California's “three strikes and you're out” law is the most notorious example of the wave of mandatory sentencing policies that many states enacted beginning in the late 1970s. While advocates and critics predicted the law would have profound effects on aggregate punishment trends and individual case outcomes, Feeley and Kamin's analysis of previous sentencing reforms suggested the law's impact would be mainly symbolic because local officials would ignore, subvert, or nullify its major provisions. While aggregate analyses have tended to confirm this argument, so far there has been no systematic test of the law's effect on individual cases. This analysis uses multilevel models applied to case‐level data from 12 urban California counties to test hypotheses about shifts in average punitiveness, the relative influence of legal and extralegal factors on sentencing, and the uncertainty of sentencing outcomes. Results mostly support Feeley and Kamin's symbolic interpretation, but also reveal important substantive impacts: since Three Strikes, sentences have become harsher, particularly in politically conservative counties, and black felons receive longer prison sentences.  相似文献

This study examined the effect of race on the pretrial release decision for drug offenders. Although this decision point has not been examined as extensively as the final sentencing decision, it is a critical discretion point which impacts defendants’ future sentencing outcomes. The results found that race had a significant impact on judges’ decisions to release a defendant on recognizance, with black defendants less likely to receive this release status. Race was not significant, however, in the decision of bail amount or in the likelihood to post bail. These results are consistent with the focal concerns perspective which suggests that black defendants are viewed by courts as more dangerous and blameworthy and thereby, less likely to be released on their own recognizance.  相似文献

Older offenders tend to be treated with more leniency in the criminal justice system. A number of studies show that older offenders are less likely to be incarcerated, and when they are incarcerated, are more likely to receive shorter sentences. However, to date, no research has directly examined why such leniency occurs. This study asked U.S. state trial court judges to reflect on their sentencing practices with older offenders and to rate the factors considered most important when sentencing this population. Responses were received from 212 judges. Only 31% of judges acknowledged treating older offenders with greater leniency. These judges also indicated that they predominantly rely on legal factors when making decisions about sentencing with older offenders rather than factors specifically associated with age. Only cognitive impairment was identified by judges as one of the five most important factors to consider when sentencing older offenders. These results are discussed in terms of judges’ awareness of how they weigh information to make legal decisions. The influence of judges’ age and attitudes about aging on sentencing decisions are also explored.  相似文献

This article examines the use of alternative sentencing provisions as mechanisms for departing from sentencing guidelines in Washington State and as structural sources of unwarranted sentencing disparity. The authors argue that these structural features of guidelines not only serve as “windows of discretion” through which disparities arise, but they also may encourage disparities by requiring consideration of substantive criteria that disadvantage certain offender groups. The analyses find that males and minority offenders are less likely to receive alternative sentences below the standard range, but that race‐ethnicity and gender have inconsistent effects on departures above the standard range. Theoretical implications of the study are discussed.  相似文献

Spohn and Cederblom’s interpretation of the liberation hypothesis asserts that with trivial crimes, judges are “liberated” to consider extra-legal attributes such as race when making sentencing decisions. The current study posits that this perspective may be too theoretically simplistic because it fails to distinguish between the concepts of discretion and uncertainty. In light of this argument, we examine the sentencing decisions of felony cases in the Florida circuit courts. Results indicate that blacks and Hispanics are more likely to be imprisoned than whites, and males more so than females. Contrary to expectations, this disparity increases with crime seriousness. Consistent with the imprisonment model, blacks and males receive longer sentences and the effect increases with case seriousness. We found no evidence that the effect of offender extra-legal attributes depends upon the characteristics of the judges handling the cases. Suggestions for future research and implications for the liberation hypothesis are discussed.  相似文献

A comparison of the distribution of the types of sentences imposed on native American offenders and Write offenders by the district courts of a western state reveals that the native American offenders were more likely to receive sentences involving incarceration in the state prison and were less likely to receive sentences which would have allowed them partially to escape stigmatization as a “convicted felon.” The introduction of a number of test factors revealed that these ethnic differences in the sentence received could only slightly be explained by ethnic differences in the kinds of offenses involved or in other differences in the legal and personal background characteristics of the offenders. A number of possible explanations of the discrepancies in the sentencing of native Americans and whites are suggested. However, regardless of the best explanation of these discrepancies, there are reasons to believe that these discrepancies in themselves may have contributed to an increased probability that the native American offenders would engage in future criminal activity and that these offenders would continue to receive harsher sentences than would similar White offenders.  相似文献

