So-called three strikes and you're out sentencing laws for criminal offenders have proliferated in the United States. The laws vary considerably in their definitions of what constitutes a strike. This paper adapts the classic Poisson process model of criminal offending to investigate how varying sentence lengths and definitions of what constitutes a strike affect the effectiveness and cost-effectiveness of these sentencing laws. In particular, it asks whether, by using different definitions for the first, second, and third strikes or different sentence lengths, one can make the resulting incarceration more efficient in the sense of incapacitating more crimes per cell-year served.  相似文献

The question considered is whether it is possible to trace a theoretical strategy for a criminal policy on the basis of Marx's work. The answer offered is that Marxian political and economic analysis does not supply any general theory of criminality and that any attempt to formulate such a theory (as in Lenin, Paukanis or Gramsci) necessarily leads to authoritarian and regressive conceptions of crime and punishment. Nevertheless the authors maintain that it is possible to trace three theoretical suggestions within Marxian thought which allow of a fruitful approach to the criminal question. The first suggestion relates to the economic roots of many aspects of modern criminality; the second regards the Christian and bourgeois superstition of moral liberty and individual culpability; the third suggestion deals with the lack of a guaranteed social space as the prime root of crime. These theoretical suggestions permit clarification of the social character of penal responsibility and this character points to the need for the socialization (but not deregulation) of criminal treatment.This essay grew out of a reply to a questionnaire drawn up by La questione criminale, an Italian review which tries to approach the criminal question from a Marxist standpoint.  相似文献

This paper is a study of the finances of insurgent groups. It takes the view that a model guerrilla movement evolves through three stages, with corresponding changes in both its expenditure responsibilities and its fundraising activities.In the earliest stage it engages in hit-and-run operations against individual symbols of the state, either officials or isolated institutions like police stations and army outposts. At that stage, the group's expenditure requirements are relatively small and mainly military. Hence, it can rely on fundraising activities based on similarly sporadic and predatory actions such as bank robbery and kidnapping that closely approximate the activities of blue-collar criminals.In the next stage the guerrilla movement begins openly disputing the political power of the state, mainly through the conduct of low intensity war against the infrastructure of the formal economy. The guerrilla group's expenditure obligations are not only much greater in absolute amounts, but also include a rising social security component, for the care of dependents of its militants, as well as providing some assistance to the population whose support it is attempting to win. Fundraising therefore shifts from once-for-all, predatory operations to parasitical ones that yield a steadier, more dependable flow of income at the expense of the formal economy. The most important will be the revolutionary taxation of income and wealth, an activity that more closely approximates that of an organized crime group.In the final stage the guerrilla movement succeeds in implanting itself firmly on a piece of territory from which the state is effectively excluded. To its obligations for military operations and social security for dependents of militants are added those arising from the provision of social services to the general population of the controlled area and the building of the infrastructure necessary for the growth and development of a parallel economy. The most important sources of revenue come from indirect taxation — sales taxes on domestic commerce and/or export and import taxes on foreign trade along with user fees for the public services the insurgent group is providing. Fundraising thus ceases to be parasitical with respect to the formal economy controlled by the state and becomes symbiotic with the emerging parallel economy controlled by the guerrilla group.Although at any point the guerrilla movement may find itself with a temporary surplus of operating funds, it is in the symbiotic stage, with regular revenue flows, that problems of asset management are likely to become significant. Therefore, at this stage, while fundraising activities take on increasingly overt and legitimate-looking forms in areas under the group's governance, fund-man-agement activities require the guerrilla group to interface with the formal and international economy in much the same manner as white collar crime, seeking to hide and launder the returns from its fundraising.  相似文献

