将罪数论升级为竞合论,关键在于要使罪数论的定罪量刑功能转变为竞合论的量刑功能。想象竞合是竞合论中最为重要的成员,它是一个针对自然行为犯数罪如何量刑的理论。在对想象竞合行为定罪时,犯罪构成仍是定罪的惟一标准,因此想象竞合为数罪,在判决书中,要将数罪一一列明。如果对想象竞合数罪并罚,就否定了其存在的必要性。不能对想象竞合数罪并罚的理由,就是想象竞合的存在根据。想象竞合的数罪中,不法量刑情节与特殊预防必要性的情节高度重合,数罪并罚会造成量刑中的重复评价。较轻的一罪在想象竞合的量刑中仍具有一定的发言权,即宣告刑不能低于轻罪的最低刑,同时必须考虑轻罪的附加刑。  相似文献

It is not unusual that one or all parties commit a genuine mistake when making contracts. While there is the strict general duty under the law to respect agreements, there equally exists the duty for courts and tribunals to be fair and to render commercial justice in the factual matrix of cases before them. In national legal systems and transnational law regimes, rescission for mistake on economically efficient and just terms is embedded in contractual obligations. The Solle v Butcher (1950) doctrine, which represented the English law approach, was rejected in The Great Peace (2002). Potential conflicts and crises now exist in commercial relations and international dispute resolution when ‘English law’ is the applicable law. This extends to jurisdictions where English decisions are highly persuasive. This article examines the correctness and effect of The Great Peace decision on the doctrine of equitable rescission for genuine mistake as propounded in Solle v Butcher, and possible clarifications needed after the complications brought by The Great Peace. It analyses the conceptual importance of the remedy of equitable rescission for mistake in commercial transactions, and identifies serious substantive errors of law by The Great Peace court. Finally, it provides other effective, fair and efficient legal methods that remain available to avoid the weaknesses of the decisions.  相似文献

This article dissects the Tadi court's argument for findingthe doctrine of joint criminal enterprise in the ICTY Statute.The key arguments are identified and each are found to be eitherproblematic or insufficient to deduce the doctrine from thestatute: the object and purpose of the statute to punish majorwar criminals, the inherently collective nature of war crimesand genocide and the conviction of war criminals for joint enterprisesin World War II cases. The author criticizes this over-relianceon international case law and the insufficient attention tothe language of criminal statutes when interpreting conspiracydoctrines. The result of these mistakes is a doctrine of jointcriminal enterprise that fails to offer a sufficiently nuancedtreatment of intentionality, foreseeability and culpability.Specifically, the doctrine in its current form suffers fromthree conceptual deficiencies: (1) the mistaken attributionof criminal liability for contributors who do not intend tofurther the criminal purpose of the enterprise, (2) the impositionof criminal liability for the foreseeable acts of one's co-conspiratorsand (3) the mistaken claim that all members of a joint enterpriseare equally culpable for the actions of its members. The authorconcludes by briefly suggesting amendments to the Rome Statuteto rectify these deficiencies.  相似文献

Abstract

The high seas is one of the last remaining commons on the planet, but comprehensive efforts to save this area beyond national jurisdiction have not been successful. This article examines the feasibility of applying the public trust doctrine to the high seas by first evaluating tools that are currently in place to protect biodiversity then analyzing the public trust doctrine in its traditional application in the United States and other countries. 外在的制度性诱因和内在的观念性诱因促成了当下持续攀升的涉法涉诉信访案件。此类信访不仅打破了司法救济的最终性,人治色彩浓厚,而且因处访机构众多、效率低下、处访程序失范、救济成本高昂等屡遭诟病。但在司法公信力低下、权利救济机制尚不健全的今天,相比终止信访的救济功能而言,结合我国实际情况,有针对性地改善现有信访制度,使其适应我国转型期的特殊需要,似乎来得更为妥当。  相似文献

Trademark dilution law, a relatively recent innovation in federal trademark doctrine, has serious implications for free expression. Dilution law purports to protect famous trademark owners from blurring and tarnishment, although critics of the doctrine suggest the harms of dilution are frequently overblown, if not imaginary. This article first highlights the differences between standard trademark infringement and trademark dilution, including the fair use provisions of the latter statute. It then analyzes the conceptual mismatch between the fair use provisions and dilution, focusing particularly on the problems with the nominative fair use doctrine. The article also explores the special problems dilution doctrine creates for parodists, including some court decisions that protect only an extremely narrow range of parodies. Finally, the article offers concluding perspectives on this difficult area of trademark doctrine.  相似文献

由于合理使用处在权利与限制的交界处,其适用范围的任何变化,都可能重塑著作权法。面对新技术的冲击,在确定合理使用的适用范围时,不能因技术的便利而干涉著作权市场对信息资源的配置,而应恪守合理使用最初的立法理由,将其定位为对市场失灵的弥补,在利用行为有助于公共利益的基础上,考察其是否符合交易不能或正外部性市场失灵,同时把对作品潜在市场的影响视为最关键的判断标准。这不但维护了著作权的私权属性,更是界定合理使用适用范围的最佳路径。  相似文献