This study examined the contributions of sentencer and case (legal and extralegal) factors to magistrates' sentences for 678 drink-drivers at 2 courts. Qualitative codings of magistrates' sentencing orientations were incorporated with case factors in a multivariate statistical model of differences in fines and disqualifications. Discriminations in penalties were related to offenders' legally relevant prior offenses and blood alcohol concentrations, and extralegal variables of offender age, gender and employment status. Men were treated more harshly than women, and young offenders more harshly than all other offenders except those over 56 years. Unemployed offenders were fined less, but disqualified for longer than offenders in the workforce. Magistrates' orientations and court interacted with offense categories to produce further differences related to blood alcohol concentration and recidivism. Sentencers responded to offender characteristics but also relied on their own mental images of stereotypic drink-drivers and their individualized sentencing orientations to exercise their discretionary powers. Results are discussed in relation to issues of warranted or justifiable discriminations and the just distribution of penalties.  相似文献

Research Summary: The growth of prison populations over the last three decades is a great source of concern for policy makers and observers. One mechanism by which this growth occurs is via sentencing reforms that extend length of stay for certain categories of offenders. This has the effect of aging prison populations, which is problematic for many reasons. Apart from the increased financial burdens entailed in caring for older prisoners, it is also important to consider the intent of reforms in evaluating them. Of late, sentencing reform has become increasingly focused on the selective incapacitation of dangerous offenders. Policies that have the effect of aging the prison population are problematic from this perspective due to the diminishing returns realized with respect to incapacitation as offenders age. Dynamic systems simulation analysis is employed to investigate the likely consequences of recent sentencing reforms that increase length of stay for some offenders. These analyses indicate that the effects of recent reforms may not be as dramatic as some observers have predicted, but they suggest that the consideration of alternatives to incarceration for elderly offenders is warranted from the standpoint of cost considerations as well as that of selective incapacitation. Policy Implications: The results indicate that California's Three Strikes law will not accelerate the rate of growth of the elderly prison population. However, even without increasing the proportional representation of elderly prisoners, the number of elderly prisoners is expected to grow substantially over the next three decades. These prisoners will strain criminal justice system resources while presenting little public safety threat. State criminal justice policy makers and their constituents should closely examine laws that impose very long stays without discretionary release, as these statutes may contribute to the production of elderly prisoners. This problem is particularly pronounced in Three Strikes and other habitual offender laws that use retrospective methods to identify habitual offenders. Additionally, the effects of reforms lengthening stay for some offenders must be considered in light of cumulative effects of sentencing reform resulting in changes to the demographic structure of the prison population overall. Dynamic systems simulation modeling is presented as a valuable policy‐making tool, as it allows the policy analyst to examine the potential impacts of laws in the absence of data suitable for conventional statistical analyses.  相似文献

This paper examines the effectiveness of two sentencing strategies for managing serious and violent juvenile offenders: judicial waiver to adult court and determinate sentencing in juvenile court. Corrections data were analyzed and it was found that both groups consistently receive longer terms of incarceration than are available through normal juvenile justice processing. However, this finding changed when actual time served was taken into consideration. A discriminant analysis showed that juveniles determin-ately sentenced in juvenile court are more likely to be younger and receive and serve shorter sentences than juveniles waived to adult court and sentenced to prison.  相似文献

How unrestricted or restricted should judges be when deciding a sentence? To what extent should sentences be predetermined, or to what extent should judges be left with the right to decide a sentence in each individual case? Some legal systems, most notably in the United States, have chosen sentencing guidelines to control judicial discretion. However, another approach has been to use computer technology in the form of so‐called sentencing information systems (SIS). This article examines these developments and what possible influence they have had and could have in the Scandinavian, particularly in the Norwegian, context. Penal institutions today are adjusting to the demands of the information society. Does and could the fact that we are living in an increasingly technologically mediated world influence judicial decision‐making? The article argues that the use of technology is not simply a question of technological change, but is first and foremost a social and political phenomenon, related to the relations of trust in a society.  相似文献

