The practice of medical research with minors in Ireland consist of practices pertaining to therapeutic and non-therapeutic medical research. Clinical trials (a category of therapeutic research), is governed by legislation. However, any other therapeutic research (non-clinical trials research) and non-therapeutic research, e.g. observational medical research such as a longitudinal study of children or non-therapeutic research such as blood sample collection for analysis of cause of disease, are unregulated by legislation. This, article will outline and describe some of the medico-legal issues involved in both types of research and will comment on matters such as what national law exists, how the directive on good clinical practice has been implemented, what guidelines, if any, exist.  相似文献

Gait is now widely used in the UK as a contributor to identification, and increasing interest is being shown in its use in both Europe and the US. One of the long standing criticisms of the use of gait as evidence has been the lack of a validated standard methodology. With the publication of the ‘Code of practice for forensic gait analysis’, and the adoption of the code as part of the ‘Codes of Practice and Conduct for forensic science providers and practitioners in the Criminal Justice System’ by the Forensic Science Regulator, forensic gait analysts are now required to provide evidence of the testing of the methods used. The Sheffield Features of Gait Tool is specifically designed to assist observational gait analysis in the forensic context, and was developed by forensic gait analysis practitioners based on their casework and trial experience. Birch et al 2019 reported the findings of a study undertaken to assess the repeatability and reproducibility of the tool. This paper reports the findings of a study undertaken to assess the accuracy with which analysts identified features of gait when using the tool.Fourteen participants, with experience in observational gait analysis, viewed footage of computer generated avatars walking, and completed the features of gait tool on multiple occasions. The results showed a mean accuracy score of 134.92 out of a possible 180 (74.96%), a standard deviation of 9.49 (5.27%) and a coefficient of variation of 7.03%, demonstrating a good degree of consistency between the scores (Cronbach’s alpha <0.90; ANOVA p-value <0.05).The findings of this study, coupled with those of the Birch et al 2019 study which showed there to be good levels of both repeatability and reproducibility of observations of features of gait made by the participants, suggest that the Sheffield Features of Gait Tool is a valid and fit for purpose method of observing and recording features of gait in the forensic context. The use of the tool provides the basis of a standardised methodology for observational gait analysis in the forensic context.  相似文献

This article proposes a new method for examining dynamic changes in thespatial distribution of a phenomenon. Recently introduced exploratoryspatial data analysis (ESDA) techniques provide social scientists with anew set of tools for distinguishing between random and nonrandom spatialpatterns of events (Anselin, 1998). Existing ESDA measures, however, arestatic and do not permit comparisons of distributions of events in the samespace but across different time periods. One ESDA method—the Moranscatterplot—has special heuristic value because it visually displayslocal spatial relationships between each spatial unit and its neighbors. Weextend this static cross-sectional view of the spatial distribution ofevents to consider dynamic features of changes over time in spatialdependencies. The method distinguishes between contagious diffusion betweenadjoining units and hierarchical diffusion that spreads broadly throughcommonly shared influences. We apply the method to homicide data, lookingfor evidence of spatial diffusion of youth-gang homicides acrossneighborhoods in a city. Contagious diffusion between neighboring censustracts is evident only during the year of peak growth in total homicides,when high local rates of youth-gang homicides are followed by significantincreases in neighboring youth- nongang rates. This pattern is consistentwith a spread of homicides from gang youth to nongang youth. Otherwise, theincreases in both youth-gang and youth- nongang homicides generally occursimultaneously in nonneighboring tracts.  相似文献

