Process choice     
Regulation scholars have long searched for the best tools to use to achieve public policy goals, generating an extensive body of research on what has become known as instrument choice. By contrast, analysis of options for structuring how officials make regulatory decisions – process choice – remains in relative infancy. Notwithstanding the emphasis legal scholars and political economists have placed on administrative procedures, surprisingly little research has investigated why regulators choose among different process options or what value they and the public receive from different choices. In their book, Regulation by Litigation, Andrew Morriss, Bruce Yandle, and Andrew Dorchak make a significant contribution by empirically and normatively examining regulators' choices between notice‐and‐comment rulemaking, negotiated rulemaking, and what they call “regulation by litigation.” This review article considers three central questions about regulation by litigation. First, how if at all does regulation by litigation differ from other uses of litigation to achieve policy goals? Second, why do regulators choose litigation over other process options? Third, is regulation by litigation as bad as Morriss, Yandle, and Dorchak say it is? By addressing these conceptual, empirical, and normative questions, this review article not only reveals the specific strengths and limitations of the book, Regulation by Litigation, but also highlights more general opportunities and challenges for future research on process choice.  相似文献

In a recently published collection of interviews with “the most prominent scholars in comparative politics since World War II,” Adam Przeworski revealed that his writings from the 1980s on Social Democracy served a political end, that is, to defend it from critics such as Lenin, Trotsky, Lukacs, and Luxemburg. His co-authored book, Paper Stones: A History of Electoral Socialism (1986), still a classic in the sub-field, claims that none other than Frederick Engels sanctioned Social Democracy's quintessential stance, the peaceful or parliamentary road to socialism. A close reading of Paper Stones reveals, however, that it misrepresents—sometimes in quite blatant fashion—the views of not only Engels but Marx as well. This involves the omission of contradictory evidence from many places in the Marx–Engels corpus, the same text, the same page or even the next sentence. Przeworski's reinvention of Marx and Engels duplicates what Edward Bernstein did more than a century ago in his quest to revise their views. Paper Stones excludes evidence that challenges its central finding that the reformist outcome for European Social Democracy was inevitable—a claim, therefore, that can only remain hypothetical.  相似文献

Abstract

In December 1993 the Taiwan government adopted a policy called nanjin zhengce or sudpolitik, a policy aimed at diverting part of Taiwan's trade and investment flows from China to Southeast Asia. This paper addresses the following questions: what is sudpolitik? why adopt such a policy? what are the economic, political, and strategic considerations in the pursuit of this policy? which countries are its specific targets? how do the countries directly affected by this policy respond to it? The paper also discusses the issue of Taiwan's aid in connection with sudpolitik. While the effectiveness of the policy is far from clear at present, the paper concludes with four observations: Taiwan's trade and aid are beginning to intertwine; Taiwan's diplomacy is largely economically or commercially led; Taiwan has achieved some positive results in improving its relations with Southeast Asian countries; and, Taiwan has reached a new stage in its economic development whereby it needs to invest overseas in order to sustain its economic growth. Overall, sudpolitik represents a novel step in Taiwan's diplomatic practice.  相似文献

Abstract

Those scholars debating the health of the human rights movement completely ignore the role of human rights education, HRE. Whether it is Samuel Moyn and Stephen Hopgood declaring the demise of what they also term the “human rights project”, or Kathryn Sikkink defending it, none explore the effect HRE is having or can have. This article argues that those who neglect to recognize the substantial and substantive conversation going on in our institutions of higher education cannot provide a complete picture of the human rights project. It will demonstrate which of the naysayers Moyn and Hopgood's arguments are weakened by ignoring HRE and argue that Sikkink's recommendations for human rights efforts can be strengthened by HRE. Also explored is what HRE should learn from the critiques of these three scholars and how university HRE can be improved.  相似文献

Abstract

This paper examines the relevance of Boltanski and Thévenot's newly translated book, On justification, to the analysis of political ideas and political action. While situating the work of the authors within its initial intellectual context, namely the ‘economics of conventions’, it shows that one of the key contributions of the ‘sociology of justification’ lies in the answers it brings to two fundamental, as yet unresolved, questions in political science and political sociology: first, how is it possible to identify those ideas which are politically relevant? Second, how is it possible to capture the dynamics of public ideas? After outlining the sources of the quandaries faced within political science and political sociology as regards these two questions, the conceptual framework of Boltanski and Thévenot is presented and explained, and research perspectives suggested. This article argues that On justification provides a highly engaging, stimulating and empirically useful contribution to current debates in social and political theory around the dynamics of political arguments and ideas.  相似文献

Abstract

Many international relations (IR) scholars discuss whether the Association of Southeast Asian Nations (ASEAN) possesses institutional utility in maintaining security in Southeast Asia or East Asia. While this has important implications for both academics and policy-makers, ASEAN's role has been too often evaluated in terms of what has persisted within the association rather than what changed. Yet, exploring the causes and processes of institutional transformation are particularly important because they have made ASEAN expand its security utility by creating security dialogues and fostering security cooperation in the region. In this context, the crucial question is: when and how has ASEAN changed?

