Following a likely relative shift from Labour to SNP in the Scottish Parliament elections of 3 May 2007 the eight year Labour/Liberal Democratic Party coalition will come under great pressure and may be replaced by a minority administration or a Liberal Democrat/SNP coalition. While the independence issue may be sidelined, key constitutional issues will arise as a result of the Liberal Democrats' proposals featuring in Moving Towards Federalism which envisage greater legislative and taxation powers for the Scottish Parliament and a reconsideration of the devolution settlement. A number of weaknesses in the documents' proposals are identified. If it is acted upon there is the possibility of considerable resulting constitutional conflict arising which could pose considerable challenges for the future of the UK. The UK government which has actual competence on these issues has largely stayed silent on them during the campaign but may have to respond sensitively in its aftermath.  相似文献

This article traces the changing funding relationships between Scotland and the UK government. Beginning from the Barnett Formula, it examines how the changing support within Scotland for greater political autonomy from Westminster has influenced the mechanisms that have determined Scotland's fiscal structure. Increasing support for the SNP, and then for the Yes campaign in the September 2014 independence referendum, has led to a mixture of new powers being granted to the Scottish Parliament. The Scotland Act 2012 extends the Scottish government's control over income tax and some other small taxes. Although independence was rejected by the Scottish people in September 2014, the ‘Vow’ made by the Westminster parties immediately before the vote is leading to far‐reaching changes in the UK's fiscal structure. This will cause a very substantial change in intergovernmental relations within the UK, which the Barnett Formula may not survive.  相似文献

Scottish politics isn't about some remote northern politics but go to the heart of the nature, character and power dimensions of the UK and British state. Scotland has been dramatically changed by the scale of the SNP landslide victory in the 2011 Scottish Parliament elections. Scottish society, identity and culture along with the politics of unionism and nationalism have all changed and will change further. The old fashioned politics of devolution are dead, but what comes next and what are the consequences for Scottish independence? The Scottish independence referendum debate, like the Act of Union of 1707, has significant religious dimensions. The Act gave special recognition through the monarch to the Presbyterian Church of Scotland. The Church, a national church, has not yet declared a position on independence, but is seeking to protect its existing privileges whatever the result. The Roman Catholic Church, recognised by the Scottish Parliament, unlike its formal rejection by the UK Parliament and monarchy, symbolically associates itself with the case for independence. Paradoxically, Catholics supporting independence subject themselves, in their religious lives, to an authoritarian foreign power. The SNP Scottish Government attempts to draw Roman Catholic support for independence from its traditional support base in the Labour Party by cultivating a sense of religious grievance that is not justified by the evidence. Old religious divisions are still relevant but non‐religion is growing fast and resulting in new perspectives on the independence debate.  相似文献

The plans of the Scottish Executive/Government for the independence of Scotland, which are very sketchy, are explored in relation to desire to retain the monarchy. The Scottish Parliament has expressed support for the removal of religious discrimination from succession to the throne and instituted an alternative state religion—measures which suggest an alternative relationship between religion and the monarchy will be required in an independent Scotland. Repealing the Act of Union will require decisions as to whether the monarchy remains as Christian, Protestant and Presbyterian in Scotland or whether some alternative religious or secular arrangements will be developed. Accepting the existing religious settlement of the monarchy, or varying it, will generate challenging issues for a Scottish administration that is seeking to be more religiously inclusive.  相似文献

In this article we use evidence from the Scottish Election Study 2007 to build an explanation for the narrow SNP victory in the Holyrood election. The theoretical focus is on valence models of voting, which are increasingly important in Scotland following dealignment and ideological convergence in the party system, and as Scottish governments flex their executive muscle. Exploring the valence battleground reveals mixed but overall negative evaluations of Labour's performance in government, and suggests advantages for the SNP on issue competence, leadership and party image. Modelling party choice at the individual level shows that key valence variables – performance evaluations, economic competence and party image – have strong and significant effects, unlike hitherto prominent factors like religion, class and national identity. Constitutional preferences are important too, but their effects suggest a further valence link: the SNP's strong showing among voters seeking further devolution but opposed to independence is due in large part to its credentials as a battler for Scottish interests. In contrast, Labour's stand against 'more powers' may have tarnished its own reputation on that score. We conclude that the SNP edged home by persuading enough voters that it had a positive agenda for governing Scotland within the current constitutional arrangements, and that it could deliver on that agenda.  相似文献

Drawing on the distinction between self‐rule and shared rule in multilevel states, this article argues that shared rule has been the neglected element of the UK devolution settlement. The ability of the devolved administrations to participate in, and influence, national decision making through shared rule mechanisms is very limited. The article argues that the lack of shared rule is especially problematic in light of the increasing complexity of the Scottish devolution settlement in the wake of the Scotland Act 2012 and the Smith commission report. Smith, in particular, seems set to increase both the power of the Scottish Parliament and its dependence on UK policy decisions in the areas of tax, welfare and the economy. Creating a more robust intergovernmental system which could manage these new interdependencies will be a significant challenge, and yet, without such a system, the new settlement will be difficult to sustain.  相似文献

