This paper examines limitations in how law enforcement and public health systems respond to domestic violence in Kyrgyzstan. Findings from interviews with domestic violence victims show that these women are subject to ineffectual practices and negative attitudes that tend to minimize domestic abuse and disempower victims. The findings reveal several problematic issues: inconsistencies in the implementation of the law, impunity for abusers because of both personal attitudes and social affinities between the police and abusers, ineffective enforcement of protective orders, and superficial processing of domestic violence cases by the legal system. Additional barriers to help-seeking include a lack of institutional support and guidelines for offering mental health services for victims as well as a scarcity of housing, childcare, and employment opportunities for women seeking to break the cycle of abuse. The findings underscore the need for society-wide changes in attitudes toward domestic violence, stricter mechanisms for enforcing the law, and mandatory training for service providers to facilitate the provision of more accessible and affirmative support to victims.  相似文献

Officer‐involved domestic violence (OIDV) is a national problem, with police officer families having higher rates of domestic violence than non–police officer families. OIDV is also an underresearched problem with few studies or proposed solutions. Many victims of OIDV do not report their abuse precisely because their abuser is a police officer, whom they fear is in a unique position to protect him/herself from any legal consequences. Often, OIDV complaints are not investigated properly in a nonbiased manner. While a handful of police agencies around the country have developed specific policies and procedures to deal with OIDV, Washington State has enacted legislation that requires its police agencies to adopt OIDV‐specific policies. The International Associations of Chiefs of Police (IACP), an organization that addresses various issues confronting law enforcement, has also developed a model policy on OIDV. This Note proposes that, in light of the Washington legislation and the model policy proposed by the IACP, each state should enact a statute that requires its police agencies to develop policies on OIDV. This Note also outlines a specific set of procedures that such statutes should, at a minimum, require its police agencies to adopt, ranging from educating police officers on domestic violence to developing guidelines on responding to and investigating OIDV complaints.  相似文献

ABSTRACT

Image-based sexual abuse (IBSA) refers to the non-consensual recording, distribution, or threat of distribution, of nude or sexual images. Over the past five years, numerous jurisdictions have amended their criminal laws to respond more effectively to this growing phenomenon, yet increased criminalization has not automatically translated into increased prosecutions. Drawing on stakeholder interviews with 52 Australian legal and policy experts, domestic and sexual violence advocates, industry representatives, police, and academics, this article examines law enforcement responses to IBSA in Australia. We argue that although there is evidence to suggest IBSA is being treated more seriously by police, there are five primary barriers to responding to IBSA, including: inconsistent laws; a lack of resources; evidentiary limitations; jurisdictional boundaries; and victim-blaming or harm minimization attitudes. Suggestions are made for how to respond to these challenges to facilitate more effective policing of IBSA.  相似文献

Responding to domestic violence poses unique challenges to law enforcement officers. Prior research has focused on issues such as officer safety and arrest policies but overlooked a critical component—the officers’ perception of their role in responding to domestic violence incidents. This study explores how police officers define their roles through the use of focus group interviews with detectives assigned to a domestic violence unit. Findings include the identification of three role perspectives. Recommendations for a more balanced approach of these role perspectives in responding to domestic violence crimes through the use of more effective training, supervision, and evaluation are proposed.  相似文献

This study examined the nature of police response to domestic violence incidents with a focus on the identification of areas of police intervention that female victims of domestic abuse find “most” helpful and “least” helpful. The first part of the study was based on the analysis of a random sample of incident reports of domestic abuse cases recorded in 2000 and 2001. These reports were examined to obtain information about the characteristics of domestic abuse victims and summary information about the incidents of domestic abuse offenses. The second stage of the research study involved a telephone survey conducted with a random sample of fifty female domestic abuse victims who called the police. The study examined female victims' perceptions of how the police responded to the domestic abuse incidents, how helpful or not so helpful victims found the police to be when they responded to their calls, and how their cases were handled by the legal system.  相似文献

Recent studies of police response to violence in which men attack women with whom they have a history of shared intimacy have not addressed the issue that inspired research in the first place: the “leniency thesis” that police treat men who beat their spouses less punitively than other violent offenders. In addition, research examining the deterrent effects of various police treatments of misdemeanor domestic violence is not responsive to complaints that abused women are denied protection of law when they have been victims of serious, felony-grade, abuse by their spouses. This research analyzes the response of the Chester, Pennsylvania, police to 392 consecutively reported felony-grade assaults by persons whose identities were known to victims and police. Results confirm the leniency thesis. Tabular analysis demonstrates that arrests occurred in 13% of male-on-female spousal assaults and 28% of other assaults. Logit analysis indicates that this difference in police response is not attributable to other variables that might be expected to result in differential treatment. We conclude that the practices and results reported by research conducted in progressive police jurisdictions that volunteer to participate in studies of police response to violence against women may not be generalizable to the great majority of U.S. police agencies that have not welcomed such study.  相似文献