Existing sentencing literature largely focuses on the study of white, African-American, and to a lesser extent, Hispanic offenders. Unfortunately, very little is known about the sentencing of Native American offenders, especially in the federal courts. To address this shortcoming, the current study employs United States Sentencing Commission data for the fiscal years 2006-2008 to examine the comparative punishment of Native Americans. Consistent with the focal concerns perspective and its reliance on perceptions of race-based threat, findings demonstrate that Native Americans are often sentenced more harshly than white, African-American, and Hispanic offenders. Moreover, race-gender-age interactions indicate that during the incarceration decision, young Native American males receive the most punitive sentences, surpassing the punishment costs associated with being a young African-American or Hispanic male. These findings highlight the importance of directing increased attention toward the sentencing of this understudied offender population.  相似文献

We examine downward departures for serious violent offenders, using quantitative and qualitative data from Pennsylvania. We find that offense severity and prior record have negative direct effects on downward departures, but a positive interaction effect on them. Offenders convicted of aggravated assault, those who plead guilty, young black women, and offenders sentenced in large urban courts are more likely to receive downward departures, whereas those convicted by trial, young Hispanic males, and offenders sentenced in small rural courts are less likely to receive them. We argue that downward departures represent local “corrections” to guideline recommendations when there is a mismatch between guidelines and local court actors' definitions of key focal concerns of sentencing for serious violent offenders.  相似文献

Sentencing research tends to focus on two questions. First, do some categories of offenders receive substantially different sentences than do other categories of offenders, for the same or similar offenses? Second, do some courts give substantially different sentences, when compared to other courts, for the same or similar offenses? Focusing on these questions, researchers have typically examined the impact of three types of variables on either sentence length or sentence type: defendant status variables (e.g., race, education), extra-legal process factors (e.g., court, plea), and legal factors (e.g., seriousness of offense, prior convictions). Study results have been contradictory and inconclusive.The problem with sentencing studies is that only main effects are examined. A more appropriate model is one that contains the interactions between the defendant's race (black/white) and the other independent variables, and the interactions between the court's locale (urban/rural) and the other independent variables.Using data collected in 1978 on 412 male prisoners in Maryland, four interaction terms were found to contribute to an understanding of sentencing decisions. It was found that blacks received longer sentences than whites, net of all other variables. However, whites received lengthier sentences for more serious offenses. In comparison to blacks, whites received lengthier sentences when they used more court resources. It was found that rural jurisdictions give lengthier sentences than urban jurisdictions, net of all other variables. However, in comparison to rural courts, urban courts give lengthier sentences when the defendant uses more court resources. More serious offenses receive lengthier prison terms in rural, as compared to urban, courts.  相似文献

Kansas' Senate Bill 123 (SB 123) created mandatory community-based drug treatment for individuals convicted of first- or second-offense drug possession. This study examined the impact of SB 123 on sentencing practices, supervision, and treatment services across Kansas. The study indicated that SB 123 diverted drug possessors not from prison, as intended, but from one form of community supervision to another, subjecting more offenders to greater surveillance and longer sentences. Such “front-end” net-widening was due to the structure of the law itself and a lack of understanding of pre-implementation sentencing practices. In some counties, judges engaged in some circumvention of the law, suggesting possible local-level differences in buy-in among courtroom actors; such circumvention was also focused on offenders with more serious criminal histories, indicating judicial-level evaluations of offender amenability to treatment. While SB 123 offenders received the treatment they were assessed to need, the provision of treatment remained heavily concentrated in a few providers, increasing disparities in access to treatment and making the success of the program highly dependant on a small number of institutional actors.  相似文献

A basic principle in sentencing offenders is proportionality. However, proportionality judgments are often left to the discretion of the judge, raising familiar concerns of arbitrariness and bias. This paper considers the case for systematizing judgments of proportionality in sentencing by means of an algorithm. The aim of such an algorithm would be to predict what a judge in that jurisdiction would regard as a proportionate sentence in a particular case. A predictive algorithm of this kind would not necessarily undermine justice in individual cases, is consistent with a particularistic account of moral judgment, and is attractive even in the face of uncertainty as to the legitimate purposes of punishment.  相似文献

