一、司法强制措施中的人权(一)司法强制措施中的人权概念司法强制措施中的人权,发生在采取司法强制措施过程中,实质是国家利用司法权解决冲突时,怎样看待个人的价值问题。“人不是为社会和国家而存在,而是社会和国家是为人而存在。人是目的,社会和国家是手段,而不是相反。     

刑事司法与人权保障