This study, derived from a sample of 108 serial rapists (rapes=565), examines the relationship between demographic, crime scene, and criminal history variables and the distance traveled by serial rapists in order to offend. The pattern of offenses perpetrated by each of the 108 serial offenders as it relates to his place of residence is also analyzed in terms of known characteristics of the offender and his offenses. The theoretical focus of the study integrates premises derived from criminal investigative analysis, environmental criminology, ethnographic geography, journey to crime research, and criminal geographic targeting to explore the cognitive symmetry between the how and the where of serial sexual offenses. These components or dimensions of serial crime are explored in an attempt to aid law enforcement in their investigation of hard-to-solve serial crimes.  相似文献

Two experiments were conducted in which 176 listeners heard male and female objectively defined high- and low-recognition voices and then attempted to identify these voices from a voice parade containing 20 distractors after either 10, 40, 100, or 130 minutes (experiment 1), or 10 minutes, one day, seven days, or 14 days (experiment 2). In experiment 1 delay had no overall effect, although further analysis revealed that the shortest delay did produce better performance than all other delay conditions. Further, high-recognition voices were better identified than low-recognition voices. In experiment 2 delay had an overall effect, with the shortest delay interval again being significantly better than all other conditions, which did not differ among themselves. High- and low-recognition voices, however, did not exhibit a statistically significant difference, although these two factors entered into a marginally significant interaction. Theoretical speculation and forensic implications were drawn.This research was funded by the British Home Office, research grant no. The University of Pennsylvania study of delinquency in a Philadelphia birth cohort has been described byNewsweek as perhaps the most influential piece of criminal justice research in the last decade (March 23, 1981). Many have construed the findings as showing that, if imprisonment were focused on the minority of offenders with especially bad prognoses, the rate of crime could be reduced substantially. But others have taken the opposite view that the cohort data, far from endorsing such a selective incapacitation strategy, might actually provide strong evidence that such an approach is futile. Through some further analyses of the Philadelphia data, we attempt to clarify their policy implications.  相似文献

Considerable attention in the popular and professional literature has focused on the relative costs and benefits of using public protectionist versus civil libertarian models of social control. In this article, we develop statistical analogs of these models to predict violent behavior among samples of defendants found incompetent to stand trial in New York State. The societal and personal costs (errors of prediction) of each model are compared and their implications for clinical practice and social policy are discussed.This research was supported in part by PHS Grant MH 20367 from the NIMH Center for Studies of Crime and Delinquency. Since the attacks of September 11th, 2001, terrorism has experienced a prominence in discourse across the U.S. The representations of terrorists and terrorism by the news media and politi have contributed to the edifice of terrorism as a moral panic. This treatise examines the social effects that have or may occur due to the social construction of a moral panic of terrorism. The thematic frame is situated within Cohens stages of a moral panic. We offer an analysis of the medias depiction and coverage of acts of terrorism, and legislative, political and legal responses in the form of social and cultural changes occurring from the creation of a moral panic. In addition, we offer an analysis of the states vested interest in the social construction of this panic, leading to increased levels of fear, targeted at the general publics consciousness. This article concludes that the presentation of terrorism and terrorists by the media and politi have contributed to unnecessary levels of panic and fear, misguided public consciousness, and the development of legislation creating negative social ramifications yet be seen.  相似文献

This paper considers the growing appeals to the idea of community in criminal justice policy and the involvement of actual communities in criminal justice initiatives. It draws on a completed two year research study of a number of community-based crime prevention initiatives in the South East of England. The paper considers the nature of community to which appeals are made in criminal justice discourse and policies, the contribution of community to the practices of social order and the nature of community representation and participation in crime prevention initiatives. It is argued that appeals to community in crime prevention, and crime control more generally, embody shifts in what constitutes the legitimate responsibilities of individuals, collectivities and the state. This has a number of implications, the first of which is a redrawing of the cost of policing and security services. Additionally, there is an associated shift in blame for failure. Finally, actual community involvement in crime control gives rise to new structures and forms of local governance that evoke key questions about the regulation of social relations, the nature of conflict resolution, citizenship, democracy and social justice.  相似文献

