The notion of ‘cognitive distortion’ has become enshrined in the offender treatment literature over the last 20 years, yet the concept still suffers from a lack of definitional clarity. In particular, the umbrella term is often used to refer to offence‐supportive attitudes, cognitive processing during an offence sequence, as well as post‐hoc neutralisations or excuses for offending. Of these very different processes, the last one might be the most popular and problematic. Treatment programmes for offenders often aim to eliminate excuse‐making as a primary aim, and decision‐makers place great weight on the degree to which an offender “takes responsibility” for his or her offending. Yet, the relationship between these after‐the‐fact explanations and future crime is not at all clear. Indeed, the designation of post hoc excuses as criminogenic may itself be an example of fallacious thinking. After all, outside of the criminal context, post hoc excuse‐making is widely viewed as normal, healthy, and socially rewarded behaviour. We argue that the open exploration of contextual risk factors leading to offending can help in the identification of criminogenic factors as well as strengthen the therapeutic experience. Rather than insist that offenders take “responsibility” for the past, we suggest that efforts should focus on helping them take responsibility for the future, shifting the therapeutic focus from post hoc excuses to offence‐supportive attitudes and underlying cognitive schemas that are empirically linked to re‐offending.  相似文献

Abstract

The present study examined the behavioural differences in sexual assault offences in relation to the offender–victim relationship (stranger versus non-stranger). These differences were examined specifically in the context of four interpersonal themes of interaction: dominance, submission, hostility and cooperation. The details of 100 sexual offence cases (50 stranger and 50 non-stranger) were content-analysed, generating 58 dichotomous variables, covering offender and victim behaviour during the offence. χ2 tests comparing the two samples found that offenders who were strangers to their victims were more likely than non-stranger offenders to display behaviours that indicate a hostile, violent offence style. In contrast, those offenders who knew their victims were more likely than strangers to display a less violent and more personal, compliance-gaining offence style. These findings are discussed in terms of their implications for offender rehabilitation and victim support.  相似文献

Abstract

This study explored a sample of 244 UK adult male offenders convicted of offences involving indecent images of children (IIOC): 120 had a previous contact child sexual offence (defined as dual offenders) and 124 had no evidence of an offence against a child (defined as non-contact offenders). Offender groups were compared regarding their socio-demographic characteristics, previous convictions and IIOC possession. Key discriminatory factors that differentiated dual offenders were: access to children, previous offence history, sexual grooming and possession of IIOC that depicts similar-aged victims. In contrast, non-contact offenders could be identified from their greater amount and wider range of IIOC possession. The results suggest a homology between Internet behaviours, IIOC possession and victim selection. Implications for law enforcement agencies are discussed in terms of assisting investigative prioritisation by identifying those most at risk of committing sexual abuse against children.  相似文献

Core cognitive schemas may play a role in the vulnerability for sexual offending. Identifying these schemas could help to conceptualize sexual crimes and rehabilitate convicted sexual offenders. The aim of this preliminary study was to explore the relationship between early maladaptive schemas (EMSs) and sexual offending, as well as how rapists and child sex molesters differ in terms of these schemas. Thirty-two men convicted for rape, 33 convicted for child sexual abuse, and 30 non-offenders were evaluated using the Young Schema Questionnaire (YSQ-S3) and the Brief Symptom Inventory (BSI). Results showed that participants convicted for child sexual abuse presented significantly more schemas from the disconnection/rejection, impaired autonomy/performance, other directness, and over vigilance/inhibition domains than non-offenders, whereas rapists presented more schemas from the impaired autonomy/performance domain than non-offenders. Differences between sex offenders showed that child molesters presented more schemas of pessimism than rapists. Preliminary findings suggested that EMSs may impact sex offender's perceptions about themselves and about the world. Schema-focused therapy (Young, 1990, 1999) may thus be an acceptable approach to sex offender's psychological assessment and intervention.  相似文献

