Offenders with antisocial traits are relatively likely to attempt suicide, largely because they are more likely to have high negative emotionality and low constraint. Among 682 male offenders, we tested whether negative emotionality, low constraint, and also substance use problems mediated any relationship between antisocial personality disorder (ASPD) and psychopathy on the one hand, and suicide-related behavior (SRB) and ideation on the other. ASPD and the impulsivity/lifestyle features of psychopathy weakly predicted SRB. High negative emotionality and low constraint (but not substance use) mediated the relation between ASPD and SRB. Impulsivity/lifestyle features of psychopathy retained an independent predictive effect. Self-report psychopathy measures added unique predictive variance to the Psychopathy Checklist—Revised. We discuss implications for suicide risk assessment and prevention.

Building on a handful of studies demonstrating battered women’s accuracy in assessing their risk of being physically reabused, this study examined how accurately victims assess their risk of future psychological abuse. Participants’ ratings of the likelihood that their partner would engage in controlling/dominance behaviors or efforts to humiliate/degrade them in the coming year and their reports 18 months later of whether this had actually occurred were used to create a four category version of accuracy (true positive, false positive, true negative, false negative). Victims were more likely to be right than wrong in their assessments of risk; PTSD symptoms, the recency of physical violence, and the degree of stalking and psychological abuse in the relationship predicted membership in the four accuracy categories. These findings overlap considerably with those examining victim accuracy in predicting physical abuse and inform ongoing debates about the value of incorporating victims’ insights into risk assessment efforts.

In the experience of stalking victims a common element is the fear of physical violence. Until now risk factors that predict physical violence within stalking contexts have been carried out in relatively small, clinical-forensic samples. Consequently, the validity and practical utility of these risk factors in the law enforcement context remains unknown. Furthermore some risk factors have been identified in this research on the basis of information that is not available for or difficult to detect by the police in an early stage of the law enforcement process. The identification of risk factors of physical violence in stalking incidents in an early stage by the police was the subject of the presented study. Risk factors are identified based on literature, content analysis of police records and by testing interaction terms. Therefore 204 judicial files were analyzed, resulting in a five factor model predicting physical violence. Theoretical and practical implications of these findings are discussed.

The power few: experimental criminology and the reduction of harm   总被引:1,自引:0,他引:1  
The promise of experimental criminology is finding ways to reduce harm from crime and injustice. The problem of experimental criminology is that so few experiments produce evidence of big effects from the interventions they test. One solution to this problem may be concentrating scarce resources for experiments on the “power few:” the small percentage of places, victims, offenders, police officers or other units in any distribution of crime or injustice which produces the greatest amount of harm. By increasing the homogeneity and base rates of the samples enrolled in each experiment, the power few hypothesis predicts increased statistical power to detect program effects. With greater investment of resources, and possibly less variant responses to greater dosages of intervention—especially interventions of support, as distinct from punishment—we may also increase our chances of finding politically acceptable interventions that will work.

This article provides the background to an international project on use of force by the police that was carried out in seven countries. Force is often considered to be the defining characteristic of policing and much research has been conducted on the determinants, prevalence and control of the use of force, particularly in the United States. However, little work has looked at police officers’ own views on the use of force, in particular the way in which they justify it. Using a hypothetical encounter developed for this project, researchers in each country conducted focus groups with police officers in which they were encouraged to talk about the use of force. The results show interesting similarities and differences across countries and demonstrate the value of using this kind of research focus and methodology.

Considering earlier research into police use of force as well as the judicial and practical frame of police work in Germany, the article presents the results of an empirical study on the individual and collective legitimization of the use of force by German police officers. There are numerous justifications for the use of force expressed by focus group participants in eight German Federal States who were responding to a hypothesized scenario. In the discussions observed within the groups, reference is first made to the state’s duty to prosecute alleged offences and the measures or formal actions to do this—hence, the legal authority to use force. In the course of the discussions, however, it became obvious that illegal violence may occur, although it was not perceived as such by the officers. Overall, and after an intensive analysis of the focus group discussions, it can be stated that use of force (whether legal or not) depends on the police officer’s perception of the resistance of the person being engaged with. In this regard, different social–cultural or physical–material factors can be identified. They have different influences on the individual legitimization of police actions, intertwined with the perception of the situation as constructed by the officer. Three ways of perceiving the situation can be deduced, resulting in different patterns of justification for the use of force.

