Families struggling with a breakdown in communication, trying to control the behavior of an unruly child, or experiencing a crisis often look for outside help. Many families, particularly those without resources to pay for private support, turn to their local status offense system. Status offenders are young people charged with behavior unique to their status as juveniles such as running away, truancy, or disobedience. In 2007, Congress will begin to consider reauthorization of the Juvenile Justice Delinquency Prevention Act (JJDPA), the federal act related to status‐offender policy. By providing an overview of recent state status‐offense legislation and case law, this article identifies issues to be addressed by Congress in reauthorizing the JJDPA.  相似文献

Developmental psychopathology emphasizes the impact that early childhood maltreatment has on adolescent and early adult development. The life‐course perspective, however, emphasizes more proximal events—adolescent maltreatment, for example—as developmentally disruptive. Prior research suggests that childhood maltreatment is a risk factor for adolescent delinquency and drug use. However, the results appear to depend on a loose definition of childhood. This study utilizes a four‐category maltreatment classification—never, childhood‐only, adolescence‐only, and persistent—to re‐examine the maltreatment‐delinquency relationship. Using data from the Rochester Youth Development Study, we find no relationship between childhood‐only maltreatment and adolescent delinquency or drug use; yet, we do find a consistent impact of adolescence‐only and persistent maltreatment on these outcomes.  相似文献

The article discusses a proposed universal adoption of comprehensive family law subject matter jurisdiction, inclusive of end‐of‐life (EOL) cases, as articulated in the unified family court (UFC) concept. It posits, using the Schiavo matter to illustrate the difficulties inherent in EOL disputes, that contested EOL cases are unlike other civil court cases in that they involve intimate facts and emotionally laden family dynamics. As such, these cases pose a distinctive challenge for the courts. The article suggests that contested EOL cases should be heard in a UFC because UFCs include alternative dispute resolution (ADR) protocols to deescalate family strife with the goal of facilitating out‐of‐court settlements and that litigation is an imperfect solution for an EOL dispute. It is also noted that judges presiding in UFCs are more experienced in handling fractious family matters and thus they are more likely to avert protracted litigation if the matter is not settled via ADR.  相似文献

Although prior work has substantiated the role of external attributes in juvenile court decision making, no study to date has examined how family situational factors as well as maternal and paternal incarceration affect juvenile court officials' responses to troubled youth. Using quantitative and qualitative juvenile court data from a large urban county in the southwest, this study draws on attribution theory to examine how family structure, perceptions of family dysfunction, and parental incarceration influence out‐of‐home placement decisions. Findings reveal that juvenile court officials' perceptions of good and bad families inform their decision making. This study emphasizes the need to unravel the intricate effects of maternal and paternal incarceration and officials' attributions about families and family structure on juvenile court decision making.  相似文献

Congress passed the Adoption and Safe Families Act of 1997 (ASFA) as a response to children waiting in foster homes for years without permanent placement. In addressing the problem of permanency, however, Congress set a strict limit on how long a child could be in foster care (15 out of the most recent 22 months) before a state must either commence a proceeding to terminate parental rights or else lose valuable federal funding. Due to health care funding schemes and quality of treatment, this requirement, in particular, negatively impacts parents currently in drug rehabilitation whose parental rights may be permanently terminated before a realistic chance to recover is permitted. Although ASFA requires that states make “reasonable efforts” to keep families united, it does not define “reasonable efforts,” leaving parental rights and family unity subject to a chaotic interpretation of this requirement from state to state. “Reasonable efforts” should be interpreted to take into account current drug addiction and recovery research and drug court programs should be used to facilitate this goal. Research has shown that focusing on adequate treatment saves states money and improves the lives of children and their families, reducing the need for reliance on termination of parental rights.  相似文献

The advent of the modern “war on drugs” and its accompanying “lock 'em up and throw away the key” crime policies largely explain the evolution of mass incarceration in the U.S. and account for much of the emotional and psychological pain caused to children who have lost their parents to long prison sentences. It is by reducing reliance on incarceration to tackle the “drug problem” in the United States that there will be a positive impact on reducing the number of parents being separated from their children for inordinate amounts of time, thereby potentially reducing the negative emotional and psychological impact on children. Aiding parents combat their addiction outside of prison walls is perhaps to most sensible criminal justice policy in addressing the needs of children who are caught in the cross‐fire of the war on drugs. In the meantime, as policy makers review, assess, and, eventually, reform draconian drug laws and sentencing policies, it is imperative that front‐line service providers who work with children and family and juvenile court judges be mindful of the emotional and psychological impact that parental incarceration has on youth. A more in‐depth understanding of the complexities of these young people's life experiences will hopefully enable the development of appropriate support services.  相似文献

Educators, parents, and community services partnered with the family court judge to implement the Truancy Court Diversion Program (TCDP). TCDP significantly impacted unexcused absences, unexcused tardies, and academic performance of the elementary and junior high students participating in the program. Elementary participants were more likely to maintain their improved attendance following participation than were junior high participants. Nonetheless, junior high participant grade point averages increased during TCDP and were maintained subsequent to TCDP. TCDP was an effective intervention for improving attendance and academic performance and helping preclude future delinquency.  相似文献

Applying Dickey-Fuller time series techniques in tandem with intuitive plot-displays, we examine recent trends in girls' violence and the gender gap as reported in four major sources of longitudinal data on youth violence. These sources are arrest statistics of the Uniform Crime Reports, victimization data of the National Crime Victimization Survey (where the victim identifies sex of offender) and self-reported violent behavior of Monitoring the Future and National Youth Risk Behavior Survey. We find that the rise in girls' violence over the past one to two decades as counted in police arrest data from the Uniform Crime Reports is not borne out in unofficial longitudinal sources. Several net-widening policy shifts have apparently escalated girls' arrest-proneness: first, stretching definitions of violence to include more minor incidents that girls in relative terms are more likely to commit; second, increased policing of violence between intimates and in private settings (for example, home, school) where girls' violence is more widespread; and, third, less tolerant family and societal attitudes toward juvenile females. These developments reflect both a growing intolerance of violence in the law and among the citizenry and an expanded application of preventive punishment and risk management strategies that emphasize early identification and enhanced formal control of problem individuals or groups, particularly problem youth.  相似文献