Event studies are among the most successful uses of econometricsin policy analysis. By providing an anchor for measuring theimpact of events on investor wealth, the methodology offersa fruitful means for evaluating the welfare implications ofprivate and government actions. This article is the first ina set of two that review the use and impact of the event studymethodology in the legal domain. This article begins by brieflyreviewing the event study methodology and its strengths andlimitations for policy analysis. It then reviews in detail howevent studies have been used to evaluate the wealth effectsof corporate litigation: defendants experience economicallymeaningful and statistically significant wealth losses uponthe filing of the suit, whereas plaintiff firms experience nosignificant wealth effects upon filing a lawsuit. Also, thereis a significant wealth increase for defendant firms when theysettle a suit with another firm, in contrast to other typesof plaintiffs, and in contrast to the settling plaintiff firms.These findings suggest that, at a minimum, lawsuits are nota value-enhancing way for corporations to settle their disagreementswith other corporations. In addition, the market appears toimpose a higher sanction on firms than actual criminal sanctions,and reputational losses are of equal magnitude for civil finesas for criminal ones. The article concludes with some recommendationsfor researchers: the standards for conducting an event studyare well established; researchers can increase the power ofan event study by increasing the sample size, and by narrowingthe public announcement period to as short a time frame as possible.The companion article reviews the use of event studies in corporatelaw and regulation.  相似文献

The article analyses the degree of substantive representation by immigrant-origin MPs in Germany's national and state parliaments. To test the expectation that an immigration background increases the likelihood of engaging with migration-related topics, an analysis is undertaken of all parliamentary questions (PQs) formally asked by immigrant-origin MPs in Germany's national and state parliaments between 1987 and 2009. By controlling for several time-invariant and time-variant factors, the longitudinal analysis confirms that a visible immigration background results in asking more migration-related PQs. While several contextual, party-political and personal (career) factors influence the likelihood of asking such questions in parliament, there is no evidence for a decrease over time. Presence effects are significant and of lasting nature. This means that the parliamentary presence of immigrant-origin MPs with a visible background goes beyond sheer symbolic representation.  相似文献

Spirituality is a component of many drug and alcohol treatment strategies, and faith‐based programming is also common within prison settings. Yet research on religiosity—crime linkages has often relied on general youth or adult samples or has included a short time line for gauging positive effects. Life‐course researchers focused on serious delinquents, in turn, have often emphasized other factors associated with long‐term crime patterns, such as marital attachment and job stability, or the criminality of the individual's social ties. This study draws on quantitative and qualitative data derived from a long‐term follow‐up of a sample of serious adolescent male and female offenders to explore the role of spirituality and religious participation as influences on adult patterns of criminal involvement (N= 152). The respondents were first interviewed as adolescents, in 1982, and again as adults in 1995 and 2003. Results of longitudinal analyses that take into account self‐report and incarceration histories at both time periods do not reveal a significant association between these indices of religiosity and the likelihood of evidencing a pattern of sustained desistance. Our analysis of indepth life‐history interviews conducted with most respondents over these two time periods and 41 additional interviews focused specifically on spirituality and religion are used to explore in more detail the promise and challenges associated with relying on religiosity as a catalyst for sustained behavior change.  相似文献

This paper builds upon two prior papers by Haviland and Nagin (Psychometrika 70:1–22, 2005) and Haviland, Nagin, and Rosenbaum (Working paper, 2006) that attempt to bring the key attributes of an experiment to the analysis of non-experimental longitudinal data. Using a case study of the facilitation effect of gang membership on violence, it systematically examines the contribution of group-based trajectory modeling to the achievement of covariate balance in observational data. In this case study, inclusion of the posterior probabilities of group membership (PPGM), from a model on the pre-treatment measures of the outcome variable, created closer balance on these key covariates than did analyses that did not include them. Still closer balance was obtained on these key covariates by stratifying the analysis by trajectory group. This stratification was achieved by fitting separate propensity score models and matching gang joiners to gang abstainers within trajectory group. In addition, we demonstrated that further balance could be obtained on additional covariates by including PPGM from a model on pre-treatment longitudinal data of these covariates. While this case study is only one empirical example, we believe that it provides useful empirical evidence on the value of performing within trajectory group causal inference in observational longitudinal data and on the use of the PPGM in achieving balance in propensity score-based causal inference.

