries such as Peru and Chile. The general spirit of these norms is to “transform a suspected irregular activity into a deliberation and democratic game,” justify the Legislative Directory.  相似文献

What impact has the 2004 enlargement had on legislative decision making in the European Union (EU)? This study answers this question by examining the controversies raised by a broad selection of legislative proposals from before and after the 2004 enlargement. The analyses focus on the alignments of decision‐making actors found on those controversies. Member State representatives, the European Commission and the European Parliament vary considerably in the positions they take on controversial issues before and after enlargement. Consistent patterns in actor alignments are found for only a minority of controversial issues. To the extent that consistent patterns are found, the most common involve differences in the positions of Northern and Southern Member States and old and new Member States. The North‐South alignment was more common in the EU‐15 and reflected Northern Member States' preference for low levels of regulatory intervention. The new‐old alignment that has been evident in the post‐2004 EU reflects new Member States' preference for higher levels of financial subsidies. This study argues that the persistent diversity in actor alignments contributes to the EU's capacity to cope with enlargement.  相似文献

Regulatory transparency—mandatory disclosure of information by private or public institutions with a regulatory intent—has become an important frontier of government innovation. This paper assesses the effectiveness of such transparency systems by examining the design and impact of financial disclosure, nutritional labeling, workplace hazard communication, and five other diverse systems in the United States. We argue that transparency policies are effective only when the information they produce becomes “embedded” in the everyday decision‐making routines of information users and information disclosers. This double‐sided embeddedness is the most important condition for transparency systems' effectiveness. Based on detailed case analyses, we evaluate the user and discloser embeddedness of the eight major transparency policies. We then draw on a comprehensive inventory of prior studies of regulatory effectiveness to assess whether predictions about effectiveness based on characteristics of embeddedness are consistent with those evaluations. © 2006 by the Association for Public Policy Analysis and Management  相似文献

Regulating interest groups’ access to decision makers constitutes a key dimension of legitimate and accountable systems of government. The European Union explicitly links lobbying regulation with the democratic credentials of its supranational system of governance and proposes transparency as a solution to increase legitimacy and regulate private actors’ participation in policy making. This lobbying regulation regime consists of a Transparency Register that conditions access to decision makers upon joining it and complying with its information disclosure requirements. The extent to which transparency‐based regulatory regimes are successful in ensuring effective regulation of targeted actors and in being recognised as a legitimate instrument of governance constitutes a key empirical question. Therefore, the study asks: Do stakeholders perceive the transparency‐based EU lobbying regulation regime to be a legitimate form of regulatory governance? The study answers by building on a classic model of targeted transparency and proposes perceived regulatory effectiveness and sustainability as two key dimensions on which to evaluate the legitimacy of the Register. The arguments are tested on a new dataset reporting the evaluations of 1,374 stakeholders on the design and performance of the EU lobbying regulation regime. The findings describe a transparency regime that scores low in perceived effectiveness and moderate to low in sustainability. Citizens criticise the quality of information disclosed and the Register's performance as a transparency instrument. The Register did not effectively bridge the information gap between the public and interest groups about supranational lobbying. In terms of sustainability, interest organisations appreciate the systemic benefits of transparency, but identify few organisation‐level benefits. Organisations that are policy insiders incur more transparency costs so they instrumentally support transparency only insofar it suits their lobbying strategies and does not threaten their position. Insiders support including additional categories of organisations in the Register's regulatory remit but not more types of interactions with policy makers. They support an imperfect regulatory status quo to which they have adapted but lack incentives to support increased transparency and information disclosure. Targeted transparency proves an ineffective approach to regulating interest groups’ participation in EU policy making, constituting a suboptimal choice for ensuring transparent, accountable and legitimate supranational lobbying.  相似文献
