This article describes the activities related to civil society'sengagement with the question of security sector reform (SSR)in Liberia since the signing of the Accra Comprehensive PeaceAccord (CPA) in August 2003, identifies the challenges it facesand draws lessons learned from this engagement; particularlythe need to develop local capacity, networks of support andnational ownership. Consideration is given to the specificsof the rapidly evolving post-conflict context in which suchreforms are taking place and their connection to the field oftransitional justice as a means of addressing a history of humanrights abuses. The discussion also covers the scope of potentialengagement for civil society in the new political landscapein Liberia that has been created by the deployment of one ofthe world's largest peacekeeping forces and the arrest of formerpresident Charles Taylor.  相似文献

Abstract

The security situation in Liberia is currently quite good, and at a glance the peacebuilding process seems to be moving ahead. However, the root causes of the conflict have not been adequately addressed, but have in fact become more interlinked in the aftermath of the civil war. Instead of addressing local perceptions of insecurity the international community made plans for Liberia without considering the context in which reforms were to be implemented. The peace in post-conflict Liberia is therefore still fragile and the international presence is regarded as what secures the peace. Still, the UN is supposed to start its full withdrawal in 2010—indicating that the international community will leave the country without addressing the root causes of conflict.  相似文献

This article explores the potential applicability of transitionaljustice ideas to the Israeli–Palestinian context. I arguethat given the particularities of the Israeli–Palestiniansetting, truth and reconciliation would be an essential componentof peacemaking even though this is an inter-societal conflictwhich will likely be resolved only through separation into twostates. Nevertheless, the interstate nature creates challengesto the application of common transitional justice mechanisms.In response to these challenges I offer a model based on anincremental process of narrow mechanisms throughout a long processof transition, rather than one high-profile all-encompassingmechanism in the post-conflict stage. I also suggest that inaddition to issues to be explored jointly by the two societies,such as refugees, prisoner release and compensation for victimsof violence, there could also be internal truth and reconciliationprocesses within each society. Finally, this model is premisedon an important role for civil society initiatives.  相似文献

Civil society actors are assumed to play an important part in post-conflict peacebuilding; therefore, the international community pushes for civil society participation already during peace negotiations. However, the actual connection between civil society’s participation in those negotiations and its role in implementation processes remains unclear. Taking the Central American peace processes of the late 1980s and early 90s as a case study, this article compares civil society participation in peace negotiations and provisions for civil society involvement for the implementation phase, with the actual role that the civil society played in the implementation processes in Nicaragua, Guatemala and El Salvador. The article questions the importance of including civil society actors in the negotiation process since the level of civil society inclusion in, activism during and influence on the negotiation process in the three cases did not result in a stronger role for civil society organizations in the implementation process. The article concludes with an analysis of how these findings modify the current understanding of the role of civil society in peace processes and proposes a different focus for future research.  相似文献

Non-governmental organisations (NGOs) are a constituent part of post-conflict Transitional Justice interventions and as such their projects shape but are also constrained by various narratives about the past. This article introduces the concept of mnemonic role attributions defined as the sum of how actors, their roles, their responsibility and their suffering are categorised as they are remembered regarding a certain period of time. The article analyses how different mnemonic role attributions that are propagated during interventions by Transitional Justice experts in civil society influence the potential for reconciliation in post-conflict Cambodia.  相似文献

In Liberia, much debate has surrounded the truth and reconciliation commission both in the challenges that it faced during its operational stage as well as in the issues surrounding the release and content of its report. This article will critically examine the establishment, proceedings, and findings of the Liberian Truth and Reconciliation Commission in order to draw conclusions regarding what lessons can be learned, what could have been done to make the commission more effective, and how we can learn from this example in applying transitional justice mechanisms for future African conflicts.  相似文献

As a twenty-first century post-war, emigrant-sending country, Liberia reflects global citizenship norms while simultaneously departing from them, and this unique positioning offers new opportunities to theorise citizenship across spatial and temporal landscapes. In this article, I examine ‘Liberian citizenship’ construction through a historical prism, arguing that as Liberia transformed from a country of immigration to one of emigration, so too did conceptualisations of citizenship – moving from passive, identity-based citizenship emphasising rights and entitlements to more active, practice-based citizenship privileging duties and responsibilities. Given the dynamic trends in citizenship configuration across the globe and particularly in Africa, this article fills gaps in the growing body of literature on citizenship and participation in emigrant-sending countries by contributing to wider debates about how identities, practices and relations between people transform in the aftermath of violent conflict. Empirical evidence presented is based on multi-sited fieldwork conducted in 2012 and 2013 with 202 Liberians in urban centres in West Africa, North America and Europe.  相似文献