This paper elaborates on Merton's theory of anomie, while aiming at the enhancement of our understanding of processes conducive to corporate deviance. It attempts to consolidate points made by theorists operating in diverse, often considered as conflicting, orientations or perspectives. A synthetic or integrated scheme is, thus, put forward, which can help appreciate the background against which corporate deviance is likely to occur. Moreover, it is argued that contemporary societies are inherently conducive to anomic trends. Such trends bring about not only lower-class deviance and crime — to which anomie theory has been traditionally applied — but also high-class and corporate deviance. Against claims by some scholars that the former is a matter of greater concern, it is suggested that the latter is at least as serious a problem and that it has significant implications for the social order.Parts of an earlier version of this paper were presented at the 10th International Congress for Criminology held in Hamburg, FRG, in September 1988.  相似文献

The paper probes the deep structure of perceptions of AIDS and the ensuing public policy trends. AIDS has become the latest symbol indexing 20th century conflicts over the family and sexuality and recapitulates some features of early debates over contraception and the control of sexually transmitted diseases. From 1981 to 1983, public talk about AIDS was virtually taboo. Since 1983, the massive proliferation of AIDS discourse has led to the development of an official story common in the press and clear in the presumptions underlying recent state policies in the United States, Canada, and the United Kingdom. These policies have favored state control of sexual speech and education, as well as control of people blamed for HIV infection, while community-based groups have sought to empower people to affirm their sexuality while avoiding viral transmission.  相似文献

In criminal justice, as in other fields, an experimental study conducted ata single site does not offer a solid basis upon which to make strong publicpolicy recommendations. To date, criminal justice researchers have reliedupon two general approaches to overcome the limitations of single-siteexperimental research. The first, termed ``meta-analysis, seeks tocombine independent studies to identify consistent effects across criminaljustice settings or contexts. The second, sometimes termed replicationstudies, seeks to replicate investigations in multiple criminaljustice jurisdictions. In this paper we describe a related approachdeveloped in clinical studies in medicine and examine its applicabilityin criminal justice settings. Termed a multicenter clinicaltrial, this method demands the implementation ofa single experimental protocol at multiple sites. We contrast themulticenter approach with other methods and provide a substantiveexample of an ongoing multicenter criminal justice study. We begin byexamining the specific limitations of current approaches and solutionsoffered by multicenter studies to overcome these. We then turn to anapplication of the multicenter clinical trial in a criminal justicesetting. Using the example of the HIDTA (High-Intensity Drug TraffickingAreas) evaluation of drug treatment programs currently being conducted atmultiple sites, we illustrate components of the multicenter approach aswell as potential drawbacks researchers are likely to face in itsapplication in crime and justice studies.  相似文献

This work attempts to formalize an emerging paradigm in criminology, examining the structural consequences of feedback between community physical decay and behavioral pathologies caused by the social disintegration resulting from that decay. Adaptation of a standard reaction/diffusion approach produces a model of radially expanding coupled traveling-wave shock fronts of interrelated contagious physical decay and criminal activity. The standard threshold theorem associated with the model equations suggests that currently advocated triage policies, which recommend the virtual abandonment of bad communities behind the expanding front, will fail spectacularly. The model suggests that, just as the hollowing-out process has a complex, synergistic and dynamic structure, so, too, must interventions be interactive and mutually reinforcing, adaptively, targeted at communities in all stages of the phenomenon.  相似文献

The collection of Malayalam records entitled Vanjeri Grandhavari, taken from the archives of an important Namputiri Brahmin family and the temple under its leadership, provides some long-awaited information regarding a wide range of legal activities in late medieval Kerala. The organization of law and the jurisprudence represented by these records bear an unmistakable similarity to legal ideas found in dharmastra texts. A thorough comparison of the records and relevant dharma texts shows that landholding Namputiri Brahmins, who possessed enormous political and economic power in the region, mediated the implementation of dharmastra into the legal system. From this comparison arise new understandings of law and legal categories such as custom and positive law. Moreover, such comparisons begin to elucidate the problems involved in Western assumptions that it is textual law, not its interpretation and application by humans, which controls behavior. The Vanjeri records demonstrate not only the importance of dharmastra as a historical document but also the manner and extent to which dharmastra provided the foundation for legal systems in Kerala as well as in other regions of India.  相似文献