She currently works on applications in criminology, health and health economics. Daniel S. Nagin   is Teresa and H. John Heinz III Professor of Public Policy and Statistics at Carnegie Mellon University. His research interests include the developmental course of violent and other criminal behavior, the preventive effects of criminal and non-criminal sanctions, and statistical methods for the analysis of longitudinal data. This article examines the decisional consistency of U.S. Supreme Court justices with lower collegial court experience in a twofold effort to expose the potential policy implications of consistent or inconsistent behavior and to show the value of longitudinal analysis of individual rather than aggregate decisional patterns. The results show a fairly high level of consistent behavior but with marked differences across the case subjects. The article concludes with an assessment of the implications for justice selection processes and Supreme Court decision-making theory.  相似文献

This paper is focused on the uncertainty of simulation results in accident reconstruction. The Upper and Lower Bound Method (ULM) and the Finite Difference Method (FDM), which can be easily applied in this field, are introduced firstly; the Response Surface Methodology (RSM) is then introduced into this field as an alternative methodology. In RSM, a sample set is firstly generated via uniform design; secondly, experiments are conducted according to the sample set with the help of simulation methods; thirdly, a response surface model is determined through regression analysis; finally, the uncertainty of simulation results can be analyzed using a combination of the response surface model and existing uncertainty analysis methods. It is later discussed in detail how to generate a sample set, how to calculate the range of simulation results and how to analyze the parameter sensitivity in RSM. Finally, the feasibility of RSM is validated by five cases. Moreover, the applicability of RSM, ULM and FDM in analyzing the uncertainty of simulation results is studied; the phenomena that ULM and FDM can hardly work while RSM can is found in the latter two cases. After an analysis of these five cases and the number of simulation runs required for each method, both advantages and disadvantages of these uncertainty analysis methods are indicated.  相似文献

Objectives

Investigate the spatial concentrations and the stability of trajectories for disaggregated crime types on street segments and intersections in Vancouver, Canada.

Methods

A longitudinal analysis of 16 years of crime data using street segments and intersections as the units of analysis. We use the k-means non-parametric cluster analysis technique considering eight crime types: assault, burglary, robbery, theft, theft of vehicle, theft from vehicle, other, and total crime.

Results

The overall results for the individual crime types versus overall crime are similar: crime is highly concentrated regardless of crime type, most street segment and intersection trajectories are stable over time with the others decreasing, and most decreasing trajectories are in the same general areas. However, there are notable differences across crime types that need to be considered when attempting to understand spatial pattern changes and implement crime prevention initiatives.

Conclusions

The law of crime concentration at places holds in Vancouver, Canada for disaggregated crime types in the context of spatial concentrations and their stability over time. However, notable differences exist across crime types that should be accounted for when developing theory or policy.

Policing terrorism has increased in recent years. Correspondingly, policing scholars and practitioners have begun to consider the potential effects of this responsibility on the performance of the police and their relationship with the public. In this article, we use a qualitative analysis of annual police reports to examine how the Israel National Police perceived its role in counterterrorism and the potential implications. We find different perceptions in different periods and partial acknowledgment of potential outcomes. We consider the views of the police in relation to those of the public, and speculate on the differences between the three examined time periods.  相似文献

This article takes a retrospective look at legal advocacy on behalf of Central American asylum seekers, which has been influential in the development of US asylum law and in the creation of an infrastructure to address immigrants' needs. The article considers three time periods when Central Americans have been deemed to fall outside of the category of refugee: (1) the 1980s, when US administrations argued that Central Americans were economic immigrants; (2) the 1990s, when civil wars in El Salvador and Guatemala came to an end; and (3) the 2000s, when some Salvadoran youths in removal proceedings have argued that they faced persecution as perceived or actual gang members. This retrospective analysis highlights the ways in which law can be creatively reinterpreted by legal actors, as well as how legal innovations carry forward traces of prior historical moments.  相似文献

