In recent years, transnational and domestic nongovernmental organizations have created non–state market–driven (NSMD) governance systems whose purpose is to develop and implement environmentally and socially responsible management practices. Eschewing traditional state authority, these systems and their supporters have turned to the market's supply chain to create incentives and force companies to comply.
This paper develops an analytical framework designed to understand better the emergence of NSMD governance systems and the conditions under which they may gain authority to create policy. Its theoretical roots draw on pragmatic, moral, and cognitive legitimacy granting distinctions made within organizational sociology, while its empirical focus is on the case of sustainable forestry certification, arguably the most advanced case of NSMD governance globally. The paper argues that such a framework is needed to assess whether these new private governance systems might ultimately challenge existing state–centered authority and public policy–making processes, and in so doing reshape power relations within domestic and global environmental governance.  相似文献

Abstract

The difficulty Israel has making peace with the Palestinians, which became evident with the failure of the 1993 Oslo Agreements, can be explained through the internal relationships and historical dynamics within the Israeli public sphere, and the relations between the public sphere and the state. Using the terms ‘civil society’ and ‘uncivil society’ as a theoretical framework, the article examines both the relations between these two binary representations within the public sphere and the ability of each of them to influence state policy through two analytical tools: cultural politics and instrumental politics. The contention is that the Oslo Agreements failed in part because while both the civil and uncivil societies arose as a cultural innovation and alternative collective identities in neo-liberal Israel, the uncivil society succeeded in translating its collective representations into effective instrumental politics that influenced the Israeli state, while the civil society failed to do so.  相似文献

Scholars have engaged in an ongoing dialogue about the relationships among management, politics, and law in public administration. Collaborative governance presents new challenges to this dynamic. While scholars have made substantial contributions to our understanding of the design and practice of collaborative governance, others suggest that we lack theory for this emerging body of research. Law is often omitted as a variable. Scholarship generally does not explicitly include collaboration as a public value. This article addresses the dialogue on management, politics, and law with regard to collaborative governance. It provides an overview of the current legal framework for collaborative governance in the United States at the federal, state, and local levels of government and identifies gaps. The institutional analysis and development framework provides a body of theory that incorporates rules and law into research design. The article concludes that future research on collaborative governance should incorporate the legal framework as an important variable and collaboration as a public value.  相似文献

Why do private governance initiatives trigger greater participation in one country than another? This article examines the domestic dimension of transnational regulation through a case study of private sustainability governance in Argentina. Drawing from theories of contentious politics, the argument poses that the resonance of transnational private governance is shaped by the semantic compatibility of “incoming” sustainability programs against national political culture. Analyzing the limited participation of Argentine actors in contemporary sustainability initiatives, the article claims that the validity and relevance of sustainability programs is affected by three dimensions of national political culture accentuated over the last decade: a politicized model of state‐society relations, the low visibility of environmental matters, and a widespread anti‐corporate culture. By examining the ideational fundamentals of the “politics of resonance” in Argentina, the article makes a relevant and original contribution to transnational regulation literature, highlighting the need for theoretical accounts and empirical analyses that address domestic and cultural variables as fundamental pieces in transnational norm diffusion and effectiveness.  相似文献

Abstract

Hong Kong and Singapore are both typical administrative states with an efficient administration and a vibrant market, which had achieved rapid economic growth in the past decades. This article examines the trajectory of their state capacity, highlighting recent problems and challenges. Based on a conceptual framework that captures and links up four dimensions – namely polity, bureaucracy, economy and civil society – their commonalities and differences in response are discussed. Their experience should be of particular relevance to transitional authoritarian states in Asia such as China, which faces similar challenges to reform in the arenas of politics, administration, economics and society.  相似文献

Abstract

This article explores the emergence of new spaces for civil society organisations (CSOs) as a result of an increasing interest by international donors in multi-stakeholder approaches to good governance under the ‘new policy agenda’. Drawing upon a contemporary case study of civil society in Cambodia, it argues that CSOs have been encouraged to perform two key roles on a national level: professional service delivery agents and democratic watchdogs. Both roles are seen by donors as integral to supporting an accountable and professional model of the Cambodian state while drawing upon valuable private sector lessons in a synergetic model of governance. The result is the construction of particular neoliberal spaces for CSOs operating as technical implementation mechanisms in response to externally driven donor pressures. Furthermore, under this new framework of governance, CSOs face pressure to undergo internal transformation akin to new public management reform; embracing economistic and administrative modes of coordination as core values of civil society participation.  相似文献