Abstract

Personality disordered and mentally disordered sexual offenders (MDSOs) with complex diagnoses such as schizophrenia, developmental disorders and mood disorders face challenges of restoring their mental health, living more safely with personality- and offence-related risks, while addressing concerns about their capacity to reintegrate into society; this has been termed “secure recovery”. This paper reviews the literature on recovery, demonstrating its commonality with the Good Lives Model (GLM) as applied to MDSOs' offending treatment. GLM appears to provide a better fit with the recovery needs of MDSOs than the Risk–Need–Responsivity model because it emphasises approach goals, enhanced responsivity and skills acquisition. Recovery needs to integrate coping with mental disorders with risk management and a healthy, future lifestyle. Both secure recovery and GLM support the need for client–clinician collaboration, promoting self-determination and a shared narrative about coping with enduring risk and the hope of sustained well-being.  相似文献

ABSTRACT

Research that attempts to understand why young people commit sex crimes points to an array of family factors that may uniquely contribute to sexual offending over general juvenile delinquency. This study examines the potentially moderating role of disrupted caregiving in the relationship between offending and caregiver-child relationship quality. Two distinct moderators were tested: gender of caregiver and biological relationship between caregiver and child. Results indicate that juvenile sexual offenders have particularly poor relationships with their primary caregivers compared to incarcerated non-sexual offenders and community controls. Furthermore, sexual offenders with male caregivers were found to have lower relationship quality scores than sexual offenders with female caregivers. In contrast, sexual offenders raised by non-biological caregivers reported better relationship quality than did offenders raised by their biological parents. These findings suggest opportunities for early intervention, before caregiving is disrupted.  相似文献

ABSTRACT

This study examines the recidivism rates of Finnish child sex offenders convicted in 2010 (n = 361) over a follow-up period of seven years. The results indicate that while reoffending for other types of offences was common (34%), offenders had very low sexual crime recidivism rates (1%). In terms of more persistent criminal careers, less than a quarter of the offenders had both a previous criminal history and at least one subsequent offence during the follow-up period. Offenders with child sexual abuse material-related crimes reoffended more rarely than did others. Study limitations and implications for policymaking, media and rehabilitation are discussed.  相似文献

ABSTRACT

We compared a total of 340 sexual assault cases based on offender characteristics, victim characteristics, and offence behaviours to identify differences among sexual assaults committed by lone, double, and groups of three or more perpetrators in South Korea. Several differences were found among sexual assaults committed by varying numbers of offenders. First, lone, double, and groups of three or more perpetrators differed with respect to age, marital status, and employment status. Second, substantial differences in victim characteristics were observed with respect to age and the victim–offender (v–o) relationship. Third, significant differences in offence behaviours, including offence type, planning, method of approach, knife possession, and stealing property, were found. Furthermore, we identified several variables that significantly predict group size using logistic regression analyses. The study has theoretical implications for understanding how group dynamics influence the behaviours of rape perpetrators, and practical implications for victim treatment and offender intervention.  相似文献

Abstract

Despite the extensive research attention directed toward criminal peer groups, there has been little attention to the peer groups of sexual offenders. Sexual offenders are often considered to be loners who offend in isolation, but cases of sex crimes involving peer support are not difficult to find, e.g., child sex rings, gang rapes. To examine the role of peers in sexual offending, sexual offenders and nonsexual offenders were asked whether they knew other people who have committed sexual crimes. In comparison to the nonoffender community comparison group, the sexual offenders reported considerably more association and identification with sexual offenders. The associations also tended to be offence specific, such that child molesters knew other child molesters and rapists knew other rapists. These findings have important implications for the assessment and treatment of sexual offenders.  相似文献

ABSTRACT

This article reports on a study which focused on young sex offenders’ empathy levels for sexual abuse victims in general as portrayed in a case study, as well as empathy for the offenders’ own specific victims. Beckett and Fisher’s Victim Empathy Distortion Scale (1994) was used to measure and compare 96 young sex offenders’ empathy levels. The quantitative research results indicated that research participants displayed significantly less empathy towards their own victims when compared to the empathy displayed towards a general sexual abuse victim in a case study. Following the completion of the questionnaires, in-depth, qualitative data was obtained regarding the young sex offenders’ thoughts prior to, during and directly after committing the offence. In addition, they also explained their current thoughts and feelings for the victims in their case. The divergent responses which were given by the participants is a clear indication of the heterogeneous nature of youth sex offending.  相似文献

