The incarceration of young people is a growing national problem. Key correlates of incarceration among American youth include mental health problems, substance use, and delinquency. The present study uses a statewide sample of incarcerated youth to examine racial differences in African American and Caucasian juvenile offenders' outcomes related to mental health, substance use, and delinquency. The data indicate that relative to Caucasian offenders, African American offenders report lower levels of mental health problems and substance use but higher levels of delinquent behavior such as violence, weapon carrying, and gang fighting. The data further reveal that African American offenders are more likely than Caucasian offenders to be victims of violence and to experience traumatic events such as witnessing injury and death. Recognition of these patterns may help to improve postrelease services by tailoring or adapting preexisting programs to patterns of risk factors and their relative magnitudes of effect.  相似文献

This article focuses on the relations of two dimensions of perceived child-rearing practices, care and protection, as measured by the Parental Bonding Instrument and on cognitive representations of future offending in a sample of 152 young offenders. The relations of two different models, predictive of juvenile delinquency, are explored. Parental influences are thought to represent distal factors affecting juvenile delinquency, whereas cognitive representations, formulating the decisions of young offenders, are proximally related with juvenile delinquency. The focus of the research is the young offenders'intentions to reoffend, and it was found that intentions to reoffend in the future were predicted by attitudes toward offending and perceived behavioural control of future offending, whereas parental variables were redundant in predicting behavioural intentions of reoffending. Any effects of parental variables on behavioural intentions were mediated by the young offenders' attitudes toward offending.  相似文献

This article examines the effectiveness of diversionary restorative justice (RJ) conferences through the eyes of juvenile offenders. In Australia, Reintegrative Shaming Experiments (RISE) are based on Braithwaite's theory of reintegrative shaming. Previous studies, although showing that RISE reported high levels of victim satisfaction and positive changes in the attitudes of offenders, also demonstrated that it has different outcomes for juvenile offenders depending on the type of offense with which they were charged. However, the effectiveness of RISE in terms of the offenders' perceptions has not been addressed, and the impact of the offenders' perceptions about RISE still remains under investigation. Using Australian data from RISE between 1995 and 1999, this article examines juvenile offenders' perceptions on preventing reoffending, repaying the victim and society, and the degree of repentance. The data were taken from interviews with juvenile offenders to measure their perceptions after the court or RISE processing. A comparison of standard court processing effects and RISE on juvenile offending, including property crime, shoplifting, and violent offenses, was undertaken. The results from this study were somewhat inconsistent with previous research. In this study, there was no significant relationship between RJ conference and the offenders' own perceptions on the prevention of future offending. However, it was found that there were treatment effects on repaying the victim, repaying society, and the degree of feeling repentance, and that younger offenders wanted to repay the victim/society and feel repentance.  相似文献

Due to an overreliance on arrests in the late 1990s, the incarceration of young women in the United States increased dramatically. On any given day in 2010, over 9000 girls were held in residential placement. Largely hidden from public view, little is known about the health requirements of female adolescent offenders in US secure custody. Less is known about how those needs are met while in detention. Curiously, while most theories regarding female juvenile delinquency draw upon non-criminogenic health-related factors – sexual abuse, family violence, and low self-esteem – their specific legal troubles are rarely, if ever, framed in public health terms. Drawing on original interviews with 100 court-involved girls, detainees’ perceptions of their medical, psychological, sexual, and social health concerns are highlighted. The data link court-involved girls’ prior health issues to their coming to the attention of juvenile authorities as well as demonstrating possible non-compliance with domestic and international standards for the health rights of juveniles deprived of their liberty.  相似文献

Prior research indicates that adolescent offenders transferred to adult court are more likely to recidivate than those retained in the juvenile system. The studies supporting this conclusion, however, are limited in addressing the issue of heterogeneity among transferred adolescents. This study estimates the effect of transfer on later crime using a sample of 654 serious juvenile offenders, 29% of whom were transferred. We use propensity score matching to reduce potential selection bias, and we partition the sample on legal characteristics to examine subgroup effects. We find an overall null effect of transfer on re-arrest, but evidence of differential effects of transfer for adolescents with different offending histories. These results suggest that evaluating the effects of transfer for all transferred adolescents together may lead to misguided policy conclusions.  相似文献