To protect what it deems fundamental rights, the Supreme Court strictly scrutinizes legislation that impinges on these rights. The Court views such legislation as a means to some end the legislation seeks to accomplish. The Court requires that the statute be neither overinclusive nor underinclusive; the legislation may not affect more people than necessary to achieve its end, nor is the statute permitted to leave some people out in achieving its end.I argue that when legislation imposes burdens, its underinclusiveness is irrelevant, and that when it dispenses rewards its overinclusiveness is irrelevant, because those affected by the statute areex hypothesi deserving. One commits thetu quoque fallacy when one tries to infer that those affected by the law are undeserving from the fact that some deserving individuals were not affected by the statute.I show concretely how the Court has erred in specific cases. I also point out how the doctrine of judicial review prevents the Court from availing itself of the remedy that logic would demand.Lastly, I consider the possibility that the Court uses the doctrine of strict scrutiny to strike down legislation that the Court suspects has an impermissible motive. I conclude that if the Court has evidence of an impermissible motive, it could present an inductive argument for such a motive and strike the legislation down for that reason. 现代风险社会给人们带来更多的不确定性和不安全感,传统侵权法律制度在面对不断涌现的新型侵权行为以及灾难性、大规模的人身损害事故时存在局限性。对此,我国《侵权责任法》在功能定位、保障范围、加害事由、归责原则等方面的制度设计,对风险社会的现实状况和生活形态作出了回应,尤其强化了侵权法的救济功能。侵权法的这种制度变化改变了我国责任风险的原有形态;同时,在侵权法律体系内也不可能完全解决对受害人的赔偿和救济问题,由此给责任保险和社会保障制度提供了更大的发展空间。在以侵权法、责任保险和社会保障为主体的多元救济体系中,各项制度之间应注意协调,避免赔偿不足或赔偿过度。  相似文献

Abstract

Climate change is a global problem resulting from our aggregate emissions. The United States has failed to take significant action on a federal level to address our country’s contributions. There are options available at the state and local levels to reduce emissions and to prepare for the effects of climate change. However, the commerce clause and the doctrine of federal supremacy may bar states and municipalities from adopting those strategies. This article discusses tactics to circumvent those restrictions, and potential changes to commerce clause jurisprudence that would give states and municipalities greater flexibility to act where Congress has not.  相似文献

For more than a half‐century, as the cornerstone of federal broadcasting and telecommunications policy, the public interest standard has always been subject to some debate. Questions have regularly been raised about its meaning and the extent of the authority it implies for regulation, particularly in the deregulatory environment of the 1980s and 1990s. Part I of this study demonstrated how a deep reading of the pre‐broadcasting state and federal regulatory history reveals that interpretations of the public interest standard that have emphasized broad, diverse, public service programming have entailed a misunderstanding of its real, underlying meaning. This part of the study shows how another definition—i.e., that the public would be best served by protecting economic viability and technological advancement for private industry broadcasters—developed as the predominant doctrine before adoption of the Radio Act of 1927 and Communications Act of 1934, and how that theme came to be the applied interpretation of the public interest during the first two decades of broadcast regulation.  相似文献

The public trust doctrine provides protection of public access to resources, such as navigable waterways, protected under the public trust. The doctrine has evolved over time to protect natural resources such as tidelands, submerged waterbeds, wildlife, and climate change. Juliana v. United States is a groundbreaking trust case that moves the application of the trust to the management of climate-change regimes. Although the doctrine has been criticized as a façade, forestalling real recourse for change, it can be used to show standing for current and future generations. Abstract

This paper critically discusses an extremely influential multi-factorial theory of child molestation, Finkelhor's Precondition Model. This model was one of the first comprehensive theories of the sexual abuse of children and represents a significant achievement. It provides a clear framework for approaching the study of men who have sexually abused children and has lead to both clear treatment goals and clinical innovations. It has rarely, however, been systematically critically examined and the cogency of its core constructs evaluated. Our analysis suggests that alongside its strengths, Finkelhor's Precondition Model has some conceptual problems. It suffers from vagueness; contains overlapping constructs; and a rich array of vulnerability factors that require teasing out and clarification. The model's attempts to provide a taxonomy highlight the diversity inherent in child sexual abuse, but it has not yet provided a structure to adequately inform treatment.  相似文献

Of all Westminster‐type representative assemblies, Canada's presents an unusually high number of cases where parties rank equal in second place, disputing the role of official opposition, both in the aftermath of an election or during a parliamentary session when party fortunes change. Although exceptional, the phenomenon is not at all uncommon; however, the uncertainty that characterises each of its occurrences indicates that no general rule has ever been drawn from doctrine or jurisprudence, as attested by the latest (1999) decision rendered by Speaker Scott in Nova Scotia. Thus, speculation persists whenever the situation presents itself. This paper attempts some rulings based on the distinction of context proper to 12 historical cases studied. It may help remove the uncertainty that plagues democratic systems in Canada as well as in any other Westminster‐type legislatures around the world.  相似文献
