David Miller’s political philosophy of immigration employs two complementary argumentative strategies to challenge open border theories. The first strategy is to defeat the principled case for open borders, such as the global equality of opportunity argument for more lax immigration control. The second strategy is to establish the democratic community’s prima facie right to determine the shape of its future, including membership and the right to exclude. First, I argue that Miller’s conception of global equality of opportunity is overly narrow and that his objections to the principle, to the metric and to what counts as feasible political action misfire against other, more plausible, accounts. Second, I argue that his democratic interpretation of collective self-determination does not solve the pressing question concerning the morally justified scope and content of self-determination and the moral limits of the right to exclude. I conclude by questioning Miller’s general strategy: whether theories of immigration should be engaged in an exercise of shifting the burden of proof between open and closed borders. By contrast, I argue that a more desirable task for the political philosophy of immigration is to find ways in which the joint requirement of global equality of opportunity and collective self-determination can be coherently upheld.  相似文献

This review essay examines recent work in political theory on the ethics of immigration admissions. It considers arguments put forward by Michael Walzer, Peter Meilaender and David Miller, among others, for state control of borders. Such arguments tend to appeal to the value of political communities and/or the exclusion rights of democratic associations, and I argue that neither of these are successful. Turning to work by Joseph Carens, Phillip Cole, Michael Dummett and others who advocate open or much more open borders, the article considers various arguments that would support this stance, including appeals to freedom of movement, utilitarianism and social justice. I argue that rights to immigration need embedding in global principles of resource redistribution. In the conclusion I sketch a cosmopolitan approach to immigration by which impartial criteria such as population density and gross domestic product would determine how many migrants states have a duty to admit.  相似文献

In this paper, I critically address the role of arbitrary and contingent features in philosophical debates about migration. These features play a central role, and display the importance of ‘unreason’ in the debate and the limits of rational criticism. Certain elements of political thought have to be taken as given, as essential starting points or indispensable building blocks. As such, they cannot be exposed to rational criticism. Political arrangements such as national borders, nation-states and national identities constitute these building blocks, and justify coercive borders in order to sustain them. If we are to subject these arrangements to critical examination, then we move beyond the limits of liberal political philosophy. I examine theorists who take this kind of approach to the ethics of immigration: Michael Blake, Samuel Scheffler and David Miller. I argue that such approaches ask us to balance arbitrary and contingent features of the political world against the non-contingent moral equality of the migrant. If we are to recognize the migrant as an equal reason-giver in the moral contestation of borders, then we are compelled to theorize beyond these limits, and to theorize instead about a global community of equals, a post-national world made up of transnational belonging.  相似文献

According to the freedom argument for open borders, immigration restrictions are generally unjust because these restrictions infringe on important freedoms, such as freedom of association and the economic liberties. Some authors have objected to the freedom argument by claiming that potential immigrants only have rights to sufficient options to live decent or autonomous lives and, consequently, states can permissibly prevent people from immigrating when potential immigrants have adequate options. This paper shows that this objection to the freedom argument for open borders is unsound and that restrictions on international freedom of movement can be morally impermissible even when potential immigrants have adequate options.  相似文献

Consequentialist cosmopolitanism, Peter Higgins argues, enables closed border liberals to evade charges of moral hypocrisy despite their commitment to moral equality of individuals, once we recognize that open border arguments rely on cosmopolitanism’s individualism requirement, which ignores social realities relevant to a realistic assessment of the social consequences of an open immigration policy. Higgins is mistaken, however, in contending that cosmopolitan individualism entails attention to people only in their capacity as the abstract atomic individuals populating Charles Mills’ idealized social ontologies. Conversely, if cosmopolitan individualism does compel us to think of people as abstract atomic individuals, we are not obliged to think of them as relatively privileged. Under liberal cosmopolitanism, however, which prohibits state discrimination between citizens and non-citizens, open border policies are subject to no such consequentialist objections.

Normative political theory over recent decades has focused mainly on what ought to be done as far as migration policies are concerned. It faces a basic challenge, which stems from two competing, yet equally fundamental, ideals underpinning liberal democratic societies: a commitment to moral universalism and the exclusionary requirement of democracy. The objective of this special issue, ‘New Challenges in Immigration Theory’, is to provide a conceptual overview of (some) immigration theories and to highlight the challenges new streams of immigration pose for normative (political) theory and liberal democratic practice. The issue will consider how to reconcile state-based exclusion with a commitment to equal moral concern for all persons, by focusing on the non-standard immigration questions that have so far been ‘neglected’ by normative political theory. In line with this objective, the issue will discuss some of the inadequacies of the dominant political theories of immigration and show how such theories can be expanded to take account of new migration challenges such as brain drain, climate migration, detention of irregular migrants and asylum seekers, rights of labour migrants, transnational networks of movement, and so on.  相似文献