There is some debate about whether sex offenders are similar to non-sex offenders. It is known that sex and non-sex offenders are heterogeneous groups. Comparative studies must take this heterogeneity into account. Based on an aggregated database, a study was conducted among adjudicated juvenile (sex) offenders. The sample consisted of juvenile male sex and non-sex offenders who had been subjected to a psychological assessment at the request of the judge or district attorney. The central question focused on the differences between juvenile sex offenders, in particular rapists and sexual assaulters (n = 57), child molesters (n = 55), and non-sex offenders: violent (n = 85) and nonviolent offenders (n = 80). The results demonstrated that sex offenders differ from non-sex offenders with regard to demographic characteristics, problem behavior, and personality traits. This study examined the contributions of sentencer and case (legal and extralegal) factors to magistrates' sentences for 678 drink-drivers at 2 courts. Qualitative codings of magistrates' sentencing orientations were incorporated with case factors in a multivariate statistical model of differences in fines and disqualifications. Discriminations in penalties were related to offenders' legally relevant prior offenses and blood alcohol concentrations, and extralegal variables of offender age, gender and employment status. Men were treated more harshly than women, and young offenders more harshly than all other offenders except those over 56 years. Unemployed offenders were fined less, but disqualified for longer than offenders in the workforce. Magistrates' orientations and court interacted with offense categories to produce further differences related to blood alcohol concentration and recidivism. Sentencers responded to offender characteristics but also relied on their own mental images of stereotypic drink-drivers and their individualized sentencing orientations to exercise their discretionary powers. Results are discussed in relation to issues of warranted or justifiable discriminations and the just distribution of penalties.  相似文献

With longitudinal data from a sample of 359 adolescent offenders, we tested three measures of social bonding (conventional moral belief, attachment, and commitment/involvement) and deviant peer association as outcomes of low self-control and as mediators of the effect of low self-control on juvenile offending. Low self-control was negatively related to each bonding measure, positively related to deviant peer association, and positively related to offending at follow-up. Its effect on offending was fully mediated by conventional moral belief and attachment. These results provide modest support for a combination of self-control and social bonding perspectives on juvenile offending.  相似文献

This qualitative research examines gender differences in offenders'ability to negotiate a positive identity once the pejorative labels of criminal, prostitute, drug dealer, and incompetent parents have been imputed onto them. In-depth semi-structured focused interviews were conducted with a purposeful information-rich sample of eight male and eight female offenders. Content analysis reveals that males were much more adept than female offenders at juggling with conventional and street norms to justify and/or resist stigmatizing labels in order to construct a favorable identity. Appeal to such personal strengths as know-how, competence, loyalty, and a code of honor allowed male offenders to challenge the boundaries between conventional and delinquent worlds. Concomitantly such an appeal gave rise to a sense of efficacy perception and an optimistic explanatory style. In contrast, even though female offenders were able to justify the labels of drug dealer, prostitute, and thief by appeal to higher loyalties and reject that of insane, all their justifications collapsed when having to negotiate the identity of incompetent mother. Female offenders' negative internal attributions and deprivation of the normative center-motherhood resulted in apathy, anomie, and lack of confidence in their ability to do something worthwhile. Rehabilitation guidelines would build female offenders' personal strengths while redirecting those exhibited by male offenders into lawful enterprises.  相似文献

The post-Mao de-politicization put an end to the continuous class struggle in China. After the post-Mao government had removed the radical elements from the party and united the society by its appealing modernization program, it directed its attention to street crime and juvenile and young offenders. Crime committed by juvenile and young offenders has become a serious social problem. It is estimated that among the total offenders apprehended by the police, 70% are under the age of 25, and 30% under the age of 18. Despite the party's tough policy, juvenile crime is increasing and becoming more organized and violent. The paralysis of the Maoist social control system is stressed in explaining the increase in crime. The disruption in the family structure, in school and work patterns, and in neighbourhood organizations, in conjunction with a sweeping crisis of belief among the populace in general, has created a vacuum of social control in post-Mao Chinese society. The seriousness of juvenile delinquency and the lack of community undertakings have forced the government to institutionalize and legalize its control over juvenile and young offenders.  相似文献

