Abstract

As part of the strategy for better governance, the European Commission has taken steps towards improved consultation and dialogue on European Union (EU) policy with interested parties. Opening up the policy process and getting interest groups involved are considered important for the democratic legitimacy of EU policy making. This article examines the public Internet consultation on the Commission proposal for a new European chemicals policy, the so-called REACH system. Being one of the most consulted issues in EU history, the chemicals policy review is considered as a critical test for the participatory mechanisms provided by the European Communities. By analysing more than 6000 contributions to the consultation, it is demonstrated that it invited broad participation, although industry was considerably better represented than NGOs and other civil society associations. Moreover, an overwhelming majority of participants were national actors from the largest member states rather than transnational actors. It is concluded that online consultations can invite broad participation in EU policy shaping but it is unlikely to bring about equal participation from different group of actors. Therefore it raises concern when measured against standards of democratic governance.  相似文献

The European Union's attempts to improve its democratic character increasingly often lead to debates about how to include civil society organizations in its decision-making processes. However, this interpretation of participatory democracy seems at odds with democratic traditions in a number of member states. Among those, France is said to be at the diametrically opposite end of the EU democratization debate spectrum. French democratic thought is based on government through electoral representation. The aim of this article is to analyze both theoretically and empirically the discourse and participatory processes in both the EU and France. While normative approaches to democratic patterns in the EU and French political debate show important differences, empirical evidence suggests that the misfit between the European and French conception of democracy is less developed than one might believe.  相似文献

In a recent article Jürgen Habermas (1999) highlighted the potential for the European Union to act as a vehicle for the extension of democratic governance beyond the nation state, a project aimed at limiting the socially corrosive impact of globalisation. Yet this position appears paradoxical as the European Union itself exacerbates a major aspect of globalisation: the emasculation of national parliaments known as the 'democratic deficit'. This paradox can be understood by analysing the dynamics of post-war European integration through the lens of Habermasian social theory: EU evolution can lead either to the colonisation of the lifeworld by market and administrative subsystems (as with the democratic deficit), or to a process of lifeworld rationalisation conducive to pan-European solidarity and democracy. The latter of these tendencies could be encouraged through 'procedural democracy': this would institutionalise the conditions by which independent associations in European civil society, channelling their 'communicative power' through parliament, might reassert control over the two subsystems. In order to retain legitimacy, procedural EU democracy would have to link existing legislatures to the European Parliament, while citizenship would combine national and civic components. Hence the European Union would be more able than the nation-state to combine universal notions of justice with ethical pluralism.  相似文献

In this article we provide a conceptual and argumentative framework for studying how institutional design can enhance civic participation and ultimately increase citizens' sense of democratic ownership of governmental processes. First, we set out the socio-political context for enhancing the democratic governance of regulatory policies in Europe, and highlight the way in which civic participation and democratic ownership is given equal weight to economic competitiveness. We then discuss the potential for institutionalized participatory governance to develop and its prospects for improving effective and democratic governance in the multi-layered European polity. We conclude by outlining a research agenda for the field and identifying the priorities for scholars working interactively with civil society and governments.  相似文献

协商民主作为重要的民主制度设计和治理形式,对于优化乡村治理具有极为重要的意义与价值。将协商民主嵌入乡村治理,实现协商民主与乡村治理的有效融合,契合党和政府推动乡村振兴战略顺利实施的迫切需要。协商民主嵌入乡村治理体系和治理过程,不是单纯的制度吸纳和整合,而是包括制度嵌入、行动嵌入和认知嵌入在内的多维嵌入结构和过程。从全国各地的治理实践来看,民主协商机制尚未真正嵌入乡村治理的各个环节和各个领域,协商民主的制度优势和治理功能未得到充分发挥。为此,必须加快协商民主嵌入乡村治理的进程,将协商民主理念嵌入到广大农村基层干部和群众的认知之中,形成有事好商量的思维方式和行为习惯;不断健全与完善协商民主的各种体制机制,促进协商民主制度优势转化为乡村治理效能。  相似文献