Abstract

This paper explores the arguments put forward for prohibiting the possession of fantasy images of child sexual abuse within the Coroners and Justice Act 2009, and applies them to sexual ageplay in Second Life. Sexual ageplay is the virtual act of simulating child sexual abuse using animated child characters operated by consenting adult users. The arguments underpinning the legislation centre on the issue of harm and the relationship between online, virtual behaviour and real world contact offences. It is argued that extant research does not support a causal connection, although some work on fantasy offence planning and online paedophilia chat groups suggests a link. Due to the lack of empirical work in the area it is concluded that legislation to criminalise such behaviour on grounds of harm causation is currently unjustified, although prohibition of sexual ageplay for known sex offenders is recommended. Further research into the extent, use and effects of sexual ageplay is required.  相似文献

This study aimed to examine the relationship of offenders' distress and responsibility with maladaptive personality traits, self‐esteem, and offence‐type. It also further validated the Distress and Responsibility Scale (DRS; Xuereb et al., 2009a, Pers. Individ. Diff., 46, 465). A new sub‐scale measuring social desirability was included and assessed in the DRS. Maladaptive personality traits and self‐esteem were measured in relation to the following predictions: (1) that maladaptive personality traits would positively correlate with distress (2) that self‐esteem would negatively correlate with distress and acknowledging responsibility. The sample was 405 male sexual, violent, and general offenders from a UK prison. Participants anonymously completed a questionnaire measuring the variables under investigation. The factor‐structure of the DRS was confirmed via Confirmatory Factor Analysis after minor changes. No significant differences in distress and denial of responsibility were found between sexual, violent, and general offenders. Maladaptive personality traits positively correlated with chronic and offence‐related distress, chronic self‐blame, and minimization of offence harm. Chronic and offence‐related distress and responsibility negatively related to self‐esteem. The study concludes that the DRS has reached stability, and that the social desirability scale increases the measure's validity. Assessment and treatment for offence‐related distress and denial of responsibility should be offered to all offence groups. Offenders would benefit from structured interventions to manage difficulties associated with maladaptive personality traits, including chronic distress and self‐blame. Finally, it was concluded that self‐esteem might serve a self‐defensive function for offenders.  相似文献

Abstract

The current study examines sexual and violent reoffence rates for a sample of 2474 sexual offenders over an average of 15 years following release from prison. Reoffence rates are reported as a function of the offenders' victim type and level of risk as assessed by the Automated Sexual Recidivism Scale, a computer scored measure of relevant historical risk factors. Observed sexual recidivism rates for offenders with child victims, adult victims, and mixed victims were quite similar. Results indicate that offenders with exclusively female child victims not only showed a lower rate of sexual reoffending, but that the reoffence rates were relatively low across all levels of actuarial risk. In contrast, those with male child victims and adult victims showed a pronounced escalation of reoffence rates as actuarial risk increased. Results also indicated that adult victim offenders are less consistent in the victim type of their reoffences, with 37% sexually reoffending against child victims. Finally, combined rates of sexual and violent reoffending were particularly high for those with adult victim sexual offence histories. Risk assessment and public policy implications are discussed.  相似文献

Since a substantial proportion of sexual offenders are not apprehended, researchers have introduced methods to test the propensity to sexually offend among the general public. Proclivity measures assess self-reported sexual interest in lone and multiple perpetrator sexual offending or rape (MPR), and can examine students and community members who indicate a proclivity to sexually offend. This study examines the role of pornography use and rape supportive cognitions to influence proclivity. Anonymous online data was collected from 295 male university students to assess the role of rape supportive cognitions and pornography use in predicting lone and MPR proclivity. Only rape supportive cognitions predicted scores on lone and MPR proclivity measures.  相似文献