Legal reform sometimes has unanticipated, even ironic, results. A good example is federal legislation adopted in the 1980s that was supposed to enhance equity in sentencing. Congress, like many state legislatures in this period, reduced judicial control over sentencing by adopting presumptive sentencing guidelines for all serious criminal offenses and mandatory sentences for some specific crimes. Reformers did succeed in reducing judicial discretion in the sentencing process, but racial disparities have gotten much worse. Unprecedented numbers of minorities, particularly black men, are going to jail for long terms. The situation leaves trial judges in a difficult position. They are legally bound to implement a sentencing regime that many of them believe is racially discriminatory. Herbert Jacob's work on criminal trial courts provides a framework for investigating this problem. As Jacob's organizational approach predicts, judges were initially more troubled by the diminution of their powers than by the emerging pattern of increased minority incarceration. Nevertheless, some judges have criticized the racial implications of the sentencing law, protesting in various, resourceful ways. Judicial resistance to a law on moral grounds, though rare, is significant because it represents a break in the ranks of officialdom that enhances the moral credibility of critics of the current law.  相似文献

Although a number of theories of law stress the importance of examining the characteristics of deviance processing agents for understanding criminal sanctioning, empirical studies have generally neglected these variables. Using data from a sample of convicted felons, this study looks at (1) both the additive and interactive effect of the probation officer's gender on sentencing recommendations accorded male and female offenders and (2) whether the social and political context, measured by the time span 1965–1980, alters any noted dyadic effects. The results indicate that both male and female officers recommend that female offenders receive the less severe sentences. Moreover, the context in which these recommendations are made has almost no appreciable effect. The implications of the findings for both the available theoretical frameworks and policy considerations are discussed.  相似文献

The ideal of fair and proportionate punishment was a major impetus for federal sentencing reform. Observers of the current federal drug sentencing regime contend that the sentencing guidelines and mandatory minimums lead to the problem of “excessive uniformity” in which offenders of widely differing culpability receive similar sentences due to the dominance of drug quantity as a sentencing factor. This study investigates this phenomenon using the 1997 Survey of Inmates in Federal Correctional Facilities. Controlling for relevant offense, offender, and case processing variables, the analysis finds that the quantity-driven sentencing fails to account for important differences in offender culpability—resulting in excessively uniform sentences for offenders with highly dissimilar roles in the offense. The main policy implication of this research is that the central, organizing role of drug quantity in federal drug sentencing needs to be rethought. Indeed, effectively dealing with the problem of excessive uniformity will likely require the wholesale restructuring of how federal sentences for drug offenders are determined.

How should sentencing disparity be assessed when decisions are constrained under a sentencing guidelines system? Much of the debate over the measurement of sentence disparity under a guidelines system has focused primarily on using specific values from within the sentencing grid (e.g., minimum recommended sentence) or on using interaction terms in regression models to capture the non-additive effects of offense severity and prior record on length of sentence. In this paper, I propose an alternative method for assessing sentencing disparity that uses quantile regression models. These models offer several advantages over traditional OLS analyses (and related linear models) of sentence length, by allowing for an examination of the effects of case and offender characteristics across the full distribution of sentence lengths for a given sample of offenders. The analysis of the distribution of sentence lengths with quantile regression models allows for an examination of questions such as: Do offender characteristics, such as race or offense severity, have the same effect on sentence length for the 10% of offenders who receive the shortest sentences as they do for the 10% of offenders who receive the longest sentences? I illustrate the application and interpretation of these models using 1998 sentencing data from Pennsylvania. Key findings show that the effects of case and offender characteristics are variable across the distribution of sentence lengths, meaning that traditional linear models assuming a constant effect fail to capture important differences in how case and offender characteristics affect punishment decisions. I discuss the implications of these findings for understanding sentencing disparitites, as well as other possible applications of quantile regression models in the study of crime and the criminal justice system.  相似文献
