The institution of committees in democratic legislatures has for years been said to bias policy making because the preferences of committee members differ from, and are more alike than, those of other legislators due to self‐selection to the committees. Based on an analysis of United States Senate committees, Hall and Grofman suggested in 1990 that the preferences of committee members primarily diverge from, and are more alike than, those of non‐committee members on policy issues that are salient to constituencies or at least to an easily definable segment of constituencies. This article argues that the logic of Hall and Grofman should in fact be reversed in legislatures characterised by highly cohesive parties. Accordingly, the main hypothesis is that in such legislatures the preferences of committee members are more likely to be alike than those of non‐committee members in the committees that work with policy issues of less salience to constituencies. Using a large‐scale comparative design comprising data collected in 2008 on the spending preferences of 1,348 Danish local politicians, evidence is found supporting this hypothesis. This finding points to the importance of considering the role of parties when assessing committee bias.  相似文献

The literature on congressional committees has largely overlooked the impact of jurisdictional fights on policy proposals and outcomes. This paper develops a theory of how legislators balance the benefits of expanded committee jurisdiction against preferred policy outcomes. It shows why (a) senior members, and junior members in safe seats, are most likely to challenge a committee’s jurisdiction; (b) policy proposals may be initiated off the proposer’s ideal point for jurisdictional gains; (c) policy outcomes will generally be more moderate with jurisdictional fights than without these turf wars. We empirically investigate these results examining proposed Internet intellectual property protection legislation in the 106th Congress.  相似文献

What explains the power of parliamentary committees? A large literature on the United States Congress sees strong legislative committees as a consequence of legislators’ incentives to cultivate a personal vote. These incentives are typically understood to be determined by formal electoral rules. How legislatures are elected thus shapes how they are organised. This article argues that explanations of legislative organisation should also consider a non-institutional source of personal vote-seeking incentives: voters’ partisanship. Where partisan dealignment is more extensive, legislators have stronger incentives to develop a personal vote. Where committee systems are more powerful, legislators have better opportunities to do so. Partisan dealignment should thus lead to stronger committee systems. This argument is supported by analysis of original data on the postwar evolution of committee systems in five ‘Westminster’ parliaments. Partisan dealignment is associated with larger committee systems, and with larger expansions of committee systems.  相似文献

Although committee assignments have been researched in various parliaments, findings are inconclusive. This article contributes to the debate by analysing the allocations to specialised committees in the Bundestag, a legislature that establishes strong committees despite having strong parliamentary party groups. Studying assignments in this legislature can, therefore, help us to solve the present disjunction between ‘European’ and ‘American’ experiences regarding committee research. The study uses the congressional theories of legislative organisation as heuristic devices but explicitly highlights the strong involvement of parliamentary party groups. The hypotheses are tested with a multiple membership multilevel model across several legislative periods (1990?2013) and backed up with evidence from 51 interviews with German legislators. The results show that next to constituency demands and the influence of regional factions, there is strong evidence for a reassignment pattern and that a legislator’s occupational background and connections to interest groups matter in the assignment process.  相似文献

Congress confronts two major organizational problems that affect the behavior of legislators, party leaders, and groups doing business with congressional committees: The costly nature of monitoring and the absence of explicit mechanisms for upholding agreements. The problem of monitoring implies that party leaders will have a difficult time influencing decisions made in decision-making arenas where the actions of legislators are less visible, as in congressional committees. While legislators can evade leadership monitoring of their actions within committees, once an issue leaves a committee, the costs of monitoring decline, and leadership influence increases. The absence of mechanisms for assuring that legislators keep their bargains means that groups will place an emphasis on dealing with reliable legislators — those who can be counted upon to uphold their end of a bargain. Thus, party leaders are more effective in influencing floor voting because of their better ability to monitor legislator behavior; however, obligations to important interest groups will be more immune to leadership influence because of the incentives for committee members to adhere to their bargains.  相似文献

This article explores how new groups can be marginalized after they gain representation in the legislature. We use data from six Latin American legislatures to examine the effect of institutional and political factors on how traditionally dominant male political leaders distribute scarce political resources—committee assignments—to female newcomers. In general, we find that women tend to be isolated on women's issues and social issues committees and kept off of power and economics/foreign affairs committees as the percentage of legislators who are women increases, when party leaders or chamber presidents control committee assignments, and when the structure of the committee system provides a specific committee to deal with women's issues. Thus, to achieve full incorporation into the legislative arena, newcomers must do more than just win seats. They must change the institutions that allow the traditionally dominant group to hoard scarce political resources .  相似文献

