Conflict resolution professionals sometimes differ from human rights professionals about the best approaches to transitional justice, particularly with regard to the scope, conditions, and timing of possible amnesties from prosecution for perpetrators of war crimes and human rights abuses. When human rights and conflict resolution professionals work at cross‐purposes, they may work less effectively to end conflict, abuses, and crimes, and to implement peace accords. A consensus among conflict resolution and human rights scholars about which legal norms should govern post‐conflict amnesty programs appears to be developing. Against this emerging legal framework, human rights and conflict resolution professionals should, I argue, develop processes for working together more effectively in the design and implementation of context‐sensitive approaches to transitional justice. These process principles should address the entire conflict period, from escalation through resolution to post‐conflict reconstruction. In this article, I describe a tentative, general framework for coordinating the development of transitional justice programs. This proposed framework is intended to stimulate and guide discussion of these issues among conflict resolution and human rights professionals and scholars.  相似文献

The 2014 Israel–Gaza war was the third of a string of conflicts to erupt between the State of Israel and Hamas in neighbouring Gaza and quickly became the deadliest for both sides. Even with the extensive media attention this crisis received, calls for more objective reporting were widespread, as locating sources that were not clearly influenced or reflective of political biases seemed near impossible. This paper seeks to explore the role “cultural proximity” plays in informing casualty count reporting in times of conflict. Qualitative content analysis is conducted on news coverage of the 2014 Israel–Gaza conflict in the American daily newspaper, The New York Times, and the Israeli daily newspaper, Haaretz, to assess whether significant differences exist in the way casualty figures are addressed across varying degrees of political and cultural involvement. This research reveals that variations in casualty count reporting do indeed exist across cultural and national contexts, and deems this subject worthy of further research.  相似文献

This article discusses an extension to the Thomas–Kilmann conflict mode instrument (Thomas and Kilmann 1977) designed specifically for conflict situations in which strong negative emotional relationships are at play. The Thomas–Kilmann (TK) model is widely used to help participants (disputants and mediators) identify how two basic conflict characteristics interact to influence how stakeholders shape their actions with regard to their interests. Essentially the TK Model is built on the premise that the two salient conflict variables are the relative importance of the relationships at hand and the substantive issues being discussed. These variables are illustrated with a simple matrix that shows how each party will interact with the other based on the relative importance it places on these variables. Graphically illustrating where the behaviors fall on the matrix can explicate parties' behaviors to add a new perspective that may change the dynamic of the conflict. But the TK Model does not address scenarios in which individuals have very negative or destructive relationships, and sabotage, blocking, and exclusion are behavioral norms. Hence, we developed the Baumoel–Trippe (BT) Extension to the TK Model to address the highly negative and often identity‐based conflicts that are often found in the world of family business. Accordingly, the BT Extension to the TK Model explores conflicts in which the relationships are not merely unimportant or uncooperative, but where they become negative to downright vengeful. There is so much at stake for family business stakeholders that the family relationships may become so adversarial that the very business and family harmony all parties value are at risk. With our extension of the TK Model, we seek to provide insight into how decisions might be made when stakeholders are in highly negative, conflictual relationships.  相似文献

Over the last decade the issue of transitional justice has attracted considerable media and academic attention. Diverse countries including such high profile cases as Chile, South Africa and the former East Germany have attempted to grapple with the complex question of how to respond to human rights abuses committed under a previous regime. Transitional justice generally surfaces as an issue during democratic transition. It is less common for this issue of past human rights abuses to be raised when democratic transition has been completed and democracy is fully consolidated. The subject of this article, however, is Spain, where the human rights abuses committed during the 1936–39 civil war, and the long Francoist dictatorship that followed, have only recently come to the fore, a full quarter of a century after the transition to democracy. The article argues that the current struggle to recover the bodies of the disappeared, and their historical memory, represents a significant case which not only provides new insights into the particular democratization process in Spain but also provides more general lessons for other countries grappling with similar problems.  相似文献

The study of nationalist and ethnic conflict has undergone considerable growth since the end of the Cold War. Much of the effort has been focused on ascertaining the nature and origins of such conflicts, and less on their process and termination. Those studies that do focus on conflict termination have generally done so using case‐study or idiosyncratic methods. Hence, we do not yet have much large‐N or statistical evidence that might suggest broad trends in how such conflicts end, or even much experience in measuring the relevant concepts in a manner conducive to such methods. This paper will address these questions by introducing a theoretical framework that seeks to explain the outcomes of violent intrastate nationalist conflicts. It will discuss measurement issues for relevant independent variables, and present data for a group of 75 violent, intrastate nationalist conflicts from 1945–1996. This data will then be used to test propositions derived from the model. The aim is to provide a useful building block for the study of the process and outcome of conflicts which political scientists now recognize to be some of the most important for the coming century.  相似文献

