论文运用波兰尼的"双向运动"理论以及一种国家与社会互相构建的逻辑,分析经济改革以来中国的国家重建及其现在与未来所面临的挑战。论文的主要观点是:从经济改革直到最近的治理转型,中国的国家重建主要是在市场化运动这个单向运动的推动下进行的。然而,进入21世纪后,国家重建不得不在市场化运动和社会自我保护运动这两个方向相反的"双向运动"的张力中展开。这就是挑战之所在。为了应对这一挑战,中国必须重构国家、市场和社会之间的关系。  相似文献

本文利用1978~2006年的数据,通过单位根检验、协整分析、误差修正模型和Granger因果检验,对成都市固定资产和经济增长关系进行了实证分析。结果表明,成都市固定资产投资与经济增长之间存在长期稳定的均衡关系,投资与经济增长之间是双向的格兰杰因果关系。  相似文献

State and federal prohibitions of referral fees have long plagued the health care sector because their broadly worded provisions threaten established and socially valuable business arrangements. Congress has recently instructed the Department of Health and Human Services to issue regulations that clarify the scope of the most threatening of these prohibitions, the Medicare and Medicaid felony referral fee statute. This article examines three possible analytical models for imposing a limiting construction on referral fee statutes by testing the models against three beneficial practices that the statute jeopardizes: physician recruitment, fee discounting, and efficiency bonuses. The article recommends primary reliance on an earned/unearned analysis that detects a prohibited referral fee by asking whether the fee is fully earned by legitimate, nonreferral services.  相似文献

This article reports an evaluation of a community intellectual disability offender service over the period from 1990 to 2001. Men who committed sex offenses or sexually abusive incidents (n = 106) and men who committed other types of offenses and serious incidents (n = 78) are compared on personal characteristics, referral sources, forensic details, and outcome up to 7 years after referral. The cohorts are older than one would expect from the criminology literature, and, at about 33%, the incidence of mental illness is consistent with some previous studies. A greater proportion of sex offenders had criminal justice involvement and a formal disposal from court. Fire raising was not overly represented as an offense. There was a higher rate of reoffending in the nonsexual cohort, which persisted up to 7 years. Investigating only reoffenders, there was a considerable amount of harm reduction recorded up to 7 years, statistically significant up to 5 years following initial referral.  相似文献

The University of Miami Linda Ray Intervention Program (LRIP) is a Part C early intervention program for children under the age of three, with verified developmental delays located in Miami‐Dade County that has established a strong link and referral process from the Juvenile Court as well as local community‐based care agencies. Creating a system where early intervention communicates well with the court system is paramount in changing the well‐being trajectories of these vulnerable children. This article describes the growing need for early intervention services as well as the results of one successful early intervention‐court partnership that has shown promising short and long‐term results for developmentally‐delayed children who were born prenatally exposed to cocaine.  相似文献

Drawing on the career of Philip Corboy, this article examines the construction of the plaintiffs' personal injury bar in the second half of the 20th century. Through a relational biography based on Mr. Corboy's career, we look at the development of this subprofession in the context of the sociopolitical environment within which Mr. Corboy and his peers operated, the social capital they possessed, and the particular strategies they used as they worked to establish both a professional and market niche. This analysis shows how and why Mr. Corboy and his peers constructed a thriving subprofession that is characterized by a unique blend of working-class ideology, trial craft, professional bar leadership, Democratic politics, local philanthropy, and a market referral system — all of which reinforce the dominance and prestige of its own elite .  相似文献

ABSTRACT

This article challenges the dominant framework that drives US public diplomacy initiatives and insists that, short of major structural changes, US public diplomacy lacks ethical legitimacy. Based on a review of past US public diplomacy practices, the article finds that these efforts were mainly characterized by a one-way flow of information and an emphasis on image management. Using the theories of hegemony, American exceptionalism, Orientalism, and cultural imperialism, the author lays a theoretical framework for analyzing public diplomacy. The author suggests that, for public diplomacy to move beyond propaganda, it needs to incorporate two-way communication and symmetry.  相似文献

The article sketches out questions that constitutional adjudication represents for democratic theory. After taking into account some of the reasons for the early emergence of judicial review in the United States, it considers different modalities of constitutional control in European countries (notably, France and Italy). Attention is drawn to the different mechanisms of referral, leading, for instance, to the political monopoly in France and to the (quasi) monopoly of the judiciary in Italy. Denying any sovereign power to the organs exercising constitutional control, the article puts forward the thesis that constitutional adjudication guarantees ultimately the control of political super-majorities over legislative majorities.  相似文献

Teen courts are juvenile justice diversion programs found in most states. Programs vary significantly between, and even within, states, making regulation cumbersome. Their grass roots nature requires legislative latitude so each program can meet the specific needs of the communities they serve. States have passed both specific and broad legislation acknowledging their existence and providing referral sources. This article examines teen court legislation from every state, analyzes each, and draws conclusions about teen courts from a legislative perspective.  相似文献