Abstract

This article investigates the participation of interest groups in the EU's Constituional Convention and their contribution to the debate on participatory democracy and EU governance. I argue that the constitutional moment prompted interest groups to define their priorities beyond focused policy issues to include wider principles of governance. While the Convention process was more inclusive that any previous treaty reform procedure, its institutional set up was a constraint to improving citizen participation either directly or via interest groups. The Convention reproduced a model of closed elitist politics which did not communicate sufficiently with the citizens, while the role of interest groups was restricted by a Convention designed as a drafting phase in preparation for the real decisive phase during the IGC. Despite the impact of specific domestic contexts, the ‘no’ votes in France and the Netherlands proved that civil society and participation were rhetorical devices deployed during the Convention to gain legitimacy rather than a genuine move towards a more pluralistic EU democracy capable of deploying effective mechanisms of active citizen participation.  相似文献

According to the prevailing concept of 'dual legitimacy', national parliaments constitute an important source of democratic legitimacy in the EU. Reinforced parliamentary scrutiny and control of the national representatives in the Council of Ministers seem to contribute to a more democratic Europe. However, if parliaments tie the hands of their governments when they negotiate at the European level, effectiveness of policy-making is jeopardised and national interests may be defeated. Realising this dilemma, members of national parliaments develop strategies to deal with conflicting requirements of national party politics and European policy-making. These strategies and their implications for democracy are influenced by the path-dependent institutional changes in national parliamentary systems. This article discusses the potential for reducing the externally exclusionary aspects of citizenship in a post-Westphalian community, as conceptualised in Andrew Linklater's critical theory. Linklater's claim that post-sovereign developments in the European Union provide encouraging signs in this regard is evaluated in the light of the EU's attempted harmonisation of free movement, asylum and immigration policies. It is argued that the case of the EU provides little support for Linklater's assumptions, largely because: (1) the theory fails to recognise the exclusionary consequences of the differentiation of outsider status; and (2) it relies too much on the causal effects of institutional frameworks. While fully supporting the theory's normative stance I suggest that the strong reliance on institutional remedies may have counterproductive effects, and thus that the regionally restricted attempt to externalise aspects of citizenship, while pushing the exclusionary boundary further outwards, has not eliminated the insider-outsider distinction in an EU context.  相似文献

This article investigates both the operation and the democratic legitimacy of the European Union committee system. This vast but rarely studied system is an important site of European governance, exercising an increasing amount of policy responsibility while also providing the essential arenas necessary for supranational problem solving. Despite their contribution to the success of the “European project,” committees are increasingly coming under attack, notably for their lack of democratic credentials. The article employs original empirical research based on interviews and internal documentary evidence to answer a timely question: does the EU committee system strike an appropriate balance between the values of system effectiveness and democratic legitimacy? Following the application of a set of democratic principles to EU committees, the article finds that a poor balance has been struck between effectiveness and democracy. The article concludes with some operational suggestions for improving this balance in the short‐to‐medium term.  相似文献

There is an interesting debate about democracy and citizenship in the EU. Views diverge about the features of democratic deficits currently facing the EU and accordingly, about the scope for Union citizenship. The paper suggests an analytical distinction between asymmetric and symmetric normative models of dual – national and Union – citizenship. Moreover, it proposes an alternative model of dual citizenship that puts emphasis on the responsiveness of citizens vis-à-vis phenomena that undermine democratic governance and the claim for equal respect and concern. One of the main ideas of responsive citizenship is that effective democratic control should complement procedural legitimacy in the EU as a means to prevent phenomena of political domination and guardianship. This is possible through the combination of competences ascribed on citizens through national and Community legislation vis-à-vis national and Union executive bodies.  相似文献