1Since the end of the Cold War, the international communityhas become increasingly involved in peacebuilding and transitionaljustice after mass violence. This article uses lessons frompractical experience and theories of peacebuilding and transitionaljustice to develop a model of transformative justice that supportssustainable peacebuilding. This model is holistic and transdisciplinaryand proposes a focus on civil society participation in the designand implementation of transitional justice mechanisms. It requiresus to rethink our focus on ‘transition’ as an interimprocess that links the past and the future, and to shift itto ‘transformation,’ which implies long-term, sustainableprocesses embedded in society and adoption of psychosocial,political and economic, as well as legal, perspectives on justice.It also involves identifying, understanding and including, whereappropriate, the various cultural approaches to justice thatcoexist with the dominant western worldview and practice. Asyncretic approach to reconciling restorative and retributivejustice is proposed as a contribution to developing transformativejustice and sustainable peacebuilding. The development of thistransformative justice model is informed by field research conductedin Cambodia, Rwanda, East Timor and Sierra Leone on the viewsand experiences of conflict participants in relation to transitionaljustice and peacebuilding.  相似文献

Organizational theory has been of surprisingly limited value in illuminating the problems of public sector management in the Third World. One reason for this is the ideal-typical bias of most studies of Third World management. This has led to an emphasis on assumed optimal performance criteria to the detriment of an understanding of how Third World organizations actually perform. The case of public sector administration in Liberia is used to illustrate this theme. The major role of administrative incorporation in the stabilization of the Liberian State is established, and consideration given to the ways in which the span of administrative employment and the extent of its popular impact were maximized through the elaboration of an idiosyncratic bureaucratic ideology. Central features of the Liberian bureaucracy are discussedthe over-definition of its external boundary; the weakness of its internal boundaries; the relative insignificance of specialized expert knowledge to bureaucratic roles; and the idiosyncratic nature of the bureaucratic career. While Weberian standards did not apply in the Liberian instance, it cannot be assumed that the latter was therefore a ‘failed bureaucracy’; for the Liberian administration was arguably effective in relation to certain goals, even if these were not ones which would have applied in the ideal-typical case. These goals were essentially political and must be understood in relation to political constraints, rather thanas is often suggested in studies of Third World managementas ‘cultural’ phenomena. Attempts to improve public sector managerial performance in the Third World need to give as much attention to operational issues as to conventional targets.  相似文献

Abstract

From 1998 to 2003, the Solomon Islands found itself in the grip of ‘the Tensions’, a violent civil conflict that left some 200 people dead, more than 20,000 displaced, and countless others subjected to torture, rape, fear and intimidation. In the aftermath of the conflict, two dominant approaches to post-conflict justice emerged. The first, implemented by the Regional Assistance Mission to the Solomon Islands (RAMSI), favoured a ‘rule of law’ approach according to which large numbers of militants on both sides were arrested and processed through the criminal justice system resulting, in many cases, in the imposition of lengthy period of imprisonment. The second, ‘reconciliation’ approach, favoured local, grassroots, traditional and indigenous justice processes and were routinely implements by community groups, women's organisations and the churches. This article demonstrates that in the absence of a formally planned transitional justice process, these two approaches to post-conflict justice have come into serious tension with proponents of each accusing the other of hampering their justice efforts. It examines those tensions and analyses the extent to which the Solomon Islands’ Truth and Reconciliation Commission, designed in part to provide a bridge between the rule of law and reconciliation approaches, has been able to quell this new set of tensions.  相似文献

ABSTRACT

There has been a growing interdisciplinary concern with the implications of public outreach processes from war crimes trials for new forms of citizenship in the wake of violent conflict. The enactment of such outreach, through seminars, civil society initiatives and workshops, provides a glimpse of the tensions between different conceptions of justice, belonging and rights in the post-conflict period. Specifically, such events constitute a rare public arena in the more fragmented and securitised domain of international legal practices. This paper focuses on a series of public workshops for survivors of wartime sexual violence carried out in Bosnia and Herzegovina (BiH) 2011–13. Drawing on participant observations and open-ended interviews, we argue that such public outreach programmes can be viewed as a form of pedagogy, where the materials, format and arrangement of the events structure the nature of participation and engagement. In doing so we are making two contributions. First, the discussion advances understandings of public outreach as a form of pedagogy, illustrating how practices of dissent, rejection and resistance animate processes of public outreach. Second, the paper illuminates the role of pedagogy as a governmental instrument, reflecting the micro-situations within which individuals are interpellated into the state.  相似文献

