This survey of regulatory inspectors reveals a surprising number of threats and assaults being made against inspectors in the course of enforcing regulatory provisions. Contrary to conventional images of regulatory enforcement, inspectors in some agencies face violent resistance from regulatory offenders that is similar to the violent resistance encountered by police officers. These findings provide support for the contention that regulatory enforcement and policing should be conceptualized as overlapping forms of law enforcement rather than as distinct governmental activities.  相似文献

警察人性化执法,是指警察在执法过程中,在依法保障当事人合法权益的前提下,依照法定的职权和法定的程序,改变执法观念和执法方式,以人为本,实现执法公正的一项专门活动。在警察人性化执法中,严格执法是前提,依法保障当事人的合法权益(包括警察自身的合法权益)是核心内容,人文关怀是方式,实现执法公正是终极目标。而"懦弱执法"、"人情执法"、"不平等执法"和"首次不罚"的执法都不是警察的人性化执法。警察人性化执法实现的途径主要有三:一是完善公安法律制度;二是提高人民警察自身的素质;三是加强监督,从严治警。  相似文献

理念是学术界目前使用频率较高的一个概念。为了揭示警务战术理念的内涵,从词源学的角度分析了理念的含义。警务战术理念是对警务战术内在规律的认识的集中体现,同时也是对警务战术的看法和持有的基本的态度和观念,并通过警务战术的目标、要求、原则来实现。警务战术的目标就是为了实现执法安全,包括执法安全意识和警务程序意识两方面。警察战术原则指警察在警务活动中必须依法施策、规范设计;加一评估、防控为先;心态平和、弹性处变。  相似文献

The coevolution of private detective agencies and municipal police bureaucracies in mid‐nineteenth‐century Chicago arose from the breakdown of an older system in which the provision of law enforcement was delegated to local communities. The growth of anonymity and the presence of strangers in a city undergoing massive changes in transportation undermined this delegative system and created the perception of new public security threats. These threats were compounded by the mobilization of ethnicity in partisan politics. To address these new concerns, political and e conomic elites did not innovate, but turned to traditional practices like special deputization. The use of deputization allowed some law officers to sell their services as entrepreneurs to private firms, while also paving the way for a new bureaucratic police department. Networks of security providers locked in this transformation and made public and private policing alike a permanent feature of the city's institutional landscape.  相似文献

人民警察职业道德中的道德两难问题,主要有执法制度化与人性化的抉择、警察公权力与私权利的抉择、警察法定职责与社会角色泛化的抉择。究其原因,主要在于外部社会环境的复杂性、内部组织管理的缺陷及个体执法素质因素三个方面。解决道德两难问题,必须以法律为底线,具体对策包括推动法律与道德相协调、加强宣传舆论改善执法环境、加强警察执法权益的制度保障、加强警用装备设施建设、减少非警务活动、深化执法规范化建设六个方面。  相似文献

Many people are enthusiastic about the potential benefits of police body-worn cameras (BWC). Despite this enthusiasm, however, there has been no research on law enforcement command staff perceptions of BWCs. Given the importance that law enforcement leadership plays in the decision to adopt and implement BWCs, it is necessary to assess their perceptions. This is the first study to measure law enforcement leadership attitudes toward BWCs. The study relies on data collected from surveys administered to command staff representing local, state and federal law enforcement agencies in a large southern county. Among the major perceptual findings are that command staff believe BWCs will impact police officers’ decisions to use force in encounters with citizens and police will be more reluctant to use necessary force in encounters with the public. Respondents also believe that use of BWCs is supported by the public because society does not trust police, media will use BWC data to embarrass police, and pressure to implement BWCs comes from the media. Perceptions of the impact of BWCs on safety, privacy, and police effectiveness are also discussed.  相似文献

Policing counter terrorism is increasingly seen as key task for police forces spanning the entire spectrum of size and capability. However, in the case of many police forces, resource limitations, low threat levels and coordination with national level law enforcement have combined to limit the expansion of their counter terrorism efforts to things like minor increases in training and heightened awareness. There are however, at the other end of the spectrum, some city police forces that have drastically reorganized and reoriented their day-to-day operations in response to heightened threats. Relying on their unique access to resources, political autonomy and unique threat levels, New York City and London have internationalized their policing efforts in an unprecedented way. This article explores the similarities, differences and dynamics of this phenomenon.  相似文献

ABSTRACT

Despite the fact that LGBTQ individuals are at greater risk of victimization than the average citizen, the LGBTQ community’s relationship with law enforcement has been a turbulent one. Using a mixed-methods approach, including surveys, semi-structured interviews and observations of town hall meetings, and following the participatory action research framework, this study examines the interactions between the LGBTQ community and law enforcement, and the perceptions of police within the LGBTQ community. The current study demonstrates how members of the LGBTQ community continue to have negative experiences with police that adversely impact their perceptions of law enforcement. Moreover, the findings underline the importance of examining how multiple identities impact an individual’s experiences with and their perceptions of law enforcement. Expanding past research on this topic, this study offers an analysis based upon suggestions of the study’s participants of what steps must be taken in order to improve relations between these two groups.  相似文献
