This article investigates the extent to which public higher education institutions participate in state-level arts policy through a history of selected budgets and a textual analysis of performing arts presenting centers at public higher education institutions in Virginia. Evidence from this research suggests that the arts policy field is altered by the emergence of public higher education institutions as policy actors. The findings have financial and decision-making implications for arts policy makers, university administrators, and arts agencies as the participation of public higher education institutions affords new opportunities and challenges for the state encouragement of the arts.  相似文献

This article explores the role of formal education and specific legal knowledge in the process of legal mobilization. Using survey data and in‐depth case narratives of workplace disputes in China, we highlight three major findings. First, and uncontroversially, higher levels of formal education are associated with greater propensity to use legal institutions and to find them more effective. Second, informally acquired labor law knowledge can substitute for formal education in bringing people to the legal system and improving their legal experiences. The Chinese state's propagation of legal knowledge has had positive effects on citizens' legal mobilization. Finally, while education and legal knowledge are factors that push people toward the legal system, actual dispute experience leads people away from it, especially among disputants without effective legal representation. The article concludes that the Chinese state's encouragement of individualized legal mobilization produces contradictory outcomes—encouraging citizens to use formal legal institutions, imbuing them with new knowledge and rights awareness, but also breeding disdain for the law in practice.  相似文献

在全球化中知识产权保护不断强化、中央提出建设创新型国家的大背景下,我国的知识产权保护面临着挑战和机遇。基于对世界上主要国家、地区知识产权制度与相关国际条约及其对我国的影响之考察,对各国及国际的知识产权保护中值得借鉴之处的分析,我们应当做的是:一方面利用知识产权制度业已形成的高端保护推动国民在高新技术与文化产品领域搞创造与创作这个“流”,另一方面积极促成新的知识产权制度来保护我们目前可能处优势的传统知识及生物多样化这个“源”。这样,才更有利于加快我国向“知识经济”与和谐社会发展的进程。  相似文献

When negotiating the new educational programmes the Council and the Commission of the EC had to deal with a profound controversy as to whether or not the programmes should aim for the creation of a European educational area. This reflects the question of whether the Community can work towards some sort of unification of the different educational systems of the Member States. As the Treaty of the European Community prohibits any harmonisation in this field the European institutions can only work towards a growing closer of the different systems by encouraging the Member States and the educational and training institutions to go this way. Such an outcome can be fostered by the legal framework protecting the individual rights of non discrimination and of free movement of workers and of services as well as of establishment on the one side and by indirectly effective and not binding measures on the other side. This influence can be achieved by the European education programmes, the common efforts to face the challenges of the knowledge society and the global competition, the incentives to ameliorate the quality of education and training and to improve the individual employability. However, harmonisation will mean losing the richness of European diversity. Instead of unifying the systems transparency and mutual recognition of individual qualifications could lead to the desired European dimension without endangering the cultural backgrounds and the responsibility of the Member States for education and training. Over the last several years, criminal justice education In the United States has increased dramatically. Much of this growth has been in response to the needs of an evolving criminal justice field. However, there is some concern among professionals that the criminal justice system needs to be impacted more directly, and that institutions of higher learning need to be impetus for this change. To complete this task, curricula in higher education programs need to become more relevant to the needs of the system, while not ignoring the student of the educational system. This paper discusses the role of higher education institutions within the framework of the knowledge triangle between academic education, scientific research and innovation, as it has gained importance in recent years as a framework for innovation policies especially in the OECD and Europe. First, complementary concepts of universities’ outreach activities and extended role model such as ‘third mission’, ‘triple helix’, ‘entrepreneurial or civic university’ models and ‘smart specialization’ are reflected against their fit with the concept of the knowledge triangle, also with respect to new requirements for university governance. Second, a new understanding of spillovers between public sectors research and the business sector according to knowledge triangle is presented.

This book by N. S. Barabasheva is an integrated study of the legal status of higher educational institutions in the unitary system of public education of the Soviet state, a system that is determined by the USSR Constitution and the Principles of USSR and Union Republic Legislation on Education, the Statute on Higher Educational Institutions, and a number of other acts of positive law. The author emphasizes that the status of a higher educational institution as an institution under law is indissolubly associated with the condition, tasks, and prospects of development of higher education. The author offers an opportunity to identify the set of rights and responsibilities of higher educational institutions and the present state of legal regulation of their organization and activity, and to investigate the real opportunities for improving higher educational institutions. The study under review makes it possible to conduct an "inventory" of the provisions of law bearing on the work of higher educational institutions scattered through many legal sources and still inadequately codified, a fact that is important in terms of the drafting of the Legal Code of the USSR.  相似文献

This article attempts to detail the range of assumptions and challenges in designing an undergraduate university degree in digital creative industries. Leaders in digital industries, who bemoan the general skills shortage and lack of “industry-ready” graduates, have identified the need for post-secondary education in this area. But in developing these new courses, how do we reconcile the traditional reflective, critical modes of academic practice with the fast and dynamic pace of the dot.com industries? How can slower-paced higher education and lifelong learning be meaningful to the current and future generations of digital natives who thrive on “just-in-time” knowledge? These important issues are analyzed and built upon to showcase the unique qualities and opportunities associated with tertiary education in this area. Overall, the article develops these high-level considerations practically by applying them to a pioneering undergraduate course in Australia that was launched in 2014.  相似文献

