Purpose. Virtually all eyewitnesses to a crime, who eventually testify in court, are interviewed by police officers at least once. How do these interviews affect what the eyewitnesses are subsequently likely to report? The purpose of this study is to compare the relative impact of self‐ versus other‐generated misinformation on confabulated memory about an event. Self‐generated misinformation can occur by encouraging eyewitnesses to guess or speculate about possible answers to questions about which they report having no memory. Other‐generated misinformation can occur by having an investigator suggest an answer to an eyewitness. Methods. After viewing a 5 minutes crime video, participants answered written questions. One week later these same questions were answered again. We specifically focused on individuals' answers to unanswerable questions that probed information not actually presented in the video. If a participant answered an unanswerable question, we know that their answer was confabulated because the information was not presented in the video. Results. If an answer to an unanswerable question was forced confabulated at time 1, that answer was more likely to be repeated at time 2 if it had been other‐generated (suggested in the question) rather than self‐generated (fabricated by the participant). Conclusions. Pressuring eyewitnesses to answer questions about an event, when they indicate that they do not know the answer, can result in false confabulations. Answers suggested by the investigator are more likely to be repeated later than are answers that are simply self‐generated or speculated by the eyewitness. These results are consistent with the reality monitoring framework and ‘recollect‐to‐reject’ metacognitive reasoning strategies.  相似文献

Purpose. In police interviews children may be asked the same question many times. We investigated how the number of repetitions and the interval between those repetitions affected the accuracy and consistency of children's responses. Methods. 156 children aged 4–9 years watched a staged event and were interviewed individually 1 week later. Children were asked eight open‐ended questions, which were each repeated a further four times (making a total of forty questions). Half these open‐ended questions could be answered from information in the event, and half were unanswerable (so children should have said ‘don't know’ in response to these questions). The questions were repeated in gist form. The interval between an initial question and its repetitions was varied by use of other questions and twenty non‐repeated filler questions. The intervals between repetitions were immediate repetition, repetition after a delay of three intervening questions, after a delay of six intervening questions, and after ten or more intervening questions. Results. Over a quarter of children's responses to repeated questions changed, usually resulting in a decline in accuracy, particularly after the first repetition. Subsequently, the number of repetitions and delay interval had little effect on responses to answerable questions although accuracy to unanswerable questions continued to decline. Conclusions. Question repetition had a negative affect on children's consistency and accuracy. For unanswerable questions in particular, the more often a question was repeated the more likely children were to invent a response.  相似文献

Examining data on the recent health care legislation, we demonstrate that public opinion polls on health care should be treated with caution because of item nonresponse--or "don't know" answers--on survey questions. Far from being the great equalizer, opinion polls can actually misrepresent the attitudes of the population. First, we show that respondents with lower levels of socioeconomic resources are systematically more likely to give a "don't know" response when asked their opinion about health care legislation. Second, these same individuals are more likely to back health care reform. The result is an incomplete portrait of public opinion on the issue of health care in the United States.  相似文献

Although eyewitness memory and identification have captured substantial research interest in the past decades, an understanding of the types and prevalence of errors typically made by eyewitnesses is lacking. The purpose of the present research was to begin the development of a taxonomy of eyewitness error, employing standardized stimuli and established techniques. Respondents were exposed to a crime scene modeled on SWAT-training scenarios for systematically varied exposure times, and were then asked to describe what they had seen. The stimuli and questions employed were prepared with the aid of senior police field training officers. As anticipated, eyewitness performance in general was subject to a variety of inaccuracies. Physical errors, such as mistakes in the clothing or physical characteristics of the perpetrator, or in details of the environmental context, predominated. However, other less-expected errors were also observed: in relatively low numbers of cases, witnesses inferred emotional states or intent on the part of the perpetrator or victim. Some contributed wholly artificial backstories, reported the future actions of the perpetrator or victim as memories, or even inserted themselves into the scene. The pattern of results was shown to interact with exposure time, gender of the perpetrator, and the presence or absence of weapons in the scene. The results of this study are consistent with reconfigurative theory dating to Bartlett (1932), with subsequent research, and with more recent work under the aegis of Gestalt/Feature-Intensive Processing theory. These findings provide information on types and prevalence of eyewitness error which should prove useful in investigative and courtroom settings.  相似文献