States often face immigration “control dilemmas” between popular pressures for tighter immigration controls versus economic pressures for more liberal work visa controls. Using a systematic process analysis of recent policy developments in Australia, this article argues that the Howard government's large expansion of “wanted” forms of immigration hinged upon its ability to control “unwanted” forms of immigration. The concept of “control signals” is introduced to account for the government's success in exiting an immigration control dilemma, which allowed it to pursue skilled immigration reforms that would have otherwise proven difficult. A research agenda is established for examining the conditions under which the use of control signals is likely to be successful and for applying the concept to other realms of public policy where states face control dilemmas.  相似文献

This article argues that traditional, labour migration flows to Western Europe are unlikely to resume in the near future and the commitment of the European Community to the free movement of labour is likely to erode as a consequence of anti‐immigrant illiberalism in Western Europe. Anti‐immigrant illiberalism in several, major labour‐importing states is evident in: the semipermanent politicisation of state immigration policy; increasing popular support for xenophobic political forces; the appropriation of anti‐immigrant votes by established political parties of the right; and the abandonment by left‐wing parties of liberal immigration and immigrant‐welfare policies.  相似文献

The issue of campaign finance reform creates a potential conflict between the democratic values of expression and equality. Using a unique experiment embedded in a national survey of the American electorate, we examine the extent to which group affect influences citizens' commitment to these values and how it contributes to the resolution of value conflict. We find that citizens' commitment to the values of expression and equality in the campaign finance system is structured by their feelings toward those whose rights and influence are perceived to be at stake. Our analysis further shows that the effects of group affect are conditioned by issue frame. The effects of group affect are less pronounced when campaign finance is framed as an issue of political expression and rights than when it is framed in terms of political equality and influence. Finally, we find that affective information contributes to the resolution of value conflict by helping citizens to make tradeoffs between competing values in judgment situations.  相似文献

Comparative scholarship tacitly assumes immigration politics to be relatively rigid. A state's immigration policy legacy is said to institutionalise policy preferences, thereby making it difficult to implement lasting reforms that are inconsistent with that legacy. This presents difficulties for states with restrictionist legacies wanting to implement liberal reforms in response to the emergence of labour shortages or demographic problems. The supposed rigidity of immigration politics is scrutinised in this article through a systematic process analysis of developments in the United Kingdom over the past decade, where the Blair government confounded the UK's characterisation as a ‘reluctant immigration state’ to implement various liberal work visa reforms. The uncoordinated nature of policymaking and implementation, and the limited involvement of state and societal institutions in the reform process, reflect the UK's historical experience with restrictionist policies, and help to explain the subsequent reintroduction of strict visa controls. The case demonstrates that policy legacies indeed play a significant role in defining the character of the policymaking institutions that shape a state's immigration politics.  相似文献

In his recent writings, Jürgen Habermas asks how the liberal constitutional principle of separation between church and state, religion and politics, should be understood. The problem, he holds, is that a liberal state guarantees equal freedom for religious communities to practise their faith, while at the same time shielding the political bodies that take collectively binding decisions from religious influences. This means that religious citizens are asked to justify their political statements independently of their religious views, resulting in a burden that secular citizens do not experience. To compensate, Habermas demands from secular citizens that they open their minds to the possible truth content of religion, enter into dialog and contribute to the translation of religious reasons into generally acceptable reasons. This article focuses on Habermas’s assumption that religious citizens suffer an asymmetrical cognitive burden that should be compensated, and his claim that his approach to religion in the public sphere is less restrictive than that of John Rawls.  相似文献

There is something gravely amiss about a liberalism based upon evolutionism, as F. A. Hayek bases his endorsement of the free, open, or 'Great Society'. Such a society—one based upon individual liberty, autonomy, and free-market institutions—is not guaranteed by the evolutionary process, as Hayek's own indictment of twentieth-century totalitarianism in The Road to Serfdom amply demonstrated.
In the first section of this paper, I explore some of the pitfalls for a liberalism grounded on evolutionary foundations: a relucance to tamper with existing institutions which borders on traditionalism; a tension between individualism and holism, the latter born of an evolutionist's concern for the survival of the group; and a relativism derived from evolutionism which seems ill-suited to a liberalism which values freedom.
The last two sections of the paper examine some striking connections between Hayek's liberalism and that of William Graham Sumner and Herbert Spencer. While there are important differences between Hayek's and Sumner's positions, on the one hand, and Spencer's, on the other, all three suffer from a common problem: their liberalism sits uneasily upon evolutionary foundations.  相似文献

