Social work played an active role in American corrections until the 1980s when the ethic of rehabilitation began to give way to a more conservative doctrine of retribution. Changes in the field of social work, characterized by preference of social workers to work only with certain populations, contributed to social work's diminishment in corrections. Although efforts at rehabilitation continue in corrections, the concept of restorative justice that emphasizes assisting victims, communities, and offenders in dealing with the consequences of crime is gaining acceptance in the field of corrections in the United States and in other countries. This study explored social work's presence in corrections, the decline of that presence, and how the concept of restorative justice can invigorate social work within the field of corrections. Several examples of social work's contemporary efforts to use the concept of restorative justice in the United Kingdom are presented.  相似文献

This article examines to what extent role-taking inspired characters in Shakespeare's play Measure for Measure to new modes of consciousness and concomitant social practices of restorative justice. The play's main character, Duke Vincentio, engages in a series of role-taking episodes through which he undergoes a self-transformation. He subsequently enacts the social practice of restorative justice. However, the play is neither a paragon case of self-transformation nor of restorative justice, especially since (1) manipulation and power are employed in the reintegrative shaming ceremony; (2) some characters are stigmatized and humiliated; and (3) the Duke still practices duplicitous, power-based, and punitive measures. Nevertheless, through the process of self-discovery and the recognition of others as like himself, the Duke reconceives his kingly role from that of an executor of law violators to that of a mediator of troubled relationships. The Duke's character reflects in part the cultural contradictions and social transformations ongoing in Shakespeare's Renaissance England.  相似文献

The implementation of restorative approaches in schools has been commonly seen in elementary and high schools, yet the development of restorative approaches in post‐secondary institutions has not been fully explored. In respect to university education, a more restorative approach to student discipline can be a proactive educational response mediating the response of student discipline boards to instances of student wrongdoing. Existing practices are explored, and critiqued from a restorative justice perspective. The rationale behind moving to a restorative response is outlined, and the experiences of student discipline boards that currently employ restorative approaches are assessed to determine how effective this paradigm shift could be. How university responses to student misconduct might function if aspects of the academic environment were built on restorative values and principles is explored, in particular, through looking at the benefits accruing to the development of restorative practices in the classroom, in distance education and for students who experience language difficulties.  相似文献

This paper analyzes the decision-making process for negotiating reparative contracts with offenders in a restorative justice model. Based on a content analysis of videotaped Community Reparative Board meetings with probationers in Vermont, this paper defines restoration as a core concept in restorative justice; examines how boards identify harm to victims and community; discusses how boards identify strategies to repair identified harm; addresses how repair often becomes a line item in reparative contracts; and offers interpretation for situations in which harm is not identified and/or not repaired.  相似文献

Restorative justice has become an increasingly popular alternative to traditional applications of criminal justice. The emphasis on victim needs and the personalizing of conflict resolution offers an attractive choice for those dissatisfied with the adversarial, impersonal, and retributive focus of the present criminal justice system. Many evaluations of restorative justice programs, especially those with a diversion goal, have rarely controlled for the possibility of net widening and the influence of offender risk on recidivism. This evaluation examined a prison diversion program that followed restorative justice principles. Using a matched comparison group and controlling for offender risk, the program demonstrated a diversion effect and a significant reduction in offender recidivism. The results are encouraging for jurisdictions experimenting with this new approach to justice and seeking a more integrated role for victims in criminal justice processing.  相似文献

While extant research generally supports restorative justice as an alternative to traditional juvenile court processing, much of this research is limited to short-term follow-up periods examining only prevalence of reoffense. In addition, recent meta-analyses point to several study design characteristics, the impacts of which are not well understood. This study compared long-term outcomes of youth referred to restorative justice and traditional juvenile court processing using multiple outcome measures. Specifically, the authors examined the impact of restorative justice referral on prevalence of reoffense, number of later official contacts, and seriousness of later offending behavior over several follow-up periods up to four years post-referral.  相似文献

This paper documents the application of restorative justice principles using a model which was developed by the Longmont Community Justice Partnership (LCJP) and is being used in other communities in Colorado. It explains the structure and operation of this model as well as addresses some of the challenging issues program participants faced during the startup, development, and maintenance phases of the program. Among other issues we consider community support, team development, evaluation, restorative language, funding, and the limitations of the model. Finally we discuss the way in which this program has potential for other communities which seek to implement restorative justice practices.  相似文献

This article examines the political and legal barriers to introducing restorative justice (RJ) in Hong Kong. It argues that the processes involved in RJ may be in conflict with the rule of law, which is regarded by the citizens of Hong Kong as sacrosanct in their resistance to the "mainlandization" of criminal justice practices after China resumed sovereignty of Hong Kong. It is argued that, because it could admit such potentially harmful Chinese criminal justice concepts as "rule by the people," "absence of the presumption of innocence," "leniency for self-confession and severity for resistance," and "toeing the party line," RJ would be devoid of any restorative substance and could breach the principles of due process.  相似文献

Nearly two hours after the September 11 terrorist attacks, a hate crime was committed against the Islamic Cultural Center in Eugene, Oregon. Rather than following the conventional criminal justice process, the director of the center and his wife chose to engage in a process of restorative dialogue with other community members and the offender himself. This case study of moving from hatred to healing occurred in the larger context of restorative justice, a movement that is now developing in many hundreds of communities in more than 17 countries. Social workers committed to community practice have played an active role in this reform movement, which has developed over the past two decades.  相似文献

Conclusion Dissatisfaction with the current paradigm of criminal justice is leading to new programs with different visions. Some, such as restitution, can be incorporated into existing structures. Others, such as victim-offender reconciliation, point to a possible new approach to criminal justice—restorative justice. In some ways, restorative justice is simply a new application of an ancient vision. It is new wine from old vines. But those of us who celebrate the harvest are advised to remember the parable of new wine and old wineskins. Before we begin to pour—before we insert restorative features into familiar responses to crime—we would do well to reflect on what the consequences may be.This article has considered four likely consequences: the challenge to abolish criminal law, the challenge to rank multiple goals, the challenge to determine harm rationally, and the challenge to structure community-government cooperation. Although each challenge is significant, I have argued that all can be effectively addressed. The current study utilized an updated systemic model of social disorganization to investigate neighborhood effects on both positive and negative youth outcomes. Although empirical support for updated social disorganization models has increased in recent years, the field continues to rely too heavily on behavioral indicators of community social organization. Unfortunately, these measures do not assess the truly important social processes and dynamics that result in cohesive and supportive neighborhoods. It was proposed that sense of community (SOC) was a more valid, comprehensive, and applicable measure for the mediating variables in social disorganization theory. Results supported the hypothesis that SOC mediates the effect of neighborhood disadvantage on youth outcomes and implications for the field are discussed.  相似文献