Purpose. Although it has often been suggested that there is a direct relationship between an individual's sexual interests and behaviours exhibited during the crime they commit, few studies have investigated this question empirically. The purpose of the present study was thus to examine the role of sexual interests and situational factors as to their possible relationship to three components of rapists' modus operandi: (a) the level of organization of the offence, (b) the level of force used by the offender, and (c) the level of injury inflicted on the victim during the sexual assault. Methods. This study is based on a sample of 118 offenders who sexually assaulted a female aged 16 or over. All participants were assessed phallometrically and through the CQSA, a computerized questionnaire. Data were analysed using multiple regression analyses. Results. Our findings showed links between sexual interests, situational factors, and rapists' modus operandi. Firstly, individuals demonstrating a greater sexual interest in nonsexual violence showed a higher level of organization in the modus operandi. Secondly, alcohol consumption prior to the offence was related to a higher level of coercion. Finally, a negative emotional state prior to the crime was related to a high level of injury inflicted on the victim. Conclusions. Despite the fact that several authors postulated a direct link between the offender's sexual interests and his behaviour at the crime scene, our results only partially support this hypothesis. Moreover, our results partly support the fact that crime scene behaviour is related to offenders' personal characteristics, challenging an assumption of criminal profiling. We still believe that the modus operandi is related to offenders' personal attributes. It is, however, dynamic and may fluctuate due to certain situational factors related to offenders and victims. Future studies should take into account situational factors related to offenders and their victims.  相似文献

Abstract

Sexual coping, general coping and cognitive distortions were investigated in 25 rapists, 36 child molesters and 25 violent offenders. Rapists did not report more support for rape-supportive distortions than the violent offender comparison group. Child molesters scored higher than the other groups on the measure of molestation-supportive distortions, although mean scores were at the low end of the scale. Consistent with previous research, all offender groups reported ineffective coping styles and child molesters reported using more emotion-oriented coping than the non-sexual offenders. Child molesters but not rapists scored higher than violent offenders on deviant aspects of sexual coping, although mean scores were at the low end of the sub-scales. Evaluation of these comparisons was aided by effect sizes. The effect sizes reveal that there may indeed be differences between rapists and the comparison group with respect to cognitive distortions and sexual coping. Modest correlations were found between deviant sexual coping and cognitive distortions. The findings are interpreted in terms of etiological development and the sexual offence process.  相似文献

Abstract

To date, there has been limited examination of variables that influence sentencing in child sexual abuse cases. This study examines the extent to which offence characteristics (such as the number of offences, number and age of victims), the behaviour and perceived credibility of the victim impact upon both sentence length and the setting of earliest parole dates. Analyses conducted using data from 66 adjudicated cases of child sexual assault from the County Court of Victoria, Australia revealed that longer sentences were handed down to offenders who had perpetrated multiple offences, or who had committed offences against younger children. Lower levels of victim credibility were associated with shorter sentences and earlier parole dates for offenders, which were also associated with the presence of more harmful behavioural indicators of abuse. The findings are discussed regarding the importance of presenting evidence about the behaviour of victims following sexual abuse in criminal trials.  相似文献

Abstract

The principal aim of this study was to investigate whether attitudes towards judicial competency, legal liability, voluntariness of offence and judicial disposal options were influenced by known classification of an offender as learning disabled compared to an offender with a suggested intellectual disability, but not formally classified. Subsidiary aims were to explore participant attitudes based upon group membership and parental status. The sample consisted of 101 participants (69 undergraduate nursing students and 32 from the general population). Participants were requested to complete a questionnaire assessing their attitudes within the aforementioned domains and towards ascribed levels of victim parental responsibility. Fifty participants completed a questionnaire designed for the purpose of the study where the offence scenario depicted made reference to the offender having a formal classification of learning disability. Fifty-one participants completed the same questionnaire where an intellectual disability was suggested but not formally stated in the form of classification. Results indicated that classification did significantly influence attitudes in most domains irrespective of group. The nursing group attributed greater levels of competency to the offenders depicted. No interactions between variables were observed. The reasons for and implications of these findings, limitations and recommendations for future research are explored.  相似文献