Focusing on the causes and processes of institutional transformation which have occurred within ASEAN, this article explores ASEAN's transformation from 1968 to 1976, by using a theoretical model, developed from historical institutionalism and the punctuated equilibrium model. Applying this approach to institutional transformation of ASEAN in the political-security field, three transformation processes are constructed. First, ASEAN member states’ expected changes in the external security environment triggered internal discussions regarding ASEAN's political-security function; second, these internal political discussions fostered institutional consolidation of ASEAN during this period; and third, such direction of institutional transformation was fundamentally guided by ideas provided by institutional norm entrepreneurs (INEs), especially Malaysia's neutrality proposal.

In particular, this article examines the process of ASEAN's creation of the Zone of Peace, Freedom, and Neutrality (ZOPFAN) in 1971, and the Treaty of Amity and Cooperation (TAC) and the Bali Concord in 1976, and argues that this model shed light on the significance of ZOPFAN that created a foundation of TAC and the Bali Concord, for which conventional wisdom has dismissed as an insignificant institutional concept by academics and practitioners.  相似文献

ABSTRACT

A growing number of governments will consider and even choose to migrate to an alternative operating system that uses Free/Open Source Software (FOSS). This research examines why governments choose to migrate and what factors affect implementation. Drawing on a comparative case study of four cities, I find that governments decide to migrate for a range of factors, but are driven more by democratic values such as independence and self-determination than by a desire to cut costs or save money. I also find that implementation is affected by a variety factors but in particular by information technology's place within a city's organizational structure.  相似文献

Barack Obama's first autobiography, Dreams from My Father (1995), explores themes of race and identity up to the late 1980s in the life of the first African American president. The book emphasizes Obama's personal struggle as the son of an interracial couple, and the social and environmental context that shaped his growth and transformation. Using the tools of critical race theory, Freeman illustrates how Obama's autobiography can be used in the classroom to explore an individual's developing racial consciousness in the 1970s and 1980s, and as a prism through which students can understand what it means to live in the post-civil-rights-movement era. Obama's life history illuminates how the ideas and meanings of racial progress in the United States are contested and struggled over on a daily basis at both the micro and macro level.  相似文献

As a new world economy emerges what is being learned about the accompanying phenomenon of administrative corruption? To probe this question we combine study of current developments in China with prevailing theories of corruption. The administrative corruption experience, as it has unfolded during the economic development thrust of the Deng reform era, is described and analysed in a comparative context. In specifically interjecting the American experience we suggest that a balanced control response to corruption —rather than an elimination focuscould be a fruitful avenue for policy and research, and that informal, social approaches to corruption control are pregnant with possibilities. China's experience offers a significant opportunity to push the margin of wisdom on these issues as they relate to economic and political development.  相似文献

This paper deals primarily with Deleuze's work on literature? but also looks briefly at related ideas in the books on cinema. Deleuze has often concentrated on what he calls ‘American‘ literature, particularly in Critique and clinlque. The first part of the paper seeks to outline some of the main elements of this particular literary field for Deleuze. The paper then goes on to show how the general rejection of metaphor that informs Deleuze's work on literature can be more precisely defined as a theory of free indirect discourse. The concept of free indirect discourse is? as Frangois Zourabichvili has shown, at the heart of Deleuze's work? aesthetic or otherwise. For example, the idea of the percept functions as an aesthetic application of free indirect discourse, and Cinema 1 and Cinema 2 suggest that this form of enunciation represents a new aesthetic cogito to which cinema is ideally suited.  相似文献