The survey addresses three key reform debates relating to devolution in Wales. These concern first, the case for the further devolution of powers, notably those over criminal justice and policing; second, the defence of Wales’ devolved powers in the context of Brexit; and third, the rooting of devolution in new constitutional ideals, primarily the Welsh government’s preferred model of the UK as a voluntary association of nations, or the alternative pressed by the independence movement. In each case, there are strong pressures within Wales for resolutions which sustain and develop devolution; and in the case of independence, have the potential, with reform debates elsewhere, to transform the UK Union. However, there are also grounds for reflecting on the contested nature of further change, the long road that a case for independence may yet have to travel, and the interests of UK government.  相似文献

The U.K. is an outlier in comparative terms in having experiencedno litigation about the division of powers following the introductionof devolution in 1998. Conventional wisdom ascribes this tothe coincidence of Labour-led governments in London, Scotland,and Wales. But other factors are also at work, which are informativeabout the flexible nature of the British constitution and theBritish approach to devolution. These include the continuingsovereignty of the U.K. Parliament, the limited extent of devolutionin the U.K., elaborate checks to ensure devolved legislationremains within competence, and adjustment mechanisms built intothe original devolution settlement. The absence of litigationhas obvious advantages, but also disadvantages, in that theinterpretation of the division of powers under devolution remainssecret law.  相似文献

For much of the 2010–15 Parliament the English Question was not a conspicuous feature of political debate in the UK. However, the issue of English votes for English laws (EvfEl) was thrust to centre stage by Prime Minister David Cameron in the aftermath of the Scottish independence referendum, when he announced that fulfilment of the promise of further devolution to Scotland must be accompanied by an answer to the West Lothian Question at Westminster. This article analyses these events and explores their possible consequences. It argues that a reform of parliamentary procedures along the lines outlined in the report of the McKay Commission looks increasingly likely, but that this will not mark a resolution of the broader English Question, and the future of the Union remains in doubt.  相似文献

While devolution has provided a stronger political voice for Scotland, Wales and Northern Ireland since the late 1990s, it is only in the past few years that English public opinion appears to have become exercised by the lack of similar arrangements for England. The renewed debates over the character of the Union after the Scottish independence referendum reveal a desire for ‘fair treatment’ of England within a Union conceived as a partnership of equals. At the same time, numerous proposals have been made for devolution of power within England, reflecting long‐held concerns about the territorial hegemony of London. Solutions to the former issue include English votes for English laws and an English Parliament. Solutions to the latter include city‐regions, strengthened local government, the first of these appears to be the government's preferred route, in the light of the recent ‘Greater Manchester Agreement’. However, none of these ‘solutions’ can count on being implemented.  相似文献

This paper provides the first systematic attempt to investigate the legislative impact of the Scottish Parliament on Executive legislation, by analysing the fate of all amendments to Executive bills from the Parliament's first session (1999–2003). Initial findings on the success of bill amendments show that the balance of power inclines strongly in favour of ministers. However, when we account for the type of amendment and initial authorship we find evidence that the Parliament (both coalition and opposition MSPs) actually makes more of an impact, particularly in terms of the level of success of substantive amendments to Executive bills. Our findings have implications for much of the current literature that is sceptical of the existence of power sharing between the Executive and the Parliament and within the Parliament.  相似文献

Scotland's party system appears on the verge of major change with the Scottish National Party poised to supplant the Labour party as the dominant force. Under a charismatic leader, the SNP is using populist means to try and secure independence. However, real change appears elusive even if constitutional arrangements are altered further. The SNP distrusts democratic participation and is keen to rule through mobilised interests groups and the civil‐service, strengthening the corporatist style of government characterising Scotland for centuries. Labour might avoid long‐term marginalisation, if it was to embrace an agenda based on strong democratic citizenship and a broad nationalism which emphasises a continuing Union in which the benefits of devolution are clearly directed towards individual citizens as well as elite groups  相似文献

The United Kingdom faces twin constitutional crises. The existence of the Union itself is now under stronger challenge than ever before, and many of the conventions and understandings which have underpinned the constitutional stability of the United Kingdom and the relationships between executive, Parliament and judiciary have been eroded or overthrown. There is no single, easy way to put things right. What is needed are reforms to the working of Parliament, the Civil Service and devolution, to restore greater balance and stability to our constitution. These should include measures to strengthen the ability of Parliament to hold the executive to account and a new Civil Service Act to provide for the independence, governance and accountability of the Civil Service. To overcome the strains that now threaten the unity of the UK we need a cultural shift in UK politics in favour of partnership and mutual respect, underpinned by changes to the way we do business in both government and Parliament and by greater devolution of power within England.  相似文献