This article offers a conceptual framework to identify and analyse the contemporary behaviour of the paradoxical government-organized, non-governmental organization (GONGO). We discuss how GONGOs’ activities fit within mainstream civil society theories and traditions. Furthermore, we compare and analyse GONGOs and NGOs in terms of their sources of power, main activities and functions, and dilemmas. Finally, we theorize the effects, and implications, the growth of GONGOs has on state and society relations globally.  相似文献

Abstract

This article seeks to provide a conceptual framework to complement and guide the empirical analysis of civil society. The core argument is that civil society must be understood, not as a category of (post)industrialized society, but as one of individualized society. Civil society is characterized by individualism that is sustained and protected by the civil values of autonomy and emancipation. This, accordingly, implies that empirical data of civil society can be understood most fruitfully within the framework of individualized society. Classical sociology, however, perceives this very individualism and its values as being antagonistic to its own civic vision. Hence, the crucial question is whether there can be any scope for citizenship, classically understood, within civil society. This article begins with the conceptual reconstruction of the social organization of civil society. Thereafter, two distinct civil society perspectives—mediating structures and Tocquevillianism—are explored to see how civil individualism and citizenship relate to each.  相似文献

This paper discusses how Marxist understandings of politics and civil society, particularly Marx's own work, can contribute to understanding the dynamics of political change in contemporary capitalist democracies. While briefly exploring the conceptual problems contained in the political-philosophical agenda set out in Marx's earliest works, the paper argues that his subsequent examinations of civil society and class relations are grounded in a political economy of capitalist development which retains considerable salience. The possibilities of a post-Marxist politics of civil society are assessed in this light, using the example of recent neo-liberal and neo-conservative assaults on the welfare state to indicate the ways in which membership of civil society is itself a critical focus of political contestation. A politics of civil society (for example, contemporary 'third way' strategies) lacks any substantive democratic potential, without the type of radical political economy developed by Marx.  相似文献

The institutional and societal framework of policy-advice-giving is changing and so are the worlds of political consultants and policy experts in Germany and other advanced democracies. While there are several new developments which are challenging established forms of policy-advice and political consulting, the present article focuses its attention on the impact of new governance structures on policy advice and political consulting. The main argument of the article is that when government becomes governance and the number of actors and venues involved in the decision-making process increase, a new cooperative and discursive mode of policy-advice giving complements or sometimes even replaces more established forms of policy-advice-giving. We review the evolution of the debate about the role of policy-advice-giving from different perspectives, and particularly explore possible consequences of the changing nature of the state as well as of newly emerging modes of cooperative policy-advice and political consulting — both for empirical as well as conceptual research in the field. Through this, we attempt to generate a debate on the future direction of different modes of policy-advice and political consulting within a changing framework of governance structures in advanced democracies.  相似文献

The politics of governance in higher education is dominated by a discourse of quality assurance which assumes the external regulation of academic activity to be the natural state of affairs. This article analyses the ideological origins of that discourse and its resonance with more general trends in the public management of welfare, the nature of the opposition from traditional university values, the stages in the translation of ideological advantage into specific forms of regulation, and the consequent shifts in the balance of power between the major players in higher education. Underlying this analysis is a framework which views the governance of higher education as an arena in which there is a continuing struggle for the control of high status knowledge through the functions of standard setting, evaluation and intervention.  相似文献

Unlike the Mao era when educational development was entirely directed by the central government, there has been a strong trend to diversification and decentralization of education in the post‐Mao period. This article, being set in this context, examines how the policy of decentralization has affected the governance modes of higher education in Mainland China. More specifically, the article focuses on three major aspects of education governance, namely, financing, provision and regulation in education, with special attention given to examining the changing relations between the state, local governments and other agents in education delivery. One very significant consequence of the change is that the public‐good functions of education, of which the state has taken the primary role of a reliable guarantor, have diminished. Nonetheless, the state's role as a regulator and overall service coordinator has been strengthened rather than weakened under the policy of decentralization. 城市基层治理涉及多元治理主体的复杂互动关系,这种复杂的互动关系内蕴着权力结构与秩序的演变。国家、市场、社会三方主体力量在中国强国家弱市场弱社会的现实背景下,呈现出以结构性非对称性形式相互依赖、三角权力关系稳定、相互弥补各方失灵为特点的互动形态。文章将此互动形态在基层社区中的运作概括为“半嵌入性互动治理”。基于国家-市场-社会三维分析视角,通过多案例比较方法研究H街道四个社区的业委会与物业管理运作,发现“半嵌入性互动治理”在现实运作中呈现多种类型。国家、市场、社会在基层社区治理中的互动关系会根据现实需求与权力博弈进行平衡与调试,最终保证社区内部安全与有效治理。  相似文献