Improving eyewitness identification evidence remains a key priority for research. Basic laboratory research has consistently demonstrated that allowing participants to withhold answers about which they are unsure leads to improved accuracy. Surprisingly, this approach has not been the subject of comprehensive investigation in the eyewitness identification literature. In this article, we explored the utility of allowing uncertain witnesses to opt out of an identification decision, by providing an explicit don't know option. Further, we contrasted the rate of use of this explicit option with the frequency that participants spontaneously withheld a decision when asked to respond in their own words. Four hundred and twenty participants witnessed a mock crime video before being presented with a showup of the perpetrator or an innocent suspect. Participants were tested either immediately or after a 3-week delay, with one of the three report options: Participants either made their choice in their own words (spontaneous report), chose between identifying and rejecting the showup (forced-report), or chose between identification, rejection and don't know (free-report). Only 2.2% of witnesses spontaneously used a don't know response, compared to 19.3% who used it when the option was explicit. Compared with the forced-report decisions, free-report decisions were more accurate, more diagnostic of the suspect's guilt or innocence, and came at no cost to the number of correct decisions rendered. These data suggest that utilisation of an explicit don't know option may be of practical value.  相似文献

Four experiments were conducted to examine whether witnesses' public confidence ratings differ from their private ratings when there are social pressures to use confidence as an impression-management tool. In all four experiments, participants answered questions about a source event (a series of faces in the first three experiments and a simulated crime scene in the fourth). Half of the responses and confidence ratings were given privately and anonymously, and half were given publicly in front of one or more mock jurors. Two central findings emerged from the results. First, public confidence differed from private confidence only when there was more than one witness; when there were no other witnesses, public and private confidence were the same. Second, the direction of the change in public confidence in the multiple-witness settings was influenced by whether or not there was a possibility of being contradicted by the other witnesses. When there was no chance that the participants' responses could be contradicted, they raised their confidence ratings in public; when there was a chance that the other witnesses might contradict them, the participants lowered their public confidence ratings. The results are discussed in terms of self-presentation theory and implications for the legal system.  相似文献

Five experiments tested the idea that instructing a witness to close their eyes during retrieval might increase retrieval success. In Experiment 1 participants watched a video, before a cued-recall test for which they were either instructed to close their eyes, or received no-instructions. Eye-closure led to an increase in correct cued-recall, with no increase in incorrect responses. Experiments 2-5 sought to test the generality of this effect over variations in study material (video or live interaction), test format (cued- or free-recall) and information modality (visual or auditory details recalled). Overall, eye-closure increased recall of both visual detail and auditory details, with no accompanying increase in recall of false details. Collectively, these data convincingly demonstrate the benefits of eye-closure as an aid to retrieval, and offer insight into why hypnosis, which usually involves eye-closure, may facilitate eyewitness recall.  相似文献

The effects of age of witness and age of suspect on eyewitness testimony were investigated. Forty-eight elementary school children and 48 college students viewed a slide sequence of a mock crime. This was followed by target-present or target-absent photo identification with a no-choice option, central and peripheral questions related to the crime, and a second photo identification. In photo identification, child witnesses had a higher rate of choosing than adult witnesses, suggesting that children have more lax criteria of responding. The accuracy data showed similar levels of sensitivity across ages although there was a trend toward reduced accuracy of child witnesses in target-absent lineups. All witnesses made more total choices and more correct rejections with child-suspect lineups than adult-suspect lineups. Central questions were answered better than peripheral questions by both age groups, but adults made significantly more “don't know” choices.  相似文献

Purpose. Children's inconsistencies when answering repeated questions about past events are a source of concern in forensic, educational, and other contexts. Theoretical accounts of these inconsistencies have predominantly assumed that children shift because they infer adult dissatisfaction with their initial answer. This study aimed to test this account via examination of the effects of question format on shifting, as well as via direct questioning of children. Method. Four‐, five‐, and seven‐year‐olds (N = 226) were asked 17 recall questions about a recent classroom activity, with eight target questions repeated in one of four formats: no‐correct (mildly misleading questions to which the correct answer was ‘no’), yes‐correct (mildly misleading questions to which the correct answer was ‘yes’), specific open wh‐ questions, and forced‐choice questions. They were then asked about the adult's reasons for repetition. Accuracy, shifting, and interpretations of question repetition were examined. Results. Shifting from accuracy decreased with age, and was affected by question format in 4‐year‐olds only, who shifted more to no‐correct than to forced‐choice questions. Shifting towards accuracy was more common in forced‐choice questions than either no‐correct or open questions, but there were no significant age differences. First‐answer‐unsatisfactory interpretations of question repetition were rare, especially in the two younger groups. The oldest group offered a wider range of interpretations and also showed some evidence of an association between first‐answer‐unsatisfactory interpretations and shifting. Conclusions. Overall, our findings present a challenge to first‐answer‐unsatisfactory explanations of young children's shifting in recall settings, at least where overt pressure to shift is low. Forensic implications are considered.  相似文献

