One. On the constitutional principle for human rights In March 2004, the Constitution of the People's Republic of China was revised at the Second Session of the Tenth National People's Congress (NPC). The clause that "The state shall respect and protect human rights" was written into the Constitution for the first time, thus making the policy of the Chinese government and the ruling Communist Party for respecting and protecting human rights a constitutional principle and the will of the people and the state. Law is the fundamental method of governance and the rule of law symbolizes modern civilization. The socialist rule of law is the rule of law rooted in the Chinese tradition, and designed and led by the Communist Party of China(CPC). It is not only a tool for government, but also a driver of social progress. Meanwhile, the Chinese human rights system is also designed by the CPC. Both concepts—the socialist rule of law and the human rights system——are different from the West in terms of theory, path and systems. Human rights are the fundamental values of and the ultimate goal pursued by the rule of law; and the rule of law is the recognition of and guarantee for human rights. The ESCR Committee considered China’s second Report on the Implementation of ICESCR on May 8,2014.During the last reporting period,China had made tremendous achievements in such areas as the formulation of a National Human Rights Action Plan,abolition of the Re-education Through Labor(RTL)system,implementing the right to social security and free compulsory education.In the consideration,the ESCR Committee raised old issues such as establishment of a national human rights institution,direct domestic application of the ICESCR and trade union rights as well as new ones such as human rights protection in international development or investment projects in developing countries.Nevertheless,the ESCR Committee also made a few recommendations that are not entirely appropriate,including abolition of the household registration system and family planning policy.Meanwhile,the Chinese delegation committed a few inaccuracies in describing the Chinese legal system.  相似文献

Comparative analysis of China’s human rights white papers provides a valuable perspective on changes in the official human rights discourse. In terms of their structures, the white papers can be divided into three types: the mixed model, the five-in-one model and the rights-list model. The rights-list model has a consistent style, standard terminology, and an arrangement of rights in line with China’s reality. In terms of contents, the right to subsistence has been gradually reduced and the right to development is increasing. In the 2013 white paper, there was a whole chapter on social security rights, which highlights China’s social development and the priority placed on the people’s wellbeing. The right to development and social security will become a new focus of human rights discourse in China.  相似文献

Asix-member delegation of the China Society for Human Rights Studies (CSHRS) headed by Deputy President Jin Jian paid a visit to Britain, France, Morocco and Egypt in December 10-27, 2002. This is the first delegation organized by CSHRS to visit the four countries and also the first such delegation visiting developing countries. The delegation made wide contacts in the four countries and exchanged views on human rights with officials, parliamentarians, non-governmental organizations, academic organizations and the media. The "2018·China-Europe Seminar on Human Rights" was successfully held at the College of Europe in Bruges, Belgium, on June 28. The seminar was hosted by the China Society for Human Rights Studies and the International Institute of Human Rights, and was organized by the Human Rights Institute at the Southwest University of Political Science and Law and the French ADELIE Language and Cultural Exchange Association. The University of Strasbourg, Vrije Universiteit Brussel and European Institute for Political and Strategic Communication were served as co-organizers. Over 60 experts and scholars in the field of human rights from China and Europe attended the seminar in search of the diversity of civilization and human rights protection, focusing on themes such as "the philosophy of human rights in a Chinese context", "the philosophy of human rights in the Universal Declaration of Human Rights and its reflection", "human rights theory and practice in a pluralistic world", "human rights exchanges and dialogues under the diversity of civilization", and "in search of human rights consensus in diverse civilizations." IN 2013,China launched a series of impressive reforms in its judicial field.These included:deepening judicial publicity to guarantee people’s rights to information and develop transparency;improving the judicial accountability system to ensure the independent exercise of jurisdiction and procuratorial power,letting the inquisitor judge and the adjudicator take charge;and abolishing the system of re-education through labor as well as improving laws on punishment and correction of crimes and delinquencies,thereby manifesting the judicial assurance of human rights.By means of these reforms,China’s judicial system has realized new breakthroughs,providing strong support for the country to build a fair,efficient and authoritative socialist judiciary.  相似文献