Detecting deception is an inherently difficult task, but one that plays a critical role for law enforcement investigators in the interrogation room. In general, research has failed to indicate that performance in this domain is improved by training or prior experience. A signal detection framework is applied to the paradigm to better conceptualize the influence of these two factors. We found that although neither factor influenced discrimination accuracy, there was an effect on response bias such that training and prior experience appeared to increase the likelihood of responding deceit as opposed to truth. This investigator bias was observed both in a review of the literature and in this study of North American law enforcement investigators who took part in a forensically based deception-detection task. Possible theoretical mechanisms and practical implications of these findings are discussed.  相似文献

Today Europe is faced increasingly with the phenomenon of organized crime, creating problems similar to those the United States faced as early as a decade ago. American forfeiture and money laundering laws provide the state with sweeping powers for use in its efforts to combat organized crime. Although study of these instruments might inspire European lawmakers to adopt similar ones, the instruments themselves carry a societal price tag that cannot be ignored. Classical principles limiting the reach of the criminal law (and the powers of its enforcement apparatus) and in a broader sense the liberal concept of the fragmentary nature of the criminal law have largely been abandoned by lawmakers in the area of organized crime. Thus, modern American forfeiture and money laundering laws have lowered the standards of protection against state intrusion into citizens' basic rights despite the lack of sufficient empirical proof that their investigative and punitive powers are efficient in skimming profits and deterring further crime.  相似文献

The main aim of this paper is to challenge the validity of the distinction between legal justice and social justice. It is argued that what we usually call legal justice is either an application of the more fundamental notion of social justice to legal rules and decisions or is not a matter of justice at all. In other words, the only correct uses of the notion of legal justice are derivative from the notion of social justice and, hence, the alleged conflicts between criteria of social and legal justice result from the confusion about the proper relationship between these two concepts. Two views about the social justice/legal justice dichotomy are of particular importance and will provide the focus for the argument: this dichotomy is sometimes identified with a classical distinction between distributive and commutative justice and sometimes with the distinction between substantive and procedural justice.  相似文献

The study proposes a taxonomy that maps and organizes various normative (ought) and empirically oriented (is) theories of distributive justice, with the aim of examining possible relations between these two research traditions. The taxonomy distinguishes between theories according to two shared dimensions of content: (a) microjustice versus macrojustice principles and (b) the unidimensional versus multidimensional character of these principles. The combination of these dimensions yields four groups of theories of distributive justice: unidimensional macro (the utilitarian approach); multidimensional macro (Rawls' theory of justice); unidimensional micro (desert and equity theories); and multidimensional micro (Miller's theory and the multiprinciple approach). A fifth group of hybrid theories is identified (including Walzer's and Jasso's theory of justice), which is built upon the layers of the other taxonomy cells, combining elements of macro- and microjustice and emphasizing the multidimensional character of distributive justice. The analysis revealed that the empirical and normative traditions have much in common. In certain cases, as with the utilitarian approach and Rawls' theory, empirical research has sought correspondence between the ought and the is. In other cases, such as with equity theory and the multiprinciple approach, it has used some basic normative ideas and assumptions as its starting point. Nevertheless, these research traditions often develop in parallel ways without sufficient mutual recognition or interaction. The study concludes by considering possible exchanges that may develop between these two traditions, examining to what extent and how philosophical–normative and empirically oriented research can contribute to one another.  相似文献

The word oppressive isin quotes because even though the researcherdescribed oppressive instances in specificways, there were times, where some subjects didnot identify those experiences asoppressive. The majority of 60 female CanadianDetectives identified oppressive experiences,and an important task of this paper is toexamine experiences that fit the researchersdefinition but were not considered oppressiveby the subjects.  相似文献