This study examined age differences in eyewitness testimony. Children, three and six years of age, and adults interacted with an unfamiliar man for 5 minutes. Four or five days later, the witnesses answered objective and suggestive questions, recalled what happened, and tried to identify the confederate from a target-present photo line-up. The adults and 6-year-olds did not differ in their ability to answer objective questions or identify the confederate, but 6-year-olds were more suggestible than adults and recalled less about the event. Compared to the older age groups, the 3-year-olds answered fewer objective questions correctly, recalled little about what happened, and identified the confederate less frequently. In addition, they were the most suggestible. The experiment extends our knowledge of children's ability to provide accurate eyewitness reports to a very young age group and to a situation in which participants are not merely bystander witnesses but instead directly interact with the confederate.  相似文献

Because most cases of alleged sexual assault involve few sources of evidence, the complainant’s testimony is crucial. In line with empirical research findings, the way in which police question sexual assault complainants has evolved to ultimately maximise both the completeness and accuracy of evidence. But has courtroom questioning changed over time? To answer this question, we compared the courtroom questioning of sexual assault complainants in the 1950s to that used in cases from the turn of the twenty-first century. Overall, lawyers in contemporary cases asked complainants more questions and uttered more words than they did historically. Complainants, too, appear to have become more vocal over time. Across the two time periods, the questioning style used by prosecuting lawyers has shifted towards a more open style. In stark contrast, the format of cross-examination questions has remained remarkably consistent over time, with leading questions still making up the bulk of the questions asked. These findings have important implications for future legal reform and legal practice.  相似文献

我国行政诉讼法对行政诉讼第三人只作出了原则性的规定,最高人民法院有关第三人的司法解释,也略嫌笼统,缺乏可操作性。其主要原因在于,学术界尚未对行政诉讼第三人某些深层次的理论问题达成共识。因此,对行政诉讼法所称“利害关系”进行科学定位,并回答目前实务界面临的一些难题,乃当务之急。如行政诉讼第三人有何特征,如何分类,行政主体是否可以作为第三人,第三人在诉讼中拥有何种法律地位,享有何种诉讼权利,承担何种诉讼义务等问题,有待进一步探讨。文章运用实证分析和理论分析相结合的方法,在对行政诉讼第三人进行科学分类的基础上,对上述问题进行了回答。  相似文献

Past work shows that direct negative feedback and suggestive questioning can lead eyewitnesses to change their memory reports. Applying Gudjonsson’s [2003. The psychology of interrogations and confessions: A handbook. West Sussex: Wiley] model of interrogative suggestibility to interviews with witnesses, the present two experiments examined how indirect negative feedback delivered in a supportive manner from an interviewer can make witnesses change what they report they remember experiencing. After viewing a video of a crime, participants were interviewed twice, with either supportive negative feedback (i.e. with the interviewer sympathetically suggesting why many people’s memory may be inaccurate) or neutral feedback between the two rounds of questions. Results showed that people given supportive negative feedback changed significantly more of their responses than those given neutral feedback. Lower confidence ratings were associated with greater response change, but overall, despite having changed more responses, people given supportive negative feedback did not have reduced confidence or perceived accuracy. Type of feedback did not impact accuracy, and accuracy was not systematically related to confidence or perceived accuracy. Given the role that eyewitness reports play in the criminal justice system, better understanding factors that impact consistency and reliability is vital.  相似文献

Given the crucial role of eyewitness evidence, statements should be obtained as soon as possible after an incident. This is not always achieved due to demands on police resources. Two studies trace the development of a new tool, the Self-Administered Interview (SAI), designed to elicit a comprehensive initial statement. In Study 1, SAI participants reported more correct details than participants who provided a free recall account, and performed at the same level as participants given a Cognitive Interview. In Study 2, participants viewed a simulated crime and half recorded their statement using the SAI. After a delay of 1 week, all participants completed a free recall test. SAI participants recalled more correct details in the delayed recall task than control participants.  相似文献

