怎样获取IP地址

网络虽然是虚拟世界,但它是建立在物质基础之上的,因而只要信息在网上传输, 就必然会在传输设备上留下“痕迹”,只不过留下的“痕迹”比现实世界留下的痕迹更加隐蔽,难以发现和提取。众所周知,在网上每台计算机都有自己唯一的地址,就如城市中每一栋房子都有一个门牌号一样,这个地址就是我们常说的“IP地址”。信息在互联网上传输是利用 TCP/IP完成的。在TCP/IP互联网上传输的一个分组信息叫IP数据包,每个数据包包含一个头部和位于其后的数据。在数据包头部有发送信息的源地址和目的地址,这些地址采用的是IP地址。根据这一原理,只要上网传送信息,就必然在IP数据包中留下发送信息设备的IP地址,该IP地址就是在网上传送信息时留下的信息源“痕迹”。在网上通信时,只要能够提取到信息源“痕迹”,侦查人员就可以通过互联网上这独一无二的 IP地址,查获发送信息的计算机,从而结合传统的侦查方法确定犯罪嫌疑人。     

基于内存中的网络传输数据结构获取电子数据

电子数据取证实践中,获取嫌疑人进行网络信息传输涉及的IP地址、端口号、MAC地址以及对应进程信息,有助于全面深入揭示嫌疑人网络犯罪行为。基于IPv4首部、sockaddr_in、_TCPT_OBJECT、Ethernet V2标准MAC帧等四种数据结构于内存中的具体格式,归纳总结用于定位相关结构的特征关键字,同时通过实例说明提取网络传输电子证据的方法,并对过程中涉及的具体技术与注意事项予以阐述。电子数据取证实践证明,所述方法准确高效。     

完善我国民事诉讼送达制度的构想——构建诉前地址确认制度

目前在审判活动中，因送达不能导致诉讼迟延，效率低下是困扰我国法院特别是基层法院的主要问题之一。笔者认为，送这难主要是由受送达人的送达地址不明确造成的，诉前地址确认制度能有效解决“送达难”问题。     

论民事诉前送达地址确认制度的构建

送达是民事诉讼正常进行的首要条件,更可能影响到审判的公平、公正。但目前我国各级法院普遍面临"送达难",并已经影响到人民法院审判工作的正常进行。如何破解"送达难",逐渐成为我国深化司法体制改革进程中迫切需要解决的问题。针对"送达难"问题,各级法院和法学界相应提出各种构想、方案,如放宽留置送达条件、扩大签收人范围等。本文在综合我国送达制度的运行现状、法学界提出的理论构想、各地法院实践经验的基础上,建议在我国现行送达体制下构建民事诉前送达地址确认制度,破解"送达难"。

The Pharmaceutical Reimbursement Board announces the suspension of the maximum allowable cost (MAC) limit on erythromycin stearate, oral tablets, 500 mg, effective November 17, 1982. The limit for this drug product was published in the Federal Register on December 11, 1978 (43 FR 57972) and became effective on January 25, 1979. This suspension of the MAC limit on erythromycin stearate, oral tablets, 500 mg, is based on general price increases by manufacturers that have occurred in the marketplace and the Board's concern that this drug product may no longer be widely and consistently available at the established MAC limit. The Pharmaceutical Reimbursement Board may reinstitute procedures to establish a new MAC limit on this drug product in the future.

Home is where the heart lies? A study of false address giving to police

Purpose. The purpose of the present paper is to identify the cognitive processes associated with the construction of a false address, and explore how this can be used to identify and trace those who give a false address to police. It is hypothesized that most people find it difficult to spontaneously fabricate an entire false address. As a consequence they provide identifiable clues as to the real address being concealed. Methods. A quasi‐experimental research design was employed where 142 students were first asked to generate a false address and second to analyse it to ascertain how random they considered it to be. Results. Participants, overwhelmingly, stated that the false addresses generated contained elements of truth which could be used to identify their real place of residence. Although most participants appeared capable of generating bona fide false postcodes, comparison with an official UK postcode list identified over 60% did not actually exist. Conclusion. People generally rely on pre‐existing address knowledge as opposed to random generation, with the latter appearing more cognitively effortful. As such, they often unwittingly provide clues to the real address being concealed, therefore, affording increased possibilities in identifying them as liars at point of contact and in tracing them after the fact.

The millennium Association of Family and Conciliation Courts conference, held in New Orleans, Louisiana, brought about the third annual Meyer Elkin Address. Following Jonah, Peter, and Marian Wright Edelman in 1998 and George Thomson in 1999, the organization was honored to have Senator Paul Wellstone and Sheila Wellstone discuss important issues involving domestic violence and other family and children's issues. Both Senator Wellstone and Wellstone are nationally recognized leaders in the area of domestic violence advocacy. They are sincere and diligent in their efforts to protect and promote families and children. It was a privilege to listen to the following address.

A consideration of user financial incentives to address health inequalities

Health inequalities and user financial incentives to encourage health-related behavior change are two topical issues in the health policy discourse, and this article attempts to combine the two; namely, we try to address whether the latter can be used to reduce the former in the contexts of the United Kingdom and the United States. Payments for some aspects of medical adherence may offer a promising way to address, to some extent, inequalities in health and health care in both countries. However, payments for more sustained behavior change, such as that associated with smoking cessation and weight loss, have thus far shown little long-term effect, although more research that tests the effectiveness of different incentive mechanism designs, informed by the findings of behavioral economics, ought to be undertaken. Many practical, political, ethical, and ideological objections can be waged against user financial incentives in health, and this article reviews a number of them, but the justifiability of and limits to these incentives require more academic and public discourse so as to gain a better understanding of the circumstances in which they can legitimately be used.     

Assessing law enforcement preparedness to address Internet fraud

Recent societal concern regarding computer crime was well documented in the research literature. To date, however, modest research addressed how large, local police and sheriff's departments confront Internet fraud. Using data collected from surveys distributed to the seven hundred largest police- and sheriff's departments, the present article addresses law enforcement: (1) preparedness to enforce Internet fraud crimes; (2) perceptions of Internet fraud; (3) cooperative policing efforts; and (4) Internet fraud information dissemination practices. Among other things, results suggested that individuals within these departments believed Internet fraud was problematic, although they lacked the resources to properly address the problem. These results are discussed as they relate to the organizational design of law enforcement agencies and their potential to adapt to innovative crimes. Suggestions are offered for a more effective approach to confronting Internet fraud.

The suspension of the MAC limit on penicillin G potassium, oral tablets, 800 mu, results from the unavailability of this product in the marketplace at or below the MAC limit. The Pharmaceutical Reimbursement Board may establish a new MAC limit on this drug product in the future.     

The outcome of our lives: a commencement address to criminal justice students

On May 18, 2003, Tom Dexter (d. April 15, 2004) delivered the commencement address to the graduates of the School of Criminal Justice at the University of Albany, State University of New York. Mr. Dexter had worked in and administered various agencies of criminal justice for over 40 years, always searching for the most human way possible for himself and his staff to treat those ‘treated’ by the system. Always open to new ideas himself – indeed, to the outcomes of his own behavior – he was instrumental in bringing together faculty from the School of Criminal Justice and staff from the St. Anne Institute and La Salle School in Albany, New York, for a decade‐long research project, the Service Outcomes Action Research (SOAR). The focus of the project is on the impact or effect of those institutions on the young people they are ordained to serve.