What are the most important sources of institutional variation among authoritarian regimes, and how do such institutions influence these dictatorships' propensity to initiate military disputes? This article argues that most existing studies in both comparative politics and international relations employ a flawed conceptualization of authoritarian institutions. Excessive focus on the personalization or institutionalization of authoritarian regimes' decision‐making procedures has distracted attention from the more critical issue of what institutions these regimes deploy to enhance social control and secure political incumbency. Since military regimes are systematically less effective than single‐party regimes at developing these types of authoritarian institutions, they more frequently resort to desperate measures to fend off domestic challenges to their power. In particular, we find compelling empirical support for our hypothesis that military regimes are more likely than single‐party regimes to initiate military disputes, irrespective of whether those regimes are highly personalized or not.  相似文献

ABSTRACT

Participedia is an open-source, participatory knowledge tool that responds to a new global phenomenon: the rapid development of experiments in new forms of participatory politics and governance around the world. The experiments are diverse and widespread, from the British Columbia Citizens' Assembly in Canada and the Oregon Citizens' Initiative in the United States to Participatory Budgeting in Brazil, deliberative forums in China, Panchayati Raj reforms in India, and citizen technology assessment in Denmark. Our knowledge of this rapidly expanding universe is shallow. The authors of this article, together with several others, have created the Participedia to respond to this deficit in knowledge. This article documents the development of the Participedia project to date. Participedia aims to be useful to scholars (and practitioners) as an open-source, real-time, cumulative qualitative and quantitative data repository about participatory and deliberative governance experiences. We believe that Participedia is the first effort in the social sciences to build a large data set through a method that is both crowd-sourced and structured to produce good quality, comparable information.

Abstract

Drawing upon Karl Polanyi's journalistic writings and unpublished lectures from the 1920s and 1930s, this article reconstructs the lineaments of his research programme that was to assume its finished form in The Great Transformation. It identifies and corrects a common misinterpretation of the thesis of that book, and argues that Polanyi's basic theoretical framework is best conceived as Tönniesian: market society is Gesellschaft, while the ‘protective counter-movement’ of The Great Transformation is Gemeinschaft, understood dynamically. It examines the two central mechanisms by which, in Polanyi's understanding, Gesellschaft broke down in the mid-twentieth century: the ‘clash between democracy and capitalism’ and the ‘perverse effects’ whereby political intervention in markets impairs profitability and saps the vitality of the market system.  相似文献

Abstract

Research on discrimination in housing credit has focused primarily on the outcomes of a complex process in which many parties play a role. The lender— or prospective lender—is only one party in the process that results in decisions by individuals and households to buy homes and finance their purchases. To focus solely on lenders would make it difficult to measure the nature and extent of discrimination and its effects on housing outcomes.

After discussing limitations of housing credit discrimination research, the author suggests two relatively underexplored areas: studying housing search behavior and auditing lenders to assess their treatment of prospective borrowers before the stage at which written loan applications are submitted. Both suggested avenues of research might better address three public policy questions for which our knowledge is incomplete: Is there discrimination? Where does it occur in the home‐buying process? What are the effects of discrimination on household behavior?  相似文献

How do we determine what are the motives of US leaders when they intervene in other countries either directly with US armed forces or indirectly with surrogate forces? Rather than accepting the policymakers' claims at face value, we can look for patterns of intervention: what kinds of governments and political movements do US leaders support? What kind do they oppose and seek to destroy? And what socioeconomic goals do they pursue upon successfully intervening? Rather than seeing US policy as befuddled and contradictory, we observe that it is often remarkably consistent in services rendered on behalf of transnational corporate global domination. Other policy considerations do come into play during times of intervention, but there is no reason to treat them as mutually exclusive of economic motives.  相似文献

Documents recently made available at the National Archives by the CIA are accessed through non-traditional archival means: researchers use keywords at computers to obtain them. Most of the documents will be uninteresting or worthless to scholars. Some add important or colorful details to our knowledge of the Agency. An example is a small set of documents detailing 1962 telephone conversations of DCI John McCone with President Kennedy, former DCI Dulles, and former Vice President Nixon about the latter's best-selling book Six Crises, which charged Kennedy with having acted unscrupulously as a presidential candidate in 1960 by advocating covert action against Cuba.  相似文献

Performance in public organizations is a key concept that requires clarification. Based on a conceptual review of research published in 10 public administration journals, this article proposes six distinctions to describe the systematic differences in performance criteria: From which stakeholder's perspective is performance being assessed? Are the criteria formal or informal? Are the criteria subjective? Which process focus and product focus do they have, if any? What is the unit of analysis? Based on these distinctions, the performance criteria of existing studies used in an empirical review of management and performance are classified. The results illustrate how a systematization of the conceptual space of performance in public organizations can help researchers select what to study and what to leave out with greater accuracy while also bringing greater clarity to public debates about performance.  相似文献