This study investigated the influence of question format on preschool-aged children's errors, their response accuracy, and their tendency to say I don't know when given non-misleading questions in a neutral, unbiased context. Children (3 to 5 years old) participated in a craft-making session that included a staged accident with two experimenters differing in gender and appearance; the environment also had several distinctive features. One week later children were interviewed about actions, participants, and environment; questions were yes/no format with the veridical response yes (yes questions), yes/no format with the veridical response no (no questions), and specific wh- format questions. Question format substantially influenced children's responses: they were most likely to make errors if asked no questions, and were unlikely to answer either yes/no question with I don't know. In contrast, children spontaneously and frequently said I don't know to wh- questions about content they did not recall (environment), but not about content that was well recalled (actions). Implications of question format for reliability of eyewitness testimony by preschoolers are discussed.  相似文献

Abstract: Lie detection procedures are typically aimed at determining guilt or innocence of a single suspect. Serious security threats, however, often involve groups, such as terrorist networks or criminal organizations. In this report, we describe a variant of the skin conductance‐based Concealed Information Test (CIT) that allows for the extraction of critical information from such groups. Twelve participants were given information about an upcoming (mock) terrorist attack, with specific instructions not to reveal this information to anyone. Next, each subject was subjected to a CIT, with questions pertaining to the details of the attack. Results showed that for every question, the average skin conductance response to the correct answer option differed significantly (p < 0.05) from those to all other options. These results show that the information about the upcoming attack could be extracted from the group of terror suspects as a whole.  相似文献

Objectives

Drawing on prior theoretical and empirical work on survey participation, this study develops one potential method for increasing response rates and response quality in correctional surveys. Specifically, we hypothesize that providing inmates with a superficial survey choice (SSC)—that is, a choice between completing either of two voluntary surveys that are actually differently ordered versions of the same questionnaire—will increase their motivation both to participate in a given survey and to respond thoughtfully to the questions asked therein.

Methods

We test the effectiveness of this method by evaluating its impact on unit nonresponse, item nonresponse, and answer reliability. To do this, we analyze experimental data from a recent survey of male inmates incarcerated in a medium security, private prison.

Results

Findings indicate that the overall response rate is higher among inmates who are provided a survey choice. In addition, the evidence shows that the SSC method increases the percentage of individual items completed, the number of demanding questions completed, and the reliability of reported responses.

Conclusion

The results from the analyses are consistent with the hypotheses that motivated this study and suggest that the SSC method holds promise as a tool for correctional researchers.  相似文献

Pairs (N = 234) of witnesses and lineup administrators completed an identification task in which administrator knowledge, lineup presentation, instruction bias, and target presence were manipulated. Administrator knowledge had the greatest effect on identifications of the suspect for simultaneous photospreads paired with biased instructions, with single-blind administrations increasing identifications of the suspect. When biased instructions were given, single-blind administrations produced fewer foil identifications than double-blind administrations. Administrators exhibited a greater proportion of biasing behaviors during single-blind administrations than during double-blind administrations. The diagnosticity of identifications of the suspect in double-blind administrations was double their diagnosticity in single-blind administrations. These results suggest that when biasing factors are present to increase a witness’s propensity to guess, single-blind administrator behavior influences witnesses to identify the suspect.  相似文献

This research tested whether mug book size moderates mug shot exposure effects. Witnesses to a simulated theft searched either a small, a large, or no mug book, followed by a perpetrator-absent lineup containing a critical foil from the mug book. Contrary to predictions of a transference effect, critical foil lineup identifications did not differ across conditions. To test for a commitment effect, only participants who selected the critical foil in the mug book were considered; there was evidence of a commitment effect in the large mug book condition. Finally, there were more lineup-correct rejections in the large mug book condition; this was explained in terms of the criterion for making mug book choices carrying over to lineup choices.

Abstract

The objective of this study was to obtain a quantitative measure of the discussion behaviour of real eyewitnesses. Undergraduate psychology students were given a questionnaire to determine if they had witnessed a serious event. Results from the questionnaire showed that the majority of respondents had witnessed a serious event at some point in their lives, and the majority of witnesses were not alone when they observed the event. Respondents who had experienced a serious event for which there was more than one witness present were invited to fill out a follow-up questionnaire. The follow-up study showed that when there is a co-witness present, most people (86%) report discussing the event with the co-witness. This is potentially problematic if the witnesses are contaminating one another's memories of the event. The results are discussed in terms of psychological research and policy implications.  相似文献