This article explores the European Union’s (EU) democratic and security objectives in the European Neighborhood Policy (ENP) toward three post-Soviet states: Georgia, Moldova, and Ukraine. By discussing the ENP’s objectives, this study concludes the following: first, despite long-term ENP democracy promotion, there have been very limited democratic developments in the partner states between 2005 and 2014; second, security challenges remain in partner states in the breakaway regions in Transnistria in Moldova, Abkhazia and South Ossetia in Georgia, and Crimea, Donetsk, and Luhansk in Ukraine. Therefore, EU’s Kantian view of security through democracy has failed, and its ambition to create a ring of Eastern friends has not led to improved relations in the Eastern neighborhood. On the contrary, the EU’s push eastward has instead intensified insecurity in its partner states due to limited democratization.  相似文献

Following the breakdown of the Soviet system, the new East European elites faced the problem of defining and building democratic institutions. This problem was not a purely institutional one, however. During the transformation process, different conceptions of democracy appear and often become critical issues for political competition. Based on the Czech case, this article aims to understand how and why one particular conception of democracy becomes dominant during a process of regime change. Personified by the two ‘Vaclavs’ in the Czech political arena (Havel and Klaus), divergent perspectives on democracy exist in the Czech Republic, having concrete consequences for the practice of politics. These conceptions (referred to here as ‘participatory’ and ‘majoritarian') dramatically differ in their perception of the role of the citizen in a liberal democracy. This article identifies and describes these two different conceptions of democracy in the present and past Czech Republic. It explores the sociological conditions of their emergence in order to understand the failure of the participatory model of democracy with respect to the alternative, majoritarian, vision of democracy.  相似文献

How does the European Union integrate new values into the text of its treaties? A growing body of literature indicates that, in the past three decades, new norms and values have entered the EU's discourse, resulting in what is usually termed ‘normative power Europe’. Yet the research and knowledge to‐date about the EU's discursive assimilation of new values and norms is surprisingly poor. As any institutional change, such integration has the potential to undermine the coherence of the EU's identity and thus also its objective to ‘speak with one voice’. This article explores the EU's discursive management of the continuity‐versus‐change imperative by analysing the integration of new values into the text of its treaties. This issue is addressed based on a quantitative content analysis on the full texts of European founding treaties between the 1950s and 2009. Findings show that the distribution of the EU's values in the text is not uniform: while the language of market economy and democracy is pervasive, the values of peace, European identity, rights and social justice are mentioned less frequently and in restricted linguistic environments. To account for the differences in the integration of values into the EU's treaty discourse, the article develops the notion of a discursive mechanism of differentiated value integration (MDVI). This rationale echoes the logic of differentiation in policy implementation employed by the EU. It is claimed here that, applied in the European discursive arena, MDVI allows radically different readings of the same text. This helps the EU to maintain a coherent value identity while at the same time enabling change.  相似文献

The delegation of policy-making tasks to EU agencies and their remarkable growth in number over the past two decades mark a striking new development in the EU's institutional make-up. While most of the nascent literature on the EU's ‘agencification’ addresses the conditions for agency creation and the implications of agency governance from the perspective of democratic accountability, there is a lack of empirical research systematically scrutinising the institutional structure and degree of formal-institutional independence of these agencies. This article offers a comprehensive empirical assessment and measure of the variation in institutional independence displayed by the entire set of 29 EU agencies operating under the EU's three pillars and tests hypotheses explaining variation in formal independence among agencies.  相似文献

E‐governance comprises the use of information and communication technologies (ICTs) to support public services, government administration, democratic processes, and relationships among citizens, civil society, the private sector, and the state. Developed over more than two decades of technology innovation and policy response, the evolution of e‐governance is examined in terms of five interrelated objectives: a policy framework, enhanced public services, high‐quality and cost‐effective government operations, citizen engagement in democratic processes, and administrative and institutional reform. This summary assessment of e‐governance in U.S. states and local governments shows that the greatest investment and progress have been made in enhanced public services and improved government operations. Policy development has moved forward on several fronts, but new policy issues continually add to an increasingly complex set of concerns. The least progress appears to have occurred in enhancing democracy and exploring the implications of e‐governance for administrative and institutional reform. ICT‐enabled governance will continue to evolve for the foreseeable future providing a dynamic environment for ongoing learning and action.  相似文献

