论在WTO规则框架下完善我国行政法律制度的对策

本文对如何在WTO规则下完善我国现行行政法律制度进行了论述,并提出了相应的对策,即按照WTO规则梳理我国现行行政法律制度;完善行政程序立法,融入正当程序理念;加强依法行政、增加行政行为的透明度以及建立独立、全面的司法审查制度。     

为经济社会发展提供司法保障和服务

加入WTO标志着我国在经济上将更广泛地参与国际竞争与合作，使我国有了更大的发展机遇和空间。加入WTO要求我们必须与时俱进，积极应对，努力适应与世界接轨的趋势，按照WTO规则要求办事。人民法院作为国家审判机关，必须更加牢固树立先进的司法理念，维护司法公正，提高司法效率，努力营造良好的法治环境，为加入WTO后我国经济、社会的全面发展提供良好的司法保障和法律服务，     

法律面前人人平等原则的思辨

法律面前人人平等是我国宪法明确规定的基本原则之一,也是社会主义法治理念的核心内涵之一。如何以社会主义法治理念为指导,准确把握法律面前人人平等原则,是当前司法工作必须面对的一项重要课题。平等原则要求司法工作必须坚持司法为民宗旨;坚持公平与正义的目标;坚持以事实为依据,以法律为准绳原则。适应平等原则的要求,司法实践中必须注意处理好几个方面的关系,包括程序平等与实体平等的关系、法律效果与社会效果的关系、平等保护与特殊保护的关系等。     

论和谐司法当代释义与进路

"和谐司法"是指在法治社会框架下,遵循公平、效率和人权的价值导向,以法律效果、政治效果和社会效果的均衡统一为目标指向的司法权运行状态。强调人本理念,公平、公正与效率有机统一的理念以及着眼化解现实矛盾的司法实践理念是当代和谐司法的重要特质。然而,当下尚存在诸多影响和谐司法的现实困境。为此,坚守"不告不理"及"司法为民"的基本司法原则,建立合理的司法权力配置机制及外部沟通机制,推进司法职业化进程、建立科学的司法职业伦理将成为我国和谐司法的重要进路。     

WTO规则与中国法制建设——以WTO透明度原则和司法审查制度为视角

透明度原则是WTO的基本原则之一，司法审查制度则是其对成员方的基本要求，我国在加入WTO的议定书中对此分别作出了明确承诺。因之，在中国加入WTO后，我们要按照WTO规则和法治社会要求建立良性高效的法律运作机制，使立法、行政、司法等活动都能按照法律和法律正当程序实行公开化、透明化的“阳光操作”，做到立法公开合理、行政透明民主、司法公正权威、执法公平适法，从而切实维护法律权威性和法制统一性，推动社会主义法治国家的早日实现。     

社会本位司法理念中国化研究——从民国的理论与实践展开

民国时期,中国法律所面临的内外环境使社会本位司法理念具有中国化的可能性。政治领域的"党国体制",使国家主义与司法党化成为中国式社会本位司法理念的重要特征。在中国特殊的社会情境下,妥善处理与传统司法的关系及注重发扬"法治"内涵,是社会本位司法理念中国化的重要问题。     

探析司法裁判的现状与走向——以热点案件引发的民意为视角

在司法领域,民意是社会公众对某些案件大体相近的、带有普遍性的意见.尽管目前缺乏较为准确、便于评估民意的方法,但民意仍对司法裁判产生了许多重要影响,并不时地使之处于尴尬地位.囿于司法者与民众的思维方式、司法裁判与民意评判的形成方式以及司法裁判与民意的本质特性方面存在差异,司法裁判与民意之间必然有诸多纠结.因此,司法裁判要改变尴尬现状,实现与民意的共赢,就必须以司法独立为基本前提,在法律的框架内尊重民意并不断完善相关制度,畅通民意参与渠道.     

恢复性司法理念与中国传统法律文化的差异

恢复性司法是传统刑事司法理念的转换,诞生于西方的法律文化之中,以基督教伦理和市民精神为支柱。中国传统法律文化中的家族伦理、重刑轻民以及家国一体与西方法律文化形成鲜明对比,对恢复性司法在中国的实践带来了挑战。

司法监督是世界各国普遍实行的一项重要制度,目的在于依法约束司法权,防止司法的懈怠和滥用,保障司法公正。然而,在不同的国家,司法监督的模式是不同的。新加坡秉承英国的权力分立理念,司法独立于立法和行政,并受宪法和法律的绝对保障,强调司法独立是公正司法的根基,司法监督是以司法独立为前提和基础的,形成了一些特有的制度和做法。