In this paper, I examine the relationship between campaign contributions from PACs representing the finance industry and membership on sixteen standing committees in the Senate. I hypothesize that finance industry PACs will contribute more to the Banking committee, the Senate committee with the greatest responsibility for developing public policy that affects the finance industry. My results indicate that committee assignment does influence the distribution of finance industry PAC money; the finance industry does give significantly more to members of the Senate Banking committee. This is the first study to find this relationship between PAC contributions and committee membership in the Senate.  相似文献

This paper presents a formal model of legislativedecisionmaking, using a common agency formulation to representinterest group lobbying of legislators. Without the imposition of some institutional structure, a legislature is a non-exclusive resource, and legislators will have a tendency to overuse the resource and reduce its productivity. The committee system is a method for granting property rights over the legislature's agenda by subdividing the agenda and assigning each committee rights over a portion of the agenda. Just as common grazing ground could be more productive if it were subdivided and assigned to individual owners, the legislature is more productive if access to the agenda is subdivided and assigned to committees.Ownership rights to committee assignments are allocated based on seniority because this makes the rights more secure and therefore more valuable to their owners. In the United States Congress, the seniority rule replaced a system in which assignments were made at the discretion of party leaders. In the former system, legislators needed to expend effort to retain their assignments, which diminished their ability to use their assignments productively. Because individuals can use resources more productively if they do not have to be concerned about protecting their ownership interest, the seniority system enables the legislature to be more productive in producing legislation.  相似文献

This article explores how the congressional committee system shapes the dynamics of issue attention. Consisting of what is referred to as a congressional opportunity structure, it describes how committee jurisdictions provide an important institutional context for the attention paid to new issues in congressional hearings. This is illustrated through an examination of congressional attention to biotechnology over a 30-year period. This article finds that committees with broader jurisdictions were more active in biotechnology than committees with a narrow policy remit. However, these institutional effects varied widely, even within a single policy domain. This variation suggests that issue attention depends on the degree of fit between issue characteristics and the congressional opportunity structure. More broadly, the findings here illustrate the virtues of public policy research in studies of Congress.  相似文献

How can legislators derive the benefits of delegation without unduly empowering the executive? This article investigates how this dilemma is met in the European Union (EU) political system where executive power is delegated to the Commission. The argument is that the European member states have found a unique solution. They install committees of member state representatives to monitor the EU Commission, the so‐called comitology committees. However, the extent to which comitology committees are installed and their exact competence vary considerably across policy areas. This article uses a delegation perspective to understand this variation. An analysis of comitology provisions in 686 directives and regulations shows that institutional conflict and issue complexity, well‐known factors from the delegation literature, are important predictors of comitology control of the Commission. The findings support one of the two prevailing images of comitology—comitology as a control mechanism, not deliberative democracy.  相似文献

Committees are the backbone of nearly every modern legislature. Yet there is relatively little knowledge about how committee assignment politics occur in the multiparty parliaments with minority coalition governments that so often are the case in many European countries. Is there a pattern to which MPs are assigned to which committees? In this article the Danish case is used to address this question. A dataset of all committee assignments in the Danish Folketing from the period 1994–2007 has been collected; added to this are data on each MP. The data are analysed using a quantitative approach, and drawing on the literature on committee assignments in the United States Congress and the European Parliament, complementing the vast qualitative studies, and updating the few quantitative studies, of the Danish parliamentary committees. The results show that which variables have an influence on committee assignments varies across parties and that no uniform pattern is found.  相似文献

The literature on the organization of the United States Congress has been dominated by “distributive” and “informational” theory. One important source of disagreement between these two theories is their characterization of whether individual legislators can engage in pork-barrel activities. Here we provide evidence which indicates that the pork-barrel is alive and well in the contemporary United States Congress. We focus on whether members of power and constituency committees can direct disproportionate federal expenditures to their districts. Finding strong and systematic evidence of pork-barrel activities by committee members provides empirical support for distributive theories of legislative organization.  相似文献

Abstract.  In Norway, as in the other Nordic countries, sector-based policy making in local government is considered a problem as it is alleged to take place at the expense of a more integrated approach. Inspired by American rational choice theories on committee power, this article first sets out to establish whether the distributive rationale of the present committee system actually does promote sector-orientation among local politicians. This approach is challenged by alternative theories on committee power, focusing on the informational rationale in specialisation and the relevance of partisanship . The findings suggest that all the three theories explain in part committee member' preferences, but partisanship is most important for explaining both spending preferences and preferences on organisational forms. The article goes on to explore whether recent local council reforms, intended to replace the sector-oriented system with strong committees by a new de-specialised system with weaker committees, are likely to curb the effect of sector on committee members' preferences. The conclusion here is not easy to draw, but it is clear that sector-orientation is not encouraged by the reforms; in fact, the opposite seems to be the case. What local councils may have overlooked, however, is the influence of the informational rationale on committees and their members. The analyses are based on data obtained from a random sample of 119 of Norway's 435 municipalities.  相似文献