This article develops an analytical framework designed to examine social policy as a strategic approach to issues of state-society relations and the problem of governance in Latin America. It argues that in Latin America and particularly Brazil social protection policy flowed from initiating capacity concentrated originally in the state, and specifically in a techno-bureaucratic elite connected to a strong executive. The policy, however, produced structures wherein initiative capacity was dispersed into a multiple of intermediate points at the nexus between the state and civil society. This in turn led to an immobilized dissipation of initiative cizpacity in this specific policy area which was symptomatic of, and reinforcing to, a generalized immobilism or power implosion that periodically has gripped these sociopolitical formations, producing shifts from formally democratic to authoritarian regimes and vice versa.  相似文献

The study of executives politics has been characterized by dichotomous country–specific debates about whether there is, for example, prime ministerial or cabinet government. Recent work has established new terms for these debates leading to more pluralistic conceptualizations of executive politics. Nevertheless, this work has not created the conditions for rigorous cross-national comparison. This article establishes a framework to compare executive branch power relations. It identifies six models of executive politics comprising a comprehensive set of ways in which power may be distributed amongst chief executives, cabinets, ministers and bureaucrats. On the basis of this framework it is argued that it is necessary to engage in empirical observation to determine which models of government occur and to identify the reasons why these models emerge.  相似文献

This article takes a thematic approach to review the existing literature (in both Chinese and English) of environmental politics in the broad context of China studies. Examined themes include state and environmental governance, public awareness and environmental social activism, and environmental foreign relations. Findings and arguments are assessed with two important questions in mind: What differentiates the environmental arena from Chinese politics in general? What new insights into Chinese politics can be gained from case studies of environmental protection? Scholarship on environmental politics contributes not only empirical findings, but also critical challenges to the conventional knowledge and frameworks of Chinese politics.  相似文献

How to generate legitimate forms of governance beyond the nation state is often considered a central question in contemporary world politics. To proceed in theory‐building, scholars need to systematically assign the theory‐driven assumptions on legitimate forms of governance beyond the nation state with the various, already observable, forms of global governance. This article aims to conduct a comparative appraisal of the legitimatory quality of different patterns of governance by applying a framework of indicators for their assessment. The indicators are selected from the scholarly debate within International Relations on the legitimacy of global governance arrangements and structured by a multidimensional concept of legitimacy (input, throughput, and output dimensions). This framework is then applied to international, transnational, and private forms of global governance in the field of Internet regulation in order to show how each of them tries to produce and maintain legitimacy, which strategies it applies, and in how it interacts with its stakeholders.  相似文献

Abstract Despite the apparent development and spread of liberal democratic state forms in the 1980s and 1990s, possibilities for genuine democratic governance overall are declining. Firstly, the emergence and consolidation of modern liberal democracy was inextricably intertwined with the development of the nation–state and is profoundly socially embedded in that structural context. Secondly, in today's globalizing world, cross–cutting and overlapping governance structures and processes increasingly take private, oligarchic (and mixed public/private) forms; hegemonic neoliberal norms are delegitimizing state–based governance in general; and democratic states are losing the policy capacity necessary for transforming democratically generated inputs into authoritative outputs. Consequently, robust constraints limit the potential for (a) reinstitutionalizing the 'democratic chain' between accountability and effectiveness, (b) rearticulating the multitasking character of authoritative institutions and (c) renewing the capacity of authoritative agents to make the side–payments and to undertake the monitoring necessary to control free–riding and assimilate alienated groups. Rather than a new pluralistic global civil society, globalization is more likely to lead to a growth in inequalities, a fragmentation of effective governance structures and the multiplication of quasi–fiefdoms reminiscent of the Middle Ages.  相似文献

The phase of democratic consolidation can significantly impact the motives, dynamics and objectives of civil society. Its internal roles, dynamics and power balances are significantly altered by the advent of democracy, due to shifting resources, political opportunities and a general reframing of goals and objectives. By adopting a definition of civil society as an ‘arena’ (which highlights the continuously evolving composition and leadership of civil society) and borrowing a number of theoretical dimensions from social movement theory (which underline the importance of resource mobilization, political opportunities and conceptual framing processes), the article shows that the advent of democracy has posed a number of challenges to civil society organizations in Korea and South Africa. Moreover, the consolidation of democracy has inevitably changed the nature of government–civil society relations. While in South Africa institutional politics reasserted itself in the first years of democracy, thereby sidelining organizations and movements concerned with public accountability and good governance (which have only recently resurfaced through the action of new social movements), in Korea corruption and lack of transparency immediately marred the dawn of democracy, providing civic movements with a fertile terrain to galvanize civic mobilizations vis-à-vis the lack of responsiveness of the political class.  相似文献
