Abstract THIS PAPER aims to establish a framework from which we can explain our dissatisfaction with defining what we teach and what and how we assess within legal education. To what extent can we, the professions or the public, have confidence that our assessment processes predict effective professional competence? We will try to establish this framework by placing the discussion in the context of a workshop of assessment of oral skills run at the 2001 Bar Vocational Course conference. The workshop raised issues which we believe encapsulate the difficulties of measuring performance in such a way that it reliably predicts professional effectiveness. From this we will attempt to highlight the shortcomings of the current teaching, learning and assessment strategies more generally. We go on to consider the role of student reflection in support of summative assessment: is it a reliable way of helping to plug the competence‐performance gap we have identified? What is its role in summative assessment? What demands does it make on tutor and learner? Since we cannot guarantee to find the best solutions first time, we make a plea for taking the risk of failure as well as success, and trying out ideas. 相似文献

Assessment of competency for execution presents two compelling ethical questions for mental health professionals: whether clinicians can ethically provide such assessment, and if so, how it should be done in order to maximize quality and minimize ethical conflict. In this article we address the issue of whether to participate and, if so, how. The question of whether to participate is discussed by summarizing the arguments for and against participation and offering guidelines for making a decision. The question of how to proceed is discussed in two contexts: preadjudication (before a formal decision about competency) and postadjudication (following a determination of "incompetent" and transfer of the offender to another facility for treatment and further assessment). Finally, recommendations are made regarding research that would improve the quality of execution competency assessments. 相似文献

Recent years have witnessed the exponential growth of community-based corrections programs for young offenders worldwide. Proponents of these programs contend that such initiatives are effective and humane alternatives to incarceration and operate to reduce youthful misbehavior. These assertions, however, have been called into question by empirical research and there is a danger that the ‘panacea’ of community corrections will be replaced by more punitive and less enlightened policies and programs.
It is argued that the potential effectiveness of community-based corrections has been hindered by the manner in which such programs are designed and delivered, and that insufficient attention has been given to the notions of community and community involvement. Several principles of ‘localized’ corrections which would address many of the current deficiencies are outlined. Localized corrections involves communities, rather than government agencies and ministries, assuming primary responsibility for identifying and addressing the needs of youth. 相似文献

Despite extensive financial losses and other indicators of harm, the American public and legal professionals have historically
been ambivalent toward white-collar crime. Recent research demonstrates that public perceptions of white-collar crime and
attitudes toward the punishment of white-collar offenders have become more punitive. Along these lines, a neglected area of
research concerns those individuals who routinely face white-collar crimes: fraud investigators. Using data collected during
the height of recent corporate scandals (2001–02), this study examines the perceptions of 663 fraud investigators and extends
prior research by considering the influence of investigator characteristics, organizational context (i.e., size, setting,
internal controls, and resource capacity), case characteristics (i.e., offense type, financial loss, and sanction), and offender
characteristics on legal professionals’ general and specific punishment perceptions. Results indicate that organizational
resources increase the likelihood of both outcomes. Additionally, the correlates of general and specific punishment perceptions
are found to differ: government agency context influences general but not specific perceptions. Comparatively, the perception
that fraud is increasing and a sanction that includes incarceration each have a significant, positive influence on specific
punishment perceptions. Implications of these findings for future research and policy are discussed.

This paper is concerned with the cultural and gendered context of crystal methamphetamine use among Asian Pacific Americans, and draws on recent sociological discussions on masculinities and feminities. The data are based on an ethnographic study of moderate to heavy ice users, and compares the experiences of Asian Pacific American women and men in their initiation to use, their motivations to continue using, and the changing nature of their relationship to the drug and significant others. This paper aims to analyse and discuss conditions for gender equality in police leadership. This is done by interviewing 28 sworn police leaders in Sweden, and using a doing gender perspective for analyses. The results show that women and, to a greater extent, men in police leadership do gender traditionally. Explanations for the lack of female leaders and strategies for increasing the number of female leaders are shown to either focus on women as individuals (mostly men) or organisational structure and culture (mostly women). Further, strategies to reach gender equality goals are critically examined. These could be used to create concrete diversity and equality work within police and other organisations. Whether or not quantitative gender equality work (raising the number of females in leadership positions) can create changes in qualitative gender equality (the learning of new norms to change experiences of inclusion and exclusion in relation to gender) is discussed. 相似文献

R&D managers at 50 firms who have formal relations with two research universities in Stockholm are interviewed about their
rationales for collaboration. Drawing on this material, a distinctive typology of rationales for establishing cooperative
relations is presented. While the typology demonstrates a considerable breadth of interaction rationales, rationales related
to innovation, in terms of invented or improved products or processes, are found to be the main drivers for interaction. Based
on this framework, we analyse which rationales for interaction are consistent with public rationales for supporting university-industry
relationships. Public co-funding that allow firms to influence (part of) the academic agenda is identified as a particularly

Both William Dean Howells and Edward Bellamy imagine brotherhood as the basis for new social orders in response to the trauma of the Civil War. Responding to the way in which the Civil War had pitted “brother against brother” in a “house divided,” Howells and Bellamy differently seek to reconstitute the American national family through revisioning brotherhood as universal, just, and equitable. William Dean Howells’s 1890 A Hazard of New Fortunes illustrates the difficulties of aligning men in brotherhood following the Civil War and amidst the economic upheaval of the last decades of the 19th century. Bellamy’s 1888 Looking Backward and Howells’s Altrurian romances (A Traveller from Altruria [1894], “Letters of an Altrurian Traveller, I‐V” [1893‐94] and Through the Eye of the Needle [1907]) demonstrate brotherhood’s importance to new visions of community. Brotherhood’s promise for remaking the nation gives rise to the Nationalist movement, which emerged to make real Bellamy’s vision of the future. Brotherhood is a powerful organizing principle for utopian endeavor in post‐Civil War America, despite the limitations coincident with brotherhood, such as the difficulty of imagining brotherhood across race and gender lines. 相似文献