There is little documentation about how nuisance property laws, which fine people for excessive 911 calls, affect victims of domestic violence. In St. Louis, we found that police and prosecutors believe that the law benefits victims of domestic violence by providing them with additional services. By contrast, advocates for domestic violence victims believe that the law undermines battered women's access to housing and discourages them from calling 911. Using qualitative data, we analyze how the organizational structures and dynamics within which each group works give rise to different stocks of working knowledge. We conclude that law enforcement officials are unaware of these harms because women's voices and experiences are marginalized during the enforcement process. This research reveals mechanisms through which law enforcement policies reinforce gender inequality, and illustrates some ways in which gender relations and power come into play in what, on their surface, appear to be gender‐neutral laws.  相似文献

Presumptive arrest and prosecution policies are designed to eradicate domestic violence by disrupting abusive relationships and transforming the subjectivities of victimized women and abusive men. Using in-depth interviews with 30 persons arrested and prosecuted for domestic violence, this article examines the power of presumptive policies by exploring how intimate abusers experience them. The study finds that while the police and courts are able to secure arrests and convictions on domestic violence cases, nearly all the respondents in this study understand their punishments as unfair sanctions meted out by an unjust local legal system rather than as the consequences of their own actions. These injustice claims emerge from abusers' group identities as well as the very practices through which the police and courts gain authority over them. These findings demonstrate that the power of the law as a force for social change may be more limited than some have claimed. In addition, they reinforce calls to reform society's response to intimate violence through procedures that can go further in empowering victims and having offenders recognize their responsibility for violence.  相似文献

A coordinated community response system to the help-seeking behaviors of domestic violence victims is critical to minimize the impact of violent events and to educate the public, so that safe and effective conflict management skills may replace violent responses. The focus for the present study is to identify and analyze victims’ choices of law enforcement assistance in stopping the violence and/or aid through the services of the regional family violence center. Some victims select legal channels of support; others rely exclusively on social service support, and others seek assistance from both sources. Characteristics of victims whose cases followed two types of help-seeking behavior patterns—legal support or social support–were determined through archived data from both the records of a regional family violence center (FVC) (n=258) and domestic violence incident reports of a police department serving a city of approximately 200,000 citizens (n=127). Findings indicate that African American victims more frequently sought protection through law enforcement sources than they did through family violence center services, and the reverse was true for Euro-Americans.  相似文献

Physical violence is but one of many tools that may be used to gain greater power within intimate relationships, yet the legal response has been critiqued for failing to recognise and respond to the full spectrum of abusive behaviours, such as coercive control. Using a sample of police officers from the United States (US) and the United Kingdom (UK), the current study utilises hypothetical vignettes to assess police officers’ perceptions of domestic abuse, including those incidents that are not necessarily physically violent, but involve stalking and other coercive, controlling behaviours that are harmful and require intervention. Within- and between-country similarities and differences were analysed. Findings revealed that the majority of officers in both countries possessed a good level of understanding of domestic abuse and how they should respond to it – amidst and beyond the physical violence. However, our analysis of both quantitative and qualitative data also showed that the use of physical violence is at the forefront of many officers’ expectations about domestic abuse, and that when physical violence is absent, the police response is less proactive. Our study finds some support for the idea that non-physical abuse does go “under the radar” to some extent for some officers, and that this is more the case for American officers than their British counterparts. Findings are discussed in terms of context of the research sites and implications for policy, practice and future research.  相似文献

Recent British work has focused attention on preventing repeat victimization as part of an overall crime prevention strategy. Because domestic violence victims are among those most likely to suffer multiple victimizations, they are logical candidates for programs targeted at reducing repeat victimization.
This article reports on a joint law enforcement-social services approach to reduce the incidence of repeat domestic violence. The research design randomly assigned households reporting domestic incidents within two public housing police service areas in New York to receive or not receive a follow-up to the initial patrol response. (The follow-up visit was conducted by a police officer and a social worker.) In addition, housing projects in the same area were randomly assigned to receive or not receive public education about domestic violence.
Neither treatment produced a reduction in violence. However, households in projects that had received public education and households that received the follow-up visits were both more likely to report new violence to the police than households that did not receive the treatments. Moreover, the effect of the follow-up visit was most pronounced among households with more serious histories of violence. The results suggest that the interventions increased citizens' confidence in the ability of the police to handle domestic situations.  相似文献

The literature of domestic violence is critical of police service dlivery in dmnestic disputes. Yet, little has been systematically documented regarding dispatch procedures, citizen-police interactions, or the special circumstances surrounding domestic investigations. This article describes the actions of investigating officers with family or intimately related persons during police encounters. It wmpares these with like investigations of non-related disputants. Among the major findings are that (1)dispatch tend to underreport the nature of domestic assaults; (2) patrol officers face mme agitated persons in domestic en- ccuunters; (3) police arrest suspects more often in domestic cases, but circumstances would appear to warrant even higher rates of arrest; (4) misis intervention appears to take precedence over arrest in some domestic assaults; and (5) police almost never refer citizens to social service agencies. Overall, the findings point to ule need for police service delivery in domestic disputes that is w e geared to law enforcement in cases of violent family Conflict.  相似文献