May 2019 marks twenty years since the first elections to the Scottish Parliament and Welsh Assembly. This report discusses a paper published by the Institute for Government (IfG) that reflects on the experience to date of devolution, drawing on interviews with thirteen individuals who have served as ministers in the devolved governments. Reflecting the structure of the IfG paper, there are three main themes in this report: governing without a majority, institutional change, and—in the light of Brexit—relationships between the devolved governments, Westminster and the EU. The conclusion is that the report, although limited in coverage, provides a useful addition to the literature on devolution.  相似文献

The issue of sovereignty has never been resolved in Scotland. The 1998 Scotland Act, creating the Scottish Parliament affirmed that the Westminster Parliament is sovereign, but this is disputed. In practice, the issue was left largely in abeyance as sovereignty was seen as an outdated concept. The Scottish independence referendum of 2014 and the UK Brexit referendum of 2016 both brought back the question of sovereignty in stark terms. Analysis of data from the British Election Study of 2019 with regard to (a) the right of Scottish self‐determination, and (b) the right of a UK‐wide majority to take Scotland out of the EU, allows us to identify ‘sovereigntists’ and ‘unionists’. Sovereigntists, on both dimensions, now constitute a majority. A smaller group of unionists reject both positions. There remains a group of ‘semi‐sovereigntists’ who accept Scottish self‐determination, but also that the UK as a whole should decide on Brexit. Controlling for the social and political factors, Scots are increasingly polarised around issues of sovereignty, which have become central to contemporary Scottish politics.  相似文献

ABSTRACT

Since the formation of the Scottish Parliament, the idea of Scottish independence increased in salience and popularity among Scottish voters to such an extent that it now constitutes the country’s defining political cleavage. Given that Scottish politics is increasingly organized around this constitutional question, support for either side of the debate among voters and elites drives political engagement, election turnout and public attitudes to other major issues. Although much popular and academic work has sought to explain the rise of support for independence, few scholars have explored changes in elite behaviour or its consequences for public opinion. From an elite-driven perspective, the increased salience of independence may be but an echo of elite and partisan attention. Developing hypotheses from this approach, we predict that voters identifying with parties developed stronger views on independence following increased attention in parties’ campaigns. We examine these hypotheses by performing computer assisted, unsupervised content analysis of Scottish Parties’ election manifestos. We then use estimates from a structural topic model to predict change in voter support for independence from the British Election Study. The theory and results suggest that increasing salience on alternative dimensions of politics likely closely relates to elite-driven choices in their election campaigns.  相似文献

Modest levels of female representation at the House of Commons are in sharp contrast to the Nordic‐levels of representation achieved in the Scottish Parliament and the National Assembly for Wales since devolution in 1999. One apparent advantage of devolution is the opportunity that it provides for lesson‐learning across jurisdictions. This article offers six lessons on women's political representation—three positive and three negative—drawn from the experience of devolution in Scotland and Wales. We draw conclusions from these lessons, including the need to keep parties under scrutiny to ensure they deliver on their rhetorical commitments. We also postulate that gender equality might prove too important to be left to political parties and consider whether there is a need to consider stronger measures such as mandatory quotas.  相似文献

This article examines the political context, campaign, election results and outcomes of the 2016 Scottish Parliament election. The Scottish National Party (SNP) secured its third electoral victory, yet failed to achieve a widely predicted majority. With just two MSPs short of a majority, the SNP has ruled out any formal coalition with the opposition and will instead govern as a minority administration. The composition of the parliament’s opposition also changed significantly. The Scottish Conservatives increased their share of the constituency and regional votes, and became, for the first time, the largest opposition party in the chamber. Scottish Labour suffered a severe electoral drubbing, losing 13 of its seats. The election was also important for the Scottish Liberal Democrats and Scottish Green Party. The latter increased its vote share and number of seats, leapfrogging the Lib Dems to become the fourth largest party in the chamber.  相似文献

Demands for a second Scottish independence referendum have persisted since 2014. The Scottish government introduced the Referendums (Scotland) Bill at Holyrood in May 2019 to enable referendums within the competence of the Scottish parliament. The Scottish National Party (SNP) government presented this as a framework enabling a range of referendums. Opponents saw this as legislating for a second independence referendum. The act will form a large part of the legal framework and rules for any second independence referendum. Importantly, the legislation provides innovation in electoral law more generally. This article discusses the background to the bill, its initial contents, and debates around and amendments to the bill. It discusses its electoral law innovations, before considering its limitations and place as constitutional debates play out over a second independence referendum.  相似文献