The goal of scientific work is to understand more and more by less and less. In this effort, theoretical unification plays a large part. There are two main types of theoretical unification—unification of different theories of the same field of phenomena and unification of theories of different fields of phenomena. Both types are usually a surprise; even when vigorously pursued, their form, when they finally appear, may differ radically from preconceptions. This paper examines a series of 21 unification surprises in the study of justice and beyond, 16 in the study of justice and 5 in the unification of 3 fundamental sociobehavioral forces—justice, status, and power—and the subsequent unification of the three sociobehavioral forces with identity and with happiness.

The European Directive on Waste Electric and Electronic Equipment 2002/96/EC distorts incentives in regulated markets. Treatment of ‘historical waste’—i.e. products sold prior to 13 August 2005—is financed by all firms in the market at the time of disposal. This stimulates excessive pre-regulation output by incumbents for two reasons: a costs sharing effect and entry deterrence. Entry deterrence is achieved by raising the common costs of waste disposal. Entry is a main driver of innovation in the affected industries. The feasibility of a first best policy is discussed and an alternative rule superior to the status quo is presented.

The role of the United Nations in global environmental governance was determined in 1972 when a new international body for the global environment was created as a programme within the United Nations rather than as an autonomous specialized agency. A set of political dynamics between developed and developing countries led to the decisions on the functions, form, financing, and location of the new intergovernmental organization—the United Nations Environment Programme. This article traces the historical roots of these choices and exposes the motivations behind them.

Stalkers engaging in persistent campaigns of harassment have the potential to cause immense harm to their victims and themselves. Being able to estimate which stalkers are likely to persist longest is important to clinicians dealing with both perpetrators and victims. This study of 200 stalkers investigated characteristics of the stalkers and their behaviour that were associated with increased persistence. Logistic regression models were developed to predict low, moderate, and highly persistent stalking. The results supported previous research indicating that the type of prior relationship between stalker and victim is strongly associated with persistence, with prior acquaintances the most persistent, and strangers least. Being aged over 30, sending the victim unsolicited materials, and having an intimacy seeking or resentful motivation was also associated with greater persistence, as was the presence of psychosis.

This is a slightly revised text of Jeffrie G. Murphy’s Presidential Address delivered to the American Philosophical Association, Pacific Division, in March 2006. In the essay the author reconsiders two positions he had previously defended—the liberal attack on legal moralism and robust versions of the retributive theory of punishment—and now finds these positions much more vulnerable to legitimate attack than he had previously realized. In the first part of the essay, he argues that the use of Mill’s liberal harm principle against legal moralism cannot be cabined in such a way as to leave intact other positions that many liberals want to defend—in particular, certain fundamental constitutional rights and character retributivism in criminal sentencing. In the second part of the essay, he expresses serious doubts—some inspired by Nietzsche—about the versions of character retributivism that he had once enthusiastically defended and now describes himself as no more than a “reluctant retributivist.”

Victimization incidence rates produced from the National Crime Victimization Survey (NCVS) are a generally accepted annual indicator of the amount and type of crime in the United States. However, persons who report a large number of similar victimizations—known as series victimizations in the NCVS—are currently excluded in government reports of annual violent victimizations. This paper quantifies the effect of series incident counting procedures on national estimates of violent victimization. The findings suggest that these high-volume repeat victims can have a significant impact on the magnitude and distribution of violent victimization. Current government counting rules that exclude series incidents do not include about three out of every five violent victimizations and distorts the characterization and risk of violence in the United States. However, the inclusion of series incidents introduces significant estimate instability. One remedy is to use prevalence rates in concert with incidence rates to present a more complete and reliable picture of victimization.

Accurately predicting inpatient aggression is an important endeavor. The current study investigated inpatient aggression over a six-month time period in a sample of 152 male forensic patients. We assessed constructs of psychopathy, anger, and active symptoms of mental illness and tested their ability to predict reactive and instrumental aggression. Across all levels of analyses, anger and active symptoms of mental illness predicted reactive aggression. Traits of psychopathy, which demonstrated no relationship to reactive aggression, were a robust predictor of instrumental aggression. This study (a) reestablishes psychopathy as a clinically useful construct in predicting inpatient instrumental aggression, (b) provides some validation for the reactive/instrumental aggression paradigm in forensic inpatients, and (c) makes recommendations for integrating risk assessment results into treatment interventions.