Victims of domestic violence are legally entitled to police protection, but multiple barriers exist in contacting law enforcement. In this study, we used Federal Bureau of Investigation data, key informant interviews, and focus groups to examine barriers to reporting domestic violence among older African American women in the rural Deep South. Three primary barriers were identified: gender roles, age dependency, and mistrust of law enforcement. The main finding was that reports of domestic violence were deterred by fears of being stigmatized by church, family, and community. The one compelling and feasible resolution is for law enforcement to take a leadership role in educating clergy and other community leaders about domestic violence as a crime against older women.  相似文献

This research examines police decisions to report child abuse. A questionnaire was administered to 142 law enforcement officers at both municipal and county police agencies in a southern county. Vignettes were used to determine the response of police to several abuse events that differ in their nature and seriousness. Other items measured include dogmatism, knowledge of the reporting law, and experience reporting child abuse. The results indicate that the primary contributors to police decisions are definition of the behavior as serious, perception that the behavior is criminal, and race of the family. Conclusions and inferences are made regarding how these perceptions are formed and their impact on police discretion.  相似文献

Police attitudes are important in facilitating a sense of safety and comfort in women seeking justice-system support for protection from partner violence. This study examined police attitudes toward sanctions and treatment for domestic violence offenders compared with other violent and nonviolent offenders. In addition, police attitudes toward domestic violence offenders who do and do not use substances were examined. Officers from one city police department (n = 315) participated in a survey. Results indicate there is a trend toward attitudes that treatment, rather than sanctions, was more appropriate for domestic violence offenders. In addition, officers rated the use of sanctions higher for domestic violence offenders who abuse alcohol or drugs compared with domestic violence offenders who did not abuse alcohol or drugs. Understanding police attitudes toward domestic violence offenders may have implications for police training and victim services in facilitating the use of the justice system in protecting women from partner violence.  相似文献

The National Crime Victimization Survey is used to examine factors that encourage and inhibit victims of domestic violence from calling the police. Victims of domestic violence are less likely than victims of other types of violence to call the police because of their privacy concerns, their fear of reprisal, and their desire to protect offenders, but they are more likely to call for self‐protection and because they perceive domestic assaults as more serious. As a result of these and other offsetting factors, victims of domestic violence are just as likely as other victims of assault to call the police.  相似文献

Police attitudes towards partner violence against women (PVAW) can play an important role in their evaluation and responses to this type of violence. The present study aims to examine ambivalent sexism and empathy as determinants of male police officers' law enforcement attitudes towards PVAW. The study sample was composed by 404 male police officers. Results suggested that male police officers scoring low in benevolent sexism expressed a general preference for unconditional law enforcement (i.e. regardless of the victim's willingness to press charges against the offender), whereas those scoring high in benevolent sexism expressed a preference for conditional law enforcement (i.e. depending on the willingness of the victim to press charges against the offender). Results also showed that police officers scoring high in empathy and low in hostile sexism were those who expressed a general preference for unconditional law enforcement. The presence of sexist attitudes and low levels of empathy among some police officers, and their influence on law enforcement attitudes, highlights not only the importance of specific training, but also the need to pay attention to the selection process of police officers dealing with PVAW.  相似文献

In recent years, increased attention has been focused on the victimization of women in domestic assaults. Several studies, derived from police reports, shelter populations, and general social surveys have documented the incidence and nature of this phenomenon. A companion discussion of the victimization of men in domestic assaults has been conspicuously absent. This article adds to our knowledge on domestic violence research by examining the incidence and correlates of male victimizations within the domicile. The findings are based on an analysis of approximately 6,200 cases of domestic assaults reported to law enforcement authorities and of national victimization data reported to the National Crime Survey.  相似文献

There is extensive research that addresses the role of police in responding to domestic violence calls. However, there has been relatively little attention to the factors that impel women to call the police during an incident of abuse. This paper investigates the role of alcohol and drugs in influencing women's utilization of the police for misdemeanor-level incidents of abuse, and is based on interview data from 419 abused women. Results indicate that women are significantly more likely to call the police when male partners use both alcohol and drugs, and when they are frequently drunk. Offender drunkenness, rather than the quantity or frequency of alcohol consumption, has a significant escalation effect on police utilization by victims of abuse.  相似文献

Although the perpetration of domestic violence by police officers has received more attention lately, little research has examined the topic. This study investigated common responses of police officers (n = 1108) to officer-perpetrated domestic violence case scenarios and the relationships between officer characteristics and such responses. Common responses included encouraging the victim to file a formal report, assisting in finding help for domestic abuse, and referring the offending officer to an employee assistance program (EAP) or counselor. Arrest was a likely response when officers were asked to imagine they witnessed a victim’s injuries and heard statements about an assault in a case scenario. Supervisors had the most victim-supportive responses, suggesting they may be very good trainers of front-line officers.  相似文献