This article focuses on two trends emerging through the eurozone crisis, both of which diminish the quality of democracy in the EU and its member states. Firstly, the crisis has led to an increased reliance on non-majoritarian institutions, such as the ECB, at the expense of democratic accountability. Secondly, the crisis has led to a new emphasis on coercive enforcement at the expense of the voluntary cooperation that previously characterised (and sustained) the EU as a community of law. Thus, the ECB’s (over-)empowerment is a synecdoche of a wider problem: The EU’s tendency to resort to technocratic governance in the face of challenges that require political contestation. In the absence of opportunities for democratic contestation, EU emergency governance – Integration through Crisis – oscillates between moments of heightened politicisation, in which ad hoc decisions are justified as necessary, and the (sometimes coercive) appeal to the depoliticised rule of rules.  相似文献

Abstract

This paper assesses the extent to which the category of hope assists in preserving and redefining the vestiges of utopian thought in critical social theory. Hope has never had a systematic position among the categories of critical social theory, although it has sometimes acquired considerable prominence. It will be argued that the current philosophical and everyday interest in social hope can be traced to the limited capacity of liberal conceptions of freedom to articulate a vision of social transformation apposite to contemporary suffering and indignity. The background to these experiences is the structural changes associated with the injustices of globalisation, the mobilisation of the capitalist imaginary and the uncertainties of the risk society. The category of hope could assist in sustaining the utopianism of critical theory through con joining normative principles with a temporal orientation. Yet, the paradoxes of the current phase of capitalist modernisation have further denuded notions of progress. Since the theological background to the category of hope constitutes a major limitation, the utopian orientation of critique is clarified in relation to the antinomies of the turn to social hope and the potential of Habermas' discourse theory of democracy, law and morality. Despite Castoriadis' profound critique of the category of hope, its present usage in social analyses will be seen to have affinities with Honneth's conception of the struggle for recognition.  相似文献

Abstract

The UK has become a prime case for the implementation of the ‘new governance’ of partnership between central government and civil society. This perspective has become central to New Labour policies for both local socio-economic regeneration and democratic renewal in the United Kingdom. However, limitations in its redistribution of power, its transparency in the policy-making process, including the representativeness of civil society participants, and, in the effectiveness of its outcomes have all been alleged by academic critics. These issues are explored by contrasting a robust, British case of local, participatory governance in Bristol with a quite different, and more conventional approach to democratic renewal in the Italian city of Naples. Despite similar problems of socio-economic dereliction and similar schemes of regeneration in the two cases, the Italian approach emphasized the exclusive role of a renewed constitutional democracy, while in Bristol central government agencies promoted an accentuation of local trends to participation by local civil society organizations. Applying an analytical framework composed of national policies and regulations, institutional rules and norms, and the collective ‘identity’ factors identified by social capital theory, governance changes are here treated as ‘exogenous shocks’ and/or as opportunities for choice. However, over and above differences in these institutional frameworks the key factors are shown to be the longer-standing political cultures influencing local actors and their own repertoires of action; with repertoires influenced by objective validations of previous policy choices, or economic or electoral successes. The study finds that the achievements of the ‘inclusive’, participative governance approach do not significantly exceed those of an exclusivist, ‘neo-constitutionalism’, as practised by a more autonomous local government in Naples. Thus, on this evidence, enhanced civil society engagement still requires greater freedom from central government direction.  相似文献

Public evaluations of EU performance are not only critical indicators of the EU's output legitimacy, but also shape future support for European integration. For citizens to monitor the political performance of the EU they need relevant facts, yet it is anything but clear that gains in information about EU performance cause change in judgements about such performance. Drawing on two‐wave panel data, this article examines whether acquiring information following a real‐world EU decision‐making event alters citizens' judgements about the utilitarian and democratic performance of the EU. It also examines how this effect differs for people with different levels of general political information. It is found that citizens who acquired performance‐relevant information became more approving of the EU's utilitarian performance but did not change their judgements about its democratic performance. Also, individuals with moderate levels of general political information were affected most strongly by new facts about performance. The implications of these findings for EU‐level representative democracy are considered.  相似文献