Building on the mandate theory of democracy and literature on media coverage of elections, this article theorizes why information regarding party promises that is transmitted through the media could affect the former’s fulfillment. Utilizing a unique data set composed of 2,676 promises issued by 14 legislative parties over a 15-year period in post-communist Bulgaria, the study is among the first to longitudinally analyze the role of media in pledge fulfillment, while controlling for institutional and other explanations. The conclusions demonstrate that media reporting of election promises affects the fulfillment of pledges made by coalition parties, when more than one outlet has printed a promise, and under conditions of strong ideological divisions within the cabinet. Furthermore, the impact of media reporting is greater for pledges that do not otherwise have a high likelihood of being fulfilled.  相似文献

Escalation of conflict, the use of progressively more contentious tactics, is not always intended. It may occur when parties become preoccupied with ideas or feelings that impair their ability to comprehend the situation and focus on the conflict issues. Action springing from such preoccupation can initiate a set of feedback loops that are self-amplifying. In this article, I suggest that by raising their present moment awareness through formal meditation and informal day-to-day mindfulness practice, parties may reduce preoccupation and thereby amplification. Drawing on Friedrich Glasl's stages of escalation and Magorah Maruyama's work on change-amplifying feedback loops, this article examines how mindfulness might contribute to a greater awareness of psychological and systemic factors that predispose disputants to escalation of their conflict.  相似文献

The legacies of mass violence can, if left unaddressed, fuel future conflicts. Transitional justice seeks to address the legacies of large-scale past abuses. Despite the sensitive nature of transitional justice and recognition that initiatives can adversely influence conflict-affected contexts, there has been limited attempt to extend the application of conflict sensitivity to transitional justice. Conflict sensitivity is an approach and tool to help aid actors to understand the unintended consequences of aid and to act to minimise harm and achieve positive outcomes. Transitional justice initiatives can exacerbate tensions by replicating existing tensions; introducing resources that become a struggle for control; or challenging power and vested interests. This article argues that conflict sensitivity should be applied to transitional justice; and identifies tools and factors that could contribute to conflict sensitive transitional justice. They include promoting: broad-based participation; resonance with local actors; social cohesion; public outreach; collaboration with other sectors; and appropriate sequencing.  相似文献

Conflicts in the 21st century differ from past conflicts based on two central factors: the level of asymmetry and disparity between the actors taking part in the conflict and the amount of foreign media coverage that a conflict receives. This article aims to develop a new theoretical perspective on the implications of these two factors on how the involved states manage a conflict. Most actors in current conflicts have vast levels of disparity and receive extensive media coverage; events in those conflicts are referred to as occurrences in the “information space” because a conflict's borders are anywhere people can receive information about it. “Imagefare”—the use of images as a guiding principle or a substitute for traditional military means to achieve political objectives—is argued to be the main tool for better facing adversaries in the information space.  相似文献

China's efforts to secure foreign oil and natural gas to meet its growing energy demand are contributing to massive human rights violations in Sudan and Burma. These human rights conflicts, significantly influenced by abundant oil and gas reserves, have strained U.S.-China relations and complicated international efforts to create a more effective architecture to address both rights crises and conflict management over energy resources. The United States and its allies should not only engage Beijing but also bring Chinese national oil companies into the international energy market as stakeholders. Failure to address these matters could encourage other parties seeking scarce energy supplies to take similar compromises on human rights as they court questionable oil regimes, a development that would be detrimental to international peace and security.  相似文献

Enduring rivalries represent the most difficult challenges for policy makers seeking to promote international peace and security. Once in place, enduring rivalries account for a disproportionate number of crises, militarized disputes, as well as wars, and include conflicts that are more likely to escalate than those falling in other conflict contexts. Unfortunately, we know very little about conflict management in enduring rivalries from either a theoretical or policy perspective. This study seeks to account for why some rivalries are successfully managed while others persist at high and unabated levels of conflict In addressing these concerns, we explore 35 enduring rivalries over the period 1945–1992. We find that although enduring rivalries are quite resistant to influences that produce changes in their dynamics, both endogenous and contextual influences can exercise a significant impact upon the prospects for conflict management between enduring rivals.  相似文献

Armed nonstate conflict without the direct involvement of the state government is a common phenomenon. Violence between armed gangs, rebel groups, or communal militias is an important source of instability and has gained increasing scholarly attention. In this article, we introduce a data collection on conflict issues and key actor characteristics in armed nonstate conflicts that provides new opportunities for investigating the causes, dynamics, and consequences of this form of organized violence. The data builds on and extends the Uppsala Conflict Data Program Non-State Conflict data set by introducing additional information on what the actors in the conflict are fighting over, alongside actor characteristics. It covers Africa during the time period 1989–2011. The data set distinguishes between two main categories of issues, territory and authority, in addition to a residual category of other issues. Furthermore, we specify sub-issues within these categories, such as agricultural land/water as sub-issue for territory and religious issues for other issues. As actor characteristics, the data set notes whether warring parties received military support by external actors and whether religion and the mode of livelihood were salient in the mobilization of the armed group. The article presents coding processes, key features of the data set, and point to avenues for new research based on these data.  相似文献