This article provides a case study on embedding employability skills into law courses at one higher education institution. The aim of the project was to further embed employability skills within curriculum delivery as part of a holistic student skills development strategy. The authors used the four-stage process, suggested by the Higher Education Academy’s Framework on Embedding Employability in Higher Education to design the project: defining employability, reviewing and mapping current employability skills, prioritising actions and measuring impact. The authors draw out three ways in which the project has wider potential relevance. From an educational theory perspective, the project represents a way to embed employability skills in a Framework for Higher Education Qualifications level appropriate way, through reference to Biggs’ taxonomy of learning. For higher education institutions, the project is particularly topical in light of the rapidly changing regulatory landscape that is becoming increasingly skills focused in nature. It is suggested that embedding employability in law courses now will assist future institutional engagement with the potentially new route to qualifying as a solicitor through the Solicitors Qualifying Examination. Individual law teachers also reported benefits to embedding employability skills in tutorial sessions from a classroom management perspective.  相似文献

Evolving technologies have created many exciting opportunities to increase the availability of legal information, and to facilitate the organization and publication of this information. With the globalization of almost all legal issues, increased access to primary and secondary resources in electronic format across jurisdictional lines has been a welcomed development by academics, lawyers, international business entities, and others. However, the myriad of legal systems and approaches to maintaining legislative and judicial records has led to a host of challenges in regard to coherent and efficient management of legal information. Focusing on development of legal information systems in China and the United States, this paper will open with a summary of the exciting current and emerging technological advances in legal research methodologies and in the electronic publication of cases, statutes, regulations and other critical resources. The paper will then analyze corresponding challenges, including authenticity, accuracy, currency and consistency. The analysis will include discussion of the varying quality of legal information resources proliferating in the Internet, as well as the host of issues surrounding electronic publishing of legal information by government entities and commercial enterprises. The paper will conclude with a prospective analysis of the manner in which emerging technologies can enhance knowledge management of legal information and strengthen legal systems in both common law and civil law jurisdictions.  相似文献

In recent years, students in police academies and higher education institutions around the world have worked together to analyse cold cases including long-term missing persons cases in collaboration with investigators and prosecutors. In 2020, three European organisations, the Police Expert Network on Missing Persons (PEN-MP), AMBER Alert Europe and Locate International, succeeded in connecting these educational organisations enabling them to work collectively on cases and conduct cold case analyses (CCA) across international borders. The International Cold Case Analysis Project (ICCAP) learning objectives were to 1) collect the necessary information about the victim, 2) reconstruct the crime, and 3) investigate trace control.In a learning objective-based evaluation using Computer-Assisted Web Interviewing, 76 participating students from the German and International ICCAP teams were asked to complete a pre- and post-review questionnaire to self-assess their personal competence development. Participants reported significant increases in competence in all evaluated areas, thus demonstrating that authentic and relevant collaborations can enrich the learning environment, promote the use of professional skills, and provide significant knowledge exchange opportunities between academia and industry.Drawing on case studies of cold case missing persons' investigations and unidentified found remains, this article shares how university academics, students and community volunteers can work together nationally and internationally to find out what has happened to missing people and how we can more effectively identify the previously unidentified. In so doing, we share the expertise required to progress these cold cases and provide recommendations to support other institutions and organisations in adopting this innovative approach.  相似文献

In this paper we describe and analyse IP-based spin-offs as a relatively new phenomenon for transferring knowledge from science to industry. We argue that the effectiveness of this mechanism is subject to a complex array of institutional factors. These factors entail national, sectoral, regional and managerial institutions. Based on an indicative comparison between the Netherlands and the United States we find that is especially the combination of national and sectoral institutions that condition whether an IP-based spin-off is established in the first place, whereas regional and managerial institutions condition its subsequent chances of success. International rivers create complex relationships between their riparian states, which can contribute to economic, political, and social losses. Treaties provide a means for states to coordinate their actions in managing international river disputes to minimize these losses. However, there is little knowledge about treaty content and the factors influencing treaty design. We test whether a relationship exists between the challenges of negotiating, complying, and distributing the gains in bilateral, multilateral, and basin-wide negotiation contexts and the depth of cooperation along with the degree of institutionalization. While the great challenges confronting multilateral or basin-wide negotiations can produce treaties that focus on joint gains and shallow cooperation to secure the signature of riparians, we find that they can also provide opportunities for deeper, more behavior-altering, cooperation. To manage the difficulties of maintaining multilateral cooperation, we find a higher degree of institutionalization. We also find that bilateral negotiations provide states with opportunities for deeper cooperation, but a lower degree of institutionalization.  相似文献

Abstract

Plagiarism is one of the most serious offences in the academic world. It has occurred as long as there have been teachers and students, but the recent growth of the Internet has made the problem much worse. Recent studies indicate that approximately 30% of all students may be plagiarising on every written assignment they complete. The “information technology revolution” is almost always presented as having cataclysmic consequences for education. In post‐secondary circles, perhaps the most commonly apprehended cataclysm is “Internet plagiarism”. Academics at all British universities and colleges can now test students’ work for cheating using the anti‐plagiarism program Turnitin. The program, run by the Joint Information Systems Committee and thought to be the first national system of its kind, offers free advice and a plagiarism detection service to all further education institutions in the UK. This article will try to: first, define exactly what plagiarism is; second, give examples and reports on samples of the new plagiarism detection software; and finally suggest strategies that lecturers can use before turning to the new software.  相似文献

行政法学界对高等教育领域的行政法问题的研究起步较晚,但近几年来,关注程度渐高,研究力量渐强,学术成果渐多,已成为行政法学研究的一个新的亮点。在这一过程中,公民的维权诉求、司法审判的突破和行政法学者的直接参与无疑发挥了重大作用。在中国走向法治的背景下,高等教育改革与发展过程中政府管理和高校治理出现的新问题将更多地被提到法律的层面,行政法学研究也将面临更多的机遇和挑战。高等教育行政法学研究将呈现出由研究内部问题到研究外部问题、从局部研究到系统研究、由关注司法实践到关注立法完善、由依托一般原理到构建部门体系的趋势。  相似文献