A gendered reading of the liberal peacebuilding and transitional justice project in Bosnia–Herzegovina raises critical questions concerning the quality of the peace one hopes to achieve in transitional societies. By focusing on three-gendered justice gaps—the accountability, acknowledgement, and reparations gaps—this article examines structural constraints for women to engage in shaping and implementing transitional justice, and unmasks transitional justice as a site for the long-term construction of the gendered post-conflict order. Thus, the gendered dynamics of peacebuilding and transitional justice have produced a post-conflict order characterized by gendered peace and justice gaps. Yet, we conclude that women are doing justice within the Bosnian–Herzegovina transitional justice project, and that their presence and participation is complex, multilayered, and constrained yet critical.  相似文献

What is the meaning and role of civil society in Afghanistan? And what contribution could civil society actors make to promoting peace and political reform? Drawing on a research and dialogue project conducted in 2009–2012, this article explores local understandings and practices of civil society in Afghanistan, and examines their relationship to security and social change. It argues that studying civil society can help shed light on the changing dynamics of political authority and security in the country, as well as offer new avenues for promoting progressive change. The article addresses some of the conceptual and analytical limitations of dominant narratives about civil society in conflict-affected environments, demonstrating how they tend to neglect certain forms of agency that have the potential to be transformative.  相似文献

1Observers of Moroccan politics have debated extensively thesignificance of the country's ‘top-down’ liberalization.At this point, there is no definitive verdict on palace-guidedreforms, such as the recent Equity and Reconciliation Commission(IER). Rather, these reforms have left an ambiguous legacy.This article uses the IER – a truth commission establishedin 2004 to examine past human rights abuses, compensate victimsand ensure nonrepetition – as an analytical tool to understandhow transitional justice carried out as a strategic measureof top-down liberalization can reshape the relationship betweencivil society and the state. While the monarchy's reform effortsin Morocco have not (as of yet) led to a civil society capableof supporting a stable democratic transition, the article arguesthat these efforts have increased civil society's expectationsof gaining capacity and space to implement ethical goals anddemands. ABSTRACT

The study of post-conflict justice and peace incorporates ideas from many disciplines and on a range of topics including justice, reconciliation, democratization, and peace. While diversity is valuable, it can also lead to confusion in theory and practice and so requires close evaluation of how diverse ideas interact, and to what end. This paper begins the systematic examination of such interactions by using new bibliometric software to track citations between two particularly influential literatures contributing to post-conflict theory: the legal and the psychosocial. The paper describes how these traditions interact and the impact on the post-conflict literature as a whole.  相似文献

Peace agreements often include provisions for the military integration of the conflict parties, involving an increase in government forces, and at the same time requesting demobilization and thus a reduction of military personnel. Depending on the modalities and magnitude both can be strong signals of a commitment to the peace process. However, tensions between these two concepts can also endanger post-conflict stability. The empirical analyses of 77 post-conflict societies show that civil war is more likely to recur if rebel forces are kept separate during the military integration process and if the military plays an important role in post-conflict economies.  相似文献

Have urban areas become strategic sites for the formation of justice movements? A justice movement is conceptualised as geographically extensive mobilisations that achieve a degree of territorial fixity at different spatial scales. It is proposed that a number of factors can encourage organisations implicated in this movement to make the urban arena a key front in their struggle to achieve justice. These factors include the intensification of urban inequalities, increased political opportunities resulting from the devolution of state capacities to sub‐national levels of government and new actors interested in pursuing innovative strategies and tactics. This hypothesis is tested through a comparison of movements in three different cities: Los Angeles, USA; Rotterdam, Holland; and Toulouse, France. The findings show that, despite the fact that new actors have begun to mobilise in these three cities around justice issues, they have experienced different degrees of territorialisation. The divergent outcomes are explained by the particular state–civil society power relations found in each of the cities. Thus, the paper concludes that, though the factors in our hypothesis may encourage actors to initiate urban justice movements, the degree of their territorialisation ultimately depends on local state–civil society power relations.  相似文献

ABSTRACT

Interventions aimed at citizenship formation and nation-building in divided and post-conflict societies place great emphasis on promoting and entrenching peace as a cornerstone of economic development and statehood. Such efforts are multi-scalar, encompassing interventions to build democratic institutions and responsible citizens with the pursuit and maintenance of peace at the heart of these ideals. Dominant international pedagogies and policies for liberal-peace-building in divided societies can be used to maintain existing power relations and hierarchies, and may prevent the realization of social (and other forms of) justice while stifling dissent and criticism through exhortations to patriotism, unity, civility, and nation-building. Thus, the ‘goodness’ of peace makes this concept particularly useful as a technique of governance. However, ‘peace’ can also be reworked to suit counter-hegemonic political purposes that open up rather than shut down the question of what peace means. Through an exploration of contestations around the notion of ‘peace’ and its deployment in efforts to promote particular foreign policy agendas we highlight the incongruities in civil society actors’ approaches to peace, and their efforts to achieve sometimes conflicting aims, within divided societies.  相似文献