This article examines the relationship between time and authority in courts of law. Newness, in particular, poses an obstacle to a court's efforts to establish authority because it tethers the institution to a timeline in which the human origins of the court and the political controversies preceding it are easily recalled. Moreover, the abbreviated timeline necessarily limits the body of legal authority (namely, the number of judgments) that could have been produced. This article asks how a court might establish its authority when faced with such problematic newness. Based on extensive ethnographic research at the Caribbean Court of Justice, I demonstrate how the staff and judges at this relatively young tribunal work to create a narrative in which the Court transcends its own troublesome timeline. They do this by attempting to construct a time‐transcendent principle of Caribbeanness and proffering the Court as a manifestation of this higher authority. The Court's narrative of its timelessness, however, is regularly challenged by far more familiar tales of its becoming, suggesting that in this court, as in all courts, the work of building and maintaining authority is ongoing.  相似文献

Much of the knowledge about police behavior on the streets is based on observational research. Little research, however, had examined the impact of reactivity in police observational data. One theme in the field research literature was that observer behavior could act as a source of bias in observational data. This article uses data from a large-scale observational study of police to predict this form of reactivity during encounters with suspects. In other words, “Are observer effects triggered by situational factors (i.e., dangerous suspects or situations) or a function of observer characteristics?” Results from a two-level hierarchical logistic model indicated that observers with higher academic rank (e.g., advanced graduate students), lower grade point averages, and more conservative attitudes toward criminality were less likely to get involved in police work during encounters with suspects. The implications of these findings for recruiting and training police researchers are discussed.  相似文献

BACKGROUND: It is well established that staff attitudes to personality disordered patients are commonly negative, characterised by pessimism and rejection. A recent study in forensic psychiatric hospitals has described the psychological and social factors underlying positive attitudes, and suggested that staff with more positive attitudes perform better and are less stressed. AIM: To assess whether it is possible to predict which staff will adjust positively to working with personality disordered people. More specifically to confirm links between attitude to personality disorder and: job performance; perception of managers; personal well-being; burnout; and interaction rates with inmates. METHODS: The opening of a new Dangerous and Severe Personality Disorder unit within a UK prison allowed a longitudinal study of prison officers to be performed, in which a number of measures, including the Attitude to Personality Disorder Questionnaire (APDQ), were collected at three fixed points (at baseline, eight and sixteen months after the opening of the unit). RESULTS: Attitude to Personality Disorder varied over the course of the study, and changes in attitude were linked to events experienced by individual officers. More positive attitude to personality disorder was associated with improved general health and job performance, decreased burnout, and favourable perception of managers. CONCLUSIONS: Attitude to Personality Disorder has important outcomes, and is responsive to the psychosocial environment. Its measurement is not useful for staff selection, because of low stability over lengthy time periods. The APDQ has been demonstrated to be valid measure of attitude to PD, and potentially useful for outcome studies, or benchmarking between units.  相似文献