The study outlined in this article addressed a key limitation of prior research on the punishment of juveniles transferred to adult court by employing propensity score matching techniques to create more comparable samples of juvenile and young adult offenders. Using recent data from the Maryland State Commission on Criminal Sentencing Policy, it tested competing theoretical propositions about the salience of juvenile status in adult court. Findings indicate that even after rigorous statistical matching procedures, juvenile offenders are punished more severely than their young adult counterparts. We found no evidence that this “juvenile penalty” is exacerbated by an offender's race or gender, but it does vary starkly across offense type and mode of transfer, being driven primarily by drug crimes and discretionary waivers. The import of these findings is discussed as they relate to the future of juvenile justice policy regarding the continued use of juvenile transfer to adult court.  相似文献

During the 2006–2007 American Bar Association (ABA) year, a special ABA Presidential Youth at Risk Initiative has addressed several important topics: addressing the needs of juvenile status offenders and their families; foster children aging out of the foster care system; increases in girls, especially girls of color, in the juvenile justice system; the need to better hear the voices of youth in court proceedings affecting them; and improving how laws can better address youth crossing over between juvenile justice and child welfare systems. Lawyers are encouraged to use their skills to improve the systems addressing at‐risk youth and their families and to help facilitate coordination of youth‐related community efforts. Learning how to effectively communicate with youth is an important skill attorneys must learn. Through the Youth at Risk Initiative, the ABA has held continuing legal education programs, hosted community roundtables among youth‐serving stakeholders, and developed projects on: juvenile status offenders; lawyer assistance to youth transitioning from foster care; educating young girls on violence prevention, conflict resolution, and careers in law and justice; and provision of useful information to youth awaiting juvenile court hearings. New ABA policy has addressed services and programs to at‐risk youth, assuring licensing, regulation, and monitoring of residential facilities serving at‐risk youth, enhanced support for sexual minority foster and homeless youth, juvenile status offenders, and improving laws and policies related to youth exiting the foster care system.  相似文献

The historic transformations of the criminal justice system must be justified and interpreted through the effects on criminals (Maruna and Immarigeon, 2011). The push for harsher sentencing policies for juvenile offenders specifically through the use of juvenile waiver to criminal court is one such policy that is not well understood in terms of its effects on offenders, especially in terms of broader outcomes beyond recidivism. We use data from the Pathways to Desistance Study, which consists of a sample of adolescent offenders followed for 7 years postadjudication, to investigate the effect juvenile waiver has on human capital acquisition and yield among 557 adolescents from Maricopa County, Arizona. By using various matching specifications, our findings demonstrate that juveniles transferred to adult court experience no deleterious effects on human capital in terms of educational acquisition compared with similar youth retained in the juvenile system, yet they still earn considerably less income 7 years postadjudication. These results suggest that an important and unintended collateral consequence of juvenile waiver is an increase in social stratification potentially through labeling and labor market discrimination.  相似文献

Juvenile probation work comprises a mixture of repressive and empowering strategies, since probation officers need to control young offenders' conduct and at the same time help the offender to take responsibility and live life within the margins of society. This ambiguous nature of juvenile probation work may confuse the communication between probation officers and juveniles. Interviews with offenders of Moroccan origin and their probation officers in the Netherlands show that both parties are unhappy with the mutual communication. According to the youngsters, a restrictive policy is inevitable but might be more effective if this would go together with an empowering approach. Interactional analysis of the conversations shows that the lack of juvenile participation is caused by professional conversational dominance, as seen in topic control, poor role clarification, and a cross-examining style of the conversations.  相似文献