I analyze the committee assignment process as an all-pay auction and derive equilibrium lobbying strategies of legislators competing for vacant seats on a committee. The model illustrates the relationship between sincere and revealed preferences, which earlier formal models of committee assignment do not explicitly consider. Incorporating seniority, party loyalty, effort constraints, or committee transfers can discourage those who highly value the assignment from competitively lobbying for the seat. I also offer an alternative interpretation of the model’s parameters to consider the pure partisan assignment model, where efforts are contributions to the party’s collective good.  相似文献

Committees linking national administrations and the EU level play a crucial role at all stages of the EU policy process. The literature tends to portray this group system as a coherent mass, characterised by expert-oriented ‘deliberative supranationalism’, a term developed through studies of comitology (implementation) committees. This article builds on survey data of 218 national officials in 14 member states who have attended EU committee meetings. These groups exhibit important common features: expert knowledge rather than country size plays a pivotal role in the decision making process; across types of committee, participants evoke multiple allegiances and identities. In spite of loyalty to national institutions, there is also a sense of belonging to the committees as such, though with significant variation among types of committee. Council and comitology groups are strongly intergovernmental, while Commission committees seem more multi-faceted. The primary aim here is to give an empirical account, but the main observations are interpreted from an institutional and organisational perspective.  相似文献

Why do industries donate money to legislative campaigns when roll‐call votes suggest that donors gain nothing in return? I argue that corporate donors may shape policy outcomes by influencing powerful agenda setters in the early stages of lawmaking. On the basis of a new data set of more than 45,000 individual state legislator sessions (1988–2012), I document how agenda control is deemed valuable to legislators and groups seeking influence on policy. Employing a difference‐in‐differences design, I assess the revealed price, as measured by campaign contributions, that firms are willing to pay for access to committee and party leaders and document how this price varies across industries and institutions. The results indicate that industries systematically funnel money to the legislative agenda setters by whom they are regulated, and to those endowed with important procedural powers. I document that the value of agenda‐setter positions has increased dramatically in recent years. Finally, exploiting changes in state laws, I show that relaxing contribution limits significantly benefits committee chairs and party leaders more so than it does other legislators, suggesting that agenda setters have strong incentives to obstruct restrictive campaign finance reforms.  相似文献

This paper argues that by arranging vote trades in the face of information costs, legislative committees contribute to the stability of legislative outcomes. A structure of permanent committees and subcommittees facilitates informational specialization and helps legislators acquire experience in their specializations. Committees arrange vote trades by adjusting amounts of recommended spending on separate items in bills that receive majority support. Each legislator is allotted a roughly equal amount of legislative spending that he can influence plus an additional amount that depends on his skill and experience as a committee member.  相似文献

Abstract: Scrutiny committees of the Thirty-Third Parliament (1983-84) are classified as undertaking work in one or more of the following categories: legislation; nonlegislative policy; administrative oversight; and information systems for increased accountability. Only Senate committees scrutinise legislation. The majority of scrutiny committees examine non-legislative policy. In contrast, administrative oversight work (compliance and efficiency) is undertaken by a relatively small number of committees. Information systems for increased accountability are a special category and represent the work of several committees particularly in respect of statutory authorities. Reports on non-legislative policy and administrative oversight are classified against the functional classifications of expenditure used in Budget Statement No. 3. In seeking to explain limited policy scrutiny in areas such as taxation and social security and welfare, one cannot ignore the effects that the strategic priorities of adversary politics have on bi-partisan committee inquiry. From classification and related comment one can question whether there is insufficient scrutiny of legislation, insufficient oversight of the administration and too much policy scrutiny. This in turn opens up the broader question of the overall direction and scope of scrutiny committee activity.  相似文献

This article is an examination of the rising prominence of House of Commons select committees during the 2010–2015 Parliament, which takes into account the impact of the Wright reforms. The new system of electing committee chairs and members is explored as a central reform that has burnished the autonomy, independence and credibility of the committees. In addition, the characteristics of the coalition government and circumstances entailed by a two‐party executive are seen as factors that have made more robust the neutrality of the committees, which have been looked to ever more urgently as impartial scrutineers of government policy and personnel. As the system has been strengthened and received greater attention from the government, the public and the media, select committees have also come to present a platform upon which certain members and chairs have grown their profile. This phenomenon in turn has added to the desirability of roles on committees, which now present an alternative career route to the ministerial ladder.  相似文献