A rapid, accurate, precise, reproducible, economical, and environmentally gentle method using capillary electrophoresis (CE) is presented for the routine analysis of methamphetamine, amphetamine, MDA, MDMA, MDEA, and cocaine in seized drugs. The methodology uses a 32 cm by 50 microm capillary (length to detector 23.5 cm) with a commercially available buffer kit and diode array UV detection. Dynamic coating of the capillary surface is accomplished by flushing with base for 1 min, a proprietary polycation for 1 min, and then a proprietary polyanion for 2 min. This approach provides a relatively high and stable electroosmotic flow (EOF), even at low pHs. The background electrolyte (BGE) contains 75 mM phosphate buffer (pH 2.5) with the same polyanion as above. Using this methodology, amphetamine, methamphetamine, MDA, MDMA, MDEA, and an internal standard (n-butylamphetamine) are baseline resolved in less than 5 min. The run-to-run migration time %RSDs and peak area %RSDs are typically <0.3% and <2.1%, respectively. The day-to-day and capillary-to-capillary migration time %RSDs are <1.5% and <2.1%, respectively. The %RSDs of the relative migration times compared with the internal standard on a day-to-day and capillary-to-capillary basis are <0.2% and <0.06%, respectively. The linear dynamic range using peak areas range from 0.003 to 0.10 mg/mL. The correlation coefficients are >0.9998, with all calibration curves passing at or near the origin. Similar data are obtained for cocaine and its internal standard henyltoloxamine. None of the compounds usually encountered in illicit samples interfere with the target compound (e.g., methamphetamine and cocaine) or the internal standard. Quantitative results for synthetic mixtures and seized exhibits are in good agreement with actual values, and also with results obtained from other techniques. The relatively high EOF for the dynamically coated capillary system allows for the screening of basic, acidic, and neutral adulterants in drug seizures; identification is facilitated by the use of automated UV library searches.  相似文献

This study examines hypotheses regarding patterns of developmental change in street code commitment from childhood through emerging adulthood. It tests whether street code commitment demonstrates developmental stability or if it fluctuates in response to evolving socially demoralizing conditions. Latent growth curve and parallel process models are applied to longitudinal data from an African American sample. Confirmatory factor analysis tests the degree to which neighborhood violence, peer processes, and family hostilities combine to form a latent construct of socially demoralizing environments. Analysis also tests measurement invariance across the study assessment periods. Street code commitment demonstrates a non-linear growth pattern across time. Commitment increases in childhood, peaks in late adolescence, and declines in emerging adulthood. Exposure to demoralizing social environments demonstrates a similar pattern of change characterized by a peak in adolescence followed by a gradual decline. Harsh childhood social environments affect the initial levels but not the growth of the street code. Street code commitment fluctuates in response to contemporaneous environmental conditions. The street code is malleable from childhood through emerging adulthood. Commitment to the street code is not a stable product of socialization or early childhood social environmental exposures. The degree to which individuals embrace the code is largely a function of their current social environment.  相似文献

Structural-equation modeling is used to test causal relationships between narcotics addiction and the associated cost-support activities of property crime and drug dealing across four critical periods of the addiction career. It is argued that structural-equation methodology yields greater insight into the causal dynamics of such activities than the typical methodologies of comparing means and proportions. Using structural coefficients of longitudinal models to infer causal relationships and stability, it is found that (1) dealing is often a predictor of future narcotics involvement; (2) narcotics use, property crime, and dealing are mutually interrelated during periods of elevated narcotics use and are not related during periods of reduced narcotics use; (3) dealing appears to be the most stable of the three variables, although narcotics use and property crime show appreciable stability as well; and (4) property crime and dealing appear to be inversely related to a moderate extent. The relevance of these findings to the understanding of the economic behavior of addicts during the initiation and cessation of addiction, relapse, and maturing out is discussed.  相似文献

Using data collected as part of an observational study of the police in Indianapolis, Indiana, and St. Petersburg, Florida, this article examines police use of force to gain a better understanding of why the police resort to force. Like analyses from previous observational studies, the present inquiry borrows from both sociological and psychological theoretical orientations to explore various determinants of force. Unlike previous examinations, the universe of behaviors considered is substantially expanded to include numerous types or levels of force, ranging from verbal commands and threats to the use of impact methods. An ordered probit analysis of 3,116 police-suspect encounters shows that officers often respond to legal stimuli (e.g., suspects' resistance, safety concerns) when applying force. Countering previous findings, it found that officers were not more coercive toward disrespectful suspects. However, the analysis revealed that officers were also influenced by extra-legal factors. Male, nonwhite, poor, and younger suspects were all treated more forcefully, irrespective of their behavior. In addition, encounters involving inexperienced and less-educated officers resulted in increased levels of police force. The implications of these findings, for both policy and future research, are considered.  相似文献