Extant research is not very specific about when the media matter for vote choice. In this study, we test multiple theories about the influences of the media on vote choice in 21 countries. The European Parliamentary (EP) election campaign offers a unique research context to test these influences. We rely on a two-wave panel survey conducted in 21 European Union (EU) member states, asking both vote intentions before the campaign and reported actual votes (among 14,000 voters). We link these data to media content data of campaign coverage between the two waves in these countries (37,000 coded news items). We conclude that media evaluations of the EU affect voting for Eurosceptic parties. On average, the more positive the evaluations of the EU a voter is exposed to, the less likely she or he is to cast a vote for a Eurosceptic party. In addition, our findings indicate that in countries where political parties have markedly different views on EU issues, the more a voter is exposed to framing of the EU in terms of benefits derived from membership in these countries, the less likely she or he is to cast a Eurosceptic vote. This suggests that the outcome of the 2009 EP elections was influenced by how the media covered EU-related news during the campaign.  相似文献

Quantitative literature discussing violence in civil conflicts tends towards a typical model of engagement between governments and revolutionaries. Whilst recent work has shown the significant impact of multiple anti-government groups, a further feature remains understudied—the role of pro-state militants. This article theorizes a “violence premium” when such groups arise, which leads to all connected groups devoting greater energy to conflict than they would in isolation. Employing duration analysis and data from The Troubles in Northern Ireland, where Republicans act as revolutionary insurgents, Loyalists as pro-state militants, and the British Army as government forces, the violence premium is empirically confirmed. Both Loyalists and Republicans deviate from their underlying strategies to attack more frequently when violence by their rivals increases, with Republicans and the British Army engaging in the same way. An extended analysis, accounting for the status of the victim, shows that the violence premium resulting from interaction between Loyalists and Republicans targeted only the civilian population of Northern Ireland, elucidating the sectarian component of The Troubles. These results show that including all conflict parties and considering how they are linked are important features in studies that aim to determine the net level of violence in civil conflicts.  相似文献

This article offers a comparative analysis of the role played by peace and conflict resolution organisations (P/CROs) in Northern Ireland and Turkey in negotiating solutions to ethno-nationalist conflicts in these countries. It argues that P/CROs have been instrumental in de-escalating violence and encouraging conflicting parties to resolve conflict peacefully. Examining both the elite and grass-roots levels, the article assesses P/CROs that have advanced middle-range approaches and track-two dialogue towards peace. Drawing on data from multiple sources, including semi-structured interviews, archival material and official documents, the analysis indicates that P/CROs have a range of tools at their disposal to influence political decision-makers. These include public (and closed) conferences, forums and events attended by current or former politicians, representatives of the conflicting parties and prominent figures and intellectuals in the conflict-affected society, as well as other grass-roots initiatives. The article finds that P/CROs provided help shaping and promoting non-violent processes of conflict resolution between the British Government and the Irish Republican Army (IRA), and the Turkish Government and the Kurdistan Workers’ Party (PKK).  相似文献

Any country which attempts to establish accountability for past abuses of human rights during the process of democratization faces political, judicial, and ethical problems. With regard to politics, the question of which transitional justice measures are appropriate, functional, and feasible has to be decided for every individual case. A judicial approach has to decide which judicial standards to apply and how to justify prosecution. Finally, the ethical dilemmas of dealing with historical injustices have to be understood. There are no ready-made concepts to define guilt and justice. In many cases it is even difficult to tell the victims from the perpetrators. This study examines the different strategies subsumed under the term ‘transitional justice’ used by emerging democracies to deal with a legacy of human rights abuses. It explores the problems and challenges posed by different mechanisms of reconciliation and societal reintegration. While existing analyses of the contribution that transitional justice measures make to the process of social re-integration stress the importance of consensus among citizens and social groups for the emergence of trust and solidarity, this study suggests also thinking about how conflicts over competing ‘truths’ can help to build social capital and reconciliation. Noting a global diffusion of international legal norms, which means at least formal universal acceptance of basic rights and judicial procedures, it is argued that international justice cannot be a substitute for transitional justice measures taken by the domestic regime itself.  相似文献

This research note examines how domestic institutions can moderate the relationship between domestic and interstate conflict involvement. Previous work has found that military dictatorships are more likely to become involved in either domestic or international conflicts, compared to party-based autocracies. We argue that the same institutional explanations for why military autocracies are more conflict-prone also make them less capable of successfully carrying out multiple conflicts at the same time. Analyzing interstate and domestic conflict involvement on a sample of dictatorships over the period 1947–2004, we show that military autocracies dealing with internal armed conflict are less likely than their nonmilitary counterparts to become involved in an international conflict.  相似文献

In today's environment, the international response to conflict often entails multiple mediators as well as other third-party actors such as peacekeeping forces, development agencies, nongovernmental organizations (NGOs), and lone operators. Such a profusion of actors has often made peacemaking efforts messy, difficult, and at times chaotic. The vicious nature of internal conflicts, however, and the high costs for the international community of failing to prevent or end war make it critical to understand these multiple third-party interventions. The principal question is: do these multiparty mediations help or hurt the cause of peace? If the answer to that question is that a multiplicity of third parties can hurt a peace process, does the solution lie in stopping multiple third-party attempts at peacemaking? On the other hand, if the answer is that multiparty mediation can help, are there ways of increasing the chances that it will?  相似文献