Mainstream criminology has traditionally focused on poverty as an isolated variable, whose effects are typically explored by inserting a limited measure of this variable in a multivariate analysis. Peacemaking criminology, however, offers an alternative perspective. In this paradigm, poverty is seen as a source of suffering and, to a degree, a “crime” in and of itself. Furthermore, the suffering poverty engenders is an enveloping social experience that exposes its victims to concentrated disadvantage—or, to use Jonathan Kozol’s (1991) term, to a range of “savage inequalities.” Thus, poverty is best understood not as an isolated variable, but as a master status of fundamental social reality that subjects people to lives filled with suffering—suffering that can engender criminal behavior. From a peacemaking perspective, a key avenue for preventing crime is, in the short run, diminishing the suffering poverty causes and, in the long run, embracing social policies that reduce the prevalence of economic suffering in contemporary society.

The world studied by empirical criminal justice research is babble—a congeries of voices whose meanings represent many normative worlds. Our research designs provide a frame for the babble, and our statistics codify and simplify it. We provide analytic portraits of it and, using the substantive language of crime control, give those portraits meaning. Yet, those meanings are located in a crime control discourse that de-legitimizes and destroys those normative worlds. This paper, an interpretive montage, is a collection of fractured narratives assembled to show that interpretation has something to offer the way we think about knowledge production in the field of criminal justice. It is also a cautionary tale to students in criminal justice, to remember that our scientific abstractions are an abstraction from the underlying realities of human life, not a “deeper” or in some way more real understanding. Our aim is to move the babble—the humanity from which the voices emerge—back into the foreground of justice research.

Using four categories of accuracy (true positive, false positive, true negative, false negative), this study explored (1) how accurately intimate partner violence (IPV) victims are able to assess their risk of re-abuse; and (2) potential predictors of accuracy. Women seeking help for IPV (N = 246) rated the likelihood that they would experience physical re-abuse in the coming year and then reported 18 months later whether those risks had been realized. Victim assessments were more likely to be right than wrong, and were subject to neither a pessimistic nor optimistic bias. In the multivariate analysis, significant/marginally significant predictors of the accuracy categories were the history of violence from this and former partners, level of substance use, PTSD symptoms, and the recency of the violence. Among the more robust findings were the connection between level of stalking and true positives, and between substance use and false negatives. This study suggests that victim assessments have significant potential to inform practice, and deserve further exploration.

After decades of neglect, a growing number of scholars have turned their attention to issues of crime and criminal justice in the rural context. Despite this improvement, rural crime research is underdeveloped theoretically, and is little informed by critical criminological perspectives. In this article, we introduce the broad tenets of a multi-level theory that links social and economic change to the reinforcement of rural patriarchy and male peer support, and in turn, how they are linked to separation/divorce sexual assault. We begin by addressing a series of misconceptions about what is rural, rural homogeneity and commonly held presumptions about the relationship of rurality, collective efficacy (and related concepts) and crime. We conclude by recommending more focused research, both qualitative and quantitative, to uncover specific link between the rural transformation and violence against women. I take it as obvious that attempts to justify the criminal law must be sensitive to matters of criminalization—to what conduct is proscribed or permitted. I discuss three additional matters that should be addressed in order to justify the criminal law. First, we must have a rough idea of what degree of deviation is tolerable between the set of criminal laws we ought to have and the set we really have. Second, we need information about how the criminal law at any given time and place is administered, since the law in action is bound to differ radically from the law on the books. Finally, we must have some basis for speculating what life would be like in the absence of a system of criminal justice—if the state ceased to impose punishments.

Even without the protection of the state and courts, illegal drug markets are generally peaceable. However occasionally specific markets exhibit high levels of violence. This essay examines the sources that might generate such violence, some internal to organizations (successional and disciplinary), some between organizations (territorial or transactional) and others between drug dealers and the state or its representatives. Particular attention is given to the extremely high rates of killing in the high level Mexican drug markets in 2007–2008 and what motivates the variety of targeted victims, including innocent parties and corrupt officials. The other episode examined in detail is the US crack market in the 1980s. The emphasis here is on the youth of the participants, the value of the drug itself and the intensity of law enforcement.
