组织出卖人体器官罪的构成及认定

近年来,我国有关人体器官买卖的危害行为日益猖獗,严重威胁到广大人民群众的生命健康安全。基于此,刑法修正案（八）第37条明确规定了组织出卖人体器官罪,《刑法》第234条把组织出卖人体器官行为作为刑事犯罪进行打击。文章通过刑法规定的犯罪构成要件,分析了本罪的构成,即本罪的犯罪客体是公民的生命健康权利和国家器官移植医疗管理秩序;犯罪客观方面表现为非法组织他人出卖人体器官的行为;犯罪主体是一般主体;主观方面是故意。因此,司法实践中准确把握本罪与它罪,一罪与数罪的界限非常必要。     

认定聚众斗殴罪应注意的几个问题

聚众斗殴罪是从修改前《刑法》中流氓罪分解出来的新罪，并且由于参加人数众多，事实情节复杂，社会危害性大，而且有时该罪可能是有组织犯罪的一部分，因而准确认定该罪，突出打击重点，防止放纵犯罪，是摆在司法机关面前的重要课题。本文针对该罪在实践中易出现的模糊认识，提出自己观点，与各界老师商榷。     

论盗窃罪与侵占罪的界限

刑法规定的盗窃罪与侵占罪都是侵犯财产的犯罪，两罪在犯罪客体、犯罪主体、犯罪主观方面都是相同的，其主要区别在于犯罪客观方面表现形式不同和犯罪对象上不同。由于这两罪有上述相同之处，加上刑法在未修改之前，凡是侵占他人财物，数额较大，拒不交出的，都是以盗窃罪类推处理。１９９７年３月１４日颁布的新刑法第２７０条专门规定了侵占罪，所以，凡是侵占他人财物，非法据为己有，数额较大，拒不交出的，就应以侵占罪论处。现在，新刑法实施两年多以来，难免有时混淆这两个罪的界限，笔者结合自己的教学经验和司法实践，如何在刑法教…     

论组织、领导传销活动罪在刑法分则中的定位

《刑法修正案（七）》将组织、领导传销活动罪作为《刑法》第224条之一纳入＂破坏社会主义市场经济秩序罪＂一章中的＂扰乱市场秩序罪＂之中,不符合犯罪归类的一般规则,不利于刑法分则罪名体系的内在协调,有必要将其调整,应将其作为《刑法》第294条之一纳入＂妨害社会管理秩序罪＂一章中的＂扰乱公共秩序＂之中。     

论毁林犯罪及其相关犯罪

新刑法将毁林犯罪规定为破坏环境资源保护罪。增加了毁林犯罪内容 ,不仅保留原刑法的盗伐林木罪、滥伐林木罪 ,新增了保护珍贵树木有关条款。加大了对毁林犯罪的打击力度 ,在加重法定刑的同时 ,将附加刑改为强制性规定 ,增加了管制刑 ;犯罪主体扩大到了单位 ,不再局限于自然人。毁林犯罪在立法和司法实践中目前存在的问题有 :滥伐林木罪的法定刑问题 ,明知持有违法发放的采伐许可证而进行采伐的罪与非罪问题 ,毁林开垦、采石、采砂等行为的刑事处罚问题     

理念转变与规则调整:涉毒犯罪的网络异化及其刑法应对

互联网的虚拟性、便捷性和大数据时代的即时聚集效应,使网络社会中的涉毒犯罪活动呈现出犯罪数量不断激增、犯罪人数急速增长、犯罪年龄呈低龄化、犯罪破坏性急剧扩张等特征。目前,学界对互联网吸贩毒"聊天平台"的定性存在辩争,因而极有必要扩大解释容留他人吸毒罪,以约束网络涉毒组织行为。此外,共犯中的组织犯和帮助犯在互联网中出现了异化,相较于传统犯罪主犯,组织犯作用在递减,较之传统犯罪从犯,帮助犯作用在递增,因而必须从严打击互联网涉毒犯罪的帮助犯,并对借助互联网实施涉毒犯罪人员增设资格刑。针对互联网新型毒品犯罪的法律缺漏,需要增设组织吸毒罪、传播毒品信息罪,强化对毒品犯罪源头和消费行为的打击。     

邪教组织的危害及防治对策

邪教组织,是指那些以宗教为名,行邪道说教、妖言惑众之实,妨害社会管理秩序,危害社会稳定和他人身心健康的组织。自８０年代以来,邪教活动在我国发展蔓延很快,参与人数多,严重影响社会稳定,特别是危害农村地区群众的生产生活秩序和经济发展,成为侵蚀瓦解基层政权、与我争夺群众的一股邪恶势力。要根据中央有关文件精神和《刑法》的规定,对邪教的活动进行严厉查禁、取缔和打击。     

大数据时代金融诈骗构罪标准的缺陷与修正

随着互联网技术的发展,大数据时代已然到来。大数据技术在给人们带来生活便利的同时,也引发了新型的金融诈骗犯罪。大数据时代下,金融诈骗犯罪存在着假借金融平台外衣、利用随机数据团组、责任影响因素多元、社会危害组成复杂等特点。当下金融诈骗犯罪唯数额论的单一构罪标准存在着无法全面反映金融诈骗行为的社会危害性、无法应对风险社会下的新型风险、刑法条文内部规定欠体系化等明显缺陷。基于此,对大数据时代下金融诈骗犯罪的构罪标准进行修正、构建金融诈骗犯罪多元化构罪标准迫在眉睫。具体而言,在修正金融诈骗犯罪的构罪标准时,除了数额因素外,还应当关注金融诈骗行为的影响范围,以及加重情节中的其他认定因素。同时,以大数据时代下金融诈骗犯罪构罪标准的修正为切入点,刑法应当对大数据时代新的犯罪形式、态势进行充分的回应,从改变金融刑法的立法范式、注重对涉数据犯罪链的整体打击、提倡"软法"之治与刑法谦抑性的坚守这三方面进行进一步的修正,以达到刑法"惩罚犯罪、保护人民"的目的。     

对“明知他人有间谍犯罪行为”的理解

刑法第311条规定的拒绝提供间谍犯罪证据罪的成立以行为人"明知"他人有间谍犯罪行为为前提条件,行为人对他人有间谍犯罪行为是否"明知"就成了本罪是否成立的关键.本文拟从"明知他人有间谍犯罪行为"的涵义、如何认定、"明知"的形成时间及其与刑法总则"明知"的关系等方面理清相关问题,以抛砖引玉,并希能对司法实践有参考价值.     

天津市黑社会性质有组织犯罪的现状、原因及侦查对策思考

目前,在实践中,典型的犯罪集团不多见,但是,一般性质的有组织犯罪团伙却在向带黑性质的犯罪严重发展。文章分析了1995年和1996年天津市公安局连续打击的42个犯罪团伙的特点,比较了这些团伙与传统刑法理论上的犯罪集团的特征的质的区别,得出结论,天津市有组织犯罪已向黑社会性质有组织犯罪发展。文章认为,马克思主义 犯罪学家认为,私有制是产生犯罪的根源,不断扩大的个体经济、私营经济是有组织犯罪团伙向黑社会有组织犯罪发展的根本性原因;社会失业现象、社会各个利益集团之间竞争的社会环境,一根根私人联系所构成的乡土社会关系,文化网络的“病毒”等,是有组织犯罪向黑社会有组织犯罪发展的社会基础。为了有力打击带黑性质的有组织犯罪,文章提出了五条侦查对策。
