建设有中国特色的军事法律制度

2001年8月,"中国法律史学会2001年学术研讨会"在福建厦门大学召开.本次会议主要议题是探讨新世纪中国法律史学研究的发展方向,并对未来法律史研究进行展望.来自全国各地的近百名法律史学者就法律史研究的方法、目前面临的问题进行了广泛深入的交流与讨论,会议受到论文几十篇,并对上一届学会的论文评选活动进行了颁奖表彰.     

语言欧化与中国新诗的自我建构

欧化是现代汉语生成与发展过程中一个不可否认的历史事实和现象,运用现代汉语进行书写的中国新诗面临着欧化带来的种种困境和难题。与欧化相对的是本土化,二者的关系相当复杂,其关键是欧化或本土化在新诗自我建构中的位置。其实,与其纠缠于欧化在新诗中的有无、可否,不如考察语言欧化的历史性存在如何重塑了中国诗歌的书写方式、改变了中国诗歌的哪些质素。这些方面在新诗的许多代表性诗人和文本中有清晰的体现。     

Chinese Organised Crime

Secret societies have always been endemic to Chinese overseas communities, surviving on fear and corruption and prospering through their involvement in a wide range of legal and illegal businesses. For many years, Hong Kong was seen as the 'capital' of this worldwide Chinese criminal fraternity and, in the 1980s, many outside observers and analysts thought the gangs that were based in the then British colony would leave once it reverted to Chinese rule in 1997. In the end, the reverse turned out to be the case. Not only did the Hong Kong Triads make arrangements with the territory's new overlords, but in Chinatowns all over the world, close links were also forged with mainland Chinese interests. In China itself, where cutthroat capitalism has replaced the old, austere socialist system, new secret societies, both Triad-linked criminal groups and various syncretic sects, are also expanding at a breathtaking pace. An entirely new breed of entrepreneurs is emerging on the fringes of China. The businesslike and well-connected, pinstriped suit-wearing managers of the Sun Yee On Triad have shown where the future lies, while gangsters are breaking new ground in such new frontiers as the Russian Far East, which could have far-reaching consequences for the stability of the entire region.     

2003年中国法律史学学术研究回顾

随着近年来对法律史研究方法与范式讨论的逐步深入,以及其他社会科学领域的新成果、新方法渐次被引入法律史研究,2003年来的法律史研究呈现出了视野更开阔,视角更丰富,方法更多元的局面.学科内部囿于陈旧的课程设计体制而产生的法制史/法律思想史对立的研究鸿沟逐渐消弭,而跨学科的研究及法史与人类学、社会学等学科的科际整合(interdiscipline integration)的特点逐渐凸显.

2004年中国法律史学研究和学术活动非常活跃,许多院校和主要学术刊物都组织了专题研究,刊发了专题文章.这一年度的法律史研究主题鲜明,特色突出,全面深入,既有史料整理,又有历史分析和学科发展的前瞻性研究.     

2005年中国法律史学学术研究回顾

一、概况 2005年中国法律史学学术研究成果丰富,学术交流活跃.就研究成果而言,据有关报刊杂志及中国人民大学书报资料中心有关论文"索引"和<新华文摘>所辑报刊目录的统计,①2005年发表的有关中国法律史及中日、中西法律史比较的研究论文近四百篇,专著数十种.2005年的中国法律史学学术研究有三个特点:第一,大量的研究成果反映了学科研究的细化和向纵深的发展,近四百篇学术论文几乎涵盖了自三代至新中国数千年每一个历史阶段,并涉及到法律所关涉到的方方面面问题.比如,宏观地研究中国传统法的内容与特点、中国古代法律形成的历史背景和文化基础等等,应该指出的是,在宏观研究中,并不乏对一朝代或一王朝法律细致的陈述和分析.

新世纪以来,中国法律史学的研究呈现出百花齐放、百家争鸣的勃勃气象.在对过去的回顾与总结的基础上,学界进一步深入地探讨中国法律史学的学科建设及其未来的发展方向问题.由中国法律史学会主办、上海大学法学院承办的"中国法律史学会2002年学术年会"11月21-25日在上海召开.……     

Chinese Drywall Liability

This article presents an overview of the defective Chinese drywall product liability including a timeline starting when complaints were received by the Florida Department of Health in June 2008. The overview of the rapidly evolving product liability also discusses the factors that contributed to drywall demand and the production of synthetic gypsum as well as the common allegations that have been made against various drywall defendants and the actions and information provided by the Consumer Product Safety Commission—the federal agency tasked with leading the investigation into drywall complaints, potential health risks, and electrical and fire safety issues. Lastly, available corporate disclosures are summarized for drywall liabilities. The drywall problem has spurred much activity from homeowners, builders, contractors, suppliers, and drywall manufacturers. Much investigation has been done and more is in process, and initial findings and results are just being made available. That said, it is too early to tell the magnitude of the liability in which many facts remain unknown, and it is uncertain when the drywall problem will abate.