Variations in criminal performance have been much less explored than other parameters of criminal careers. We explore the factors associated with differential criminal achievement in a sample of 154 adolescent offenders involved in cannabis cultivation. Drawing from theories of earnings attainment, we examine the role of drug use, criminal social capital and criminal human capital in providing either (a) monetary, or (b) in kind (cannabis) rewards from crime. Results reveal that criminal social capital and criminal human capital are related to performance while drug use explains little of the variation. Their effects, however, differ between outcomes: young offenders who are mainly connected to adult growers tend to be paid in kind, whereas respondents connected to a majority of other young growers tend to receive money. Criminal human capital is crucial to earning money but insignificant to obtaining larger payments in cannabis. Implications for criminal career and desistance research are discussed.  相似文献

Research has shown that youthful offenders in the juvenile justice system report an array of substance use and emotional and other mental health needs. The current study closely examined these issues in a large national sample (n = 539) of Native American youth drawn from the Survey of Youth in Residential Placement. Results demonstrated that frequent substance use was associated with the likelihood of being detained for a drug offense, while emotional and mental health needs were associated with detention for the most serious offenses. These results highlight the need for comprehensive substance use and other mental health assessments for Native American youth in the juvenile justice system.  相似文献

Moral reasoning and development have been the focus of considerable research in the past two decades, stimulated primarily by Kohlberg’s formulation of the stages of moral development. Studies of juvenile delinquents have indicated that youthful offenders are at lower developmental stages of moral reasoning than their nondeliquent counterparts. Some research has also examined patterns among juvenile delinquents with respect to moral judgments, as it is recognized that they are heterogeneous as a group. In order to further examine correlates of moral judgments among juvenile delinquents, a sample of 411 adolescent offenders was obtained. The sample consisted of all adjudicated male delinquents aged twelve to fifteen admitted to a state training school over a sixteen month period of time. Data was obtained on a measure of moral judgment, the Morality-Immorality Scale (Baker, Stewart, Kaiser, Brown & Barclay, 1979), along with a variety of measures of personality, behavioral, social, intellectual and educational skills. The adolescents were divided into three groups based on their scores on the MIS. The highest scoring group on MIS had better scores on a variety of behavioral, intellectual and personality indicators, while the lowest scoring group had the worst scores on such measures. Moral-religious emphasis in the home was not associated with the scores on the Morality-Immorality Scale, but a measure of family pathology was negatively related to these scores. Implications of the findings for research and for the development of moral education programs for delinquents is discussed.  相似文献

This paper discusses how biological and psychological literature on the developmental differences between juveniles and adults may affect juvenile judges in their “dual role” as retributive and rehabilitative decision‐makers in juvenile cases, specifically focusing on sentencing. Particularly, it discusses potential influences of this research on adolescent development regarding four factors known to be integral in juvenile judge decision‐making: legal factors, characteristics of juvenile offenders, and individual structural and social contexts in which judges’ decisions are made. Unwelcome touching, groping, and kissing are illegal, but widely tolerated in public drinking settings. This contingency in the law's response means that patrons routinely negotiate the moral boundaries of nonconsensual sexual contact. We use 197 interviews with college‐age individuals to examine the discursive strategies young people employ when negotiating those boundaries. We find that most interviewees have experiences with sexual aggression, do not categorize it as aggression, but advocate for stronger legal punishments against offenders. In accounting for this paradox, they draw on contradictory legal and cultural narratives that both normalize and condemn men's sexual aggression. We build on legal consciousness theories and gender theories by highlighting the complex ways that gender stereotypes enshrined in law are implicated in the construction of a social problem. We also contribute to the sociology of culture by explicating the often unconscious link between culture and action revealed in young people's narratives about sexual aggression.  相似文献

The purpose of this review was to better understand the impact of community notification, known as "Megan's Law," on sex offenders' reintegration into the community. Eight quantitative studies that examined the social and psychological impact of community notification on adult sex offenders (N = 1,503) were reviewed. The pattern of results across studies showed considerable similarities despite marked variability in the populations examined, survey methods used, and response rates obtained. Sex offenders rarely reported being the target of vigilante attacks. Substantial minorities reported exclusion from residence and job loss as social consequences of being publicly identified as sex offenders in their communities. The majority of offenders reported negative psychological consequences of notification but also identified benefits of knowing that others were monitoring their behavior. More intrusive notification strategies were associated with higher rates of socially destabilizing consequences. Results are discussed in terms of their policy and research implications.  相似文献