This paper proposes a scheme of large-scale migration from poor countries to rich ones to speed up economic development and raise the world's economic level. The key behavioral mechanism is non-school learning; as the migrants and their children take on the culture of the rich country, they acquire the skills and attitudes necessary for modern industrial production. Rich nations will not voluntarily open their borders to such immigration. A change in the international system is therefore suggested, giving power of taxation to an international body. This body would then hold an auction among the rich countries for immigration contracts. Though the present international system makes no provision for such policies, it makes sense to discuss and analyse the policies now, to be ready for possible future changes and perhaps to help stimulate changes in the international level.  相似文献

In her introductory essay to this special issue on refugees and xeno­phobia--in which the articles focus primarily on asylum-seekers,2 mostly in the United Kingdom, but also in France and Ireland--guest editor Liza Schuster draws on the work of the contributors and on her own research in Britain, France, Germany and Italy to address the treatment of asylum-seekers by European states. European liberal democracies share a common commitment to granting asylum to those in need of protection, a commitment made legally binding by signing the 1951 Geneva Convention relating to the Status of Refugees. They also share a commitment to principles of equality and non-discrimination. However, in recent years European states have embraced practices that permit discrimination against and unequal treatment of asylum-seekers, and recent British government proposals threaten the 1951 Convention itself. Schuster interrogates some of the underlying assumptions of asylum policies in the United Kingdom in particular, but also with reference to other European states, arguing that common-sense assertions of the ‘need for control’, which underlie the differential treatment of asylum-seekers in particular, are expressions of a racism at the heart of European states. She further argues that, at the border, racism intersects in a complex and shifting way with class and gender, creating a hierarchy of the excluded. Following a discussion of racism and these other modalities of exclusion, Schuster examines practices through which this racism is articulated.  相似文献

While immigration is attracting increasing attention in political theory, there are as yet, few political theorists who adopt a restrictionist stance. With very few exceptions, the most political theorists have offered so far are pragmatic, not principled, defenses of the right to exclude. Looked at in this light, David Miller’s engagingly thoughtful book is surely a welcome and distinctive addition to the burgeoning literature on immigration. But readers who are looking for a normative counterpart to Joseph Carens’ Ethics of Immigration might be disappointed. In fact, the two books display more similarities than one would expect. Most notably, they share a common methodological ground: both reject top-down approaches, which proceed from abstract normative principles and apply these principles to immigration and integration policies. Yet, Miller’s realism reaches farther, giving greater weight to empirical evidence and focusing on institutions instead of on how individuals should act. This institutional focus is a key-defining feature of Miller’s political philosophy of immigration as distinct from an ethics of immigration. However, as I shall argue in the first part of this paper, Miller does not remain faithful to this distinction. He blames unauthorized migrants for acting ‘unfairly.’ But his criticism of irregular migration lacks a sufficient normative and empirical basis. The second part of the paper deals with the question whether legal coercion gives rise to a right to stay. My focus is in particular on the costs that irregular immigrants must bear when they are forced to go back to their countries of origin. These costs tend to be much higher than one expects.  相似文献

This article explores the neglected relationship between conservatism as political theory and conservatism as political practice using the example of recent immigration to Europe. A cursory glance at how European politicians have responded to migration challenges suggests that they roughly divide into an open‐arm, leftist ‘liberal’ camp and a right‐wing ‘conservative’ one. The situation, however, is more complex. This article engages with the resources of conservative theory to argue that there are many distinct conservative theoretical positions for any one policy point. Using contemporary migration patterns as a case study, the findings suggest that Conservative parties have not borrowed much from conservative theory in its variety of incarnations. In fact, conservative theory can buttress a course of action that is generous toward migrants and at odds with the claims of right‐wing populist movements. While certain strands of conservatism imagine a homogenous people, there are others that are no less pro‐pluralism than liberal theories, and sometimes more so.  相似文献

Since the 1940s, Congress and the federal courts have sought to make U.S. federal administration more responsive to democratic–constitutional values, including representation, participation, transparency, and individual rights. As manifested in the National Performance Review, the New Public Management emphasis on results may reduce attention to these values, which for most agencies are not intrinsically mission–based. Freedom of information illustrates the problem of protecting nonmission–based, democratic–constitutional values in results–oriented public management. Agencies' annual performance plans under the Government Performance and Results Act overwhelmingly ignore freedom of information, even though it is a legal requirement and performance measures for it are readily available. This study concludes that focusing on results may weaken commitment to democratic–constitutional values by default. It suggests that using a balanced scorecard approach in performance plans could enhance attention to freedom of information and other democratic–constitutional values.  相似文献
